UCP 600상 상당일치론의 적용에 관한 연구 (A Study on the theory Substantial Compliance under UCP 600)

  • L/C transaction, the most important issue for the seller and the buyer is the theory of documentary transaction and the theory of strict compliance which are the principles of L/C transactions. According to the leading cases in England and America where the practice of L/C transactions was created and developed, the descriptions of the commodities specified on all the documents which are submitted based on an L/C, should be identical to the descriptions of commodities specified in the L/C. And further, many leading cases of L/C continuously repeat to emphasize strict compliance. However, the recent leading cases in and out of the country show that the principle of strict compliance is being weakened. The leading cases in America show two trends of weakening the principle of strict compliance. That is, on the contrary to strict compliance, tends to apply substantial compliance (which puts more value on the substance of the documents). These leading cases reflect the attitudes of the judicial and the legislative authorization that don't want to approve formal approach to the commercial law. Recently, the Supreme Court of Korea is giving a decision on the principle of strict compliance, "The documents attached to an L/C should strictly comply with the conditions in the L/C, but it doesn't mean that they should be perfectly identical without any mistake in words. In case the bank can understand through reasonable care that a small mistake in words is too trivial to give different meaning or to give damage to the conditions of the L/C, the documents are regarded to comply with the conditions of the L/C. However, the judgment should be based on whether the difference between the documents and the L/C can be admitted by the international standard bank transaction practice or not." This decision tells that the principle of strict compliance is quite much modified so application of this modification can't be ignored. However, from the viewpoint of the party who requests to open an L/C, there is a criticism that a bank's arbitrary judgement can be involved. Therefore, reviewing the original purpose of L/C transactions (activating international transactions), the principle of strict compliance may be thought old-fashioned because it emphasizes a form, but in reality, for prompt transaction and payment, the principle of strict compliance should be observed in L/C transactions. And further, if a legislative device is prepared to systematically compensate for several side-effects, the principle of strict compliance will improve dynamic flow of prompt and low-costly L/C transactions. On the other hand, it will be able to protect the interested parties.

ICC 중재규칙(ICC Rules of Arbitration)의 "위탁조건"(Terms of Reference)에 관한 연구 (A Study on the "Terms of Reference" in the ICC Rules of Arbitration)

  • The Terms of Reference are one of the most distictive features of ICC Arbitration. No document of this type is required to be drawn up under the rules of any of the other major international arbitration institutions. The purpose of this paper is to examine their advantages and to introduce main contents provided in Article 18 of ICC Rules of Arbitration, which results in the wide recognition of the Terms of Reference. As the volume of our international commercial transaction ranks almost ten in the world, the frequency using ICC Arbitration is expected to increase continuously. The Terms of Reference provide the parties and the arbitrators with an opportunity to identify and agree on procedural and other matters, such as the applicable law, the language of the arbitration and the timetable for the arbitration. They also afford the parties and the arbitrators to identify the substantive issues that are addressed in the arbitration and to delimit the precise scope of the Arbitract Tribunal's mandate. The contents of the Terms of Reference which are provided in Article 18(1) include the summary of parties claims, the list of issues and procedural rules. For the effects of the Terms of Reference, they are not intended to replace the parties' arbitration agreement. But they may in certain circumstances be regarded as a form of submission agreement. Article 18(2) provides that the Terms of Reference shall be signed by the parties and the Arbitral Tribunal, and requires the Arbitral Tribunal to transmit a signed copy of the Terms of Reference to the Court within two months of the date on which the file was transmitted to it by the Secretariat. The Court enjoys the power to extend the two-month time limit for the Terms of Reference on the reasoned request of the Arbitral Tribunal or on the Court's own initiative. Article 18(3) provides that if any of the parties refuses to take part in the drawing up of the Terms of Reference or to sign the same, they shall be submitted to the Court for approval. Article 18(4) allows the Arbitral Tribunal to extablish in a separate document a provisional timetable. This is a provision that encourages the acceleration of the arbitraction process. The timetable provided for therein is merely "provisional" and may be modified, as necessary, during the course of the arbitration.

