고속철도 교량상판의 온도신축작용이 궤도처짐에 미치는 영향과 대책에 관한 연구 (The Effect and Countermeasures of The Vertical Track Settlement Caused by Expand and Contract Behavior of the High-Speed Railway Bridge Girder)

  • According to continuos welded rails on a bridge, temperature changes bring about the expansion of the bridge deck adding axil forces on the track. Moreover, the ballast on the bridge deck expansion joint is moved due to the bridge deck. If bridge decks are longer, the influence is greater, loosening ballast, causing track irregularities, and deteriorating passengers' comfort. Considering structure of bridge itself and tolerance of track irregularities caused by the loosened ballast on bridges, the maximum length of a deck should be less than 80m, which is the same as the standard of the French railway. In this study, an interaction between the expansion related to the bridge length and irregularity in longitudinal level referring to measurements and maintenance works performed in the high-speed railways was analyzed. This research shows that installation of sliding plate or vertical ballast stopper is not a good option since it is difficult to install. On the other hand, installation of movable fastener or gluing is easy but its influence is insignificant. To conclude, switch tie tamping or manual tamping is more effective than others.

문화유산 교육과정 개발 방안 연구 - 문화유산교육 현황과 지속가능한 교육과정 방안 제안 - (A Study on the Development of Cultural Heritage Education Courses - Current Status of Cultural Heritage Education and Proposal of Sustainable Education Courses -)

  • This research aims analyze the current situation and problems of cultural heritage education, and propose the methodology of cultural heritage education and the model of the curriculum for each education subject. This study consists of three parts. First, the current status of education related to cultural heritage was examined separately by general public, university and graduate students, and practitioners. Second, we reviewed the National Competency Standard(NCS) and the UNESCO World Heritage Competency Framework(CF) as a way to solve the problem of cultural heritage education for each education subject. By examining the methodology and curriculum model of cultural heritage education, we tried to find the future direction of cultural heritage education. Third, the education model of the cultural heritage curriculum for each educational subject was proposed by reflecting the direction and the cyclical education model of sustainable cultural heritage education. In future studies, we intend to use the education model presented in this study to specifically propose basic guidelines for the cultural heritage convergence curriculum.

  • 업무용 건축물 분야에서의 초에너지절약형 시스템으로의 개선이 절실하다. 사무소용/병원/호텔 건물을 중심으로 시간대별 및 연간 전력사용량 등의 전력소비 특성을 조사하였고, 건물연면적, 계약전력, 최대수요진력 등을 조사 분석하였다. 조사된 자료의 전체 특징과 중심적인 경향을 알아 보기 위해서 평균값, 표준편차, 최대값, 최소값, 부하율 등의 특징파라메터를 분석하였다 이를 토대로 연간 전기에너지 사용 총량과 에너지절약 성능의 관리기준을 나타내는 전력원단위를 분석하였고, 전기에너지 연간 사용총량 산정에 필요한 자료를 데이터베이스화하였다.

Information-based Smart Construction Management of High Rise Building Under the Complex Surrounding Environment in City Core Area

  • With the development of urbanization, the increasing of buildings density in urban core areas result in the complexity of construction environment. High-rise landmark building is always preferred in the construction of urban core areas. Super high-rise buildings construction are facing construction management difficulties due to the complex working conditions and enormous building system, especially with the complex surrounding environment of the urban core area, the construction management of super high-rise buildings in the area requires higher, refined and detailed standard. Based on a super high-rise project in a core area of Shanghai which has 370 m building height and 772,643 m2 building area, with complex surrounding environment, narrow construction site and many super-high-altitude crossing works. With the application of BIM technology, the Internet of Things, the LAN communication and other various intelligent mechanical equipment, information management systems, the efficiency and refinement of construction management are improved, ensuring the smooth implementation of the project while effectively controlling the impact on the surrounding environment.

