  • Piracy has been an ongoing and serious problem in international shipping industry. Somalia is often in the news these days. Somalia has been in a state of unrest for more than two centuries. In recent times, the situation has remained unstable. The persistent unrest is the major driver behind the piracy epidemic in Somalia waters. By the MIA 1906, s.78(1), the expenses in order to be recoverable must have been "properly incurred". The underwriter is also liable in certain circumstances for expenses incurred by the assured in an attempt to avert or diminish loss covered by the policy, under provisions. This class of expenditure is commonly referred to as sue and labour expenses, or suing and labouring expenses; less commonly, as particular charges. The standard marine policy(the S.G.Form) contained what was invariably called the sue and labour clause, which has been replaced in the current Institute Clauses by the "Duty of Assured(Sue and Labour)" Clause in the Hull Clauses, and the "Duty of Assured" Clause, headed "Minimizing losses", in the Cargo Clauses. Sue and labour charges are not confined to expenditure on the part of the assured and his agents, but can include quantified loss consequent upon a sacrifice properly and reasonably made to avert or minimize an insured loss.

  • For the problems in executing rural development, recent recognitions are that discovery, preservation, and utilization of area-unique resource are unsatisfactory, that participation of local residents was neglected, and that approach to gradual refurbishment of houses and common space of town in consideration of existing spatial pattern of the town was not adequate. Especially, neglect for exact investigation, analysis and evaluation on rural local resources is bringing about social problems such as mass production of uniform rural area and loss of local identity. In this study, rural resources were listed and resource evaluation items was designed in order to establish development direction of rural village. According to these results, for the efficient and reasonable drive of the resource evaluation system, following items are required; A premise of local development by participation of local people, Development of diversely appliable resource evaluation clauses, Establishment of development type in connection with resource evaluation clauses, Systematic management of local resource through spreading DB resource. This research was loused on unearthing direction development of rural village and theme. However, what should be reconsidered through continuous study is that resource evaluation clauses are somewhat general and not concretely illustrated. Therefore establishment of characterized development is expected through clarifying local identity and presenting direction of local development, with the importance of resource and systematic analysis in planning on rural village in the future.

Document Research for the Restoration of Traditional Acupunctural Methods (전통침구기법(傳統鍼灸技法)의 복원을 위한 문헌조사)

  • 1) Objective This research is a process of examining the Traditional Acupunctural Methods left in our documents. The objectives of this paper are explaining the process of researching documents and reporting several points revealed in this process. 2) Process This study was done through the following steps: (1) We located the Acupunctural Methods in the original text database on the web. (2) We sorted them according to criterion. (3) We set up some standard clauses in order to organize the selected information. (4) We re-organized the information following the standards within the categories. (5) As for clauses that were not fully explained in the documents, we tried to restore them through other documents. 3) Results (1) 11 standard clauses were set up in order to organize the Traditional Acupunctural Methods. (2) Traditional Acupunctural Methods were extracted from 22 documents, (3) 24 Traditional Acupunctural Methods were extracted and organized by standards. (4) We learned of similar methods with resembling ways of drawing blood and methods with deep interest in the depth of needle insertion. Also, we were able to gain a clue to the exchange of Acupunctural Methods among the three Asian countries and the possibility of research using the Korean Medicine Database.

Optimized Encoding of Sudoku Puzzle for SAT Solvers (SAT 처리기를 위한 수도쿠 퍼즐의 최적화된 인코딩)

  • Sudoku can be regarded as a SAT problem. Various encodings are known for encoding Sudoku as a Conjunctive Normal Form (CNF) formula, which is the standard input for most SAT solvers. Using these encodings for large Sudoku, however, generates too many clauses, which impede the performance of state-of-the-art SAT solvers. This paper presents an optimized CNF encodings of Sudoku to deal with large instances of the puzzle. We use fixed cells in Sudoku to remove redundant clauses during the encoding phase. This results in reducing the number of clauses and a significant speedup in the SAT solving time.

Ergonomic Analysis and Improvement of Crane Safety Certification Standards (크레인 안전인증기준에 대한 인간공학적 분석 및 개선)

  • Crane is an important equipment for the transport of heavy goods in industrial sites, but it is also known as one of the most fatal machines. In order to reduce crane accidents, it is necessary to minimize human errors during crane operations. To achieve this, ergonomic design principles are recommended to be reflected from the crane design stage. The study analyzed the safety certification standards for crane that should be fulfilled at the crane design and manufacturing stage. This study selected five representative ergonomic design principles (feedback, compatibility, consistency, full-proof, and fail-safe) by surveying heuristic evaluation principles that are widely used for usability evaluation in early design stage. Next, the principles were applied to the safety certification standards to identify insufficient clauses. This study identified 12 insufficient clauses out of 119 in the current safety certification standards for crane and discussed their improvement directions to comply the ergonomic principles. The analysis results of this study can help of improving the safety certification standards and the method used in this study can also be applied to identify insufficient clauses in the safety certification standards for other industrial machines such as press machine and lift.

