A Study on the Characteristics of Chinese Arbitration System and Its Historical and Cultural Background (중국 중재제도의 특징과 그 역사.문화적 배경에 관한 연구)

  • This thesis, which mainly focuses on the characteristics of the Chinese arbitration system, will mainly deal with three characteristics and analyze the causes that directly or indirectly influence them. The first characteristic is China does not recognize ad hoc arbitration. Ad hoc arbitration is the initial form of arbitration, and it occupies an important position in many countries; however, China's judicial system does not recognize it. There are many disadvantages for building a system of ad hoc arbitration in China; i. e., the arbitration system in China is undeveloped and shot-time established, and it lacks social and civil society basis, along with a credit system, which the Western ad hoc arbitration relies on. The second characteristic is the existence of excessive judicial supervision and control over arbitration in China. Judicial supervision over arbitration has been the customary practice in each country of the modern world, but sharp variation exists in the legal stipulations and the courts' attitude toward the standard to be applied in the supervision over arbitration. In China, there has always been a controversy over judicial supervision, and the standards applied in the supervision over arbitration by courts in different regions are less than identical. The last characteristic is the existence of a combination of mediation with arbitration, which is called Arb-Med in China. Such means that in the process of arbitration, the arbitrator may conduct mediation proceedings for the case it is handling if both parties agree to do so. Under the Chinese law, Arb-Med may lead to a binding and enforceable outcome. However, it has several legal disadvantages and almost no country adopts this system. China still insists that this system will go on because Arb-Med was first made in China, and its effect was proven through long-time practice in CIETAC.

  • The nature of supervision is to improve the quality of school education by assisting the teaching activities of teachers and development of a learning community. The school library should be considered a classroom, and should offer library-assisted instruction and information literacy through collaboration between the teacher librarian and subject teachers. Therefore, it should be under the systematic and settled supervision of school library experts. However, analysis shows school library-related divisions have carried out administrative supports in the 16 city and provincial education offices. It is necessary to seek a new supervision system in order to develop and support the education of teacher librarians and the educational value of school libraries. This study suggests The Reading and Library Section which integrates reading in school and public libraries as an independent division in municipal and provincial offices of education.

  • The construction industry in Korea has seen significant improvements in quality management techniques, driven by the dramatic development of new technology through Manhattanization and enlargements, but compared with technical development, the level of building quality improvement is still lagging behind. In the meantime, as the interest in construction quality soars due to changes in user consciousness, the level of quality that is being demanded is rising. The government has reinforced quality systems by implementing responsible supervision requirements and granting overseas companies permission to enter the supervision business in Korea, and private sector companies also are attempting quality improvement through quality assurance approaches like the preliminary qualification screening system and ISO 9000 series. But currently, building constructions are done only according to the construction specifications of project owners, whose design, materials and construction methods are already decided, and do not leave any necessity or opportunity for technical developments for the quality improvement of contractors. Therefore, in this study, a work process and system improvement plan for payment regulations is proposed, with which contractors can secure quality voluntarily in the building construction phase.

  • The government seismic retrofit project for educational facilities is progressing more actively due to the 2018 Pohang earthquake. It is most important that seismic retrofit constructions are conformed to seismic design to achieve the desired purpose of the project as reduce direct damage caused by earthquake. However, the construction supervision system is not mandatory for the retrofit construction site of small buildings including school buildings according to applicable laws and regulations. The purpose of this study was to develop a guide for constructions management of school building seismic retrofit. In order to achieve this goal, the survey on the construction site was conducted and various problems related to the construction site of school building seismic retrofit was derived Additionally, the systematic checklist was presented according to the user and seismic reinforcement method.

