대전지역 시험용 시추공 지하수내 우라늄 및 라돈-222의 지화학적 산출특성 (Geochemical Occurrence of Uranium and Radon-222 in Groundwater at Test Borehole Site in the Daejeon area)

  • 본 연구는 대전지역 기존 지하수중 우라늄 및 라돈-222와 같은 자연방사성 물질의 농도가 높은 것으로 알려진 한 지점을 선정하여 121 m 심도의 연구용 시추공을 확보하여 심도별 지하수내 우라늄 및 라돈-222의 산출특성 밝히고, 시추코어를 이용하여 우라늄의 기원에 대한 지화학적 상관성을 알아보고자 하였다. 이를 위하여 더블패커를 이용하여 시추공내 심도별로 6개 지하수 시료를 채취하여 화학성분 분석, 우라늄과 라돈-222의 함량을 분석하였다. 분석결과 지하수의 pH는 중성내지는 알카리성이며, 화학성분상 $Ca-HCO_3(SO_4+Cl)$ 유형에 속한다. 그리고 우라늄과 라돈-222의 농도는 각각 169~1,020 ppb와 $9,190{\pm}96{\sim}32,800{\pm}180$ pCi/L를 보여 심도별 뚜렷한 농도차이를 보이며, 모두 미국 EPA 권고치를 초과하였다. 지하수내 우라늄은 지하 45~50m 심도에서 가장 높은 함량을 보인다. 이 구간 지하수는 약알카리성의 산환환경이며 높은 $HCO_3$의 함량으로 우라늄 용존에 유리한 환경으로 보인다. 지하수내 우라늄의 형태는 우라닐탄산염화합물{$(UO_2CO_3)^0$ 혹은 $(UO_2HCO_3)^+$}이 우세한 것으로 보인다. 라돈-222 함량은 심도가 깊어질수록 증가하는 경향을 보인다. 시추코어에 의한 지질주상도특성을 보면 모암은 복운모화강암이며 페그마타이트가 수 곳에서 확인되었고, 중성질 암맥이 100 m 내외에서 확인되었다. 암석내 우라늄과 토륨의 함량은 0.372~47.4 ppm과 0.388~11.2 ppm의 범위를 보여 기존 국내에서 보고된 함량보다 높은 값을 보인다. 암석현미경 관찰 및 전자현미분석결과 방사성원소를 함유하는 광물로는 장석과 흑운모내 포획된 모자나이트, 인회석, 녹염석 광물로 확인되었으며, 광물내 주요성분을 치환하여 주로 존재한다.

매향 딸기로부터 anthocyanin 합성 유전자의 분리 및 과실발달 과정에서의 발현 분석 (A Set of Anthocyanin Biosynthetic Genes are Differentially Expressed in Strawberry (Fragaria x ananassa cv Maehyang) during the Fruit Development Process)

  • 매향' 딸기의 안토시아닌 생합성은 개화 후 26일째 시작되어 과실의 성숙기 동안 계속된다. 딸기로부터 안토시아닌의 생합성에 관여하는 주요 유전자를 분리하였다. 각각의 유전자에 대해, 다양한 식물체의 유사 유전자의 염기서열을 비교하여 PCR (polymerase chain reaciton) primer를 제작하였다. 숙기의 딸기에서 분리된 total RNA로부터 합성된 CDNA와 각 primer를 이용하여 RT (reverse transcriptase)-PCR을 수행하였다. 각 CDNA clone의 염기서열을 작성하여 분석한 결과, 이들은 안토시아닌 생합성에 관여하는 phenylalanine ammonia lyase (PAL), 4-cummarate CoA ligase (4CL), chalcone synthase (CHS), chalcone isomerase (CHI), flavanone-3-hydroxylase (F3H), dihydroflavonol 4-reductase (DFR), anthocyanidine synthase (ANS) 그리고 UDP-glucose:flavonoid-3-O-glucosyltransferase (UFGT) 효소에 해당되었다. Northern blot 분석 결과, 이들 유전자는 과실 발달과정에서 시기적으로 조절되었다. 특히 PAL을 제외한 모든 유전자는 과실에서만 주로 발현되었다. PAL, DFR 그리고 ANS유전자는 과실 초기 발달 단계인 개화 후 10일에 검출된 후 감소하다가, 22일에 다시 증가하기 시작하여 34일에 최대가 되었다. 한편, 다른 유전자들은 초기에는 발현되지 않다가, 안토시아닌이 축적되기 시작하는 개화 후 $22{\sim}30$일에 처음으로 검출되었다. 본 연구를 통해, 딸기 과실 발달과정에서 안토시아닌 생합성 과정에 관여하는 여러 유전자가 과실 숙기에 함께 조절되는 현상을 알 수 있다. 이러한 연구 결과는 안토시아닌 합성과정을 제어하는 조절 유전자가 존재한다는 것을 시사한다. 그리고 딸기의 안토시아닌 생합성 유전자의 발현패턴을 크게 두 가지로 나눌 수 있는 것으로 보아, 딸기의 안토시아닌 생합성에는 적어도 두 가지 서로 다른 조절 기작이 관여하여 색소 발달 과정을 제어할 것으로 보인다.

