The Prospect of 'Recordkeeping Regime' in the Public Sector of Korea : Examination on the characteristics of the Tables of Transactions for Records Scheduling by PRA Act (한국 공공분야 '기록보유(Recordkeeping)'체제 전망 -'기록물분류기준표'의 제도적 의의와 특성 -)

  • In this paper, I examined specific characteristics of the Tables of Transactions for Records Scheduling(TRS) (記錄物分類基準表 ; Kirokmul-Bulyukijun - Pyo) system by Public Records and Archives Act(PRA Act, No. 5709, 1999). All staffs and employees in governmental agencies of Korea must register, classify and dispose of their official records according to TRS by the Presidential Regulation for the application of PRA Act(No. 17050, 2000). Namely, the criteria of TRS is applicable to all stages of records lifecycle from creation to disposition(transfer to Archives or legal destruction). In the theoretical and methodological area, therefore, it is absolutely important that records managers and archival professionals in Korea make analysis on functions and characteristics of TRS by PRA Act. In the first, my examination take notice of possibility of 'adequate and proper documentation' about activity of the executive organization in TRS system. Other attention is that records management according to TRS means managing of records not only as physical entities but as logical entities which imply content and context of creation and use. In other hand, I wish to account for reasonable separation consideration for continuing utility of archives from current use of records throughout agencies duration Another theme of discussion in this paper is the theoretical framework which give account of TRS's characters. In conclusion, accountability for characteristics of TRS system could have been found in counterproposal view including the concept of Records continuum and the notion of Recordkeeping regime in Australia based on rethinking about Records lifecycle model. In the extent of practical area, more or less, it is imbalanced method that compare TRS by PRA Act to Recordkeeping regime based on Records continuum. Nevertheless, the concept and notion is suitable framework that give account of the prospect of recordkeeping system under PRA Act.as well as the meaningful characteristic of TRS.

  • This study aims to identify the work process of records managers under the Freedom of Information Act (FOI). In particular, it attempted to reveal the problems and difficulties that record managers encounter during FOI work. To do this, this study conducted in-depth interviews with 11 records managers who were in charge of records management and FOI work, and the accumulated data were subjectively analyzed. The study discussed the relationship between records management and FOI and emphasized the need for procedural improvements of the act to alleviate psychological pressure on records managers and help them focus more on the records management process itself.

A Study on the Management of Copyright Information for Increasing the Free Use of Government Publications as Public Works (공공저작물로서 정부간행물 자유이용 촉진을 위한 저작권정보 관리에 관한 연구)

  • This study aims to suggest measures for handling copyright information on government publications during records and archives management to use them freely as public works according to Article 24-2 of the Copyright Act in Korea. Through email interviews with 17 records managers, persons in charge of government publication management, and government staff with experience in production from April 4 to June 13, 2022, this study determined the current situations and problems related to producing and managing copyright information on government publications. Based on the interview findings, this research suggested the following. First, Article 24-2 of the Copyright Act must be revised to apply the Korea Open Government License (KOGL) type 1 mandatorily to all public works. Second, a cooperative system for managing copyright information on government publications should be established to improve their production and management effectiveness. Third, copyright information, such as authors, copyright holders, copyright duration, information on the copyright property transfer, public works status, and reasons for nonpublic works, must be managed through records and archives management systems. Fourth and last, information on public works must be provided during the registration number application for government publication so that everyone can access the full texts of the publications on the National Archives of Korea website.

  • There have been constant requests for urgently recruiting professionals in the archives to establish archival management systems by reflecting public institutional feature as well as reinforcing expertise and independence of them. However, it is true that some even adequate professional manpower haven't been secured at each level of public institutions due to ambiguous standards for the placement of professionals in the field of records management followed by the current [Public Records Management Act]. Thereupon, this study is to create records management task model for the archival management institutions with the workload of records management induced by the model, and to present reasonable scale of workforce to deal with the assignment. Moreover, here is shown which professional staff should be allocated for better efficiency and systems to carry out the task of records management in each relevant institution.

