국제분쟁해결센터(ICDR)의 '긴급구제'제도('emergency relief' system)에 관한 연구 (A Study on the 'Emergency Relief' System of International Centre for Dispute Resolution)

  • This article examines the requirements of Article 37 of the ICDR International Arbitration Rules and issues that could arise if a party petitions a U.S. Federal Court to enforce an emergency arbitrator's Article 37 decision to grant pre-arbitration provisional relief. On May 1, 2006, ICDR introduced a new procedure for the granting of emergency arbitral relief under its ICDR Rules. The procedure enables a party to apply for emergency interim relief before the appointment of an arbitrator or tribunal to adjudicate the merits of the dispute. Instead, the application for emergency relief is considered by an emergency arbitrator appointed by the ICDR. In short, the ICDR has quickly appointed emergency arbitrator and resolved a challenge to an appointment within 36 hours. In addition, the emergency decisions have been issued within just a couple of weeks. In particular, we looked at what would happen after Article 37 emergency relief is granted. Based on my examination of U.S. cases on the enforceability of interim awards and orders, We conclude that U.S. courts would enforce Article 37 interim measures, whether they are characterized by the emergency arbitrator as an interim order or award. Where the situation warrants, arbitration executives should embrace and use emergency relief procedure of ICDR Rules.

병원 전 단계 응급의료 서비스 개선방안에 관한 연구 : 119 구급대원과 응급실 간호사의 응급처치 지식 및 기술 숙련도 비교 (How to Improve the Emergency Medical Service System: Levels of Knowledge and Techniques in Prehospital Care for 119 Relief Squad Members and Emergency Room Nurses)

  • During the past decade or so in Korea, 119 relief squad members were supposed to respord first urgent or emergency cases. The primary purpose of this study was to assess what levels of knowledge and techniques in prehospital care the 119 relief squad members showed. Data regarding the knowledge and technique levels were collected from both the 119 relief squad members (n=63) and the emergency room nurses(n=46). The Results indicated that the 119 relief squad when compared to emergency nurses, showed higher scores for knowledge and techniques in some areas of prehospital care but not in other areas, However, no differences in knowledge and technique were found when the ANOVAs were calculated with two covariates : duration of their career in emergency medical services and frequency of their exposure to lectures on emergency medical technology. In addition, many respondents in the 119 relief squad group rated themselves poorly in knowledge and techniques of prehospital care, The findings imply that qualitatively better curricula should be given to the 119 relief squad members before they are allowed to play an important role in the emergency medical service system. These findings are also discussed in the context of improving the emergency medical service system.

Text Mining 기법을 활용한 농촌마을 긴급구호서비스 접근 취약성 평가 (Evaluation of Vulnerability on Rural Emergency Relief Service using Text Mining)

  • The rural areas are large residential space with fewer people than urban areas. That is why they are vulnerable to social services such as health care and security. This research analyzed the vulnerability of emergency relief service in rural village through text mining and the weighting value have been calculated. Based on the calculated statistics data, the police facilities are the most important, While the fire fighting and hospital facilities are important as well. In addition, the distance from the emergency relief service facility to the rural village was confirmed by using Open API. By combining these results, The vulnerable areas of the rural villages and the emergency relief service facilities were calculated and classified into 5 levels. For rural areas, the 1st class will have 33 places, following by 1,179 in 2nd class, 199 in 3rd class, 17 in 4th class and 8 in 5th class. Hence in order to further supplement the vulnerable areas to emergency relief service in villages, geographical relocation and policy approach of emergency relief service facilities are necessary.

A Stock Pre-positioning Model to Maximize the Total Expected Relief Demand of Disaster Areas

  • Stock pre-positioning is one of the most important decisions for preparing the stage of emergency logistics planning. In this paper, a mixed integer model for stock pre-positioning is derived to support an emergency disaster relief response against the event of earthquake. A maximum response time limit, budget availability, multiple item types, and capacity restrictions are considered. In the model, the decision of the distribution centers to cover a disaster area and the amount of supplies to be stocked in each distribution center are simultaneously determined to maximize the total expected relief demand of the disaster areas covered by the existing distribution centers. The proposed model is applied to a real case with 33 disaster areas and 16 distribution centers in Indonesia. Several sensitivity analyses are conducted to estimate the fluctuation on the emergency stock pre-positioning planning by changing the maximum response time and budgets.

