  • Using small cameras such as smartphones, criminals shoot secretly in public restrooms and women's changing rooms. And Revenge porn is also increasing. As a result social damage is increasing. Tumblr is an overseas service and it is very difficult to work with Tumbler on international legal cooperation and deletions. Thus In order to block the distribution of videos, victims must find and report the video URL themselves. But it's hard for victims who lack IT expertise to proceed those procedure. In this study, we automatically collect the URL of stored information and hash values of the images from API permlink of Tumbler blog. It is then saved as a document file with and presented to the victim. Through these technical methods, we can help victims report violations easily and quickly.

Analysis of the IP Spoofing Attack Exploiting Null Security Algorithms in 5G Networks

  • In this paper, we analyze the feasibility of the IP spoofing attack exploiting null security algorithms in 5G networks based on 3GPP standard specifications. According to 3GPP standard specifications, the initial Registration Request message is not protected by encryption and integrity. The IP spoofing attack exploits the vulnerability that allows a malicious gNB (next generation Node B) to modify the contents of the initial Registration Request message of a victim UE (User Equipment) before forwarding it to AMF (Access and Mobility Management Function). If the attack succeeds, the victim UE is disconnected from the 5G network and a malicious UE gets Internet services, while the 5G operator will charge the victim UE. In this paper, we analyze the feasibility of the IP spoofing attack by analyzing whether each signaling message composing the attack conforms to the 3GPP Rel-17 standard specifications. As a result of the analysis, it is determined that the IP spoofing attack is not feasible in the 5G system implemented according to the 3GPP Rel-17 standard specifications.

  • The 「Act on Special Cases concerning the Punishment of Crimes of Domestic Violence」 still has various problems in the legal system and enforcement process. Contrary to the original intention of the legislation, it is operated very passively in terms of state intervention and punishment of domestic violence actors in actual operation. Even if it is treated as a home protection case, if you look at the details of the protection disposition, there is a problem that the decision on the protection disposition is biased towards a specific type of protection disposition. In order to improve this, the need for cooperation and active intervention between state agencies is required. In addition, it is necessary to establish a legal basis for a request for personal protection by recognizing the status of a victim who reported domestic violence as a crime reporter. In addition, in order to secure the effectiveness of the protective disposition, it is necessary to strengthen sanctions for non-compliance or violations of the protective disposition.

  • A stalking is becoming more diverse and the methods are developing over time as the society has changed over time due to the advancement of information technology but an initial countermeasure seems to be difficult as there is no sufficient legislations against such crimes as stalking. Our country passed laws regulating such stalking at 1999 and four more additional bills were proposed until the 18th National Assembly but they failed to become legalized. Two more additional bills were proposed during 19th National Assembly which are still pending. Crimes such as stalking violates and invades physical and psychological freedom of the victims and the crimes are severely inveterate and intentional. Advanced countries such as the United States, the Great Britain, Germany, and Japan enacted legislations that strictly regulates stalking and also appropriate responses. As these exemplary cases show, it is essential that our country also requires an effective legislations against crime of stalking and protecting a victim of the crime.

  • 스토킹현상을 신종범죄로 규정하고 스토커 처벌에 관한 내용을 입법화하려는 움직임은 미국에서 1990년 캘리포니아주에서 '스토킹방지법'이 제정됨을 시작으로 1999년에 50개주 및 콜롬비아 특별구까지 입법화되었다. 이에 반해 우리나라는 1999년 스토킹 규제 관련 법안이 발의된 이후 제18대 국회까지 4개의 법안이 발의되었으나 입법화되지 못하였고 다만 2013년에 개정된 경범죄 처벌법에 의해 미미한 처벌규정만을 두고 있다. 현재 제19대 국회에는 스토킹 규제에 대한 법안이 발의되어 있고 이에 대해 많은 논의들이 진행되고 있고 우리나라도 스토킹 행위에 대한 효과적 대응과 피해자의 보호를 위한 과련 법 도입이 절실하다.

  • 우리나라는 2000년에 제조물책임법이 제정하여 2002년 7월 1일부터 시행하였으며, 제조물의 제조, 설계, 표시등의 결함으로 인하여 발생한 손해에 대한 제조업자 등의 손해 배상책임을 규정하고 소비자의 결함 입증부담 경감과 피해자의 보호를 도모하자 하고 있다. 제조물의 표시등의 결함은 지시결함이나 경고결함에 관한 것으로 제조자는 그 위험에 의한 사고를 방지 회피할 수 있도록 소비자에게 정보를 제공하여야 하나 이를 이행하지 않아 발생된 결함이다. 본 논문에서는 A사(社)의 공기정화기 B모델 사용설명서에 나타난 정보제공사항을 주의 경고표시 가이드 등에 따라 검토하였으며, 그 결과 일부 지시 및 경고사항에서 보완해야할 사항이 발견하였다. 보완사항은 제안사항으로 기업내부 에서 처리하되 전문성이 부족한 분야는 외부의 PL전문가의 협력하에 바람직한 개선안이 도출될 수 있을 것이다.

Study on Preventing Retaliation against Crime Victims (범죄피해자에 대한 보복범죄 방지 대책에 관한 연구)

  • The guarantee of citizens' safety from crime is the reason for a nation's existence according to the social contract, and it is also a salient task in securing the citizens' right to the pursuit of happiness, which is a constitutional right expressing the nation's duty to its citizens. First, a procedure must be made mandatory that corresponds to the Miranda rule applied during the arrest of criminal suspect, which verifies whether there exists a risk of retaliatory crime to the victim of crime, crime reporter, or witness following their report of a crime or testimony. A measure to punish those who violate this should be devised. The second is the improvement of related laws and systems, such as expanding the scope of persons subject to protection from retaliatory crimes under the current law and strengthening information protection. Third, a retaliatory crime risk evaluation index must be developed, and the evaluation results must be quantified to clearly state measures and responsibilities, in detail, for personal safety at each level of intensity. The fourth is the expanded implementation of proactive personal safety measures for victims of crime and witnesses, as well as the development and application of advanced techniques. The last is a change in the perception s of those working for the judicial body. From the initial investigation stage of the crime to the diagnosis regarding the possibility of retaliation perpetrated on an ex-convict through psychological tests, systems of general cooperation, and mutual assistance must be established.

