Research on improvement of law for invigorating autonomous vehicle

  • The Korean government announced its goal of commercializing autonomous vehicle by year 2020. With such changes, it is expecting to decrease car accident mortality by half. To commercialize autonomous car, not only worries on safety of autonomous vehicle has to be solved but at the same time, institutional system has to be clear to distinguish legal responsibilities in case of accident. This paper will present the legal improvement direction of the introduction of autonomous vehicles as follows. First, it is necessary to re-establish concept of 'driver' institutionally. Second, it is appropriate to focus on Level 3 autonomous vehicle which is about to be commercialized in year 2020 and organize legal responsibility. Third, we should have a clear understanding on how level 3 autonomous vehicle will be commercialized in the future. Fourth, it is necessary to revise The Traffic Law, Act on Special Cases concerning the Settlement of Traffic Accident, and Automobile Accident Compensation Security Law in line with level 3 autonomous vehicle. Fifth, it is necessary to review present car insurance system. Sixth, present Product Liability Law is limited to movable products (Article 2), however, it is necessary to include intangible product which is software. Seventh, we should review on making special law related to autonomous car including civil, criminal, administrative, and insurance perspectives.

  • The first and the longest criminal indictment case of Korean medico-legal battle, so called BORAMAE Hospital Incident, was finally on its end by Korean Supreme Court's decision on June 24, 2004, after 7 years long legal dispute via Seoul District Court and Seoul Superior Appeal Court's decision. Boramae Hospital case was the first Korean legal case of Withdrawing Life-sustaining treatment of mechanical respirator on 58 years old Extradural Hematoma victim who was on Respirator under Coma after multi-organ failure postoperatively(APACHE II score: 34-39). Two physicians who have involved patient's care and had helped to make discharge the Near-death patient to home after repeated demand of patient's wife, due to economic reason, were sentenced as homicidal crime. This review article will discuss the following items with the review of US cases, Quinlan(1976), Nancy Cruzan(1990), Barber (1983), Helen Wanglie(1990), Baby K (1994) and Baby L cases, along with Official Statement of ATS and other Academic dignitaries of US and World.: [1] Details of Boramae Hospital incident, medical facts description and legal language of homicidal crime sentence. [2] The medical dispute about the legal misinterpretation of patient's clinical status, regarding the severity of the victim with multi-organs failure on Respirator under coma with least chance of recovery, less than 10% probability. [3] Case study of US, of similar situation. [4] Introduction of ATS official Statement on Withdrawing/ Withholding Life sustaining treatment. [5] Patient Autonomy as basic principle. [6] The procedural formality in Medical practise for keeping the legitimacy. [7] The definition of Medical Futility and its dispute. [8] Dying in Dignity and PAS(Physician Assisted Suicide)/and/or Euthanasia [9] The Korean version of "Dying in Dignity", based on the Supreme Court's decision of Boramae Hospital incident (2004.6.24.) [10] Summary and Author's Note for future prospects.

의료분쟁의 법적책임과 ADR제도의 효율적 운영방안 (A Study on Legal Liability and Efficient Planning for Alternative Dispute Resolution in Medical Disputes)

  • Medical dispute means the dispute between the hospital and the patient due to a medical accident. In general, medical accidents must be in accordance with the terms that are used in the medical dispute adjustment method stated in Article 2 (definition). In relation to this, there is a need to discuss an efficient operation scheme for Alternative Dispute Resolution (ADR) in medical disputes. In addition, it is necessary to look at issues of civil liability and criminal liability. In particular, in the consumer dispute arbitration committee, there is a case to make a "decision not to adjust" in aggressive intervention in the process of conflict resolution. The medical staff, on the basis of its "decision," can use this as a proven material for civil and criminal cases. This is rather upon the determination of the consumer council as a typical side effect to defend the user's perspective. This is the "decision" as was expressed from an order, "not adjusted." It is also determined to be easy and clearly timely. In the medical litigation, it is requesting the burden of proof of a patient's cause-and-effect relationship with the doctors committing negligence and medical malpractice. This seems to require the promotion of legislation in the direction to reduce future cases. It is determined that the burden of proof of medical accidents must be improved. The institution receiving the medical accident should prevent a closure report. Further, it is necessary to limit the transition to a franchise point. In this paper, we understand the problems of the current medical dispute resolution system, trying to establish a medical dispute resolution system desirable through an efficient alternative. In addition, it wants help in the protection and realization in medical consumers' and patients' rights. The relevant authorities will take advantage of these measures. After all, this could contribute to the system for a smooth resolution of a medical dispute.

