2019년 일본상사중재협회(JCAA) 중재제도의 개혁동향 (2019 Reform of Japan Commercial Arbitration Association (JCAA) Arbitration Rules)

  • This paper reviews 2019 new arbitration rules of Japan Commercial Arbitration Association (JCAA). JCAA has amended its Commercial Arbitration Rules, and its Administrative Rules for UNCITRAL Arbitration. Also, it has introduced a new Interactive Arbitrations Rules. These new rules take effect from 1 January 2019. First, principal amendments of JCAA Commercial Arbitration Rules are such as arbitrator impartiality, tribunal secretaries, no dissenting opinions, expedited proceedings, arbitrator fees, administrative fees. Second, JCAA's new Interactive Arbitration Rules compel communication from the arbitral tribunal to the Parties and introduce a system of fixed compensation for arbitrators. Third, JCAA's Administrative Rules for UNCITRAL Arbitration are designed to provide the minimum essentials to allow the UNCITRAL Rules to be overseen by an institution. The only significant updates focus on arbitrator remuneration. This paper presents the intent and some implications of JACC's 2019 new rules for Korean Commercial Arbitration Board (KCAB) arbitration rules. Also, it seeks to provide a meaningful discussion and improvement on the facilitating of arbitration system in Korea.

행정정보 데이터세트의 기록관리 방안 (Managing Data Set in Administrative Information Systems as Records)

  • 기록관리 전문가와 학자들은 행정정보 데이터세트 기록의 관리 필요성과 그 시급성을 역설하여 왔으나 실제 현장에서 데이터세트의 관리는 시행하지 못 하고 있는 실정이다. 데이터세트는 기술 종속적인 특성과 방대한 규모는 물론 시스템별 다양한 운영 환경으로 인해 현행 종이기록 중심의 표준 기록관리 지침과 절차를 적용하기 어렵다. 무엇보다 데이터세트 자체의 고유한 특성을 수용하는 관리체계가 필요하며, 그 관리 방안은 업무 현장에서 적용할 수 있어야 한다. 이 연구는 공공기관에서 실제 운영 중인 행정정보시스템의 데이터세트의 현황을 조사한 분석 결과에 기반하여 데이터세트 관리 방안과 절차를 개발하여 제시하였다.

The Governance of Mineral and Coal in Indonesia: The Theory U Approach

  • The purpose of this study is to map mineral and coal (Minerba) policies by analyzing the law and producing research novelty on mineral and coal governance policies in Indonesia with the Theory U approach. This study uses a qualitative research with the U theory approach. The results of the SNA analysis indicate that good mineral and coal governance must be carried out at various levels, from micro to macro. First, related to regulations on mineral and coal governance at the macro level. Regulations regarding the management of mineral and coal need to be carried out with a deeper evaluation related to the tax system, licensing system, increased value added and downstreaming and mineral and coal funds. The second is related to the regulation of mining management in the meso level. Third, related to the management of mineral and coal at the micro level, it is necessary to conduct more stringent supervision of the impacts caused by the mining sector of the Minerba. In addition, surveillance is also carried out as per law in order to avoid harmful behavior for both the company and the state. The originality of this research is the theory of U in the Mining Law research.

행정정보 공동 활용의 현황과 성과에 관한 연구 (An Analysis of Public Agencies' Sharing Administrative Information: Current Status and Future Prospects)

  • The development of IT has contributed a lot to enhancing administrative efficiency. In particular, it enabled administrative agencies to be able to upgrade the effects and efficiency of public services by saving unnecessary time, labor, and equipment that might surely occur in delivering routine services in repetition. As the concept of governance and knowledge-based administration assumes a pivotal value in the 21 century administrative innovation, sharing information among agencies is a key to building effective governance system. However, current extent of sharing information in public agencies is below the level of expectation and thus the need exists for the steps to making information shared more widely and effectively among public agencies. This paper gives a snap shot on the extant status of information sharing among public agencies and seeks ways to facilitate it from the perspective of electrical government.

기업 보안 유형에 따른 보안사고 대응역량 : 사회기술시스템 이론 관점에서 (Incident Response Competence by The Security Types of Firms:Socio-Technical System Perspective)

  • This study proceeded to examine the cause of the continuous secret information leakage in the firms. The purpose of this study is to find out what type of security among administrative, technological and physical security would have important influence on firm's security performance such as the security-incident response competence. We established the model that can empirically verify correlation between those three types of security and the security-incident response competence. In addition, We conducted another study to look at relation between developing department of security in the firms and reaction ability at the accidents. According to the study, the administrative security is more important about dealing with the security-incident response competence than the rest. Furthermore, a group with department of security has better the security-incident response competence and shows higher competence in fixing or rebuilding the damage. Therefore, this study demonstrates that investing in administrative security will be effective for the firm security.