Proposal for Amendment of the Basic Environmental Policy Act ('BEPA') Article 31 (환경정책기본법 제31조 무과실책임규정의 개정방안)

  • The Basic Environmental Policy Act (BEPA) (Law No. 4257 effective 1. August 1990) sets forth the basic policies and administrative framework for environmental preservation, leaving more detailed regulations, and emission controls to separate laws targeting air, water, and solid waste, etc. The BEPA Article 31 adopts an unprecedented strict liability standard for damages as an absolute liability. The BEPA Article 31 provides for liability as follows. If a company is alleged to have caused damage through pollution of the environment, it will be liable for damages unless it can show that the pollution did not cause damages, or that it did not actually cause pollution. If the company did cause pollution, and if the pollution is the cause for the damages in question, the company will be liable irrespective of whether it was negligent or otherwise at fault. If there are two or more companies involved in the pollution, but it is unclear which company caused the damages, all of the companies will be jointly and severally liable for the damages. In this paper, the author attempts to uncover the problems of BEPA Article 31 and then seeks desirable amendments by comparing it to the German Environmental Liability Act. First, it will be necessary to provide definitions of 'companies etc.'. Second, it will be necessary to enumerate the kinds of company facilities. Third, it will be necessary to provide exclusionary clauses on material damages. Fourth, it will be necessary to show 'presumption of cause and effect'. Fifth, it will be necessary to provide a clause on 'right to information'. Sixth, it will be necessary to provide a clause for force majeure. Seventh, it will be necessary to take measures to secure abundant liability for damages which can be caused by the owner of the facility, the potential polluter. Finally, it is appropriate that Korea now legislate an Environmental Liability Act akin to the German Environmental Liability Act.

Exploring Rape Reports in Newspapers - A Longitudinal Analysis of Four Korean News Dailies between 1990 and 2007 (한국 신문에 나타난 강간보도의 통시적 분석 - 강간통념과 양가적 성차별주의를 중심으로)

  • The present study delves into how rape reports are framed in popular Korean newspapers over time. Specifically, the primary purpose of this study was to examine how rape myths and ambivalent sexism and were presented in three Korean newspapers. In order to assess longitudinal trends of rape reports, the sample for the content analysis was drawn from 1990 to 2007. Four newspapers, Chosun-Ilbo, Dongah-Ilbo, Jungang-Ilbo and Hankyoreh, which have been the most popular in terms of circulation and ad revenues, were selected for this longitudinal content analysis. Using random stratified sampling and screening process, A total of 2160 articles were content analyzed for the main study. The results revealed that rape reports appearing in Korean newspapers were overwhelmingly dominated by episodic frame rather than thematic frame. Particularly, It was found that Korean rape reports generally have attributed the cause of rape crimes to the victims. Implications for results were discussed in terms of rape myth and ambivalent sexism theories.

  • 2023년 8월 3일 다중이용시설과 운송시설이 맞닿아 있는 서현역 부근의 다중이 밀집한 장소에서 차량돌진 및 흉기난동의 묻지마 범죄가 발생하였다. 차량을 인도로 몰아 보행자를 들이받은 뒤 백화점 내부로 들어가 흉기를 휘둘러 차량돌진으로 5명, 흉기난동으로 9명의 피해자가 발생하였다(리차드김, 2023). 서현역의 묻지마 범죄 이후, '살인예고 지도' 서비스의 등장하면서 많은 이용객이 상시 붐비는 번화가 및 백화점 등의 다중이용시설을 이용하는 시민들의 불안감이 전국적으로 크게 확산하고 있다(김잔디 & 최윤선, 2023). 급격히 늘어나는 국민의 불안감으로 정부에서는 '묻지마 범죄'를 '이상동기범죄'로 명명하고 근절을 위해, 사실상 테러와 비슷한 수준의 강력한 대책을 추진하고 있다(강은민, 2023). 이상동기범죄에 따른 강력한 대책으로 국무조정실(대테러센터), 경찰청 등 관계부처의 다중이용시설 대한 안전대책들이 강구되어지고 실정에서 「경비업법」에 따라 시설의 위험발생을 방지하는 업무를 담당하고 있는 민간 경비원에게 이용객의 안전을 보호하고 피해를 최소화하기 위한 일선 역할이 중요해졌다. 하지만, 이상동기범죄에 대한 일선의 초동대응이 인력과 장비, 정당방위에 대한 법제도의 뒷받침 미흡 등으로 인해 민간 경비원의 실질적인 대응이 어려운 실정이다. 많은 사람의 왕래가 있는 다중이용시설에서의 민간 경비원 최소 경력배치 기준, 현행범 제압을 위한 무기사용 기준, 이용객 보호를 위한 경비원 위력 사용 기준 등의 제도적으로 마련되어 있지 않아 민간 경비원이 범죄로부터 시설 이용객을 보호하는 것은 쉽지 않은 것이 현실이다. 따라서 본 연구에서는 다중이용시설 묻지마 범죄 등의 위험성과 민간 경비원의 무기사용과 관련한 법제도적 한계점을 고찰하여, 이에 대한 개선방안을 제시하고자 한다.
