Prevention and Resolution of Conflicts on Development and Environment in Korea (개발관련 갈등의 예방과 해소방안)

  • 정부 주도의 대규모 개발사업은 개발과 환경보전이라는 가치관의 차이, 개발로 인한 공익과 환경 파괴로 인한 환경이익 침해와 같은 공익 간의 상충, 사업으로 예상되는 국익과 개인의 재산권 침해 등과 같은 문제를 초래하는 경우가 많았다. 그럼에도 불구하고 정부는 개발정책과 계획을 수립하고 개발사업을 집행하는 과정에서 발생되는 자연훼손이나 환경파괴, 경제적 타당성, 사회적 문제 등을 객관적이고 과학적으로 조사하거나 제대로 검증하지 않아 갈등이 빈번하게 발생하였다. 이러한 갈등을 해결하기 위한 기존의 연구는 대개 갈등의 원인을 이해관계, 가치관, 사실관계, 제도 측면에서 규명하고 해결방안으로 주로 주민참여와 거버넌스, 전략환경평가, 사회영향평가 등을 제시하였다. 본 연구에서는 한국에서 1980년대 중반이후 주요 개발갈등사례를 개발사업 종류, 갈등당사자, 갈등 쟁점, 갈등 원인, 선거공약 여부, 소송 여부에 따라 정리한 후, 갈등 예방과 해소를 위한 법과 제도를 고찰하였다. 그리고 선거공약 또는 개발정책 및 계획안 구상단계, 개발정책 및 개발계획 수립 단계, 개발사업 시행단계, 갈등 분쟁 발생단계 등으로 구분하여 갈등예방 및 해소방안을 제시하였다. 선거공약 단계에서는 공직선거법상 선거공약서 규정에 국가재정법상 예비타당성분석을 도입하고, 개발정책 및 개발계획 수립단계에서는 전략환경평가와 갈등영향평가의 연계, 전략환경평가과정에 사회영향평가 및 주민참여의 강화, 환경계획과 개발계획의 연계 등을 제시하였다. 개발사업 시행 단계에서는 환경영향평가 과정에서의 주민참여를 강화하고, 개발사업 시행단계에서 갈등이 발생하는 경우 거버넌스 구축과 환경분쟁조정법, 공공기관의 갈등예방과 해결에 관한 규정 등을 근거로 하는 갈등해소방안을 제시하였다.

  • 본 논문에서는 도시 개발현장의 재해저감시설 중 하나인 침사지겸 저류지의 효과평가를 위한 모니터링 방안을 제시하였다. 전 지구적으로 기온이 급격히 상승하고 있으며 이상 자연현상이 지속적으로 증가하고 있다. 특히 우리나라는 매년 태풍에 영향을 받고 여름에 강수량이 집중되고 있다. 개발 중 지표면이 침식에 노출되고 불투수면적의 증가로 홍수위험이 높아져 재해영향평가제도에 따라 침사지겸 저류지를 설치하여 토사의 하천 유출을 방지하고, 첨두유출을 완화시키고 있다. 설치 시 외국의 경험식과 재해영향평가서 기준 기상청 관측대의 30년 빈도 강우량을 사용하고 있으나, 유형 및 제원의 적절성의 효과평가 방안이 부재하다. 향후 이상기후로 강하고 잦은 폭우가 예상되며, 이로 인한 홍수 피해를 예방하기 위한 침사지겸 저류지에 대한 효과 평가 방안이 필요하다. 이에 침사지겸 저류지의 재해저감 효과평가를 위해 타 재해저감시설 모니터링 체계 분석을 통해 수위값과 퇴사위 계측을 활용한 침사지 겸 저류지의 모니터링 방안을 도출하였다.

