오늘날 일반적으로 국제상거래에서는 매수인과 매도인이 표준화된 서식을 이용하여 서로 거래한다. 서식분쟁은 이러한 서식의 교환의 결과이다. 서식분쟁에서 해결되어야 하는 몇 가지 문제들이 있다. 예를 들어, 상이한 조건의 교환으로 계약이 성립하는가? 계약조건은 무엇인가? 어느 당사자의 조건을 적용할 것인가? 누구의 것인가? 등이다. 2015년, 헤이그 국제사법회의는 헤이그준거법원칙을 최종적으로 승인하였다. 해당 원칙은 서식분쟁을 다루고 있다. 또한 2013년, CISG 자문위원회는 CISG에 의거한 표준조건의 편입과 관련한 문제를 해결하기 위한 효과적인 방법을 제기하기 위하여 "Black letter rules"를 채택하였다. 본 연구는 헤이그준거법원칙과 CISG에서 서식분쟁을 관련 규정과 사례를 종합적으로 검토하였다. 본 연구의 목적은 양당사자의 서식분쟁 문제를 해결하기 위한 적절한 실무적 해결방안을 제안하는 데 있다.

International sales contract, in general, is concluded through the exchange of written forms which contain each of their own business terms and conditions among the contractual parties. To illustrate, A sends the other an offer on A's general terms and conditions of business and B accepts the offer subject to the use of B's own general terms and conditions. Where the two sets of terms and conditions do not coincide, the question may arise whether the parties(A and B) have contracted and, if so, whose general terms and conditions apply. This situation is referred to as "the battle of forms". This article would try to make, in terms of the battle of forms, a comparison between the classical perspectives and opinions which are based on the principle of the English Common Law and the modernistic perspectives and opinions which are applied to the provisions in the UCC, CISG, and PICC. Therefore, the aim of this article is to provide the increase self-consciousness with respect to the battle of forms between the contractual parties that may frequently happen in the international business transactions and will pave the way for further research in the future.

전투기가 임무수행중 기체에 발생할 수 있는 전투손상에 대처하기 위해 손상평가 및 수리설계, 구조건전성 평가방법 등 손상 후속절차를 연구하였다. 사례로서 F-15 ECS Bay에 발생한 전투손상에 대하여 ABDR(Aircraft Battle Damage Repair) 기술을 적용하여 손상평가 및 수리설계를 수행하고, 그 내용과 절차를 양식에 정리하였다. 또한, 정적강도 및 피로수명 계산과 같이 수리설계 구조의 구조건전성을 평가하여 비행안전 여부를 입증하고 영구수리 시점을 판단하였다.

본 연구는 조선후기 병서 중 "이진총방"의 진도(陣圖)를 바탕으로 고전 진법의 기본모형(陣形)을 재구성하여 진법의 구성원리와 운영체계를 분석하였다. 연구방법은 고전진법의 기본인 방진(方陣)을 토대로 원진(圓陣), 직진(直陣), 곡진(曲陣), 예진(銳陣) 등의 오방진(五方陣)과 현무진(玄武陣), 팔진(八陣), 육화진(六花陣), 구군진도(九軍陣圖) 등 진법의 운영체계를 재구성하여 비교분석 하였다. 분석결과, 모든 진법의 운용은 기본적으로 방진에서 출발하되 정사각, 직사각, 오각형 그리고 원형의 형태로 변형되고 있음을 확인하였다. 또한 진법 내부의 진용 구성은 5가지 선형을 활용하는 바 직사각, 정사각, 대각선, 곡선, 원형 등 5가지 동선체계로 이루어져 있음을 확인하였다. 연구대상인 원진도는 기본방진에서 2중 원의 선형으로 동선체계를 갖추고, 예진도는 기본방진의 편성대열에서 여타 진법보다 최소의 동선거리로 공격적 선형을 갖춘다. 곡진도는 방패형 2중진 형태로 이동동선을 유지하고, 현무진도는 거북모양의 진형으로 좌우 균형의 5각형 동선을 형성한다. 육화진은 원이 지니는 회전력을 무기로 삼는 진법으로 좌우 및 상하 대칭으로 원주율이 같은 여섯 개의 원형동선을 형성하여 꽃잎모양의 선형(線形)을 갖춘 형태이다. 구군진도는 육화진도에서의 원형 대신 9개 정사각형 선형(線形)을 갖추는 방식이다. 팔진도는 정사각, 직사각, 십자형의 3가지 선형으로 14개 진형을 형성하며 면과 선, 외곽선과 대각선의 중층적 3중 방어체계를 갖춘 동선체계이다. 연구 성과는 군사적인 면에서 진법의 실체를 규명함으로써 조선시대 전투양상의 실체를 파악하게 해주면서, 현대전에서 병사들의 훈련에 활용가능한 병법의 유형을 제시한 점에서 군사적, 학술적 가치를 지닌다.

