  • Wenn man das fahrl${\"{a}}$ssige Begehungsdelikt in Bezug auf ein Niveau eines Risiko der objektiv vorhandenen tatbestandlichen Erfolgsm${\"{o}}$glichkeit und auf die n${\"{o}}$tige Sorgfaltspflicht, die die T${\"{a}}$ter nimmt, um das solches Risiko abzuhalten, berucksichtigt, ergibt sich der spezielle Fall selten bei der Person, mit dem hoch-gefahrlichen Berufszweig besch${\"{a}}$ftigt ist, auf den die bestehende Allgemeine-Theorie ${\"{u}}$ber das gafahrl${\"{a}}$ssige Begehungsdelikt gleichm${\"{a}}$ssig unanwendbar ist. Bez${\"{u}}$glich des Piloten des Milit${\"{a}}$rflugzeug ergibt sich oftmals ein bestmmter Fall, die die KontroIIe des Risiko gesch${\"{a}}$ftlich uber sein eigenes pers${\"{o}}$nliches Ermessen geht, und er nimmt die Pflicht, die notwendige milit${\"{a}}$rische Zielsetzung zuerst vor allem zu ber${\"{u}}$cksichtigen, wenn auch technisch, klimatisch und umstandehalber ein normales Niveau von Risiko ${\"{u}}$bersteigt wird und zugleich ein bedenkliches hoches Risiko mit sich gebracht wird. Aus diesem Anla${\beta}$ kann man folgem, da${\beta}$ der Pilot des Milit${\"{a}}$rflugzeug ein besonderer Fall ist, auf den die Kriterien in Bezug auf das Gebiet der Regel ${\"{u}}$ber das fahrl${\"{a}}$ssige Begehungsdelikt gleichm${\"{a}}$ssig unanwendbar sind. Und weil die Vermehrung der Gefahr des Flugzeug sofort an die Vermehrung der Gefahr seines eigenen Leben angeschlossen wird und daher es eine M${\"{o}}$glichkeit gibt, da${\beta}$ der Pilot dem Resultat eines Gefahr zum ersten Opfer f${\"{a}}$llt, ist die Regelung in der Punkt der Generalpr${\"{a}}$vention gegen das fahrl${\"{a}}$ssige Begehungsdelikt sinnlos. Und auch muB die militarpolitische Punkt, die Piloten des Milit${\"{a}}$rflugzeug gem${\"{a}}$${\beta}$ dem notwendigen Ausma${\beta}$ auszubilden und das Ausma${\beta}$ zu behalten, aktuell berucksichtigt werden.

Effective Herbicide Application on Dry Seeded Paddy Rice (벼 건답휴립직파재배(乾畓畦立直播栽培)에서 효과적(效果的)인 제초제(除草劑) 사용법(使用法))

  • Several rice herbicides were evaluated to determine the herbicidal efficacy on dry seeded paddy rice. The time of herbicide application was within 1 day after seeding(DAS), 18 DAS, and 40 DAS. Under the upland conditions 30 DAS(before permanent flooding) dominant weed species were Echinochloa sp., Digitaria sp., Leptochla sp., weedy rice and other several annual broadleaved weeds belonging to Cruciferae, but after flooding Echinochloa sp., Aeschynomene sp., Eleocharis kuroguwai, Cyperus sorotinus, Ludwigia prostrata, Aneilema japonica were dominat. Early application (1 DAS) of thiobencarb, pyrazolate/butachlor, or chlomethoxyfen/butachlor resulted in very good herbicidal efficacy only during the first 30 days, but not thereafter. Application of propanil+butachlor on 18 DAS did not control the late occurring weeds effectively. Application of bentazone/quinchlorac on 40 DAS successfully suppressed weed growth throughout the remaining rice growing season and showed similar grain yield as hand weeded plot. Weed growth reduced the plant height, panicle number, 1000-grain weight, percent ripened grains, and grain yield of rice by 7, 82, 19, 55 and 87% respectively. There was a positive linear relationship between weed weight and lodging index of rice.