고지방식이로 유도한 비만 Mice에서 잣송이 초임계 추출물의 항비만 효과 (Anti-Obesity Effect of Pine Cone (Pinus koraiensis) Supercritical Extract in High-Fat Diet-Induced Obese Mice)

  • 본 연구에서는 C57BL/6J 마우스에 고지방 식이를 통한 비만을 유도시키며 동시에 잣송이 초임계 추출물을 식이에 첨가하여 8주간 식이 투여하여 항비만 식품 소재로서의 기능성을 알아보고자 하였다. 잣송이 초임계 추출물 20 mg/kg b.w.(HFD+PC low), 잣송이 초임계 추출물 100 mg/kg b.w. (HFD+PC high) 섭취군의 체중증가량은 고지방식이 유도 비만 대조군(HFD)에 비해 각각 유의적으로 감소하였고, 간, 백색 지방, 총 지방 무게의 변화량 역시 잣송이 초임계 추출물 섭취군이 HFD군에 비해 유의적으로 감소하였다. 실험동물의 혈청 지질 함량은 총콜레스테롤, 중성지방, LDL/VLDL 콜레스테롤, HDL 콜레스테롤이 HFD군에 비해 잣송이 초임계 추출물 섭취군에서 유의적으로 감소하였으나, HDL/LDL 비율을 계산한 결과에서는 잣송이 초임계 추출물 섭취군이 HFD군에 비해 유의적으로 증가하였음을 확인하였다. 실험동물군의 지방 조직에서 adipogenic transcription factor ($PPAR-{\gamma}$, SREBP, C/EBP)의 발현을 측정한 결과, 잣송이 초임계 추출물 섭취군이 HFD군에 비해 유의적으로 감소하였다. 또한, adipogenic enzyme(FAS, LPL)의 발현을 측정한 결과, 잣송이 초임계 추출물 섭취군이 HFD군에 비해 유의적으로 감소하였다. 이러한 결과로부터 잣송이 초임계 추출물이 항비만 효과를 가진 천연 기능성 식품의 개발에 있어 기초 자료로 활용할 수 있을 것으로 기대할 수 있다.

고려홍삼의 수지상세포 활성화 효과 (Effects of Red-ginseng Extracts on the Activation of Dendritic Cells)

  • 본 연구에서는 정관장 홍삼의 물(water) extract, 식용발효 주정 extract 및 홍삼 추출물로부터 분리 제조한 crude saponin을 이용하여 면역반응을 매개하는 수지상세포의 활성 효과에 대하여 알아보았다. 그 결과 홍삼시료 중, crude saponin $100\;{\mu}g/ml$을 처리하였을 때 수지상세포의 세포표면 분자인 MHC class II, CD40, CD80, CD86의 발현이 증가하였으며, phagocytosis는 감소하였다. 또한 홍삼시료를 처리한 수지상세포와 allogeneic T세포를 함께 배양하였을 때, 홍삼시료의 물 extract, 식용발효주정 extract, crude saponin 모두 allogeneic T세포의 증식반응을 유도하였고, IL-2와 $IFN-{\gamma}$의 생산량을 증가시키는 것을 확인하였다. 또한 $CD4^+$ syngeneic T세포와 $CD8^+$ syngeneic T세포의 반응에서도 T세포의 증식반응을 높게 유도하였으며, $CD4^+$ syngeneic T세포에서 IL-2와 $IFN-{\gamma}$의 생산량을 증가시키고, $CD8^+$ syngeneic T세포에서는 $IFN-{\gamma}$ 생산량을 증가시키는 것을 확인하였다. 이상의 결과로 crude saponin의 경우 수지상세포 의 세포표면 공동자극분자의 발현을 유도하고 성숙을 유도함으로써 T세포의 활성을 증진시키는 것으로 생각되며, 물 extract와 식용발효주정 extract는 crude saponin과는 다른 기작으로 T세포 활성화를 유도하는 것을 알 수 있었다. 따라서 실험에 사용한 홍삼시료, 즉 물 extract, 식용발효주정 extract, crude saponin 모두 수지상세포의 활성을 유도하는 물질로써 암항원 특이적 T세포 활성화를 이용한 항암치료에 이용할 수 있는 가능성이 있다고 사료된다.