스미싱 범죄 프로파일링 모델 설계 (Designing SMS Phishing Profiling Model)

  • 스미싱 범죄 피해 사례에서 수집할 수 있는 공격정보들을 이용하여, 범죄수사에 사용하는 프로파일링 기법을 응용한 스미싱 범죄 프로파일링 모델을 제안한다. 기존에 수사기관에서는 apk 파일의 해시를 이용한 시그니처 분석과 코드 내 삽입된 C&C IP 분석방법을 사용하였으나, 시그니처의 다변화와 코드 난독화로 인해 그 활용도가 낮아졌다. 실제 수사기관에 접수된 169건의 피해사례의 분석을 통해, apk 파일 내 인증서 파일 일련번호의 재사용이 151건(89%), 퍼미션 파일의 재사용은 136건(80%)에 달한다는 점에 착안, 인증서 파일의 일련번호와 퍼미션 파일의 해시를 중심으로 한 스미싱 프로파일링 모델을 설계하여 범죄를 군집화하여 기존의 해시 기반 군집화 방법을 보완하였고, 코드 유사도 검증을 통하여 추가로 신뢰성을 확보하였다.

의료사고에서의 형사책임 -원내감염사고의 해결을 향하여- (The Criminal Liability of Physicians in the Case of Medical Accidents)

  • 예전부터 일본에서 의료사고가 형사사건으로 취급되는 경우는 드물었다. 하지만 요코하마시립대학병원과 같은 중대한 의료과오가 발생한 이후 검사가 의료과오를 기소하는 태도를 보이고 있다. 의료사고는 의료관계자간 역할분담의 형태가 과실 인정에서 중요한 하나의 요소가 된다. 요코하마시립병원사건에서는 환자의 동일성확인에 관하여 의료관계자 사이에 역할분담이 확립되지 않은 경우에는 관계자 전원이 환자의 동일성을 확인하여야 할 의무가 있다고 하였다. 또 사이타마 의과대학병원사건에서는 치료에 신중할 필요가 있는 중대한 증례에 관해서는 그 증례를 담당하는 주치의 뿐 만 아니라 대학병원의 과장도 치료방침에 관하여 확인할 의무가 있다고 하였다. 현립 오오노병원사건에서 무죄판결이 내려진 이후는 형사소추에 신중을 기할 필요가 있다는 목소리가 강해지고 있다. 이러한 상황 속에서 후생노동성은 의료사고방지를 위해 의료사고조사제도를 도입하여 의료사고에 제3자기관에 의한 검증의 강화를 도모하고 있다.

  • 최근 정보통신시설에 대한 사이버공격을 보면 추적회피기술, 방어우회기술 등이 급속도로 발전하고 있고 전 세계에 있는 다수의 취약시스템을 경유지로 사용하기도 하며 또한 새로 개발된 사이버공격 도구들을 보면 취약점 공격 추적회피 증거훼손 등 완전범죄를 노리는 기술들이 패키지형태로 개발되어 유포되고 있다. 따라서 단순 예방기술로는 한계가 있으며 사안에 따라서는 실시간 추적 등 특별한 절차를 통해서 대응할 수밖에 없다. 나아가 국경을 넘어서는 사이버범죄의 특성상 세계가 공동으로 대응할 수 있는 국제적인 협력과 관련된 절차법적 정비가 요구된다. 특히 미국은 사이버범죄대응절차법의 제정으로 이에 대응하고 있다. 그러나 우리 현행법은 단순히 침해행위에 대한 처벌규정 등 실체법 등의 규정만 있고 절차상으로는 오프라인 범죄인 일반 형사사건과 동일한 절차를 밟아 대응하는 수준에 머물러 있다. 따라서 본 논문에서는 미국의 사이버범죄에 대한 절차법을 살펴보고 우리나라의 현실적 문제점과 대응방안을 제시한다.

The Current State and Legal Issues of Online Crimes Related to Children and Adolescents

  • There are two categories of online crimes related to children and adolescents: those committed by adolescents and those committed against children and adolescents. While recent trends in criminal law show consensus on strengthening punishment in cases of crimes against children and adolescents, there are mixed stances in cases of juvenile delinquency. One perspective emphasizes strict punishment, whereas the other emphasizes dispositions aligned with human rights. While various forms of online crime share the commonality in that the main part of the criminal act occurs online, they can be categorized into three types: those seeking financial gain, those driven by sexual motives, and those engaged in bullying. Among these, crimes driven by sexual motives are the most serious. Second-hand trading fraud and conditional (sexual) meeting fraud fall under the category of seeking financial gain and occur frequently. Crimes driven by sexual motives include obscenity via telecommunication, filming with discrete cameras, child and adolescent sexual exploitation material, fake video distribution, and blackmail/coercion using intimate images/videos ("sextortion"). These crimes lead to various legal issues such as whether to view vulgar acronyms or body cams that teenagers frequently use as simple subcultures or crimes, what criteria should be applied to judge whether a recorded material induces sexual desire or shame, and at what stage sexual grooming becomes punishable. For example, sniping posts, KakaoTalk prisons, and chat room explosions are tricky issues, as they may or may not be punished depending on the case. Particular caution should be exercised against the indiscriminate application of a strict punishment-oriented approach to the juvenile justice system, which is being discussed in relation to online sexual offenses. In the punishment case of online crime, juvenile offenders with a high potential for future improvement and reform must be treated with special consideration.