국제항공운임과 국내 경쟁법규의 적용 (International Airfares and Application of Competition Laws)

  • 제2차 세계대전 이후 국제항공체제의 근간이 되는 1944년의 시카고협약에 의하면 국가 간 항공 운송은 양자협상체제로 규율되며, 특히 운임은 IATA의 운임설정기구를 통한 항공사간 협의와 관련국 정부의 인가로 운영되고 있다. 항공 운임은 여객, 수하물 및 우편물을 제외한 화물의 운송에 대해 부과되는 가격과 그 가격의 가용성 및 사용을 지배하는 조건이다. 전통적인 양자협정이 질서 있고 원만한 항공 시장의 발전에 주안점을 두고 있는 반면 자유화협정 체제는 운임의 자유 경쟁을 비롯하여 가능한 한 모든 규제를 철폐하고 있다. 또한 EU를 비롯한 지역적인 블록은 역내 항공자유화를 추구하고 있다. 한편 자유화와는 별개로 전 세계적인 차원에서 자원의 효율적인 활용과 파괴적인 경쟁으로 초래되는 시장의 독과점 상태를 방지하기 위하여 항공사간 다양한 형태의 협력(합병 및 인수, 공동 운항, 운임협의, CRS, 지상조업 등)이 추구되고 있다. 이들 자유화를 지향하는 국가에서는 항공 운임을 포함한 항공사간 협력이 경쟁을 저해함으로써 소비자 후생에 반하는지 여부를 판단하여 반독점 면제(antitrust immunity)를 부여할 것인가를 결정하고 있다. 운임을 비롯한 항공사간 협력이 항공사간 공정한 경쟁을 유지하고 소비자 이익을 증진할 경우 반독점 면제를 부여하고 있다. 면제의 허용 여부는 관련 국가와의 원만한 관계 등을 종합적으로 고려하여 신중하게 결정하여야 한다.

However, due to unconstitutional, in the circumstances which a false hype is flooding and increasing, it has been realized that the fair competition of medical community, life and health rights of the people are threatened by in reverse. In this regard, the abolition of the pre-deliberation system of medical advertising can be welcomed by abolition of the old system which is the legal and institutional censorship. Since its abolition, the alternative policy direction is insufficient also it is not clear. Therefore we need to study this. Therefore, in this paper, we try to find general theoretical background and problem of pre-deliberation system of medical advertising. Also, as trying to find feasibility or ambiguity of regulation and issues about medical advertising on medical law, we argued the provision of special measures of the medical advertising for introduction of integrated medical advertising deliberation committee which can ensure the independence and autonomy, strengthening of the monitoring on the internet advertising, legal resolving through amendments, strengthening of penalties, and establish special measures of medical advertising for the medical privatization and demand for the foreign medical tourist, etc. Empirical study about practical regulatory measures of medical advertising which converged the various opinions of consumer groups, government and academia, and medical community, and we expect hope to see the more realistic alternative provision.

전자항공권의 법적 제문제에 대한 고찰 (A Legal Study on the Electronic Ticketing)