Increasing of Macrophage Migration Inhibitory Factor Expression in Human Patients Infected with Virulent Brucella in Iraq

  • Brucellosis is a zoonotic disease caused by Brucella infections and humans usually contract this disease from close contact with infected animals or their products, usually via the ingestion of cheese or crude milk. Macrophage migration inhibitory factor (MIF) and Pro- and anti-inflammatory cytokines play an important role in susceptibility/resistance and the immunopathogenesis of Brucella infection. These cytokines are crucial factors in the initiation and progression of protective immunity against Brucella infection but the role of MIF has not been well studied in the human response to intracellular microbes. This study was designed to investigate the effect of MIF expression on Brucella susceptibility. A total of 85 positive rose Bengal tests and 24 samples from healthy individuals were collected for this study and subjected to polymerase chain reaction assays (PCR) of the bcsp31 diagnostic gene. MIF concentrations were evaluated using Enzyme-Linked immunosorbent assay (ELISA) and the results showed that 46 (54%) of the rose Bengal test samples were positive and 39 (46%) were negative for bcsp31 (p ≤ 0.05) and used as the gold standard for all of the comparisons in this study. The ELISA results indicate that the mean concentration of MIF was significantly higher in patients with positive rose Bengal tests when compared to the control groups and that its concentration increases with increasing age in both the patient and control groups (p ≤ 0.05).

Modification of Public-Private Partnership in Japan

  • Procurement system of public construction projects in Japan is changing with diversity in rapid pace. The quality assurance and risk management of construction projects should be more certain as the projects are turning into larger scale and more complexed. The clients in the public sector will want to make the relation of responsibility among the client, the designer (architects and engineers), and contractor clearer in terms of role and risk. Public-Private Partnership (PPP) is one of the methods for collaboration of the public sector and the private sector in public construction projects where the public utilizes the ability and suggestion of the private. Private Finance Initiative (PFI), Design-Build-Operate (DBO), market testing, designated manager system, outsourcing of tasks in local governments are well-known as examples of PPP in Japan. Indeed, there is an obvious trend that Design-Build (DB) is adopted in public construction projects in many countries including Japan. In this paper, the public construction projects in various procurement systems are surveyed and analyzed. They are not limited within the traditional procurement, Design-bid-Build, a separate order system of design and construction. Design-Build or PFI are adopted. In particular, contract by wide range including maintenance of equipment can be found. On the other hand, modification from originally typical PFI is taking place, such as concept design and project finance are removed from the roles and the tasks of the special purpose company (SPC) in PFI. Standard roles and tasks in a construction project are modeled in this paper.

영국 2015년 보험법의 해상보험 담보특약 제도에 대한 연구 -한국과 중국의 판례를 중심으로- (A Case Study on the Warranty in Marine Insurance under the Insurance Act 2015 in the UK -The Case of Korea and China-)

  • In the UK's the insurance law 2015, a remedy for breach of warranty in marine insurance was introduced. Also, if the insured proves that breach of warranty in marine insurance does not affect damages, the insurer pays the insurance money to the insured. The UK's marine insurance law has served as the governing law that has been the standard for the marine insurance industry for a long time. Korea and China were heavily influenced by the UK maritime insurance law. Therefore, this study analyzed the cases of breach of warranty in marine insurance in Korea and China. Through this, the insurer avoid the insurance contract for an accident that occurred after the breach of warranty. this result will be different under the new revised insurance law system. With the revision to The Insurance Act 2015, one of the biggest change in the insurance system is that it is possible to remedy of the violations of warranty. However, such a revision of the law requires considerable attention as it also changes the interpretation and judgment of the courts. Accordingly, a practical response of the insurance industry is required. It is necessary to prepare for possible disputes in practice.

AN AUSTRALIAN PERSPECTIVE OF THE SUITABILITY OF THE SCL PROTOCOL'S PROVISIONS FOR DEALING WITH FLOAT FOR ADOPTION AND USE BY THE AUSTRALIAN CONSTRUCTION INDUSTRY

  • During the negotiation and resolution of delay and disruption disputes on construction projects, the use and misappropriation of float, and the question of float ownership, are considered to be a major concern to those involved. Most practitioners and authors are of the opinion that it is an issue that should be clearly defined and addressed within the provisions of the contract. However, the terms "float" or "ownership of float" are rarely mentioned (if at all) in most of the standard forms of Australian construction contracts, giving little guidance to those involved as to how this issue should be addressed. In October 2002 the United Kingdoms Society of Construction Law (SCL) published a Delay and Disruption Protocol (the Protocol) that contains a suggested approach to the issue. The aim of this research was to obtain an Australian opinion of the suitability of the SCL's Delay and Disruption Protocols suggested approach to the issue of float and ownership of float for use by the Australian construction industry. Qualitative interviews were carried out with Australian construction industry experts experienced in the administration, negotiation, and resolution of delay and disruption disputes to obtain their opinions of the suitability of the SCL's proposed approach. Results indicate general confusion and uncertainty as to how the issue of float and float ownership should be addressed in general, with the SCL's approach adding further to that confusion.