Utilizing chromosome segment substitution lines (CSSLs) to evaluate developmental plasticity of root systems in hardpan penetration and deep rooting triggered by soil moisture fluctuations in rice

  • Water availability in rainfed lowlands (RFL) is strongly affected by climate change. In RFL, rice plants are exposed to soil moisture fluctuations (SMF) but rarely to simple progressive drought as widely believed. Typical RFL field is characterized by a about 5-cm thick high bulk density hardpan layer underneath the cultivated layer at about 20 cm depth that impedes deep root development. Root system has the ability to develop in response to changes in SMF, known as phenotypic plasticity. We hypothesized that genotypes that can adapt to RFL have root plasticity. The roots can sharply respond to re-wetting after drought period and thus penetrate the hardpan layer when the hardpan is wet and so becomes relatively soft, and thus access water under the hardpan. This study aimed to identify CSSLs derived from a cross between Sasanishiki and Habataki which adapted to such RFL conditions. We used 39 CSSLs together with the parent Sasanishiki, which were grown in hydroponics and pot under transient soil moisture stresses (drought and then rewatering), and compared with continuously well-watered (WW) (control) up to 14 days after sowing (DAS), and 20 DAS, respectively. Based on the results of hydroponics and pot experiments, we selected a few lines, which were grown in the soil-filled rootbox with artificial hardpan layer and without artificial hardpan. For the rootbox without artificial hardpan, plants were grown under WW and transient soil moisture stresses for 49 DAS. While the rootbox with artificial hardpan, the plants were grown under WW (control) and SMF (WW up to 21 DAS, 1st drought (22-36 DAS), rewatering (37-44 DAS), and followed by 2nd drought (45-58 DAS)). Among the 39 CSSLs, only CSSL439 (SL39) consistently showed significantly higher shoot dry weight (SDW) than Sasanishiki under transient soil moisture stress conditions as well as SMF conditions in all the experiments. Furthermore, under WW, SL39 consistently showed no significant differences from Sasanishiki in shoot and root growth in most of traits examined. SL39 showed significantly greater total root length (TRL) than Sasanishiki under transient soil moisture stress, which is considered as phenotypic plasticity in response to rewatering after drought period. Such plastic root development was the key trait that effectively contributed to root elongation and branching during the rewatering period and consequently enhanced the root to penetrate hardpan layer when the soil penetration resistance at hardpan layer reduced. In addition, using the rootbox with artificial hardpan layer ($1.7g\;cm^{-3}$, heavily compacted), SL39 showed greater root system development than Sasanishiki under SMF, which was expressed in its significantly higher TRL, total nodal RL, and total lateral RL at hardpan layer as well as at below the hardpan layer. These results prove that SL39 has plasticity that enables its root systems to penetrate hardpan layer in response to rewatering. Under SMF, such root plasticity contributed to its higher gs and Pn.

Effect of prohexadium-calcium on growth, lodging and yield of proso millet (Panicum miliaceum L.)