119구급대의 간호사 배치여부에 따른 응급처치 실태 (Emergency Care Conditions where the Nurse is posted in the 119 Relief Squad)

  • The purpose of this study is to identify the difference of emergency care conditions where the nurse is posted in the 119 relief squard or not. The data composed a total of 777 cases of emergency activity of one police stand in Seoul during March, June. September and December in 1998. The results of this study were as follows: 1. The age of the subjects was 20-60 age 54.3%, over 60 age 35.4% with an average age of 50.2. Among them men were 55.0%, the unemployed were 60.8%. The place of the occurrence of an accident was the house, 49.7% and the cause as illness was 59.6%. 2. The main symtom was pain the 36.2% the main consciousness state was alert 76.9%: The state of the patients as chronic was 59.6%. 3. The consulting hospital of the 119 relief squad as a third medical center was 79.9%. The distance to the medical center as less than 5 km was 77.2%, and an average transfer distance was 5.38 km. The cases of doctor guided emergency care was 0.9%, the cases that had posted nurses in 119 relief squads was 48.6%. 4. The case of the best emergency care operation was difficulty in breathing, 62.1% and the second was unconsciousness, 46.1 %. The more serious the consciousness state, the higher the rate of emergency care operation. There wasn't any difference in emergency care operation concerning transfer distance. 5. The cases that had the posted nurses was 19.1%, the cases of no nurse was 11.7% among the cases of emergency care operation during transfering; the cases that had posted nurses had the higher emergency care operation. (p<0.05). Airway maintenance was 14.8% in cases that had the posted nurses, while in the cases of no nurse, 10.9%; and oxygen inspiration was 16.0% in cases that had the posted nurses while in the cases of no nurse 7.6% (p<0.01); spinal fixation was 6.6% in cases that had the posted nurses while in the cases of no nurse 4.6%(p<0.05). With these results, we can conclude that the cases that had the posted nurse showed higher emergency care operation.

  • 재난상황하에서는 신속한 지역단위 재난복구를 전문적으로 담당하는 인력이 필요하다. 그러나, 현재의 재난대응체계에서는 대민지원, 자원봉사 등 수준에서 재난복구를 시행하고 있으므로 전문성 부족으로 인한 초기대응 및 재난복구 지연, 재난 지속시 대응 미흡 등 다양한 문제점이 발생하고 있다. 그러므로, 재난상황시 지자체단위 초기 대응능력 구비와 신속히 재난복구를 할 수 있는 전문성을 가진 부대의 창설이 필요하다. 따라서, 본 연구에서는 재난상황하 긴급 재난복구를 통한 지역안정과 재해 주민구호, 재난이전으로의 신속한 전환을 위한 예비군 긴급대응부대를 창설과 운용방안 수준의 방향성을 제시하였다.

  • Arbitration has grown a unique resolving method for international commercial disputes. However, it has considered a similar court process, such as interim relief, during arbitration proceedings. Further, it would be asked for urgent measures before the arbitrators are constituted in the proceedings. In this case, the disputing party has to apply in the court. This is an unattractive factor in international arbitration; therefore, some institutions are trying to reform such an inconvenient system by adopting the emergency arbitrator. The purpose of this study is to look into ways of utilizing the emergency arbitrator for effective dispute resolution in shipbuilding and shipping industries. The emergency arbitrator needs to solve problems such as making a decision on leaving cargos in the ship, matters involving a ship arrest, or issues regarding vessels under construction. In order to utilize the emergency arbitrator system, it needs to make a close partnership with related institutions, prepare Korean-style standard shipbuilding and shipping contracts, and provide training programs for new emergency arbitrators and staff of institutions. Next, the arbitration institution has to have a great working relationship with a court. Finally, it should try to implement a new system, such as on-line service, for the procedures of the emergency arbitrator.