Crafting a Quality Performance Evaluation Model Leveraging Unstructured Data (비정형데이터를 활용한 건축현장 품질성과 평가 모델 개발)

  • The frequent occurrence of structural failures at building construction sites in Korea has underscored the critical role of rigorous oversight in the inspection and management of construction projects. As mandated by prevailing regulations and standards, onsite supervision by designated supervisors encompasses thorough documentation of construction quality, material standards, and the history of any reconstructions, among other factors. These reports, predominantly consisting of unstructured data, constitute approximately 80% of the data amassed at construction sites and serve as a comprehensive repository of quality-related information. This research introduces the SL-QPA model, which employs text mining techniques to preprocess supervision reports and establish a sentiment dictionary, thereby enabling the quantification of quality performance. The study's findings, demonstrating a statistically significant Pearson correlation between the quality performance scores derived from the SL-QPA model and various legally defined indicators, were substantiated through a one-way analysis of variance of the correlation coefficients. The SL-QPA model, as developed in this study, offers a supplementary approach to evaluating the quality performance of building construction projects. It holds the promise of enhancing quality inspection and management practices by harnessing the wealth of unstructured data generated throughout the lifecycle of construction projects.

  • As data management and analysis technology advances, there is active discussion on how to utilize data generated in construction projects. Among them, the materials produced during the supervision work are highly useful because their generation cycle and format are regulated according to relevant laws. In this study, we analyzed whether the data produced during the supervision work in the construction phase of apartment housing can be utilized for project performance management. First, this study identified key data necessary for performance management through FGI with experts in the field of apartment housing. Next, we collected supervisory data from the case project and identified whether the data was generated, its cycle, and storage format. As a result of the analysis, the supervisory data contained various information that could measure the performance of construction projects and had the advantage of standardized data. In the future, utilizing supervisory data is expected to enable effective performance management of apartment housing construction projects.

Process Improvements for Reducing Apartment Defects after Completion (준공후 아파트 하자 저감을 위한 절차개선 방안 연구)

  • Many defects are occurring in apartments, the main residential area in Korea. This is due to a lack of construction skills and a lack of management. As many apartments are provided to buyers, the dispute over defects after completion is increasing rapidly. The Housing Act was amended so that local governments could order contractors to repair defects. However, even if defects are resolved after a defect is generated, it is not a fundamental solution that can be satisfied because buyers have to endure the pain caused by the defect. So, it is necessary to protect the interests of buyers by fundamentally reducing defects in apartments. Therefore, in this study, it was suggested that the asymmetry of the information about the apartment buyers should be resolved at the time of sale of the apartment, the final drawings should be a contract document, the review period of the apartment house supervision should be secured, the appropriate supervisory fee should be secured at the time of contract change and the payment procedure should be improved.

  • Since many accidents have occurred in Korea in these days, many people have lost their health and have been damaged. The damages caused by fires which occur to many buildings where many people always reside takes a substantial share of the total damages. And since the proportions of the domestic fire protection designing/supervising industries are relatively much disregarded compared to other kinds of work, it is in the situation that there are many cases of serious damages because the fire protection equipment didn't exert the proper functions on fire after a building is constructed since the supervision against the poor construction along with the inadequate design. In order to improve such situations, in case of the design industry, the criteria on registration and workforce placement, the scope of operation, the design documents required when requesting the agreement to the construction permits, the responsibilities and authorities about the jobs of the fire protection facility designers must be improved and, in case of supervising industry, the registration criteria, the operation scope and the kinds, methods, targets and criteria of supervision, the criteria on the additional placement of assistant supervisors, the contents and scope of work must be improved, the PQ system and Public Supervision System must be reviewed and the systems for preventing any poor supervision must be improved in order to pursue the security of the people and their properties at the same level as the other kinds of work by preparing for the firm position and foundation of the fire protection design and supervision.

  • According to the analysis report of construction fall accident, situation not installed safety facilities caused the largest of disaster in temporary structure. Therefore, actionable measures will be needed identifying the installation of safety facilities immediately. In this study proposed plan by the safety facilities to effectively visualize, supervision can be easily for reduce fall accident. This system can be used BIM and augmented reality technology by combining in the field in real-time. Through this study, safety facilities management is improved and expected to prevent a accident.

  • Construction industry has been participated in the effort for the reduction of environmental pollution such as introduction of green building certification, enactment of environment related regulation. However these efforts are focused on the design and maintenance phases of entire life cycle, construction phase that can occur intensive environmental impact in a short period is insufficient. Therefore this study aim to derive environmental management factors in construction phase and assess them using reliability analysis and factor analysis. As a results, the 20 factors was classified into 4 superordinate such as 'plan and supervision', 'environmental factor management', 'licensing management', 'surrounding environment management'.Based on result of this study, further study should be developed the checklist for effective environmental management in construction phase.
