The medical practice does not always get a satisfatory result since the disease progress of patients are depended on patients' physical constitution and the doctors cannot control the outcomes about patients' physiological and biological reaction after the treatment. Moreover, the medical practice may bring wrong result fatalistically because of the unpredictablility of life. To demand for compensation of the damage to the doctors about these wrong result, the patient side holds the burden of proof that is between medical practice and demage, and there is damage from doctor's malpractice according to the accepted theory about the fundamental principle of distribution of the burden of proof. This falls not only under the liability of Tort Law, but also liability of Contract Law. However, the patient may be in difficult situation to prove the malpractice of doctors since he or she cannot recognize the facts because he or she was in unconscious while the medical practice was conducted, or they cannot judge precisely even though they recognize the facts. Nevertheless, the lawsuits against medical malpractice are the field that never achieves the equality of arms since the most of the evidence belong to the doctor's side. Hence, to maintain the principle of the equality of arms under the constitution, the theory leads to alleviate the burden of proof that patients hold. However, the doctors cannot be asked for the burden of proof that they conduct medical practice without errors. Because the doctors may experience difficulty to prove their innocence as the patients because of the unique characteristic that medical practices have. Therefore, the methods of the alleviation of the patient's burden of proof should have the equality of arms and the equal opportunity between the patients and the doctors with the evaluation of the justifiable interest from both the patients and the doctors. As the methods of the alleviation of the burden of proof, the alleviation of the demands and the degree of the burden of proof or resolutely the conversion of the burden may be considered. However, Recognizing the exception from general principle with converting the burden of proof is not proper in principle because the doctors may experience difficulty of the proof as the patients may have. If the difficulty of proof can be resolved by alleviating of the demands and the degree of the burden of proof, it is more desirable resolution rather than converting the burden of proof.
Purpose: This study was conducted to identify subjective attitudes towards terminal patients in nursing students who had clinical practice. The types of subjective attitude were classified by applying Q methodology. According to those types, basic reference data for the development of educational programs were provided. Methods: Thirty-four final Q samples were selected, and Q classification with a nine-point scale was performed with P samples of 43 nursing students. A key factor analysis was conducted with the collected data using the PC QUANAL program. Results: Nursing students' attitudes towards terminal patients were grouped into three types. The total variable was 49.96%. Students with Type 1 ("wish for life-sustaining medical treatment") thought that terminal patients accurately understood their medical condition and wanted to prolong their lives. Others with Type 2 ("need for service and support") believed that a multidisciplinary nursing system needs to be established to help terminal patients prepare for death. Students with Type 3 ("awareness and acceptance of death") thought that terminal patients wanted to die with dignity at a hospice unit. Conclusion: This study analyzed various types of attitude towards terminal patients, as perceived by nursing students with clinical training experience. Development of educational programs for each attitude type analyzed in this study could contribute to systematic training programs for nursing students caring for terminal patients.

This study is a preliminary survey to determine the desired demanding well-dying education requirements for subjects aged 65 years or older according to their family's death experience. The results of this study report that all subjects needed well-dying education regardless of their family's death experience. In addition, 71.8% of those who had experienced family deaths said they needed education. On the other hand, 40% of those with no family deaths said that education was needed. Both groups responded as needing well-dying education based on the meaning of death and value of life. Groups with family death experiences hoped to include 'how to overcome sadness related to the death of family and friends' and 'information about organ or body donation procedures'. Both groups responded that 1 week was appropriate for the duration of well-dying education, and that the lectures and discussions were appropriate for the education method. In the future, well-dying education will require sustainable education, not one-offs, and education for the family as well as the elderly.
This study presented the role of the counselor's transitional object through literature research, focusing on Winnicott's theory. In the process of development, infants experience anxiety when they move from absolute dependence to relative dependence with their mother. In this way, the counselor's role as an transitional object buffers separation anxiety and depressive anxiety about the loss experience, and mediates from the omnipotent fantasy to the real world. transitional objects are new objects and have a function of contributing to adaptation in reality. And it leads to the stage of separation and individualization through transitional object and transitional phenomena. It can be said that he acquires a sense of the real other that exists in order to create and destroy omnipotent, and to adapt to reality. A good enough mother makes the child's omnipotence meaningful. In this case, the true self helps the infant's weak self to grow and lead him to live his own life. When the mother fails to satisfy the infant's needs, her fantasies and spontaneous impulses are lacking. In other words, when the mother fails to reflect the infant's needs, the infant looks at her mother's mood, giving up her true self and creating a false self. The pathology of the absolute dependence phase is caused by the failure of a good enough mother's empathy and nurturing environment. At this time, the child experiences the collapse of the omnipotence illusion and experiences annihilation anxiety. Therefore, effective counseling can be carried out when providing a comfortable and stable environment by reducing separation anxiety and depressive anxiety of clients through the role of the counselor's transitional object in the counseling field.

Although Traditional Korean Medicine had always referred to Mamok(痲木: Paresthesia) as the prodrome of stroke for a long time, yet there were only few research papers on it. Hence, the purpose of this research is to explore the relationship between Mamok(痲木; Paresthesia) as the prodrome and an attack of stroke. Setting 509 Korean impatient women as the subject of research, 264 of the whole are stroke patients and 245 are non-stroke patients. Blood tests, questionnaires, and body measurements (height, weight, waist, hip) are performed to the subjects. Basic population traits, life-style, and past history are included in the contents of questionnaires. whether or not they have experience the numbness, description about the clinical characteristics of the symptom, the body parts which the symptom occurred, the onset of the symptom, and the incidences are examined in the category inquiring the numbness of the hand and foot. After adjusting for age, unilateral numbness was associated with significantly increased risk of stroke. When adjusted for other factors(Half of WHR, History of Hypertension and Diabetes mellitus, Cigarette smoking, Alcohol drinking, Education, Marital status, Regular exercise), the risk of stroke was positively associated with unilateral numbness.(Age Adjusted Odds Ratios=2.282(95%CI=1.107-4.705), Multivariate Odds Ratios=4.105(95% CI=1.233-13.671)) Whereas no significant association was observed in the onset and the incidence of unilateral numbness. This study suggest that preceding Mamok(痲木; paresthesia) before stroke attack is may be common prodrome symptoms of stroke. Prospective cohort study on the association between Mamok(痲木;Paresthesia) as the prodrome and an attack of stroke in Korean population will be necessary.