  • The proso millet is vulnerable to lodging due to high plant height and shallow root. A lodging results in a hard mechanical harvesting and yield loss. One of solutions on this problem is inhibition of internode elongation. The objective of this study was to set up use time and dose of prohexadium-calcium, is growth inhibitor. The experimental variety was Ibaekchal. The experiment design was a split-plot design with three replications. The treatments were as follow: Main-plots were 25 and 35 day after sowing(DAS) as use time and sub-plots were 0%, 50%, 100%(diluted solution of 1000 times, $1000{\ell}\;ha^{-1}$), 150% as dose. The amount of nitrogen, phosphate and potassium fertilization were 90, 70, $80kg\;ha^{-1}$, respectively. The size of high ridge and plant spacing were $90{\times}30cm$ and $60{\times}15cm$, respectively. Proso millet was sown on June 9, 2016 by hands and was adjusted at 2 plant per hill. The growth survey of vegetative growth stage was conducted at 1 day before treatment and with one week interval after treatment. Data were collected: (1) grain yield: weight of grain in $kg\;ha^{-1}$, (2) 1000 grain weight: average weight of 1000 grain, (3) plant height: distance from soil to top of panicle or leaf in cm, (4) ear length: distance from top of stem to top of ear in cm, (5) stem diameter: diameter of second internode (6) degree of lodging: percentage of lodging area, etc. Analyses of variance were performed using R version 3.3.1(https://www. r- project. org). The Duncan's multiple range test(DMR) was used to separate treatment means at P < 0.05. There was a significant difference in plant height and number of stem among the use time and dose of prohexadium-calcium during vegetative growth stage. At 25 DAS, the difference with no treatment increased until 25 day after treatment and decreased since then. The difference in number of stem increased until 18 day and decreased since 25 day. At 35 DAS, the difference with no treatment in plant height and number of stem increased until 22 day after treatment and decreased since then. We assumed that the effect of prohexadium-calcium was inhibition of internode elongation and promotion of tillering, continued untel 25day after treatment. At 25 DAS, the degree of lodging deceased to 100%, 30%, 10% and 0% as dose increased. At 35 DAS, the degree of lodging decreased to 100%, 20%, 0% and 0% as dose increased. At 25 DAS, the yield was 2910, 2710, 3190, $2310kg\;ha^{-1}$ among dose. At 35 DAS, the yield was 2750, 2630, 2220, $2050kg\;ha^{-1}$. We recommend that the optimum use time and dose of prohexadium-calcium for proso millet is 1000 times diluted solution of $1000{\ell}$ per ha at 25 day after sowing.

Effects of Seeding Rates on the Endosperm Depletion and Seedling Growth of Rice for Mechine Transplanting (수도기계이앙육묘에 파종량이 배유물질의 소모 및 묘소질에 미치는 영향)

  • This study was carried out to investigate the change of endosperm substance and seedling growth in rice seedlings for machine transplanting with use of two rice varieties, which Samgangbyeo (Indica${\times}$Japonica) and Dogjinbyeo (Japonica) were sown on May 8 with five levels of seeding density. 1. The total dry matter weight, leaf area, length of the longest root, number and length of new roots were negatively correlated with seeding density, and the plant height had the similar tendency to them from 20 days after sowing(DAS). 2. The rooting ability was negatively correlated with seeding density and decreased from 35 DAS in Dongjinbyeo. 3. The endosperm substance were exhausted at 25 to 30 DAS in Samgangbyeo and at 25 DAS in Dongjinbyeo. 4. The leaf area was more useful than the ratio of plant height to dry matter weight for judging the constitution of seedlings. 5. The reducing sugar contents in the endosperm were the greatest among parts of rice seedlings followed by leaf and root. The contents in leaf, root and endosperm reached maximal at 10 DAS, and varied with plant parts, seedling growth and varieties in different levels of seeding density. 6. The protein contents in leaf and root of rice seedlings became decreased with seedling growth., and were minimal values at 15 DAS. The content in endosperm was decreased soon after seeding, and minimal at 4 DAS with showing some fluctuation of protein content after then.