Searching for Laws and Systems to Revitalize Private Archives (민간 아카이브 활성화를 위한 법·제도 모색)

  • From the beginning of the enactment and implementation of the Public Records Management Act, there has been a steady discussion on the establishment of local archives. Local archives include not only administrative records of local governments, but also private archives such as containing the lives of residents. Along with the academic discussion, there have been movements for local autonomy and decentralization. Currently, interest and discussion on private archiving are in the historical flow. In addition, private archiving has become a social concern because of the establishment of systems such as the Public Records Management Act and the Information Disclosure Act, the establishment of a digital environment, and the spread of the meaning and value of village community activities. There are several government agencies related to private archiving, and the grounds for performing their work are different, and there are many central administrative agencies to which they belong. Therefore, I propose that the National Archives take the lead and form a 'Consortium of Private archives Management Institutions'. The organization should promote first, cooperation of collection information and archives, second, coordination of tasks and functions between institutions, and third, establishment of a nationwide private archives management system. Now is our chance. Instead of reacting on an ad hoc basis, respond systematically with a long-term perspective.

  • Korea's public institutions produce mandatory production records under the "Public Records Management Act" and submit statistics on production status to the National Archives of Korea every year. However, there is a difference between the actual status of compulsory records produced by local governments and the status statistics submitted to the Archives. Based on this, an improvement plan was proposed after identifying problems with the production management system of the production obligation records. In particular, the scope of the production obligation records is ambiguous, and the person in charge lacks an understanding of the specific scope. In addition, only certain work-oriented records are being produced. As such, the improvement plan shall clearly determine the target of the local government's production obligation records, and the person in charge of the affairs shall understand it and implement an ordinance on the production and management of the local government's production obligation records.

  • Destruction appraisal system improved with the enactment of the 1999 Public Records Management Act has the strategic concepts to prevent loss of important records with prohibiting the destruction in creation organization of records. But destruction appraisal carried out in record center realistically has the big difference with destruction appraisal system intended by Public Records Management Act. Therefore this article intends to explore the importance of destruction appraisal system through a review of the record appraisal system, and investigates operation status of destruction appraisal system in record center and operational issues. And it intends to explore scheme for practical application of destruction appraisal system based on actual cases of destruction appraisal which operates as a model.

  • The purpose of this study was to identify the records management system through the United States Records Management Act. The focus was on dividing its record management system into a state with the federal government, and looking at the operations. State records management does not cover all states, so it cited cases in Wisconsin and California where the systems are thought to have been best overhauled. The characteristics of the United States' recordkeeping system in this study are likely to be summarized in three ways: independence and autonomy of records management are guaranteed, many exchanges with cultural institutions in the region, and a historical society that is greatly influenced by them.

  • In this study, the improvement plan for the appropriate archives opening system in this country was proposed, by searching for the optimal operating method of opening system of archival institutions through the foreign instances related to the integrated type operation and the separate type operation.   • Recently, following the opening of the Gyeongsangnam-do Archives and the Seoul Archives, work to establish local archives management institutions in cities and provinces is being actively carried out. In this process, there is an institution directly or indirectly affected by the records management work following the emergence of metropolitan·provincial office of education records management institutions. Article 11 of the current Public Archives Act is centered on cities and provinces, such as giving only the mayor and provincial governor the duty to establish a local record management institution. When a management agency is established, only the obligation to transfer the records with a retention period of 30 years or more among the records under its jurisdiction is specified. This is not appropriate when considering that each metropolitan·provincial office of education and each metropolitan·provincial perform their own duties and roles at the metropolitan·provincial level in accordance with the Constitution and laws. Therefore, in this study, legally, institutionally and historically, the fact that metropolitan·provincial offices of education and metropolitan ·provincial are the core institutions that realize local educational autonomy and local autonomy, and are equivalent administrative agencies independently in charge of their own affairs in their respective jurisdictions. We compared and examined the need to revise Article 11 of the current Public Archives Act, which is overly composed of cities and provinces, and presented the expected effects of the establishment of local records management institutions by cities and provinces of education.
