Legal Problems of Crimes against Aircraft Safety in Korean Law (항공안전 관련 형사특별법에 대한 연구)

  • The penalty clauses of 'Aviation Act' and 'Aviation Safety and Security Act' going into effect now were legislated because the aviation safety is being more influenced by the aviation safety system compared to the ground or maritime transportation and it is possible the aircraft can harm to people and wealth located in the ground as well as threaten the safety of the passengers and crew on board when it is the target of crimes. However, analyzing the current acts, applicable objects and behavioral requirements of some provisions are too general, and they are providing severely high penalties in many clauses without separating applicable objects and behavioral requirements. In addition, there are some critical legislative defects and there is a problem in terms of law-applicable area in the legal system. It is inferred that these legislative problems of the criminal special-law related to the aviation were caused by following reasons; first, aviation security experts or policy-makers than criminal law experts attended more actively in the enactment process, second, the communication among specialist groups were not accomplished well enough.

  • The International Civil Aviation Organization(ICAO) recently established the Global Aviation Safety Plan(GASP) for national aviation safety management, along with the enactment of Annex 19, Safety Management System(SMS). ICAO require the establishment of the 'States Safety Programs(SSP)' for countries with excellent safety evaluation, including Korea, and the establishment of aviation safety supervision systems for all Contracting States by 2017 under the enactment of ICAO Annex 19. Required. The Ministry of Land, Infrastructure, and Transport has continuously invested in R&D to secure such aviation safety systematically, and is making efforts to develop and disseminate related technologies by establishing long-term R&D roadmaps. A study on aviation safety supervision among the system-based aviation safety supervision support technology development R&D project, which is underway as part of the aviation safety technology development project of the Ministry of Land, Infrastructure and Transport. We conducted a study to see if this methodology logically guarantees reasonableness.

  • The checklist currently used for aviation safety inspection performed by ASIs(Aviation Safety Inspectors) consists of inspection groups and multiple items, it does not have safety attribute and structured hierarchy system which required to efficiently process aviation safety analysis. On this study, categorized the domestic and foreign ASI checklist by safety attribute from ICAO recommended and presented composition of checklist for safety assurance by comparative analysis composition of domestic and foreign ASI checklist.

A Study on The Enhancement of Aviation Safety in Airport Planning & Construction from a Legal Perspective (공항개발계획과 사업에서의 항공안전성 제고에 대한 법률적 소고)

  • Today air traffic at the airport is complicated including a significant increase in the volume of air transport, so aviation accidents are constantly occurring. Therefore, we should newly recognize importance of the Air Traffic Safety, the core values of the Air Traffic. The location of airport that is the basic infrastructure of the air traffic and the security of safety for facilities and equipments are more important than what you can. From this dimension, I analyze the step-by-step safety factors that are taken into account in the airport development projects from the construction or improvement of the airport within the current laws and institutions and give my opinion on the enhancement of safety in the design and construction of airport. The safety of air traffic, as well as airport, depends on location, development, design, construction, inspection and management of the airport including airport facilities because we have to carry out the national responsibility that prevents the risk of large social overhead capital for many and unspecified persons in modern society through legislation regarding intervention of specialists and locational criteria for aviation safety from the planning stage of airport development. In addition, well-defined installation standards of airports and air navigation facilities, the key points of the airport development phase, can ensure the safety of the airport and airport facilities. Of course, the installation standards of airport and air navigation facilities are based on the global standard due to the nature of air traffic. However, to prevent the chaos for the safety standards in design, construction, inspection of them and to ensure the aviation safety, the safety standards must be further subdivided in the course of domestic legislation. The criteria for installation of the Air Navigation facilities is regulated most specifically. However, to ensure the safety of the operation for Air Navigation Facilities, performance system proved suitable for the Safety of Air Navigation Facilities must change over from arbitrary restrictions to mandatory restrictions and be applied for foreign producers as well as domestic producers. Of course, negligence of pilots and defective aircraft maintenance lead to a large portion of the aviation accidents. However, I think that air traffic accidents can be reduced if the airport or airport facility is perfect enough to ensure the safety. Therefore, legal and institutional supplement to prioritize the aviation safety from the stage of airport development may be necessary.

  • The demand for safety certification of Light Unmanned Aerial Vehicles (LUAVs), weighing between 25kg and 150kg, is rapidly increasing in Korea. Unfortunately, the number of LUAV safety certification failures is also on the rise, with manufacturing quality issues being identified as the main culprit. However, there is a lack of quality system standards for manufacturers within the LUAV safety certification system. As a result, this paper aims to analyze the domestic safety certification system and the quality standards set by the American Society for Testing and Materials (ASTM) for small Unmanned Aerial Systems (sUAS). The goal is to establish quality system inspection standards specifically tailored for LUAV manufacturers. To achieve this, we propose additional inspection items that reflect the characteristics of the manufacturing quality system. These items will be identified through on-site inspections of LUAV manufacturers, ensuring that the resulting quality system standard aligns with the actual situation of domestic manufacturers. In order to gauge the feasibility and effectiveness of the proposed quality system standard, we conducted a survey of seven domestic LUAV manufacturers.