  • i) Das deutsche Arzneimittelgesetz(AMG) vom 24. 8. 1976 hat neben der Einf$\ddot{u}$hrung des Zulassungsverfahren f$\ddot{u}$r Arzneimittel anstelle des bisherigen Registrieungsverfahrens vor allem auf dem Gebiet des Haftungsrechts eine bedeutende Neuerung gebracht: die Gef$\ddot{a}$hrdungshaftung f$\ddot{u}$r den pharmazeutischen Unternehmer. Gem$\ddot{a}{\ss}$ $\S$84 AMG ist der pharmazeutische Unternehmer zum Schadensersatz verpflichtet. wenn infolge der Anwndung eines Arzneimittels ein Mensch get$\ddot{o}$tet oder K$\ddot{o}$rper oder die Gesundheit eines Menschen nicht unerheblich verletzt wird. Pharmazeutischer Unternehmer ist, wer das Arzneimittel unter seinem Namen in Verkehr bringt. ii) Die Ersatzpflicht des pharmazeutisches Unternehmers besteht jedoch nur in zwei F$\ddot{a}$llen: a) Das Arzneimittel hat bei bestimmungsgemm$\ddot{a}{\ss}$em Gebrauch sch$\ddot{a}$dliche Wirkungen, die $\ddot{u}$ber ein nach den Erkenntnissen der medizinischen Wissenschaft vertretbares Ma$\ss$ hinausgehen($\S$84 Abs. 1 Satz 2 Nr. 1 AMG). b) Der Schaden ist infolge einer nicht den Erkenntnissen der medizinischen Wissenschaft entsprechenden Kennzeichnung, Fachinformarion oder Gebrauchsinformation eingetreten($\S$84 Abs. 1 Satz 2 Nr. 2 AMG). iii) Mit dem 2. Schadensersatzrechts$\ddot{a}$nderungsgesetz ist, dem Konzept von $\S$6 Umwelthaftungsgesetz folgend, eine gesetzliche Kausalit$\ddot{a}$tsvermutung eingef$\ddot{u}$hrt worden. Ist das angewendete Arzneimittel nach den Gegebenheiten des Einzelfalls geeignet, den entstandenen Schaden zu verursachen, so soll vermutet werden, da$\ss$ das Arzneimittel auch den konkreten Schaden beim Anwender verursacht hat($\S$84 II AMG). Der pharmazeutische Unternehmer hat dann diese Vermutung zu wiederlegen. iv) Gem$\ddot{a}{\ss}$ $\S$94 AMG hat der pharmazeutische Unternehmer f$\ddot{a}$r seine Haftpflicht Deckungsvorsorge entweder durch eine Hafpflichtversicherung oder eine Freistellungs- oder Gew$\ddot{a}$hrleistungsverpflichtung eines Inl$\ddot{a}$ndischen Kreditinstituts zu treffen. v) Aber koreanisches Arzneimittelgesetz hat keine Gef$\ddot{a}$hrdungshaftung f$\ddot{u}$r Arzneimittelschaden. Es gibt nur Gefahrdungshaftung des Hersteller aufgrund des Produkthaftungsgesetzes, das auf das Arzneimittel Anwendung findet. Ich glaube, in Zukuft soll koreanisches AMG die Gef$\ddot{a}$hrdungshaftung f$\ddot{u}$r den pharmazeutischen Unternehmer regeln.

Investigation of Rhizome Enlargement Stage and Harvest Time in Rehmannia glutinosa (Gaertn.) Libosch. ex Steud. (지황의 비대시기와 수확시기 구명 연구)

  • Background: There have been no studies to date on rhizome development and optimal harvest timing for Rehmannia glutinosa. We therefore, undertook this investigation. Methods and Results: R. glutinosa 'Jihwang 1' was sown in early May and harvested in early November. Growth investigations were carried out at intervals of 10 days between 90 and 180 days after sowing (DAS). Leaf length, leaf width, and number of leaves increased until 150 DAS but decreased after 160 DAS. Rhizome length increased until 120 DAS subsequently, rhizome diameter increased rapidly between 130 and 150 DAS. Thus, the key period for rhizome enlargement in R. glutinosa is thought to be 130 to 150 DAS. Fresh root yield increased sharply from 916 kg/10a to 1,914 kg/10a between 4 and 5 months after sowing (MAS). Dry matter ratio increased gradually from 19.2% at 4 MAS to 24.4% at 6 MAS. Finally, the level of catalpol, a key active ingredient, increased sharply from 0.41% to 4.21% between 5 and 6 MAS. Given the dry matter ratio, catalpol content and yield measured, we suggest that optimal R. glutinosa harvest time is 6 MAS. Conclusions: Based on our results, the key period for rhizome enlargement is 130 to 150 DAS and optimal harvest timing is 6 MAS. We anticipate that these and other results of this study can be used to inform cultivation of R. glutinosa.