산국(Chrysanthemum boreale Makino) 꽃 유래 에센셜오일(Essential oil)이 지방세포 분화 및 지방생성에 미치는 영향 (Inhibitory Effects of Chrysanthemum boreale Makino on 3T3-L1 Preadipocyte Differentiation and Down-regulation of Adipogenesis and Lipogenesis)

  • 비만은 2 형 당뇨병, 고혈압 및 고지혈증을 포함한 다양한 질병과 관련이 있으며, 산국꽃은 전통적으로 비만과 2형 당뇨병 치료제로 사용되어왔다. 본 연구는 전지방세포(preadipocyte, 3T3-L1)를 사용하여 산국꽃 에센셜오일이 지방세포 분화 및 지방 생합성에 미치는 영향을 확인하였다. 산국꽃 에센셜오일은 $0.1-5{\mu}g/ml$의 농도에서 3T3-L1 세포에 대해 독성을 나타내지 않았다. 산국꽃 에센셜오일은 지방세포 분화 유도물질(MDI)을 처리한 3T3-L1세포에서 농도 의존적으로 지방분화를 억제하였으며, $1{\mu}g/ml$ ($28.94{\pm}2.01%$)농도에서 최대 효과를 나타내었다. 산국꽃 에센셜오일은 MDI에 의해 분화가 유도된 3T3-L1 세포에서 지방생성전사인자인 peroxisome proliferator-activated receptor ${\gamma}$ ($PPAR{\gamma}$), CCATT/enhancer binding protein ${\alpha}$ ($C/EBP{\alpha}$) 그리고 sterol regulatory element binding protein (SREBP-1)의 단백질 발현을 억제하였다. 중성지방 생성 및 지방산합성효소 조절인자인 acetyl-CoA carboxylase (ACC)와 fatty acid synthase (FAS)의 발현 또한 산국꽃 에센셜오일에 의해 억제되었다. 따라서 본 연구를 통해 산국꽃 에센셜오일은 천연 항비만 기능성 소재로써의 사용이 가능할 것으로 사료 된다.

무막줄기세포추출물의 LLC-PK1 세포에서의 산화적 스트레스 개선 효과 (Protective Effect of Membrane-Free Stem Cell Extract against Oxidative Stress in LLC-PK1 Cells)

  • 신장에서 발생한 산화적 스트레스는 조직을 손상시키고 이는 만성신장질환으로 이어질 수 있다. 본 연구에서는 LLC-$PK_1$ 신장세포를 이용하여 산화적 스트레스 개선 효과를 살펴보았다. LLC-$PK_1$ 세포에 무막줄기세포추출물을 처리했을 때 체내 항산화 단백질인 heme-oxygenase-1, thioredoxin reductase 1, 및 NADPH quinine oxidoreductase-1의 발현이 증가함을 확인하였다. LLC-$PK_1$에 산화적 스트레스를 유도하기 위하여 3-morpholinosydnonimine (SIN-1)을 처리한 결과 세포생존율이 감소하여 산화적 스트레스로 인해 세포가 손상됨을 확인하였다. 그러나 무막줄기세포추출물을 처리하였을 때 세포생존율이 증가하였으며, $2.5{\mu}g/mL$에서 세포생존율이 58.84%에서 64.43%까지 증가하였다. 또한 무막줄기세포추출물은 LLC-$PK_1$ 세포에서 SIN-1으로 유도된 염증 및 세포사멸을 조절하였다. 염증 관련 단백질인 inducible nitric oxide synthase와 cyclooxygenase-2는 무막줄기세포 추출물을 처리했을 때 단백질 발현이 감소하였고, 세포사멸과 관련된 B-cell lymphoma-2-associated X protein/B-cell lymphoma-2 비율과 cleaved caspase-3, cleaved-poly (ADP-ribose) polymeras의 단백질 발현이 감소함을 확인하였다. 결과적으로 무막줄기세포출물은 SIN-1을 처리한 LLC-$PK_1$ 세포에서 산화적 스트레스에 대한 보호 효과가 있음을 알 수 있었으며, 이들 결과를 바탕으로 무막줄기세포추출물의 항산화 기능성 소재로서의 활용 가능성을 확인하였다.