Study on Legal Issues of Facility Management of Children's Swimming Pool

  • Purpose: Children's swimming pools are picking up faster than the other types of swimming pool. Yet, safety law-related studies are still lack. This study is to review legal status of children's swimming pool in Korea and to discuss the related legal issues for safety management of children's swimming pool. Research design, data, and methodology: The study reviewed law and clauses for sport facility management and related legal clauses with chilren's swimming pool management, and sport facility-related articles. Results: Safety management of children's swimming pool should currently follow law for sport and physical education facility management because of no its own legal norm for children's swimming pool. Given this, specific law and clauses for children's pool management need to be legislated to prevent risks for children and to satisfy specific safety factors considering careless behavior of children. Conclusions: Regarding this, the study points out five suggestions. First, law should be established to make notification of safety rules mandatory and this notification should be placed in the pool. This notification would be better effective if it is visualized. Second, according to law, safety 7 rules of children' s swimming pool need to be legistrated and educated for pool managers to obey them. Pool managers could also add their own rules to the 7 rules. Finally, preparation of emergency kits and safety devices need to be mandatory in the pool. Further implications were discussed.

Text-Driven Multiple-Path Discourse Processing for Descriptive Texts

  • This paper presents a text-driven discourse analysis system, called DPAS. DPAS constructs a discourse structure by weaving together clauses in the text by finding discourse relations between a clause and the clauses in a context. The basic processing model of DPAS is based on the stack based model of discourse analysis suggested by Grosz and Sidner. We extend the model with dynamic programming method to handle various discourse ambiguities effectively and efficiently. We develop the idea of a context space to keep all information of a context. DPAS parses a text by considering all possible discourse relations between a clause and a context. Since different discourse relations may result in different states of a context, DPAS maintains multiple context spaces for an ambiguous text. Since maintaining all interpretations until the whole text is processed requires too much computing resources, DPAS uses the idea of depth-limited search to limit the search space. If there is more than one discourse relation between an input clause and a context, DPAS constructs context spaces one context space for each discourse relation. Then, DPAS applies heuristics to choose the most desirable context space after it processes some more input clauses. Since the basic idea of DPAS is domain independent, although we used descriptive texts to demonstrate DPAS, we believe the idea of DPAS can be extended to understand other styles of texts.

Study on Open Access Transformative Agreement (오픈액세스 전환계약서 분석 연구)

  • Since the introduction of the OA transformative agreement as a new way of licensing electronic resources, the number of OA transformative agreements has continued to grow. Despite the wide range of content that should be included in the agreement due to the nature of the OA transformative agreement, there is a lack of research on OA transformative agreements. As a basis for developing a standard for OA transformative agreements, this study examines the current status of OA transformative agreements and analyzes the differences between two types of OA transformative agreements and the subscription contract. It was found that the number of OA transformative agreements has increased significantly worldwide, but the disclosure of OA transformative agreements has not been universalized. The overall structure of two different types of OA transformative agreements and a subscription contract is similar, but there are differences in the detailed clauses. In the OA transformative agreement, the detailed clauses related to the characteristic of the transformative agreement were newly created, or the details of the transformative agreement were added to the existing clauses of the subscription agreement. There were also some differences between the two types of agreements, identifying clauses that differed in content regardless of the OA transformative agreement. The study concluded that it is important to standardize the OA transformative agreement, as the number of different clauses between agreement types may increase the burden on librarians. This study is significant in that it provides a basis for the development of standardized agreements by examining the overall status of OA transformative agreements and analyzing actual agreements.

Deriving Key Risk Sub-Clauses which the Engineer of FIDIC Red Book Shall Agree or Determine according to Sub-Clause 3.7 -based on FIDIC Conditions of Contract for Construction, Second Edition 2017- (FIDIC Red Book의 Engineer가 합의 또는 결정해야할 핵심 리스크 세부조항 도출 -FIDIC Red Book 2017년 개정판 기준으로-)

  • The FIDIC Red Book is an international standard contract condition in which the Employer designs and the Contractor performs the construction. The Engineer of FIDIC Red Book shall agree or determine any matter or Claim in accordance with Sub-Clause 3.7 neutrally, not as an agent of the Employer. This study aimed to derive Key Risk Sub-Clauses out of 49 Sub-Clauses that the Engineer of FIDIC Red Book recently revised in 18 years shall agree or determine according to Sub-Clause 3.7 using the Delphi method. A panel of 35 experts with more than 10 years of experience and expertise in international construction contracts was formed, and through total three Delphi surveys, errors and biases were prevented in the judgment process to improve reliability. As for the research method, 49 Sub-Clauses that engineers shall agree on or determine according to Sub-Clause 3.7 of the FIDIC Red Book were investigated through the analysis of contract conditions. In order to evaluate the probability and impact of contractual risk for each 49 Sub-Clause, the Delphi survey conducted repeatedly a closed-type survey three times on a Likert 10-point scale. The results of the first Delphi survey were delivered during the second survey, and the results of the second survey were delivered to the third survey, which was re-evaluated in the direction of increasing the consensus of experts' opinions. The reliability of the Delphi 3rd survey results was verified with the COV value of the coefficient of variation. The PI Risk Matrix was applied to the average value of risk probability and impact of each of the 49 Sub-Clauses and finally, 9 Key Risk Sub-Clauses that fell within the extreme risk range were derived.
