영상저작물이 우리에게 익숙해진 만큼 영상저작물의 침해도 증가하고 있다. 영상저작물은 인터넷을 통해 늘 가까이에서 접할 수 있기 때문에 이러한 현상은 영상물의 장르나 국경을 손쉽게 넘나들며 발생한다. 우리나라의 뮤직비디오 "유혹의 소나타"가 일본 애니메이션 "파이널 판타지7"의 저작권을 침해한 사건이 대표적인 경우이다. 두 작품을 비교.분석해 보면 상당 부분에서 유사점이 발견되고, 심지어 뮤직비디오 "유혹의 소나타"에서 가수가 노래하는 부분을 제외하고는 새로운 장면이 없다고 표현할 수 있을 정도이다. 이런 상황은 개인에게도 불명예일 뿐만 아니라 국가적으로도 큰 손실일 수밖에 없으므로, 무의식적으로라도 타인의 저작권을 침해하지 않도록 철저한 대비를 하여야 한다.

저작권법이 규정하는 '공연'은 상식적으로 생각하는 공연의 개념보다 훨씬 그 폭이 넓다. 저작물을 가창, 연주, 연술하는 실연 행위뿐만 아니라 음반이나 영상물을 공중이 열람할 수 있도록 상영하는 행위까지도 모두 저작권법이 규정하는 '공연'에 해당이 된다. 저작권법 제29조는 공연권의 제한 사유에 관한 것이다. 제1항은 영리를 목적으로 하지 아니하는 공연과 방송에 대한 저작권 제한 사유를 규정하고 있으며, 제2항은 판매용 음반과 판매용 영상저작물을 활용한 공연에 관한 면책 요건을 규율한다. 최근 도서관의 저작물 공연이 저작권법의 주요 이슈 가운데 하나가 되고 있다. 그 가운데에는 도서관 관내에서의 영상물 열람도 공연에 해당되고, 발행 후 6개월이 경과되지 않은 저작물을 서비스할 때에는 저작권자의 사전 허락을 받아야 한다는 주장도 포함되어 있다. 이러한 주장은 정상적인 도서관 서비스를 불가능하게 만드는 것이어서 부당하며, 도서관에서의 저작물 열람과 공연을 구분할 수 있는 입법적인 조치가 시급히 이루어질 필요가 있다.

A video-work story analysis system based on emotional state measurement includes a content provision unit which provides story content of a video-work, a display unit which displays content provided by the content provision unit, an emotional state measurement unit which measures a tense-relaxed emotional state of a viewer viewing the displayed story content, a story pattern analysis unit which analyzes the tense-relaxed emotional state measured from the emotional state measurement unit according to a scene in the story content provided by the content provision unit, and a story pattern display unit which prints out an analysis result or displays the analysis result as an image. The emotional state measurement unit measures a tense or relaxed emotional state through one or more analyses among a brainwave analysis, a vital sign analysis, or an ocular state analysis. A writer may obtain support in an additional scenario modification work, and an investor may obtain support in making a decision through the above description. Furthermore, the video-work story analysis system and analysis method based on emotional state measurement may extract a particular pattern with respect to a change in an emotional state of a viewer, compile statistics, and analyze a correlation between a story and an emotional state.

이 연구는 저작인격권 중에서 분쟁이 가장 많은 동일성유지권의 침해에 대해 판례를 분석하여 법원의 침해기준과 침해의 원인을 규명하고 영상저작물 제작 현장에서 법원의 판례 경향에 대해 어떤 시각차가 있는지 비교하고자 한다. 저작권은 저작재산권과 저작인격권으로 구분한다. 여기서 다루고자 하는 동일성유지권은 저작인격권의 일부로 하나의 콘텐츠를 제작하여 다양한 매체에 이용한다. 콘텐츠의 이용 과정에서 편성, 광고시간 등에 맞추기 위해 편집이 필요할 경우 권리자에게 사전에 협의를 하거나 서면 동의를 받아야 하는데 시간이 촉박하거나 저작권에 대한 무지로 인해 임의적으로 편집하여 사용하다 동일성유지권을 침해하게 된다. 영상저작물이 제작, 이용되는 과정에서 저작물, 제작비, 출연자 등의 변수가 많아 저작권의 권리 확보나 이용을 위해 사전 동의가 필요하다. 그러나 제작을 우선시 하는 제작과정과 권리보호에 대한 인식이 낮아 동일성유지권 침해는 법조항의 미비보다 이용자들이 업무 관행을 따르거나 개인적 과실에 의한 분쟁으로 분쟁예방을 위해서는 세부적인 업무매뉴얼 제공과 저작권 전문가의 체계적인 교육이 필요하다.

The purpose of this paper is to examine the possibility of application of some French and German movies to teaching of multi-culture in elementary, middle and high schools. Three different films are selected. (2005), a French animation film directed by B?n?dicte Galup and Michel Ocelot, is appropriate for the education of understanding cultural relativity and improving multi-cultural sensitivity in elementary school. is a French short film directed by Walter Salles and Daniela Thomaso and included in omnibus style film (2006). This short film relating a story of an immigrated woman who leaves her baby in a cr?che and travels through Paris to work for a bourgeois mother can be used for developing a bond of sympathy between natives and immigrants. It is recommended for the class of junior high school. Finally (2007), a German film directed by Fatih Akin, provide a learning model for the education of multi-culture in high school classrooms. The cinematographic aesthetic of this film is focused on a process of reconciliation with others over the cultural, racial, national and generational differences. Analyzing the structure of the film and being guided by teachers the students can understand better in improving abilities to understand others.