Relationship between porcine miR-20a and its putative target low-density lipoprotein receptor based on dual luciferase reporter gene assays

  • Objective: Mutations in low-density lipoprotein receptor (LDLR), which encodes a critical protein for cholesterol homeostasis and lipid metabolism in mammals, are involved in cardiometabolic diseases, such as familial hypercholesterolemia in pigs. Whereas microRNAs (miRNAs) can control LDLR regulation, their involvement in circulating cholesterol and lipid levels with respect to cardiometabolic diseases in pigs is unclear. We aimed to identify and analyze LDLR as a potential target gene of SSC-miR-20a. Methods: Bioinformatic analysis predicted that porcine LDLR is a target of SSC-miR-20a. Wild-type and mutant LDLR 3'-untranslated region (UTR) fragments were generated by polymerase chain reaction (PCR) and cloned into the pGL3-Control vector to construct pGL3 Control LDLR wild-3'-UTR and pGL3 Control LDLR mutant-3'-UTR recombinant plasmids, respectively. An miR-20a expression plasmid was constructed by inserting the porcine premiR-20a-coding sequence between the HindIII and BamHI sites in pMR-mCherry, and constructs were confirmed by sequencing. HEK293T cells were co-transfected with the miR-20a expression or pMR-mCherry control plasmids and constructs harboring the corresponding 3'-UTR, and relative luciferase activity was determined. The relative expression levels of miR-20a and LDLR mRNA and their correlation in terms of expression levels in porcine liver tissue were analyzed using reverse-transcription quantitative PCR. Results: Gel electrophoresis and sequencing showed that target gene fragments were successfully cloned, and the three recombinant vectors were successfully constructed. Compared to pMR-mCherry, the miR-20a expression vector significantly inhibited wild-type LDLR3'-UTR-driven (p<0.01), but not mutant LDLR-3'-UTR-driven (p>0.05), luciferase reporter activity. Further, miR-20a and LDLR were expressed at relatively high levels in porcine liver tissues. Pearson correlation analysis revealed that porcine liver miR-20a and LDLR levels were significantly negatively correlated (r = -0.656, p<0.05). Conclusion: LDLR is a potential target of miR-20a, which might directly bind the LDLR 3'-UTR to post-transcriptionally inhibit expression. These results have implications in understanding the pathogenesis and progression of porcine cardiovascular diseases.

전기가열방식 스크러버의 NF3 제거 효율 (The progress in NF3 destruction efficiencies of electrically heated scrubbers)

  • 현재 반도체 및 LCD(Liquid Crystal Display) 제조 공정에 널리 사용하는 $NF_3$는 국제적으로 대기중 배출량에 대한 규제를 실시 중인 온실가스 중의 하나다. 온실가스의 배출량 감축을 위하여 국내 대상 산업체들은 $NF_3$ 배출량의 감소에 지속적으로 노력을 해 오고 있다. 본 연구는 LCD를 제조하는 국내 3사에 설치된 $NF_3$ 처리용 전기가열방식 스크러버(scrubber)의 제거효율(DRE, Destruction and Removal Efficiency)과 process chamber에서의 $NF_3$ 사용 비율(use rate in process)을 측정하였다. 스크러버의 효율을 정확하게 측정하기 위하여, 비활성 기체인 He을 일정 유량으로 주입시켜주는 방법으로 시료를 채취하고, 정밀 가스질량분석기(Gas-MS)를 이용하여 시료 중 화학종들의 분압을 측정하였다. 세 회사에 설치되어 있는 스크러버의 효율을 측정한 결과, 2004년 이전에 설치한 스크러버의와 그 이후 개선한 스크러버의 DRE는 각각 52%와 95% 이상임을 확인하였다. 또한 Process chamber의 $NF_3$ 사용 효율은 1세대 및 2세대 공정라인에 설치한 RFSC(Radio Frequency Source Chamber)의 경우 75% 보다 낮지만, 3세대 이상 라인에 설치한 RPSC(Remote Plasma Source Chamber)의 경우는 95% 이상으로 측정이 되었다. 반도체 및 디스플레이 공정에 개선된 스크러버와 RPSC식 process chamber를 사용할 경우 $NF_3$ 배출량을 99.95% 이상 줄일 수 있을 것으로 예상된다. 따라서 $NF_3$에 대한 국내 3사의 온실가스 감축 목표가 성공적으로 이루어 질 것으로 예상된다.