Investigation of Emergence Conditions and Plug Seedling Periods in Rehmannia glutinosa (Gaertn.) Libosch. ex Steud. (지황의 출아조건 및 플러그 육묘기간 구명 연구)

  • Background: Rehmannia glutinosa (Gaertn.) Libosch. ex Steud. has long been used as a traditional medicinal plant in Korea. This study was carried out to investigate the emergence conditions during the seedling periods in R. glutinosa. Methods and Results: The rhizomes of R. glutinosa variety (Jihwang 1) were harvested in the 22, March, 2018. The rhizomes were sown on in 50-cell plug trays. The emergence rates of seedlings at $15^{\circ}C$, $20^{\circ}C$, $25-40^{\circ}C$, and $45^{\circ}C$ treatment seedling were 1.3%, 96%, 100% and 0%, respectively. Rhizome rot was occurred at the temperature of $15^{\circ}C$ and $45^{\circ}C$. The emergence rates of seedlings in high moisture (HM), moderate moisture (MM) and low moisture (LM) treatments at $35^{\circ}C$ were 99.3%, 100%, and 0%, respectively. Drought damage was recorded in plant with the LM treatment. Seedling quality surveys were carried out at 10-days intervals from 10 to 60 days after sowing (DAS). Leaf length and leaf width were increasing until 50 DAS and the number of leaves was increasing until 60 DAS. Root length was increasing until 40 DAS, and then, flowering occurred from 30 to 60 DAS. Lastly, at 40 DAS, leaf aging and root enlargement was observed. Conclusions: We concluded that the emergence of seedlings was possible in the range of 20 to $40^{\circ}C$. Considering drying and rotting damage, we concluded that the moderate level of moisture is most appropriate for seedling emergence. In addition, we concluded that optimal seedling periods are between 30 and 40 DAS.

Der Begriff der Heilkundeausübung nach deutschem Medizinrecht (독일법상 의료행위 개념)

  • Der Begriff der Heilkundeausübung ist im positiven Recht in Korea nirgends festgelegt. Der wurde jedoch indirekt durch die Auslegung der Heilkundeausübung ohne Erlaubnis gemäß § 27 Abs. 1 des "Medizingesetzes" geregelt. In der Vergangenheit beschränkte der kOGH(the Supreme Court of Korea) die Heilkundeausübung auf die "Behandlung von Krankheiten und stellte fest, dass "medizinische und technische Maßnahmen, die keine pathologischen Symptome oder Funktionsdefizite im Körper voraussetzen, nicht zur Heilkundeausübung gehören." Danach änderte der kOGH seine Rechtsprechung auf "Vorbeugung oder Behandlung von Krankheiten durch Durchführung ärztlicher Untersuchungen, Optometrie, Verschreibung, Medikation oder chirurgischer Eingriffe auf der Grundlage von Erfahrung und Fähigkeiten, die auf medizinischem Fachwissen basieren, und anderer Gesundheitsfürsorge, definiert "medizinische Maßnahmen" als "eine Handlung, die eine gesundheitliche Gefahr darstellen kann, sofern diese nicht von einem Mediziner durchgeführt wird". Der Begriff der Heilkundeausübung in der Rechtsprechung ist einerseits zu abstrakt und kann eine Leerformel sein, andererseits kann seine Einschränkung eine Gefahr für die öffentliche Gesundheit erbringen. Daher besteht Bedarf an einem Kriterium, das dar derzeitige Begriff der Heilkundeausübung entsprechend dem gesetzgeberischen Ziel reduzieren kann, das Risiko für das Leben, den Körper oder die öffentliche Gesundheit von Menschen zu verhindern, das durch die Durchführung medizinischer Arbeiten durch nichtmedizinisches Personal entstehen kann. Um ein Kriterium vorzustellen, das das aktuelle Konzept der Heilkundeausübung reduzieren kann, werden in diesem Artikel das positive Recht, Theorien und Rechtsprechung zum Begriff der Heilkundeausübung in Deutschland untersucht und nach einer Alternative gesucht.