항공기사고에서 국제근로계약과 불법행위의 국 제재판관할권 판단기준 (A Comment on the Standard for International Jurisdiction to foreign-related cases by the employment contract and tort in Air crash)

  • 이 논문은 외국적 요소가 있는 사안에 있어서 우리나라의 국제재판관할권에 관한 판례를 분석한 것이다. 대상 판결은 우리나라에서 발생한 항공기사고에 기인한 외국항공사와 외국인승무원간의 근로계약관계 그리고 불법행위에 대한 우리 법원의 국제재판관할권의 유무를 판단한 판례로서 이후 우리 법원의 판례에 기준이 되고 있다. 본 사건은 항공기가 대한민국 내에 추락함으로써 사망한 중국 국적 승무원의 부모가 그 항공운송인으로서 중국 법인인 피고 항공사를 상대로 대한민국 법원에 그 손해의 배상을 구하는 것으로, 이는 외국적 요소가 있는 법률관계에 관한 분쟁으로 우리 국제사법의 규정에 따라 대상사안에 관하여 우리나라에 국제재판관할권이 있는가의 여부에 대한 판단이 필요하였다. 제1심법원은 우리나라의 국제재판관할권을 부정하였으나, 대법원은 우리나라의 국제제판관할권을 긍정하였다. 이는 국제사법에 따라 국제재판관할권의 유무를 판단하게 되는데, 이에 있어 '실질적 관련성'에 대한 검토가 필요하다. 이에 본 판례평석에서는 국제사법 제2조에서 규율하는 국제재판관할권에 있어서의 판단기준인 실질적 관련성과 국제재판관할 배분의 이념에 부합하는 합리적인 원칙, 토지관할과 국제재판의 특수성에 관한 이론적 배경에 대하여 알아보고, 당해 사안에 대하여 토지관할권과 예측가능성에 따른 국제재판관할권의 인정 여부로서 불법행위지, 근로계약을 검토하고, 예측가능성과 항공기 승무원의 노무의 특징, 준거법 등에 관하여 대법원판결과 제1심, 학설 등에 비추어 그 의의와 쟁점을 살펴보기로 한다. 또한, 이번 사안에서와 같이 항공기 승무원의 노무와 그 근로계약에 따른 법적 성질에 관하여 EU의 계약상 채무의 준거법에 관한 'Rome I'(Regulation(EC) 593/2008 on the law applicable to contractual obligations) 상에서 논의된 '기지 원칙'에 따른 적용을 해 보았다.

서울시 철도터널 건설공사의 공사계측비 분석 및 개선방안 연구 (A Study on Analysis of Construction Monitoring Cost and Improvement Measures of Railway Tunnel Construction in Seoul)

  • 연구목적: 본 연구는 서울시 철도터널 건설공사의 공사계측비 분석 및 개선방안을 도출하여 건설계측의 신뢰향상으로 계측기술 발전에 기여한다. 연구방법:공사계측비의 설계 및 계약 현황, 공사계측비의 적용 현황 및 분석, 안전관리비와 품질관리비 분석, 이를 개선하기 위해 계측관리용역에 대한 대가 산정기준 적용 확대와 발주처에서 직접 발주하는 방안을 제시한다. 연구결과: 그동안 건설공사에 포함하여 발주하던 계측관리용역을 입찰참가자격 사전심사를 통하여 발주처에서 계측업체를 직접 선정하여 계측을 수행하면 계측 품질을 높이고 정확한 계측데이터 확보가 가능하다. 결론:계측관리용역에 대한 대가 산정기준은 시공사에서 하도급으로 수행하게 되는 순공사비 내에 포함하는 방식이 아닌 발주처 직접 발주로 엔지니어링진흥법에 따른 실비정액가산방식과 지반조사 표준품셈의 계측관리비 산출기준의 적용을 확대해야 한다.