항공기(航空機) 사고조사제도(事故調査制度)에 관한 연구(硏究) (A Study on the System of Aircraft Investigation)

  • The main purpose of the investigation of an accident caused by aircraft is to be prevented the sudden and casual accidents caused by wilful misconduct and fault from pilots, air traffic controllers, hijack, trouble of engine and machinery of aircraft, turbulence during the bad weather, collision between birds and aircraft, near miss flight by aircrafts etc. It is not the purpose of this activity to apportion blame or liability for offender of aircraft accidents. Accidents to aircraft, especially those involving the general public and their property, are a matter of great concern to the aviation community. The system of international regulation exists to improve safety and minimize, as far as possible, the risk of accidents but when they do occur there is a web of systems and procedures to investigate and respond to them. I would like to trace the general line of regulation from an international source in the Chicago Convention of 1944. Article 26 of the Convention lays down the basic principle for the investigation of the aircraft accident. Where there has been an accident to an aircraft of a contracting state which occurs in the territory of another contracting state and which involves death or serious injury or indicates serious technical defect in the aircraft or air navigation facilities, the state in which the accident occurs must institute an inquiry into the circumstances of the accident. That inquiry will be in accordance, in so far as its law permits, with the procedure which may be recommended from time to time by the International Civil Aviation Organization ICAO). There are very general provisions but they state two essential principles: first, in certain circumstances there must be an investigation, and second, who is to be responsible for undertaking that investigation. The latter is an important point to establish otherwise there could be at least two states claiming jurisdiction on the inquiry. The Chicago Convention also provides that the state where the aircraft is registered is to be given the opportunity to appoint observers to be present at the inquiry and the state holding the inquiry must communicate the report and findings in the matter to that other state. It is worth noting that the Chicago Convention (Article 25) also makes provision for assisting aircraft in distress. Each contracting state undertakes to provide such measures of assistance to aircraft in distress in its territory as it may find practicable and to permit (subject to control by its own authorities) the owner of the aircraft or authorities of the state in which the aircraft is registered, to provide such measures of assistance as may be necessitated by circumstances. Significantly, the undertaking can only be given by contracting state but the duty to provide assistance is not limited to aircraft registered in another contracting state, but presumably any aircraft in distress in the territory of the contracting state. Finally, the Convention envisages further regulations (normally to be produced under the auspices of ICAO). In this case the Convention provides that each contracting state, when undertaking a search for missing aircraft, will collaborate in co-ordinated measures which may be recommended from time to time pursuant to the Convention. Since 1944 further international regulations relating to safety and investigation of accidents have been made, both pursuant to Chicago Convention and, in particular, through the vehicle of the ICAO which has, for example, set up an accident and reporting system. By requiring the reporting of certain accidents and incidents it is building up an information service for the benefit of member states. However, Chicago Convention provides that each contracting state undertakes collaborate in securing the highest practicable degree of uniformity in regulations, standards, procedures and organization in relation to aircraft, personnel, airways and auxiliary services in all matters in which such uniformity will facilitate and improve air navigation. To this end, ICAO is to adopt and amend from time to time, as may be necessary, international standards and recommended practices and procedures dealing with, among other things, aircraft in distress and investigation of accidents. Standards and Recommended Practices for Aircraft Accident Injuries were first