  • 기상학적 측면에서 강수 부족으로 인한 수생태환경(하천), 호소환경(저수지) 및 유역환경(중권역)으로 미치는 환경학적 가뭄의 영향을 평가하기 위한 시도는 매우 중요하다. 만약 동일한 규모의 강수부족 현상이 발생할지라도, 환경적 측면에서의 수질 및 수생태에 미치는 영향이 매우 큰 유역이 있고, 반면 어느 정도의 복원력을 유지할 수 있는 유역이 있을 것이다. 즉, 서로 다른 유역환경에 따라 가뭄으로 인한 환경적 영향은 달라질 가능성이 크며, 이처럼 환경적 가뭄에 취약한 지역을 위해서는 지속적인 환경가뭄 모니터링이 중요하다. 환경적 측면에서 가뭄의 영향을 평가하기 위해서는 다양한 수질 관련 항목을 연계한 환경가뭄 감시가 중요하며, 이와 더불어 가뭄과 관련한 다양한 이해관계자 간의 효율적인 의사결정 도구가 필요하다. 따라서 본 연구에서는 다양한 시나리오 정보를 제공할 수 있는 베이지안 네트워크 모형을 적용하여 환경가뭄 민감도 평가 방안을 제시하고자 한다. 본 모형에서는 수질 문제가 가장 심하게 대두되고 있는 낙동강 유역을 대상으로, 기상학적 가뭄에 의한 수생태 및 환경 관련 변수들(BOD, T-P, TOC)의 복잡한 상호의존성을 파악할 수 있는 베이지안 네트워크 모형을 활용하였다. 또한, 기상학적 가뭄에 의한 상류와 하류 간의 환경적 영향을 연계하여 해석하기 위한 모형을 구축하였다. 그 결과, 기상학적 가뭄으로 인한 환경적 민감도가 크게 나타나는 중권역(예: 임하댐유역)과 이와 반대인 중권역(예: 병성천유역)의 구분이 가능하였다. 또한, 상류에서 발생한 심한 기상학적 가뭄이 하류 지역 내 환경적인 영향을 지속할 가능성이 있음을 확인되었다. 따라서 본 연구에서 제안한 방법은 환경적 가뭄의 취약지역을 우선 선정하고, 나아가 상-하류 간의 환경적 가뭄을 감시하는 데 있어 활용도가 있을 것으로 기대된다.

Standardization Plan for Activation of Environmental Impact Assessment based on Spatial Information (공간정보 기반 환경영향평가 활성화를 위한 표준화 방안)

  • Environmental impact assessment has been performed as preliminary assessment system in order to conserve environment value and minimize negative effect from development. Assessment based on data has been necessary to strengthen objectivity in process of Environmental impact assessment process. Furthermore extended use of spatial information in Environmental impact assessment system has been required through spatial information provided at government level and possibility connected with spatial information in Environmental impact assessment. However spatial information has not been systematically utilized in current Environmental impact assessment. Also the environmental impact assessment workers including assessment government employees, agencies of Environmental impact assessment document and review agencies lack an understanding in the concept of spatial information, so there is limit about their use to efficiently. In order to improve these limits in use of spatial information, this study suggested measures to standardize spatial information (coordinate and attribute table). To do so, based on coordinate and standards certified by the government, this study defined standard coordinates (GRS-80, central datum point, False East: 100000, False North: 200000) and established 9 default items. Lastly, the aforementioned standards were tested for actual environmental impact assessment projects. Standardization measures suggested in this study are expected to contribute to invigorate spatial information utilization in Environmental impact assessment and expand the scope of the assessment.

  • The study is to analyze the contents of Environmental Impact Statement(EIS) and supplementary EIS prepared from 1981 to 1992. The contents are project area, project cost, EIS volume, project term, assessment term, EIS preparation cost, land use plan, and kinds of predictive model concerning air quality, water quality, noise and vibration etc. by project type. Data are collected with EIS analysis checklist and analyzed by $SPSS/PC^+$.

  • Public participation in Environmental Impact Assessment (EIA) process has been implemented since the introduction of EIA project on August 1 1991, followed with Environmental Policy Act promulgation on August 1 1990. Though public participation has room for improvement. This study compared before and after the introduction of public participation on EIS preparation cost, project cost, EIS preparation term and project term through 293 EISs analysis. Also public opinions in EIS after introduction of public participation were analyzed. The results are expected to be contributed to the system improvement of public participation.

