다음은 "법제업무 운영규정" (대통령령) 제26조 제27조 및 "법제업무 운영규정 시행규칙" (총리령) 제22조에 의해 법제처에서 "어업허가 등을 하면서 보상청구를 제한하는 조건을 붙인 경우 하천공사 추진 시 손실보상 가부"에 대한 법령 유권해석(안건번호 2010-0040, 회신일 2010. 03. 26)의 내용이다.

Integrated Pollution Prevention and Control(IPPC) has become an idealistic environmental prevention concept in developed countries and corresponds with principles of Industrial Ecology. The concept of emissions regulatory integration is a key factor for an integrated environmental management system. While most EU member countries have a cross-media regulatory system, Korea has a media-specific regulatory system which was found to have significant environmental management problems. The purpose of this study is to integrate the emissions regulatory system by resolving difficulties through procedural, organizational, and substantive analysis of integration. To this end, the following research was performed: The first task was to determine the target of the integrated emissions regulatory system. In connection with this, the "IPPC directive" of the EU and the "PPCA 2000" schedule 1 of the UK, as well as environmental laws in Korea were compared and analyzed. The second was to design a regulatory system model. This model was divided into three groups after considerations were made regarding the time it would take for the pre-application,application, and permission stages. Lastly, on the basis of this research, a revised bill for an integrated emissions regulatory system was suggested. Nevertheless, substantive analysis of integration focused on BAT requires supplementation in order to make the integrated emissions regulation system operate normally as an environmental management policy and regulation method. To this end, the specific characteristics of Korean society, culture, and law should be actively considered.

[ $\triangle$ ] 건설부는 90.6.15 경부고속철도 및 신공항건설계획발표, 수도권내 공장 건설규제 완화 등과 관련하여 투기발생이 우려되는 지역을 토지거래 허가구역으로 지정하여 지가의 안정을 유지하면서 국토의 균형개발을 도모하기로 하였음. $\triangle$ 이번에 토지거래허가제가 실시되는 지역은 $\bullet$ 경부고속전철건설에 따라 영향을 받는 지역의 투기와 지가상승을 방지하기 위하여 역에서 반경 20km이내의 영향권내에 있는 천안시, 온양시, 청주시, 경주시전역과 안성군, 평택군 등의 일부 지역 $5,750.05km^{2}$와 $\bullet$ 신공항건설로 투기적 거래가 우려되는 신공항인근 지역과 공항진입도로, 진입철도 등의 설치로 향후 개발이 예상되는 이넌직할시, 부천시전역과 웅진군북 도면등 $129.37km^{2}$, $\bullet$ 수도권내의 공장설치규제가 완화됨에 따라 투기발생이 우려되는 지역과 수도권중 택지소유상한제가 실시되지 않는 지역에 대한 투기확산을 방지하기 위하여 경기도지역중 현재 허가제가 실시되고 있지 않은 $6,237.93km^{2}$, $\bullet$ 안면도 관광도지개발로 인하여 투기적거래과 우려됨에 따라 태안군 고남면 $26.48km^{2}$등을 허가구역으로 지정하게 되었음. $\triangle$ 이로써 허가구역은 현재 실시중인 지역 $28,323.47km^{2}$를 포함하여 전국토의 $40.78{\%}(40,467.30km^{2})$가 되며 신고구역은 $12,075.45km^{2}$가 감소하여 전국토의 $40.07{\%}(43,735.38km^{2})$가 됨.

The National Assembly of the Republic of Korea recently enacted laws to fortify sanctions about data manipulation of pharmaceutical companies. The medicine approval system is the result of legislative efforts to prevent accidents that caused damages to patients' life and health. The medicine approval system is based on the trust that the data submitted by pharmaceutical companies is not manipulated. The Supreme Court of Korea clarified that strict standard shoud be required to secure the medicine safety in Supreme Court Decision 2008Du8628 decided November 13, 2008. We agree. This paper suggest legislation to weaken the economic incentives for pharmaceutical companies to choose data manipulation by minimizing the expected profit. In addition to revoking the marketing authorization of the medicine, the 'unfair' profits the pharmaceutical company has earned must be recovered. In addition, in order to increase the possibility to discover data manipulation, it is necessary to strengthen the review capacity and to activate the whistle-blowing.

