Major Issues and Improvement Measures for Disputes between Construction Companies and Residents Related to Defects in Multi-Family Housing Complexes (건설사와 입주민의 공동주택 하자분쟁 쟁점 및 개선 방안)

  • In the area of construction defects, residents have a tendency to focus on visually identifiable defects, while construction companies focus on defects that affect the structural and functional integrity of apartment housing. Accordingly, construction companies and residents have conflicting views on defects in apartment housing. To address this issue, this study aimed to accurately identify the main disputes surrounding defects in multi-family housing complexes or multi-dwelling unit apartment housing caused by such sharply different perspectives and suggest improvement measures. First, standards to determine different defects and remuneration standards between the Ministry of Land, Infrastructure and Transport and the court were analyzed. Then, problems were derived through an analysis of defects in past court cases, and the differences in perspectives between construction companies and residents were identified based on defect data from various construction companies. To tackle these issues, a classification measure for establishing a defect database for multi-family homes was also proposed.

  • Characteristics of Contactor's Defect Liability was too many discussed. But it's not clearly defined yet. Because recent Government Construction Projects are very complex and executed through long time, too many conflicts were appeared related to Contactor's Defect Liability. Therefore to analyse and to resolve the conflicts legal aspects of Contactor's Defect Liability stated in Civil Law and Government Contract Act was systematically compared. The result of this research is as follows : (1) Characteristic of Contactor's Defect must be regarded as a breach of Contract and be an incomplete contract implementation. (2) To decide the range of Damage, Characteristic of Defect must be regarded. (3) Contactor's Defect Liability must be effectual from the day of delivery. (4) Retainage must be added to secure the completion during the Contract Period and Defect Repairing Liability must be omitted in the Contract performance Security.

A Study of the Prevent Measure by Case Analysis of Apartment Building Defect Lawsuit (공동주택 하자소송 사례분석을 통한 분쟁방지 대책에 관한 연구)

  • This study analyzed the major issues of 24 defect litigation precedents before and after 2013, based on 2013, when defect litigation in relation to the rapidly increasing defect disputes in apartment houses. The amount of defect removal per household is 2,572 thousand won per household, which is about 5% less than before 2013 from 2013, but the judgment amount per household has rather increased by about 19%, showing 1,916 thousand won per household after 2013. By type of construction, defects on cracks accounted for the largest proportion before and after 2013. Before 2013, equipment, tiles, and windows appeared in the order, and after 2013, landscaping, tiles, insulation and window work were in the order. In order to prevent such defect disputes, efforts to prevent defect disputes will be needed in the design stage, construction stage, and maintenance stage.

The analysis of defects types and patterns in high-rise residential buildings (초고층 주상복합 건물의 하자 발생 유형 및 분석 연구)

  • Recently, public interest in housing defects, such as construction errors, occupiers' complaints, faults in production, and so on, is increasing. In addition, the construction requirements of high-rise residential buildings have increased, due to the higher prices of urban areas, especially in metropolitan areas. While previous research has focused on the defects occurring in apartment housing complexes, research has not been carried out on the defects occurring in high-rise residential buildings. In this paper, the defects patterns and characteristics of high-rise residential buildings are examined and analyzed and a defect management plan is then suggested. In order to do this, we collected the defects data of high-rise residential buildings recorded by 2,299 of 2,327 occupants. The defect occurrence rate (DOR) in the residential area is 98.8%. The frequency rate of defect occurrence over the total defect occurrence since building completion is 63.28% during the first year, 24.63% (second year), 6.88% (third year), 2.27% (fourth year), and 2.53% (fifth year). The result of correlation analysis between work types showed that there is a relationship between the built-in furniture and electronics (F&E) and painting works, and the F&E and masonry works, such as marble finishing. We expect that this research will assist in the efforts to decrease the number of defects in high-rise buildings.

Article 36 (Liability for warranty Repair Defects), Article 37 (About Repair Defect, etc), and its implementing ordinances, Article 36 (Term of warranty liability) Article 37 (Defect criteria), Article 38 (procedure of Repair defect), Article 39 (type of warranty liability), Enforcement Rule Article 17 (Certifiation of warranty liability). On the basis of the upper Decree, In spite of Standard and forms of 'Completion of Repair Defect' was exist, it was hard to receive 'End of Confirmation' in practice. The purpose of this study is to propose basics in order that Practitioners can apply problems and improvements about Decree on the Management of Apartment Houses.

  • Recently, as the living standards of residents in apartment houses continued to improve, the dispute of post management have also increased. one of the Issue, Concrete Cracks comprised high percentage of dispute. Especially, between criteria the cost of repairing defect and the judgement of defect isn't clear, they are a lot of dispute in this regard. Even though lots of the criteria about Inter-layer crack is existed by judging defects, In a court, they are judging their own criteria about Inter-layer crack. The purpose of this study is to compare and analyze Defect Judement Standard both MOLIT and Court, and to provide the Improvement for Defect Judgement and Repair Method of Inter-layer concrete crack.

  • The purpose of this study is to evaluate a defect in apartment buildings as review a safety investigation and consult a defect. As a result to compare a safety investigation to consult a defect, they are almost similar in spite of the purpose and the scope of evaluation are different. Therefore, it needs to establish a special and systemic system, and follow an organized effort about raising a consultant and improving an ability.

  • In recent years, the proportion of medium and small-sized apartments within the housing market has seen a noticeable increase, alongside a corresponding rise in disputes related to construction defects. Such disputes are most prevalent in the finishing works phase of construction, which not only are frequent in occurrence but also impose significant repair costs. Furthermore, there is a noticeable scarcity of research focused on the quality management of finishing work defects prior to the completion of construction. Addressing this issue necessitates a methodology capable of preemptively identifying defects by analyzing their frequency and associated costs across various defect types. Consequently, the aim of this study is to propose a risk assessment methodology by conducting an analysis of defect cases across 3,299 apartment units, considering aspects such as frequency and severity. The outcomes of this research endeavor are expected to offer practical management strategies to enhance the quality of apartment finishing works and serve as an academic foundation for the enhancement of construction management systems pertaining to apartment finishing works.

  • It is an social issue that is various claim related on the defect of apartment house. The cost of defect repair is the most important matter that residents dispute constructers with the huge time wasting and cost loss. For resolve the matter of defect claim, it must to be analyze to the cost property that study and find to pending issue about the cost of defect repair. Therefore this study is investigated the cost property of defect repair relation on correlation analysis and regression analysis around the judgement cost. Consequently, cost of the judgment is associated with cost of the accusation and cost of the defect repair, is recognizable as them that is closely connected. Meanwhile, the more time of take effect and time of lawsuit increase, the more cost of the judgment decrease by draw the regression equation. On the contrary, there are same aspects in the case on the cost of the accusation and cost of the defect repair.

  • Due to the lack of available land for housing in Korea, apartment has been supplied in great quantities to raise the rate for land-use since the middle of 1980s. Many people in Korea live in apartment because the number of apartment occupies more than half of total houses. Nevertheless, the concern on the house management with respect to the quality is insufficient, it is currently required the concern on the quality of housing. Moreover, many defects in apartment has been occurred repeatedly now, so, it is necessary to analyze the defect in order to raise the quality of living environment. This study aimed to survey the types of defect in apartment according to the construction types through the questionnaire analysis about apartment residents in Gwangju city for the purpose of reducing the defects.