  • The fishermen around fishing villages have organized the Eo Chon Gae, a co-operative organization based on the Fisheries Co-operative Law. The Eo chon Gae plays a vital role in the fishing village community, and the common economic, administrative and social profits are expected by members. The members of the Eo Chon Gae must work together in a common coastal fishing ground, this fishing ground is jointly owned by the community, and the members have to conduct the Eo chon Gae jointly for their common profit. This system, as mentioned above, is called the Eo Chon Gae, which is generally called a fishing village community, or a fishing administrative community. The purpose of these theses is to consider what kind of character and principles the Eo Chon Gae has. The contents of these theses are divided into six parts: 1. The various concepts of the fishing administrative community 2. The progress of the Eo Chon Gae. 3. The organization of the Eo chon Gae. 4. The purpose of the Eo chon Gae. 5. The work of the Eo Chon Gae. 6. Types of the Eo Chon Gae.

일제강점기 수원의 도시공간구조에 관한 연구 (A Study on Spatial Structures of Suwon in the Japanese Colonial Period)

  • After opening Suwon railway station in 1905, a new road was constructed between Suwon station and Paldalmun(the South gate). It was the starting point to change urban structures of Suwon and shape the new city scape. In 1914, administrative districts of Suwon were reorganized. Suwon-myeon (township, a subdivision of Suwon-gun) was promoted to Suwon-eup(town) in 1931. Suwon-eup expanded its territory and changed the address system from 'li(里)' system to Japanese address system, 'Jeong(町)' in 1936. From 1920s, road system was changed and transformed Suwon's urban structures. A straight road was built from Jongro intersection to Janganmun(the north gate) in 1928. Another straight road was constructed between Suwon station to Padamun in the early 1930s. Public office buildings used the Hwa Seong HaengGung(華城行宮) and some of building moved to new location with new buildings. Main buildings of most schools in Suwon were reconstructed since 1930s. Commercial buildings and stores were sprung up and had their own characteristics by region. Around Suwon station, there are more hotels and restaurants than other areas. Rearranging administrative areas, developing road system and new buildings transformed Suwon's spatial structures. Constructing new roads formed a straight road passing through Suwon. After reorganizing administrative areas, this road turned to be the central axis of Suwon. Buildings in new style on the axis made the modern cityscape in Suwon.

공공데이터의 의미적 연계를 위한 행정구역 지식 그래프 구축 (Building Knowledge Graph of the Korea Administrative District for Interlinking Public Open Data)

  • 오픈 데이터는 전세계적으로 많은 관심을 받고 있다. 우리나라 정부는 데이터 개방에 많은 노력을 기울이고 있다. 그러나, 공공 데이터의 양적 증가에도 불구하고 데이터에 대한 부족함이 여전히 지적되고 있다. 본 논문은 공공 데이터를 의미적으로 연결해 데이터 공유 및 활용을 향상시키기 위한 방법을 제안한다. 첫째, 대한민국 행정구역의 정의와 행정구역 사이의 관계를 의미적으로 표현하기 위한 지식 모델을 제안한다. 행정구역은 국가의 영역을 국가 행정상의 목적에 따라 구분한 단위이다. 행정구역 지식모델은 지방자치법을 기준으로 행정구역체계의 구조, 행정단위별 관계를 정의한다. 둘째, 대한민국 행정구역 데이터에 대한 지식그래프를 소개한다. 공공 데이터를 의미적 수준에서 연결시키는 기준정보로써 행정구역 지식그래프의 특징과 이기종 공공데이터 연계 및 데이터 품질 개선을 위한 방법을 소개한다. 마지막으로 행정기관 데이터의 연계 결과를 통해 행정구역 지식그래프의 응용 방법을 살펴본다. 행정기관 명칭은 기관별로 상이하게 활용하고 있기 때문에 행정구역 그래프를 통한 데이터 식별 및 정제와 더불어 데이터 품질 개선에 효과적인 접근 방안으로 고려할 수 있다.

  • Administrative procedures are the heart of the activity in each Town Council. Citizens do transactions every day and, sometimes, they do not understand what they must do or the steps to follow. We are developing a Web-based system to help citizens with this task in an easy way. The application is integrated a four year project called Albacete[Digital] that began in 2002 with the purpose of building an e-government system in Albacete, a city with over 150.000 citizens. This Administrative Information Centre is the result of the Administration study in the first year of the project and it will continue with the on-line transaction in the following years.

  • In Korea, condominium apartment was supplied 50 years ago. However, the problems related to contract and selling in lots still happens. Most of these problems is due to be made a contract and selling in lots before completion of condominium. For solving these problems, it is necessary for throughgoing selling in lots and administrative guidance in time for development. Because of the problem after the selling in lots become involved not only selling in lots of developer and the contract with purchaser, but also condominium management and repair of defect processing system. As a result of consideration to development control and administrative guidance in Hawaii State, it may be had some effects like an appropriate management system, consumer protection and consumer education.
