Liability for Damage due to Doctors' Unfaithful Medical Practice (의사의 불성실한 진료행위로 인한 손해배상책임)

  • In order to account for whether a doctor should indemnify damages resulted from violation of duty of care, the fact that a doctor violated duty of care, that damages were incurred, and the link between violation of duty of care and damages incurred, respectively, should be verified. So even though a doctor violated duty of care to patients, he or she will not bear the responsibility to indemnify damages unless it is not verified. If a doctor's negligence in medical practices is assessed that obviously unfaithful medical practice far exceeds the limit of admission of a patient, it will not go against people's general perception of justice or law and order to constitute a medical malpractice itself as an illegal action that will require liabiliy for damage. However, when the limit of admission is set too low, a patient's benefit and expectation of proper medical treatment can be violated. In contrast, if the limit of admission is set high, it can leave too little room for doctors' discretion for treatments due to a bigger risk of indemnification for damages. Thus, a reasonable balance that can satisfy both benefit and expectation of patients and doctors' right to treatment is needed.

A Study on the Work-related Low Back Pain of Workers at a Refractories Manufacturing Factory (모 연와제조 공장 근로자의 작업과 관련된 요통 및 대책에 관한 연구)

  • Work-related low back pain(below LBP) is one of the major cause of morbidity, disability, limitation of activity and economic loss. Therefore the work-related LBP is one of the major issue in the field of industrial safety and health. This study was performed for detecting the risk factors and proposing the effective control programs of work-related LBP. The subjects were male workers employed at the welding and metal factory. The data was collected by self-reported questionnaire, interview and checking abdomen muscular and grasping power for two days on October, 1993. The contents of questionnaire were as follow: the experience of LBP, general characteristics, physical characteristics, employment status, type of work and working environment. The number of cases was 104 with a history of work-related LBP, so the prevalence of work-related LBP was 35.0%, and the number of controls was 140 without any history of LBP. As a result, marital status, educational level, abdomen muscular power, tenure, category of job, satisfaction of job, working posture, satisfaction for table and chair and lifting materials showed a statistical significance between the case and control groups. 284 Lifting jobs were quantified by NIOSH lifting equation method and ergonomic computer modelling methods. There were no significant differences in the action limit and disc compression force between group with LBP and without LBP. But in the lifting frequency and cumulative disc compression force there were significant differences. Therefore work-related LBP should be prevented by the ergonomic and environmental control.

Composite Action in Masonry Columns Due to Damage and Creep Interaction (손상과 크리프의 상호작용에 의한 조적조 기둥의 복합거동)

  • Since the collapse of historical masonry structures in Europe in the late 1990's, the interests in understanding the long-term effect of masonry under sustained compressive stresses have increased. That requires combining the significance of time-dependent effects of creep with the effect of damage due to overstress to realize the evolution of cracks and then failure in masonry. Meanwhile, composite analysis of masonry columns was proven effective for realizing ultimate strength capacity of masonry column. In this study, a simplified mechanical model with step-by-step in time analysis was proposed to incorporate the interaction of damage and creep to estimate the maximum stress occurred in masonry. It was examined that the interaction of creep and damage in masonry can accelerate the failure of masonry.

'Health Preservation' Resistance Against Senile Involution ('양생' 중재보진기)

  • Senile involution is divided into two classes : physiological senile involution and pathological senile involution. Physiological senile involution is a natural process of vital action of decreasing Vital Essence and Energy in kidney that is a necessary physiological phenomenon. Pathological senile involution is an evidence of impairment of True Qi of internal human body. Human vital action is a changing process of life, senility, sickness, and death. In other words, this is a natural process of being full and decreasing of Vital Essence and Energy in kidney, and True Qi of human body decides this process. The Vital Essence and Energy in kidney vary, and they are influenced and restricted by various elements. The time of a senile involution varies individually. Human body protects and makes efforts not to leak out True Qi in effective ways. We can postpone a limit of time of physiological senile involution phenomenon. This is called 'Health Preservation' - resistance against senile involution.