가정폭력에 대한 기혼여성의 배우자 처벌에 대한 견해 (Married Women's Opinion of the Spouse's Punishment in Domestic Violence Cases)

  • Purpose: The purpose of this study was to investigate current circumstances of violence against wives, and to identify the wife's opinion of the spouse's punishment in domestic violence cases. Method: The subjects were 216 married women in G province. Data was gathered from November 22 to December 6, 2004. Data was analyzed by descriptive statistics, and the $x^2$-test using SPSS/Win 10.0 program. Results: About thirty six percent of the subjects had experience with domestic violence. There was a high prevalence of psychological aggression(68%), sexual coercion (36%), physical assault(31%), and injury(19%). The subjects experiencing domestic violence had a higher positive attitude towards the spouse's punishment than subjects not experiencing domestic violence. The more severe the domestic violence was, the more the battered women's positive attitude for criminal action increased. Conclusion: An educational program and public relations will increase women's empowerment to solve domestic violence. A more cooperative and integrative program for prevention and an intervention system against domestic violence should be developed for women in battered situations.

응급구조 교통사고에 대한 운전자의 보호방안 (Driver's Protection Method of Ambulance Car Accident)

  • Exceptive clause of ambulance stated in Road Traffic Laws of ambulance car accidents is not properly applied and emergency staffs who transfer over 85% of emergency cases are to be forced to start out to the emergency field with unstable conditions which they may be punished on the criminal and civil laws. Hereby this study makes the following suggestions to activate the duties of transferring emergency cases by emergency staffs, promote their morale and diminish the victim of emergency staffs due to traffic accidents. 1) It is prescribed that ambulance car drivers should be protected legally by applying the exceptive clauses thoroughly regulated in special case clauses because ambulance cars are used for the purpose of saving the human life. 2) On the traffic accidents occurred during the transfer of emergency cases, the special insurance system is created for treating the ambulance car accidents, not to bind the emergency staff's mistake to traffic law and the victims are compensated by the nation on the basis of insurance system and emergency staffs have the systematic security. 3) On the road over six lanes, emergency lane is set on the center and ambulance car should be used as the exclusive lane. 4) Ambulance car drivers must have the habit of transferring emergency cases rapidly within the range of legal operation.

최근 살인 사건의 살해도구에 관한 연구 - 칼을 중심으로 - (A Study on Kitchen Knives Used in the Homicide Crimes)

  • 최근 살인사건의 실태를 보면 칼을 이용한 살인사건이 가장 많다. 살인을 음모하고 예견된 살인도 있지만, 순간적인 분노로 인한 우발적으로 저질러지기도 한다. 우발적인 범행에서 주변 가까이에 있는 가정용 칼을 범행에 사용하는 경우가 많지만 일상생활에서 칼의 위험성을 인식하는 경우가 드물다. 이에 전국에서 발생하는 살인사건의 범행방법 중 칼에 의한 범행에서 동기 분석과 함께 살해에 사용한 칼의 종류를 분석하였다. 그리고 칼에 대한 인식을 알아보고자 성인 남녀 500명을 대상으로 가정용 칼에 대한 21항목의 설문조사를 실시하였다. 그 결과를 일반 가정에서 사용하는 칼의 대부분이 칼끝이 날카로워 사실상 범행에 사용하기가 용이하였다. 그렇기 때문에 범인들이 칼을 휴대하기보다는 범행 장소에서 칼을 쉽게 구하여 범행에 사용하는 경우가 많다. 그리고 우발적인 살인의 경우에도 주방이나 식탁 또는 거실에서 칼을 쉽게 구할 수 있기 때문에 살인 사건이 더욱 빈발할 수 있다. 일반인의 칼에 대한 인식에서 칼의 위험도를 낮추기 위하여 칼끝을 둥글게 하자는 여론은 매우 높은 결과로 나타나지만 실제로 칼의 위험성에 대한 인식이 낮았다. 따라서 가정이나 가까운 사이에서 우발적 충동적인 살인을 예방하기 위하여 생활도구로 사용하는 칼도 위험한 물건으로 분류하여 인식전환과 함께 칼의 제작과 판매에 있어서 적절한 규제가 필요하다고 생각한다. 칼에 대한 인식을 새롭게 하여 가정에서 칼의 보관과 잠금장치의 필요성에 대한 홍보가 절실하다고 생각한다.