In the (3,3) close combat model based on the Lanchester Square Law, this study proposes a plan to optimally allocate residual combat power after the battle to other battlefields. As soon as the two camps of three units can grasp each other's information and predict the battle pattern immediately after the battle began, the Time Zero Allocation of Force (TZAF) scenario was used to initially allocate combat power to readjust the combat model. It reflects travel time, which is a "field friction" in which physical distance exists from battlefields that support combat power to battlefields that are supported. By developing existing studies that try to examine the effect of travel time on the battlefield through the combat model, this study forms a (3,3) combat model, which is a large number of minimum units. In order to achieve the combat purpose, the principle of optimal combat force operation is presented by examining the aspect that support combat power is allocated to the two battlefields and the consequent battle results. Through this, various scenarios were set in consideration of the travel time and the situation of the units, and differentiated results were obtained. Although the most traditional, it can be used as the basic logic of the training or the commander's decision-making system using the actual war game model.

최근 전 세계적으로 모바일장치의 확산과 초고속 인터넷의 확장에 따라 모바일게임시장이 더욱 활성화되고 있다. 모바일게임은 기술의 발전과 함께, 이젠 사회적으로 분명한 대중문화로서 자리 잡고 있다. 그러나 기존의 모바일 게임들은 오프라인 형태로 사용자가 한 번 다운 받아 즐기는 게임이거나 온라인 네트워크 모바일 게임의 형태이라 할지라도 배틀 형태의 대전 게임으로만 이루어져 있는 종류의 게임이 대부분이다. 본 논문은 온라인 배틀 게임의 형태와 캐릭터를 육성 시키는 게임의 형태를 혼합하여 두 가지 방법으로 하나의 게임을 즐길 수 있는 한 줄다리기 게임을 제안한다. 따라서 단순한 온라인 배틀 게임이 아닌, 오프라인의 연습과정을 트레이닝 모드라고 정의하여 기존의 모바일 게임들과 차별되는 혁신적인 모바일 게임 모델이라 말할 수 있다. 그러므로 본 논문에서 제안하는 Rope Survival게임은 네트워크 대전게임과 캐릭터의 육성 게임을 동시에 즐기는 게임이라는 측면에서 모바일게임의 연구분야에 새로운 방향을 제시한다.

To the extent that CISG and UNIDROIT Principles address the same issues, the rules laid down in the latter are normally taken either literally or at least in substance from the corresponding provisions of the former. Nevertheless, we may find cases where the latter depart from the former. The purpose of this paper is comparison of the two instruments, especially in part of contract formation. The result of this paper shows the fact that in the chapter of UNIDROIT Principles on formation provisions are included on the manner in which requirements that an offer and an acceptance must meet are more comprehensive, and in result a contract may be concluded more easily.

본 연구는 국제무역거래에 있어 빈번하게 사용되는 약관의 계약편입과 관련하여 CISG 자문위원회의 공식 의견인 Black Letter Rule을 중심으로 고찰한다. 그 주요 내용으로 약관의 계약편입 관련 적용규정과 요건을 상세히 고찰하고, 약관의 계약편입을 의도한 청약상 참조표시 및 약관내용의 명확성 요건을 살펴보도록 한다. 이와 더불어 약관의 계약편입 관련 기타 원칙으로서 계약체결 후 약관편입의 배제, 의외조항배제, 개별약정우선, 작성자 불이익 원칙 및 서식분쟁에 대하여 살펴본다. 이와 더불어 본 연구는 약관의 계약편입 관련 기존 판례 및 학설을 검토한 후 이를 CISG 자문위원회의 공식의견과 상호 비교 검토함으로 약관의 계약편입 관련 원칙을 재정립하고 이에 따른 실무적 시사점을 도출하고자 한다.
