독일의 독점금지제도

  • 독일의 독점금지관련 법제는 크게 기업의 불공정 경쟁행위를 규제하기 위하여 1909년에 제정된 부정경쟁방지법(UWG:Gesetz gegenden Unlauteren Wettbewerb, AUC:Act against Unfair Competition)과 제 2차대전 후 금융자본에 의한 기업의 카르텔과 콘체른의 성행으로 독과점의 폐해가 심해지자 독과점 규제의 실효성을 위하여 1957년 제정된 경쟁제한금지법(GWB:Gesetz gegen Wettbewerbs Beschrankungn, ARC: Act against Restraints of Competition)이다. 부정경쟁방지법은 부당한 거래거절이나 부당한 거래방해 행위, 부당한 차별적 취급 및 기만적인 광고 등 기업의 영업활동과 관련한 불공정경쟁행위 규제가 주된 목적으로서 민사절차에 의한 손해배상소송 등에서 활용되고 있으며 경쟁제한금지법과 중복되는 분야(부당한 거래거절 등)에 대하여는 행정벌의 부과를 규정하고 있어 경쟁제한금지법과 상호보완적 관계를 유지하고 있다. 따라서 본고에서는 독일의 경쟁제한금지법의 내용에 대해서만 살펴보기로 한다.

Analysis and countermeasure of causes of inducing violence of private security companies on the actual sites of administrative execution by proxy (행정대집행 현장에서 민간경비업체의 폭력 유발 원인 분석과 대책)

  • Administrative execution by proxy is one of forced executions of administration and is also called as "enforced execution by proxy" in which administration institutions or the third party executes by proxy on behalf of parties who did not execute obligations under administration law and files claims to compensate expenses required in the proxy execution. Despite the actual site of administrative execution by law, social problems are generated because various violence and behaviors of infringement of human rights between executer and obligator are rampant and thus causing human damages since forced execution by physical force is carried out and cases of police indictments and petition to human rights committee are gradually increasing. Majority of people mobilized in this actual site of violence are supplied by private security companies which provide service contract and mobilization of people without qualification of guards or security service and irrational execution by proxy and violent actions by so-called service hooligans connected to violence organizations are now becoming social issues. In these actual sites of violence, structurally very complicated problems such as economic rights, right of residence, struggle for living, and intervention by outsiders are contained. This thesis has analyzed causes of outbreaks of violence and discussed about improvement countermeasure by paying attention to mobilization of people by private security companies. As the result, through revision and improvement of laws and systems, execution institution and policemen must be present at actual sites of execution by proxy to control physical execution of private security companies to be carried out legally and when violent collisions are occurring, it shall be stipulated that police should immediately intervene. Practices of execution by proxy of execution administration institutions shall be avoided and causes of occurrences of violence shall be eliminated by discrete decisions of execution by proxy, elimination of service contract conditions focused on accomplishments, and stipulation of responsibility of execution institutions when problems occur. Practices of solving petitions through collective actions of obligators shall be eliminated and strict enforcement of laws such as disturbance of official execution or compensation claims for expenses of execution by proxy must be carried out and intervention by the third parties must be intercepted. Mobilization of manpower by security companies shall be limited to people with prior registration who have acquired and finished qualification and education by security business law and before putting them on actual sites, it shall be obliged that execution plan with clear written records of working location, mission, and work rules must be submitted in advance to police station in charge and also they must be controlled to follow laws and statutes such as uniform and equipments. In addition, personal criminal responsibility for violent actions must be clearly stipulated and advanced securing soundness of security companies such as limits of service contracts with records of accidents is required. Order placement behaviors of special organizations under the pretext of rehabilitation business must be eradicated and companies with capability and strong intention of observation of laws must be able to receive orders by intercepting chains of contracts and sub-contracts. Issues of improvement countermeasure of social problem, living, and compensation including rights of residence and environment are excluded from the discussion.

  • Purpose: The purpose of this study was to define cost-countable perioperative nursing activities and to analyze the cost of each nursing activities based on the Resource-Based Relative Value Scale (RBRVS). Method: Researcher and 3 research assistants observed and documented the 83 operating patients in order to measure nursing time for each of the perioperative nursing activities. And then, 35 operating room nurses with at least one year of perioperative nursing experience were observed for the RBRVS of perioperative nursing activities. Finally, the direct and indirect nursing costs were estimated. Result: Nursing costs of 25 nursing activities were estimated using the RBRVS. Most expensive nursing activities were delivery of the instrument and implement for OP team (9,780 won per hour) and behavior of wash, pack, disinfect the instrument (6,770). Conclusion: Based on the relative values of each perioperative nursing activities estimated in this study, proper medical reimbursement system should be established in a near future.

Analysis of nursing activities in ambulatory units of secondary and tertiary hospitals (종합병원${\cdot}$종합전문요양기관의 외래 간호활동 분석 연구)

  • Purpose : For improvement of nursing services in ambulatory unit, ambulatory nursing activity was identified and the required time by nursing activity was measured. Method : The data were collected from 4 tertiary hospitals and 2 secondary hospitals. The method of data collection was used the self-reporting method. The 123 nurse-work days and 137 nurse-aid-work days in 6 hospitals were analyzed. Results : As a result, 11 ambulatory nursing domains and 79 ambulatory nursing activities were confirmed. Above 50% of subjects performed the general outpatient affair domain. The percentage of total time spent in each domain were as follows : general outpatient affair domain, 58.3%, patient education ${\cdot}$ counseling domain, 10.8%, therapeutic care domain, 8.6% and so on. And the average hours were measured by activity and domain. Conclusion : For the improvement of ambulatory nursing care, the strategies that keep the legal standard of number of ambulatory nurse and exchange the nursing-aid for the nurse is needed. And it is also needed to standardize the ambulatory nursing services.

The Relations of Nurses' Job Stress and Knowledge, Attitude and Care Behavior for Elderly Patients (간호사의 직무스트레스와 노인에 대한 지식, 태도 및 케어실천행위)

  • Purpose: This study was to examine the relation of nurses' job stress and knowledge, attitude and care behavior for elderly patient in hospitals. Method: One hundred ninety one nurses caring the elderly patients in hospitals in Ilsan, Busan and Gyeongsangnam-do were subjects. The data was collected between Sept. 21 and 31, 2009. Data was analyzed using t-test, ANOVA, Pearson correlation with SPSS/Win 17.0 and the fitness of pathway models with AMOS 5.0. Results: The mean scores of job stress and knowledge were in middle range, and attitude and care behavior were in a little higher range. The fitness of hypothetical model was excellent. Job stress had direct effects on attitude and care behavior, knowledge had direct effect on attitude and attitude had direct effect on care behavior. But the pathways related to job stress and attitude and job stress and care behavior were not significant. In modified model deleted the pathway between job stress and attitude, the pathway related to job stress and behavior also was not significant. Conclusion: Education related to the elderly for nurses to improve care behavior is needed continuously.