adopted by the ICAO Council on 11 April 1951 pursuant to Article 37 of the Chicago Convention on International Civil Aviation and were designated as Annex 13 to the Convention. The Standards Recommended Practices were based on Recommendations of the Accident Investigation Division at its first Session in February 1946 which were further developed at the Second Session of the Division in February 1947. The 2nd Edition (1966), 3rd Edition, (1973), 4th Edition (1976), 5th Edition (1979), 6th Edition (1981), 7th Edition (1988), 8th Edition (1992) of the Annex 13 (Aircraft Accident and Incident Investigation) of the Chicago Convention was amended eight times by the ICAO Council since 1966. Annex 13 sets out in detail the international standards and recommended practices to be adopted by contracting states in dealing with a serious accident to an aircraft of a contracting state occurring in the territory of another contracting state, known as the state of occurrence. It provides, principally, that the state in which the aircraft is registered is to be given the opportunity to appoint an accredited representative to be present at the inquiry conducted by the state in which the serious aircraft accident occurs. Article 26 of the Chicago Convention does not indicate what the accredited representative is to do but Annex 13 amplifies his rights and duties. In particular, the accredited representative participates in the inquiry by visiting the scene of the accident, examining the wreckage, questioning witnesses, having full access to all relevant evidence, receiving copies of all pertinent documents and making submissions in respect of the various elements of the inquiry. The main shortcomings of the present system for aircraft accident investigation are that some contracting sates are not applying Annex 13 within its express terms, although they are contracting states. Further, and much more important in practice, there are many countries which apply the letter of Annex 13 in such a way as to sterilise its spirit. This appears to be due to a number of causes often found in combination. Firstly, the requirements of the local law and of the local procedures are interpreted and applied so as preclude a more efficient investigation under Annex 13 in favour of a legalistic and sterile interpretation of its terms. Sometimes this results from a distrust of the motives of persons and bodies wishing to participate or from commercial or related to matters of liability and bodies. These may be political, commercial or related to matters of liability and insurance. Secondly, there is said to be a conscious desire to conduct the investigation in some contracting states in such a way as to absolve from any possibility of blame the authorities or nationals, whether manufacturers, operators or air traffic controllers, of the country in which the inquiry is held. The EEC has also had an input into accidents and investigations. In particular, a directive was issued in December 1980 encouraging the uniformity of standards within the EEC by means of joint co-operation of accident investigation. The sharing of and assisting with technical facilities and information was considered an important means of achieving these goals. It has since been proposed that a European accident investigation committee should be set up by the EEC (Council Directive 80/1266 of 1 December 1980). After I would like to introduce the summary of the legislation examples and system for aircraft accidents investigation of the United States, the United Kingdom, Canada, Germany, The Netherlands, Sweden, Swiss, New Zealand and Japan, and I am going to mention the present system, regulations and aviation act for the aircraft accident investigation in Korea. Furthermore I would like to point out the shortcomings of the present system and regulations and aviation act for the aircraft accident investigation and then I will suggest my personal opinion on the new and dramatic innovation on the system for aircraft accident investigation in Korea. I propose that it is necessary and desirable for us to make a new legislation or to revise the existing aviation act in order to establish the standing and independent Committee of Aircraft Accident Investigation under the Korean Government.

아시아 주요국가(主要國家)들에 있어서의 바르샤바 체제(體制)의 적용실태(適用實態)와 전망(展望) (The Current Status of the Warsaw Convention and Subsequent Protocols in Leading Asian Countries)