한국 긴급중재인 제도의 긴급성과 집행력에 관하여 (A Study on the Emergency Arbitrator Provisions in Korea: A Focus on Urgency Inherent and Enforcement)

  • Two years ago, an emergency arbitrator procedure in accordance with the international arbitration rule has been finally adopted in Korea?a decade after its introduction. Arbitral institutions provide interim measures in the course of tribunal proceedings to avoid litigation in open court that is often expensive and time-consuming. An emergency arbitrator procedure offers an urgent relief prior to the constitution of an arbitral tribunal, thus enhancing the speed and effectiveness of the arbitration procedure even further. Although most of the arbitral institutions interpret that the emergency arbitration rulings are binding on the parties, enforcing the emergency arbitration provisions have some difficulties in practice, and it is not clear whether or not arbitral interim measures will be enforceable under the newly adopted provisions in Korea. In this study, experiences in other countries are explored in seeking for the possible problems and solutions of enforcing the emergency arbitration rulings. For example, Singapore and Hong Kong insert terms such as "finality," "enforceable in the same manner as an order or direction of the Court," "same effect as an arbitral tribunal or interim measures" in their emergency arbitrator legislation to enhance enforcement. Moreover, "urgency inherent" are considered.

119수난구조대의 현황 및 발전 방안 (A study on Development way of 119 drowning rescue)

  • In Korea, the number of those who were drowned of the dead by 'accident and injury' ranked the third of causes of death is over 2,300 people a year. So the Ministry of Home Affairs arranged '119 drowning rescue team' at frequent occurrence regions of drowning temporarily as a part of drowning rescue measures during every summer season and made perfection more perfect for safety control and rescue services at prevention areas of accidents. However, considering that the number of professional drowning rescuers is small and it is managed temporarily only for summer, the placement of special rescue team equipped with professional education and qualification should be ensured and quick lifesaving and first-aid treatment should be conducted, since much time is required to arrive at accident place after receiving accident report at 119 office, rapid rescue and relief have not been achieved. Therefore, the placement of special rescue team should be increased for reducing the personal damages by considering regional characteristics and in particular placement of more drowning rescue teams in Jeonnam region which has more seas and rivers is needed This study aims at analyzing relief activities and statistics to cope with water accidents and achieve qualitative growth of first-aid services, examining actual conditions of water accident relief team and personnel assignment, providing first-aid services of good quality and establishing improvement methods to increase operation of relief team.

방사능 재난에 대한 방사선비상계획구역내 주민의식조사 (A Study on the Residents Consciousness in Emergency Planning Zone for Radioactive Disasters)

  • 연구목적: 본 논문은 방사선비상계획구역 내 거주하는 주민의 방사능재난 발생시 대피방법과 대피시설 등에 대한 인식 현황 기초자료를 수집하는 것이다. 연구방법: 무작위표집으로 표집된 방사선비상계획구역 주민을 대상으로 구조화된 설문지를 이용하여 1:1 면접조사를 실시하였으며 미니탭 프로그램을 이용하여 통계분석 하였다. 연구결과: 조사대상자들은 첫째, 방사능재난에 대한 지자체 업무에 관해 비교적 낮으면서 부정적인 인지도를 나타냈다. 둘째, 주민안전교육 측면에서는 교육 경험이 적으나 필요하다고 느끼며 주민대피방법과 행동요령, 구호소 위치 등에 대한 교육을 원하였다. 셋째, 방사능재난 관련 구호소는 위치를 잘 모르고 있고 안내를 받은 적이 없으며 구호소 이용시 가족과 함께하겠다는 응답이 많았다. 구호소 시설에 대해서는 대체로 만족도가 낮은 편이었다. 넷째, 방사능재난에 대비하여 필요한 우선순위는 방사능재난에 대한 교육과 훈련, 시설 보완, 방호약품 보급 등을 지적하였다. 결론: 본 연구에서 원전 주변 지역 주민은 방사능재난 발생에 대비하여 정부나 지자체의 정책과 업무 내용을 비교적 부정적으로 인식하고 만족도는 낮았다. 우선순위로 지적한 사항에 대해 정부와 지자체는 방사능재난에 대한 정확한 정보와 정책 내용을 주민에게 홍보하고 교육해야 한다.