  • Korea's economic development plans instituted in the 1970's, affected by the growth centered policy and rapid industrialization, have prevailed without having aviation safety management system, along with the safety of the other various means of transportation, settled in its place, and subsequently, the aviation accidents occurred until the beginning of year 2000 have incurred an enormous social expense, not to say of a massive loss of human lives. Especially, with regard to the causal factors of accidents, most of recent accidents have been associated with human factor of airmen, thus, only if this can be detected in advance and prevented, the aircraft accident rate will be reduced by a large margin. Therefore, in order to develope improvement methods on the safety system of civil aviation, in this study, safety management system has been divided into three stages: an advance preventive system, a handling system at an accident's occurrence and a post accident handling system, and thereby improvement methods on aviation safety have been suggested for each stage. The threatening factors agatinst aviation safety have been found to be the absence of management standards and regulations, the indifference to or the lack of the law abiding apirit as major factors, and in order to improve on which, it is required that the settlement of the institutional safety management system should precede, and that the Government and the aviation industry should also make a continuous effort to identify the threatening factors against aviation safety, and to provide incentives for the law abiding spirit and the attitude of giving top priority to safety to spread among all the employees.

  • The world-wide principal criteria of aircraft operations is ICAO Annex 6. Operations of Aircraft. Among ICAO Annex 6, Part I is for International Commercial Air Transport - Aeroplanes and it assumes major part of civil aviation. ICAO has been providing Contracting States with SARPs(Standards and Recommended Practices) and monitor each State's reflection degree into their domestic air law, so-called USOAP(Universal Safety Oversight Audit Program). Current ICAO USOAP is Snap-shot method, but it will be changed to USOAP-CMA method from the year of 2013. ICAO USOAP results have overall effects on national aviation industry such as routes, insurance, airlines cooperation and so forth. Low grades of results attract international attention and that leads to flag carrier's operation stoppage, route restriction, airlines cooperation restriction, insurance increase directly or indirectly. Thus it is important to get excellent grades in ICAO USOAP and to maintain confidence. Our government ranked top to get 98.89 grades in 2008 ICAO USOAP but after 2008 the revised provisions have not been reflected sufficiently into our air law. So I would like to grip reflection ratio of ICAO Annex 6 Part I into our domestic air law by using the most updated revised edition on this paper. Together I would like to suggest alternatives for the non-reflected and partially reflected.

  • This study will be regarded significant in terms that empirical analysis was used to prove "Aviation Safety", a variable which had not been regarded as a airline choice factor within Korea air transport market so far, has an effect on the aviation consumers' airline preference change and choice after recent frequent aviation accidents. On releasing this paper. I wish, it can be another opportunity for Korean two national flag airlines to reappraise and reinforce the significance of "aviation safety" and set forth immediate vigorous efforts to support the government's aviation safety improvement countermeasures The study was performed to provide data and information for this.

  • Avionics electronic equipment refers to the electronic equipment installed on an aircraft. Failure of avionics equipment can have a significant impact on aircraft operations as well as threaten the safety of pilots and passengers. Therefore, avionics electronic equipment is required to have higher reliability and safety than electronic equipment used for other purposes. Avionics equipment must consider various component selection and system design to meet reliability and safety-related requirements from the initial design stage. In this paper, we describe safety, reliability performance analysis method of avionics equipment, and introduce various design improvement methods that can be performed to meet safety requirement performance. Finally, the safety performance of the improved avionics equipment was reanalyzed and compared with the value before the improvement, the validity of the proposed design change was verified.

  • ICAO has recommended data-based aviation safety management and decision-making systems through Annex 19(Safety Management) and Doc 9859(Safety Management Manual), stressing that safety can be greatly improved by sharing aviation safety information throughout the industry. Accordingly, advanced aviation countries have built infrastructure to collect and analyze various aviation safety data in an integrated manner, and also tried to spread identified major safety issues across the industry. On the other hand, in Korea, each stakeholder collects, manages and analyzes safety data individually, so there is a limit to use them in integrative manner. In addition, the scope of using and sharing aviation safety information such as analysis result is also focused on safety management at the national government level, which is insufficient to be shared throughout the industry. Accordingly, the purpose of this study is to present a plan to share and utilize the domestic aviation safety information. To do this, we compare the current situation between FAA and domestic industry and suggest the improvement plans.