우리나라는 얼마 전까지만 해도 어업허가제도에 의하여 어업자원을 관리하여 왔다. 그러나 어업기술의 발달로 상대적으로 과거에 비해 어획노력의 증대와 더불어 대부분의 수산자원이 남획상태에 이르게 되었다. 허가제도하에서는 과잉노력량에 대한 조정이 곤란하고 현실적으로 불법ㆍ남획어업이 자행되어 어업자원 고갈현상이 가속화되고 해양오염 증가와 매립ㆍ간척으로 인한 어장축소 등으로 어업생산성 저하됨으로서 새로운 어업관리제도의 필요성 대두되어 간접적 자원관리방식의 전통적 방법에서 어획량을 직접 관리하는 TAC제도로의 전환 필요성 증대되었다. 최근 기후변화에 따른 잦은 이상 가뭄으로 물 부족 현상이 심화되고 있어 물 안보가 중요한 사회적 이슈로 부각되고 있다. 물 부족에 대비하기 위해 수자원은 인류가 마음대로 사용할 수 있는 자유재가 아니라 보호·관리하여야 하는 대상으로, 보유한 미사용량을 회수·재배분하여 물 이용의 공정성을 강화 등 물 이용 제도의 전반에 대한 검토·개선이 필요한 실정이다. 하지만 일부 유역에서는 하천수 사용량이 정확하게 계측되지 않아 공정한 하천수 배분 등에 한계가 발생하고 있다. 본 연구에서는 충주댐 하류 유역에 위치한 자동유량측정소 원주시(남한강대교)와 여주시(남한강교) 상·하류 유량자료를 검토·분석하여 하천수 사용허가권에 등재된 하천수 이용량을 검토하고자 한다. 아울러 상·하류 자동유량관측소 내 지류 하천(섬강, 청미천)이 유입되고 있어, 추가 유입량을 고려한 물수지 분석을 위해 원주시(문막교)수위관측소, 여주시(원부교)수위관측소의 유량자료를 이용하였다. 상·하류 유량자료 검토 결과, 지류 유입량 + 하류 여주시(남한강교)) 유량이 상류 원주시(남한강대교) 유량보다 작은 상·하류 유량이 역전('19~'20, 평균 787,753m³/day)되는 흐름이 발생하였다. 구간 내 등재된 취수시설물(11개소) 허가량(39.66×10⁶m³) 보다 실재 사용량은 많을 것으로 추정되며 상·하류 역전 흐름에 직접적인 영향을 준 것으로 판단된다, 또한 현장 조사에서 허가대장에 미등재된 다수의 시설을 발견하였으며 이는 하천수의 효율적인 관리에 장애요인으로 작용된다. 하천수 사용은 복합허가사항으로 홍수통제소에서 사용허가부터 관리까지 실시하고 있는데 하천수 허가 신청량은 계획수요량 산정과 물수지 분석결과를 통하여 적정성 검토가 이루어지고 있다. 그러나 하천수 사용허가량 대비 실제 하천수 취수량이 얼마나 되는지 파악은 불가능한 실정이다. 결국 하천 유량을 관리하기 위해 강수량, 수위, 유량 등 많은 수문요소를 정확하게 측정하는 것도 필요하지만 이처럼 하천수 이용을 위해 취수되는 양을 정확하게 계측하지 않는다면 효율적인 하천수 관리는 어렵다. 하천수를 관리하고 효율적으로 이용하기 위해 하천수 이용에 대한 제도적인 보완이 필요해 보인다.

This study is designed to examine international export control norms, analyze current national export control system and identify the problems thereof, presenting several proposals for development in the system. The Republic of Korea, as a signatory of non-proliferation treaties and multilateral export control regimes, is obligated to comply with the international non-proliferation and export control norms, irregardless of hard or soft laws. Korea's export control system has been implemented in earnest since 2005; however, it contains serious problems in terms of the legal system and objectives of relevant laws and regulations, terms and definitions of the items subject to export controls, catch-all requirements, brokering license, response to the U.S. re-export controls, and so on. Proposals for development in the system include (i) enacting an independent law integrating the current dual-use items export control law and regulations, (ii) making use of the term of "strategic items" as a uniform terminology replacing 'goods etc.', 'strategic goods(inclusive of technology)', 'strategic goods, etc.', 'WMD, etc.' so as to preclude any possibility of misunderstanding, (iii) rewriting the catch-all control requirements, (iv) introducing registration system of brokering firms, (v) including provisions to comply with U.S. reexport controls, and (vi) providing stakeholder with correct and full information on export controls.
