Content Regulation: Meeting the Regulatory Challenge in the Age of Media Convergence (미디어 융합시대 콘텐츠 규제방안과 과제 - 심의제도를 중심으로 -)

  • This study takes a critical perspective that current vertical regulatory framework for broadcasting, telecommunications, films and games cannot cope with media development in the age of convergence. Changes in media environment mitigate the uniqueness of terrestrial television causing doubts as to why television contents should be treated more strictly than the rest of media contents. Consensus is being reached that horizontal regulation would be the appropriate regulatory measure for media contents. However, which content should be aligned to what level of regulations have not been fully dealt with. The paper shows that the current regulatory framework which is established according to each delivery platform is no longer valid in convergent media environment. It shows why all content regulation should be applied in platform neutral manner. Then it also suggests both short and long term regulatory changes that need to be made in order to meet the future challenges in media convergence era.

Effects of Regulation against Unlicensed Contents Sharing on the Contents Producers' Profit (불법복제에 대한 규제가 콘텐츠 제작자의 수익에 미치는 영향)

  • As software producers have tried to keep their profit against illegal piracy, contents producers also want to protect their contents from unlawful sharing among users. Some researchers uncovered that the regulation on the unlicensed contents is not the best policy to maximize their profit mainly due to network effect but this issue has been still controversial. In this paper, we develop a model to investigate the effect of regulation against unlicensed contents sharing on the profit of contents producers and present the optimal condition to maximize profit of contents producers under the regulation and non-regulation of unlicensed contents. As a result, we analyzed that the firm's payoff under the regulation on unlicensed contents is not always greater than the payoff under the non-regulation because of network externality. If the additional utility from off-line purchase of type P consumers (who enjoy the additional benefit of off-line purchase) is large enough, then the firm's payoff is maximized without regulation.

VR 규제의 현황과 개선 방향 - VR 콘텐츠 규제를 중심으로 -

  • VR 기술 및 활용에 대한 다양한 연구와 장밋빛 전망에도 불구하고, 현재 우리 법 제도는 VR 산업 활성화의 걸림돌이 되는 규제들을 완전히 제거하지 못한 상태이다. 특히, 의료 및 게임 분야에서 VR 콘텐츠의 특수성을 고려한 맞춤형 규제설계가 필요하다. 먼저, 현행 규제상 의료용 VR 콘텐츠 및 소프트웨어는 의료기기 수입 제조허가와 신의료기술평가를 모두 거쳐야 하는데, 특히 신의료기술평가의 경우에는 의료용 VR 콘텐츠 및 소프트웨어에 대한 대비가 충분하지 않아 이의 활용에 상당한 장애가 될 수 있다. 그러므로 정부가 가이드라인 등 적절한 해석기준을 통해 의료기기의 범위를 불필요하게 확대하지 않도록 하고, 아울러 신의료기술평가에 있어 '선 진입, 후 평가' 제도를 활용할 수 있도록 개선이 요구된다. 다음으로, 게임의 경우에는 현행 게임산업법상 게임물의 정의가 너무 광범위하여 양방향성이 있는 VR 콘텐츠들이 게임물로 분류되어 불필요한 규제를 받을 가능성이 있으며, 여기에 더하여 최근 세계보건기구에서 '게임 이용 장애'를 국제질병분류에 포함시킴으로써 추가 규제에 대한 우려까지 더해지고 있다. 이러한 문제점을 해결하기 위해서는 법제처가 최근 발표한 "적극행정 법제 가이드라인"의 취지에 맞게 정부가 게임물 규제의 범위를 적극적으로 축소 해석하거나, 이러한 규제의 예외를 정하는 고시 또는 가이드라인을 제정할 필요가 있다. 또한, 현재 시행 중인 'ICT 규제 샌드박스' 제도를 잘 활용하고, 이와 별도로 국제질병분류의 국내 수용에 대해서도 보다 신중하게 접근할 필요가 있을 것이다.

A Case Study for IPTV Regulation Trends (해외의 IPTV 규제동향)

  • IPTV는 IP를 기반으로 한 초고속인터넷을 기반으로 제공되는 미디어 서비스로서, 국내에 널리 확산된 초고속인터넷을 기반하여 급속도로 확산되고 있는 추세에 있다. 특히, 국내에 IPTV서비스가 본격적으로 상용서비스를 제공한지 3년이라는 시간이 경과하면서, 2012년 8월 500만 가입자를 돌파하여 국내의 주요 방송미디어 매체로 등극하였다. 하지만 IPTV는 도입초기부터 많은 법규제 논란이 제기되어 기존의 방송법이 아닌 인터넷멀티미디어방송사업법(이하 IPTV법)을 별도로 제정하여 IPTV를 규제하고 있다. 이는 IPTV가 기존의 방송과는 달리 VOD 및 양방향서비스 등과 같은 비선형 서비스 및 부가서비스 제공이 가능하기 때문에 기존법으로는 규제가 어렵기 때문이다. 해외의 경우에는 IPTV에 대해서 정도의 차이는 있지만 기존 방송의 규제틀안에서 차별화를 하는 방향으로 규제가 이루어지고 있다. 유럽은 EU의 '국경없는 TV지침(TWFD)이 확대 개정된 시청각 미디어지침(AVMSD)을 근간으로 규제를 하고 있는데, 이 지침에 따라 EU 역내국가들은 방송미디어서비스를 선형서비스와 비선형서비스로 구분하고 있다. 기존 방송이 해당되는 선형서비스에 대해서는 강한 규제를, VOD와 같은 비선형 서비스에 대해서는 약한 규제를 적용하고 있다. 미국은 IPTV를 다채널 유료방송시장(MVPD)의 일종으로 구분하고 케이블방송과는 별개의 서비스로 구분하고 있으며, 주 단위의 IPTV 면허를 필요로 한다. 따라서 IPTV는 위성방송이나 케이블방송과 같이 콘텐츠 규제를 받게된다. 캐나다는 규제당국인 CTRC가 공공방송, 사적방송, 공동체 섹터로 구분하여 면호규제를 시행하며, 콘텐츠 규제는 CTRC와 업계의 자율규제를 통해 시행하고 있는데, IPTV와 같은 뉴미디어에 대해서는 규제의 예외를 인정하고 있다.