Equivalent moment of inertia of a truss bridge with steel-concrete composite deck

  • Flexural stiffness of bridge spans has become even more important parameter since Eurocode 1 introduced for railway bridges the serviceability limit state of resonance. For simply supported bridge spans it relies, in general, on accurate assessment of span moment of inertia that governs span flexural stiffness. The paper presents three methods of estimation of the equivalent moment of inertia for such spans: experimental, analytical and numerical. Test loading of the twin truss bridge spans and test results are presented. Recorded displacements and the method of least squares are used to find an "experimental" moment of inertia. Then it is computed according to the analytical method that accounts for joint action of truss girders and composite deck as well as limited span shear stiffness provided by diagonal bracing. Finally a 3D model of finite element method is created to assess the moment of inertia. Discussion of results is given. The comparative analysis proves efficiency of the analytical method.

  • In this study a control system with variable gain schedule using real speed and moving direction is proposed to control a Permanent Magnet Linear Synchronous Motor (PMLSM) with Z-axis operation structure. The implementation of the controller is designed on the DSP TMS320C32 board. PMLSM is operated by using 4-point absolute positions profile with each velocity, acceleration and deceleration. The direction of the initial angle action for starting is set from the lower limit point to the upper limit point on PMLSM operation stroke. The effectiveness of a control system with variable gain schedule is demonstrated by some experimental results.

$\bar{X}$ Control Chart with Runs Rules: A Review (규칙을 가진 $\bar{X}$ 관리도에 관한 통람)

  • After a work of Derman and Ross(1997) that considered simple main runs rules and derived ARL (Average Run Length) using Markov chain modeling, $\bar{X}$ control chart based on diverse alternative main and supplementary runs rules that is the most popular control chart for monitoring the mean of a process are proposed. This paper reviews and discusses the-state-of-art researches for these runs rules and classifies according to several properties of runs rules. ARL derivation for a proposed runs rule is also illustrated.

Workload of Patients Transferring and its Improving Methods (병원 환자 운반 업무의 작업 부하 분석 및 개선 방안)

  • Nursing often requires heavy physical work activities such as lifting heavy loads, working in awkward postures, transferring patients, operating hazardous equipment, etc. Among various nursing tasks, patients transferring is one of the most physically demanding tasks. This study aims to investigate workload of the patients transferring, and to propose its improving methods for reducing high workload. The results showed that irrespective of methods for patients transferring and the number of workers involved, workload for most patients transferring tasks exceeded the action limit represented in terms of L5/SI compressive force of 3,400N or LI of 1.0 by NIOSH. The loads for some tasks were far larger than the maximum permissible limit of 6,400N. It is recommended that the mechanical devices for transferring patients such as ceiling crane, sling lift etc. should be introduced rather than simply increasing the number of workers in the tasks.

  • Most structures are constantly influenced by repeated weathering phenomena and load action during a period of its utilization, and their component materials become superannuated and their design performance becomes slowly lost. Therefore, it is thought that it is necessary to develop the online monitoring system that can make a great contribution to the maintenance management and disaster prevention of the building structure by sensing any slight change of the entire structure regardless of its inside and outside. Especially, this study was intended to explain the entire system of the online structure by interpreting welded built-up H-beams, of structural steel members having many advantages in terms of the qualities of structural materials, through limit state design, and presenting the basic plan to apply it to the structure.

Shear Deformation Characteristics of Concrete Beams Strengthened with Steel/FRP Bar (철근 및 FRP Bar 콘크리트보의 전단변형 특성)

  • This paper deals with the shear deformation charateristics of concrete beams strengthened with steel/FRP Bar. Applying the shear behavioral model based on shear deformation compatibility to RC beams tested by Ahmed K. El-Sayed et al.(2006), their transverse deformation in the web are calculated at ultimated loads after decoupling the shear carried by arch action in each beams. The calculated transverse deformation at ultimated loads are nearly same for the different reinforcement ratio. From these results, the temporary transverse deformation limit criterion is deduced. Using the proposed temporary limit criterion, the shear strength of concrete beams strengthen with FRP Bar tested by Ahmed K. El-Sayed et al.(2006) is predicted. These predicted values are compared with the measured values and the results are also compared with the current ACI and JSCE equation. The proposed method predicts the ultimate shear capacities more accurately than the equation of ACI and JSCE code. The predictions by the ACI and JSCE code are founded to be very conservative.