  • 앞으로의 국제항공운송업계에서의 항공권 판매 형태는 인터넷을 통한 전자항공권 판매형태가 대세를 이룰 것으로 예측되고 있다. 실제 국제항공운송협회(lATA)에서 2007년 연말까지 전 세계적으로 E-Ticketing을 실시간 할 것을 목표로 한다고 천명한 바 있고 우리나라에서도 내년부터 전면적인 전자항공권 제도가 실시되는 만큼 인터넷 보급이 제대로 되지 않은 일부 국가를 제외하고는 전자항공권 제도는 조만간 전 세계적으로 실시될 것으로 본다. 이러한 전자항공권 제도는 종래의 항공권 판매제도와는 전혀 다른 인터넷이라는 가상공간(Cyber Space)에서 계약이 체결되기 때문에 종전에는 볼 수 없었던 새로운 많은 법적 문제를 야기시키고 있다. 즉 전자항공권의 법적 정의 문제를 비롯하여, 항공권 교부 의무는 어떻게 되는지, 계약 체결시기를 언제로 볼 것인지, 재판관할권 문제는 어떻게 되는지 등의 많은 법적 문제가 전자상거래의 특성과 관련하여 문제가 되고 있다. 우선 이들 가운데 가장 현실적이고 시급한 중요한 문제는 계약체결시기와 재판관할권 문제라고 할 수 있을 것이다. 이 논문에서는 이러한 전자항공권 관련 법적 문제를, 이를 규정하고 있는 새로운 국제항공운송책임조약인 1999년 몬트리올조약에 입각하여 계약체결시기와 재판관할권 문제를 중심으로 살펴보았다. 이울러 이에 대해서 규정하고 있는 국내항공사의 관련운송약관도 살펴보고 그 문제점을 지적하였다. 이제 전자항공권 제도는 우리에게 현실적인 문제가 되었고 앞으로도 계속 확장 및 발전이 예상되는 만큼 이에 따른 법적 연구도 병행되어 나가야 할 것으로 본다.

해양플랜트공사계약상 제조물인도지연에 따른 당사자의 법적 책임에 관한 고찰 (A Study on the Legal Liabilities of Contractor as a Delay in the Product Delivery on the Offshore Plant Construction Contract)

  • 2007년 미국에서 시작된 글로벌 금융위기의 영향은 국내의 해운 조선 분야에도 크게 영향을 미쳤다. 이와 관련하여 국내 조선소는 해운경기 악화로 인한 상선 수주물량 감소의 대체수단으로 여러 방면에서 수주전략을 수립하였고, 선택한 분야가 해양플랜트였다. 그러나 국내 조선소는 해양플랜트 관련 계약이 갖고 있는 위험성 분석에 대한 대비 없이 단순한 매출액 확대와 일감확보를 위한 무리한 영업 수주전략을 추진하였다. 이러한 결과, 해양플랜트 발주자와 초기에 계약한 금액보다 많은 비용이 투입되거나 제조물 인도지연에 따른 지체상금을 지급해야 하는 법적인 문제로 확대되었다. 주요 법적분쟁의 원인은 해양플랜트공사 시 발생할 수 있는 비선형모델에 의한 위험성 분석, 공정관리의 미숙, 국내 조선소가 "Engineering Procurement Construction 일괄계약"을 사용하는 해양플랜트공사계약의 이해 부족에 기인한다. 특히, 위험성 관리 항목의 한 요소로써 계약상의 독소조항에 대한 충분한 검토가 이루어지지 않은 점에 있다. 이러한 계약서를 검토할 만한 인력도 부재하다. 따라서 이 연구에서는 계약목적물의 인도지연이 발생할 수 있는 구체적 위험성의 존재를 식별하고, 해양플랜트공사계약 상에는 어떠한 불공정조항이 존재하며, 그러한 불공정조항이 실제 양 당사자에게 어떻게 적용되는지를 국내 조선소의 프로젝트 관리자의 인터뷰와 선행연구를 참조하여 구체적 위험요소가 계약상으로 어떻게 함의되는가에 대해서 살펴보았다. 이를 통하여 해양플랜트공사계약상 제조물인도지연에 관한 계약당사자의 법적 책임관계와 국내 조선 해양플랜트 산업발전에 기여할 수 있는 개선방안을 도출하였다.