  • The current status of the application and interpretation of the Warsaw Convention and its subsequent Protocols in Asian countries is in its fredgling stages compared to the developed countries of Europe and North America, and there is thus little published information about the various Asian governments' treatment and courts' views of the Warsaw System. Due to that limitation, the accent of this paper will be on Korea and Japan. As one will be aware, the so-called 'Warsaw System' is made up of the Warsaw Convention of 1929, the Hague Protocol of 1955, the Guadalajara Convention of 1961, the Guatemala City Protocol of 1971 and the Montreal Additional Protocols Nos. 1,2,3 and 4 of 1975. Among these instruments, most of the countries in Asia are parties to both the Warsaw Convention and the Hague Protocol. However, the Republic of Korea and Mongolia are parties only to the Hague Protocol, while Burma, Indonesia and Sri Lanka are parties only to the Warsaw Convention. Thailand and Taiwan are not parties only to the convention or protocol. Among Asian states, Indonesia, the Phillipines and Pakistan are also parties to the Guadalajara Convention, but no country in Asia has signed the Guatemala City Protocol of 1971 or the Montreal Additional Protocols, which Protocols have not yet been put into force. The People's Republic of China has declared that the Warsaw Convention shall apply to the entire Chinese territory, including Taiwan. 'The application of the Warsaw Convention to one-way air carriage between a state which is a party only to the Warsaw Convention and a state which is a party only to the Hague Protocol' is of particular importance in Korea as it is a signatory only to the Hague Protocol, but it is involved in a great deal of air transportation to and from the united states, which in turn is a party only to the Warsaw Convention. The opinion of the Supreme Court of Korea appears to be, that parties to the Warsaw Convention were intended to be parties to the Hague Protocol, whether they actually signed it or not. The effect of this decision is that in Korea the United States and Korea will be considered by the courts to be in a treaty relationship, though neither State is a signatory to the same instrument as the other State. The first wrongful death claim in Korea related to international carriage by air under the Convention was made in Hyun-Mo Bang, et al v. Korean Air Lines Co., Ltd. case. In this case, the plaintiffs claimed for damages based upon breach of contract as well as upon tort under the Korean Civil Code. The issue in the case was whether the time limitation provisions of the Convention should be applicable to a claim based in tort as well as to a claim based in contract. The Appellate Court ruled on 29 August 1983 that 'however founded' in Article 24(1) of the Convention should be construed to mean that the Convention should be applicable to the claim regardless of whether the cause of action was based in tort or breach of contract, and that the plaintiffs' rights to damages had therefore extinguished because of the time limitation as set forth in Article 29(1) of the Convention. The difficult and often debated question of what exactly is meant by the words 'such default equivalent to wilful misconduct' in Article 25(1) of the Warsaw Convention, has also been litigated. The Supreme Court of Japan dealt with this issue in the Suzuki Shinjuten Co. v. Northwest Airlines Inc. case. The Supreme Court upheld the Appellate Court's ruling, and decided that 'such default equivalent to wilful misconduct' under Article 25(1) of the Convention was within the meaning of 'gross negligence' under the Japanese Commercial Code. The issue of the convention of the 'franc' into national currencies as provided in Article 22 of the Warsaw Convention as amended by the Hague Protocol has been raised in a court case in Korea, which is now before the District Court of Seoul. In this case, the plaintiff argues that the gold franc equivalent must be converted in Korean Won in accordance with the free market price of gold in Korea, as Korea has not enacted any law, order or regulation prescribing the proper method of calculating the equivalent in its national currency. while it is unclear if the court will accept this position, the last official price of gold of the United States as in the famous Franklin Mint case, Special Drawing Right(SDR) or the current French franc, Korean Air Lines has argued in favor of the last official price of gold of the United States by which the air lines converted such francs into us Dollars in their General Conditions of Carriage. It is my understanding that in India, an appellate court adopted the free market price valuation. There is a report as well saying that if a lawsuit concerning this issue were brought in Pakistan, the free market cost of gold would be applied there too. Speaking specifically about the future of the Warsaw System in Asia though I have been informed that Thailand is actively considering acceding to the Warsaw Convention, the attitudes of most Asian countries' governments towards the Warsaw System are still wnot ell known. There is little evidence that Asian countries are moving to deal concretely with the conversion of the franc into their own local currencies. So too it cannot be said that they are on the move to adhere to the Montreal Additional Protocols Nos. 3 & 4 which attempt to basically solve many of the current problems with the Warsaw System, by adopting the SDR as the unit of currency, by establishing the carrier's absolute liability and an unbreakable limit and by increasing the carrier's passenger limit of liability to SDR 100,000, as well as permiting the domestic introduction of supplemental compensation. To summarize my own sentiments regarding the future, I would say that given the fact that Asian air lines are now world leaders both in overall size and rate of growth, and the fact that both Asian individuals and governments are becoming more and more reliant on the global civil aviation networks as their economies become ever stronger, I am hopeful that Asian nations will henceforth play a bigger role in ensuring the orderly and hasty development of a workable unified system of rules governing international commercial air carriage.