The Study on the Difference of Regulation Recognition among Generations (연령별 규제 인식 차이에 관한 연구)

  • The difference of generation is the main cause of society transition. If we know about the gap of generations, then we know where we go in future. This study focus on the differences of a regulation recognition among the generations. When we understand the differences of regulation recognition among the generations, we can realize the trait of regulation in society. In result, there are a lot of differences of regulation recognition among the generations. The older they are, the more they are positive to regulation. And the younger they are, the more they are negative to regulation. In particular, 50's generation have the opposite regulation recognition to 20's generation in specialty of regulation and in a conglomerate regulation.

Direction of Laws and Policies for the Regulation of Internet Personal Broadcasting (국내외 인터넷 개인방송 규제현황 및 규제 방향성 제언)

  • This study aims to analyze the social and legal status of Internet personal broadcasting in Korea and propose the direction of personal broadcasting regulation based on overseas regulatory laws and the media characteristics of Internet broadcasting. The influence of Internet personal broadcasting has increasing, and social and legal problems such as pornography and fake news have also growing. In the absence of legal regulations on personal broadcasting on the Internet, academia is also discussing relevant legislation and policies at a general level of analysis. In addition, the current study argues that new legislative research is needed to respond to the rapidly changing media environment and to cope with the newly introduced Internet broadcasting content and platforms. The findings suggest that freedom of expression is a significant value, yet obscene materials for minors should be thoroughly regulated, and that internet personal broadcasting should be regulated to the minimum extent through self-regulation guidelines through cooperation between councils and related agencies or businesses. The significance of the current study indicates that it proposed the practical and concrete laws for the improvement of the quality of Internet personal broadcasting content, the establishment of new broadcasting policies for fair and diverse content development, and the efficient and fair regulation of personal broadcasting content.

Criticizing the Market Concentration Regulation in Open Media Environment (개방형 콘텐츠 유통환경에서 시장집중 규제에 대한 비판적 고찰)

  • Government has strictly regulated the concentration of the media market because the number of broadcasters was traditionally limited and they had significant influence on public. However as the media market converges with Internet's open architecture, scarcity and pervasiveness are losing their roles in justifying media regulation. This article examines market convergence and its impact on market concentration, and criticizes the current concentration regulation. The study indicates that market performance are much governed by firm's competitive actions than market structure, and that vertical integration contributes to service innovations, and that horizontal concentration makes it difficult to measure due to its even-changing market definition. Therefore, the regulation for market concentration should shift its focus from firm's market share to broadcaster's unfair acts driving market inefficiency and hurting content diversity.

  • In South Korea, regulations on gambling have been implemented since the beginning of the Game Rating Board, and they have been improved, newly enacted or deleted according to the current game industry. For instance, regulations on arcade games include that no more than 10,000 KRW can be input per hour, automated operation is prohibited, results cannot be saved, money exchange is prohibited, etc. The study aimed to relieve excessive regulations on gambling arcade games in South Korea such as unnecessary regulations and duplicate regulations in a practical way. It is therefore expected to contribute to implementing regulation plans for gambling games suitable for the level of consciousness of the South Korean people.

  • There are a lot of articles about government trust, but there are very few researches about regulation trust. So, this study analyzes the influence factors on regulation trust, specially focuses on the mediated effect of government trust. This study surveys on 1,000 people, and the result shows that the influence factors on regulation trust are a academic ability, the benefit of regulation, the specialty of regulation, the fairness of regulation, and necessity of government. And there are the mediated effect of government trust on regulation trust. Therefore, if the government want to increase the execution and accommodation of regulation, then it is necessary to get the regulation trust. And to get the regulation trust, it is necessary to increase the government trust besides the specialty and the fairness of regulation.

  • Party is the main factor in modern country. Therefore, there are a lot of articles about the difference of public policies and citizen's recognition according to their supported party. However, there is few research about the regulation recognition according to citizen's supported party. This study focuses on the differences of a regulation recognition according to citizen's supported party. In result, there are a lot of differences of regulation recognition according to citizen's supported party. The people who support Saenuri Party have a positive recognition about a necessity of regulation, a fairness of regulation, a reliability of a regulation. But the people who don't support Saenuri Party have a negative recognition about those. In Korea, government regulations have a lot of relationship with a party and politics.