인장시험의 실험과 해석 결과를 이용한 임계손상도의 결정 (Determination of a critical damage by experiment and analysis of tensile test)

  • A new method of evaluating critical damage values of commercial materials is presented in this paper. The method is based on the previous study of the methodology [1] of acquisition of true stress-strain curves or flow stress curves over large strain from the tensile test in which the flow stress is described by the Hollomon law-like form, that is, by the strain dependent strength coefficient and the strain hardening exponent. The strain hardening exponent is calculated from the true strain at the necking point to meet the Considere condition. The strength coefficient is assumed to be constant before necking and represented by a piecewise linear function of strain after necking. With the predicted flow stress, a tensile test is simulated by a rigid-plastic finite element method with higher accuracy of less than 0.5% error between experiments and predictions. The instant when the fracture begins and thus the critical damage is obtained is determined by observing the stress variation at the necked region. It is assumed that the fracture due to damage begins when the pattern of stress around the necked region changes radically. The method is applied to evaluate the critical damage of a low carbon steel.

UNCITRAL의 최근 동향 : 1976년 UNCITRAL 중재규칙 개정안의 제3회독을 중심으로 (Recent Developments : The Third Reading of the Revised Version of the UNCITRAL Arbitration Rules of 1976)

  • In 2006, the UNCITRAL Working Group II started a new project on the revision of the UNCITRAL Arbitration Rules of 1976. Ever since that time, 9 sessions of the Working Group II were devoted to the discussions on such topic. The Arbitration Rules has been acknowledged to be used for settling international disputes involving various disputing parties. In recent years, many treaty-based arbitrations have been subject to the Arbitration Rules. This article focuses on the discussions made in the 52nd session of the Working Group II where the third reading of the revised draft of the Arbitration Rules was completed except for a few provisions. Among the draft rules, the delegations were hardly able to reach an agreement with regard to Articles 2(2), 34(2), 41(3), (4), and (6). It is expected that those provisions would be agreed in the coming 43rd plenary session of the UNCITRAL. The use of the Arbitration Rules is dependent on the agreement by the disputing parties. It is not like the UNCITRAL Model Law on International Commercial Arbitration which was adopted in Korean legal system in 1999. However, the proper functioning of arbitration rules is essential for the efficient and successful operation of the arbitration system in a particular country. That is the reason why we should keep close attention on the discussions of the UNCITRAL with regard to the revision of the Arbitration Rules.

분지관 내 물체 주위 맥동류에 대한 CFD 해석 (CFD ANALYSIS FOR A PULSATILE FLOW AROUND A BODY INSIDE A BIFURCATED TUBE)

  • The objective of this study is to get simulation data about pulsatile flow around an interior solid body inside a bifurcated tube. All the processes were based on CFD method, with a commercial FVM code, SC/Tetra ver. 6.0 for solving, and with CATIA R16 for generating geometries. The bifurcated tube models were drawn with the bifurcated angle of 45 degrees, considering Murray's law about the diameter ratio. With various locations of the object, the effects of flow on the drag were considered. For the pulsating flow condition, the velocity wave profile was given as the inlet boundary condition. To validate all the result, the simulation was compared with the existing data of the other papers first. Overall flow field of both data were similar, but there was some difference at a zero velocity. Therefore the next simulation was continued with the sine wave profiles where there is no negative flow, and then the data was compared with one of the pulmonary artery velocity where there is negative flow. The final process was to calculate flow variables such as the wall shear stress (WSS) and to compute the drag of the solid object.

2열 휜 튜브 열교환기의 공기측 압력강하 및 열전달 특성을 고찰하기 위한 확대 모형실험 (A large scale model test to investigate the pressure drop and heat transer characteristics in the air side of two-row heat exchanger)

  • This work is performed to investigate the pressure drop and heat transfer characteristics in the air side of finned-tube heat exchanger for air conditioner. Experimental apparatus and method are described to simulate the heat exchanger performance by using the three times enlarged model. The pressure drop and heat transfer coefficient were measured and compared for the heat exchangers with a plane fin and a commercial strip fin. The measured data for the strip fin agree well with those of prototype within a few percentages. For the plane fin, the measured data had similar trend to Gray & Webb's correlation at high air velocity, however a new correlation is needed to give more accurate prediction at low air velocity. It is found that most heat was transferred around the front row of the two-row heat exchanger, and the ratio of thermal load at the front tube row was increased for decreasing air velocity.