Content Analysis of Mitigation Measures in Environmental Impact Statement (환경영향평가서 저감방안의 실효성에 대한 연구: 내용분석을 중심으로)

  • Mitigation measures in EIS are the important factors in the effectiveness of EIS. This paper analyzed the content of mitigation measures described in the 30 EISs selected, using 7 analysis items in order to discover the degree of effectiveness of mitigation measures. 30 EISs used in this study were selected through variance maximization strategy, and the 7 analysis items were; 1) thoroughness of mitigation content, 2) quantification of mitigation content, 3) explicit description of mitigation effect, 4) likelihood of mitigation effect, 5) impacted area of mitigation effect, 6) time frame of mitigation effect, and 7) environmental impact of mitigation measures. The results showed that the effectiveness of mitigation measures in the analyzed EISs was relatively low both in the appropriateness and in the specificity. It was suggested that in order to improve the appropriateness of EIS as a decision making tool, the effect of mitigation measures, as well as the mitigation measures themselves, should be studied and described more thoroughly and specifically.

  • Muju Resort Development environmental impact statement(EIS) in Mt. Teogyu National Park are evaluated with the results of post-environmental evaluation. Three EIA items (ecosystem, hydrology, landuse) are investigated. In terms of ecosystem and hydrology, the environment during construction period was compared with post-construction and it was also true of hydrology section. The land use surrounding the resort area have been changed seriously, and the wildlife in large patch are endangered with the fragmentation by road and resort construction. The three items in the Muju Resort EIS was not assessed properly. So, in order to assess properly accurate data, appropriate approach, and periodical post evaluation are required.

Effect and Satisfaction according to the Review of the Electronic Document of Environmental Impact Assessment - Focus on Cost and Carbon Emissions Reduction - (환경영향평가서 전자문서 검토에 따른 효과와 만족도 - 비용 및 탄소 배출 저감을 중심으로 -)

  • The way we work is changing significantly with the rapid development of digitaltechnology, and paper documents are being replaced by electronic documents. However, in accordance with the Enforcement Decree and Enforcement Regulation of the Environmental Impact Assessment Act, the environmental impact assessment report must submit a set number of paper reports to organizations related to the project, and about 42 years have passed since it was submitted as a paperreport. In 2022, the National Institute of Ecology introduced a system to review paperreports as electronic documents in line with the trend of digital transformation. The cost reduction and carbon emission reduction effects of electronic document review were analyzed for 1,398 environmental impact assessments submitted and reviewed in 2022. In addition, a satisfaction survey was conducted targeting type 1 environmental impact assessment companies that were directly affected, and a total of 134 people responded. As a result of analyzing the effect of reviewing electronic documents, costs are reduced by a total of 101,424,900 won per year and carbon emissions are reduced by about 59.7 tons. As a result of the satisfaction survey, 94.8% of the respondents said electronic documentreview was very helpful, and 4.5% said it was helpful. The effectiveness of electronic documentreview was high, with 94.8% of respondents saying it was helpful in economic terms and 91.8% saying it was helpful in reducing work hours. If electronic documents are reviewed through the revisions to the Enforcement Decree and Enforcement Regulation of the Environmental Impact Assessment Act, the implementation of electronic document review is expected to have a ripple effect across the country, not only reducing costs and carbon emissions, but also reducing administrative time and saving storage space. Rapid changes in law and administration are needed to adapt to the digital transformation era.

A Guide for Environmental Impact Assessment for the Installation of Water-friendly Facilities in River Zones (하천구역 내 친수시설물 설치를 위한 환경영향평가 검토 가이드 연구)

  • Recently, local governments have recognized river zones as leisure spaces and local festival venues, and hence, the pressure for developing these zones has increased significantly. However, given the unique functionalities of river zones and the time and costs associated with maintaining facilities and restoring damaged areas, a development plan must be selected carefully. To preserve river zones and to facilitate nature-friendly space utilization, this study focused on improving environmental impact assessment (EIA), which is an institutional implementation procedure for project plans. This study prepared a draft guide for EIA by providing an overview of the research background and survey outcomes, including the status of laws and regulations on river zones, development plans, and opinions on EIA. The results showed that because strategic EIA of basic river plans is important for district designation of river zones and the scope and direction of space utilization, it is necessary to establish a more meticulous business plan before reviewing and evaluating the mini EIA linked to the future implementation of a plan to derive a reasonable assessment. Additionally, this study provides a draft guide for EIA to evaluate the suitability of water-friendly facility construction plans considering the location characteristics and to reflect the factors that can reduce the environmental impacts during the mini EIA stage. In the future, we expect that the results of this study will serve as a foundation for establishing instructions and guides for the development of nature-friendly and water-friendly facilities in river zones during the establishment of plans.
