Singham이 발표한 자료와 참석자들의 토의내용을 발표 이후 정리, 이를 요약문 형식으로 번역(의역)한 것이다. 이 글의 주요 논지는 경쟁당국의 지식재산권에 대한 전통적 관점에 대한 재고찰로서, 필자는 "지식재산권 보호가 반드시 경쟁정책에 반하는 것은 아니고, 오히려 지식재산권 보호가 경쟁을 촉진하는 효과를 가진다"는 점을 강조하고 있다. 저자는 자신의 논지를 설명하면서 의약산업의 예시를 상당부분 들고 있다. 이 글 중에는 국내 사정과 정서에 일부 부합하지 않는 내용도 있을 수 있지만, 국내외 경쟁정책에 대한 다양한 관점을 경험할 수 있다는 점에서 의미가 있다고 생각한다.

Changes of Export Structure and Crowding-out Effects of China on Korean and Japanese Exports in Southeast Asia: Analysis by Production Phase (동남아에 대한 한·중·일의 생산공정별 수출구조와 경쟁관계: 중국의 한·일수출 구축효과를 중심으로)

  • One of main findings of the competitiveness relation is rapid increase of Chinese influence on the southeast Asian market. While Japanese market share is decreasing, Chinese market share is continuously increasing in the market. It is the same regardless of types of production phases. Analysis based on gravity model shows that in general Chinese exports is crowding out Korean and Japanese export to the market. The magnitude of the effects on Korean exports is larger than on Japanese exports. Also, It is found that the directions of the effect of Chinese exports on Korean and Japanese exports are different by production phrases. For all processed goods, increase of Chinese exports decreases both Korean and Japanese exports to the market. However, for some final goods such as transport equipment and food & beverages for household, Chinese exports is increasing Korean and Japanese exports to the market.

A Study on Ensuring Biosafety of Biotechnology Product under Debate about Trade and the Environment (DDA 무역-환경 논의와 생명공학제품의 안전성 확보)

  • This paper analyze problems about scope of specific trade obligations(STOs), principle of dispute settlement procedure, and non-parties in context of the Cartagena Protocol on Biosafety(POB), which based on sub-paragraph 31(i) of DDA WTO Ministrial Declaration. The implications based on result of this study are as follows. First, to accept the wider scope of STOs under POB in Korea, importing country, won't be harmful to LMOs and Bioindustry. Instead, it will ensure a high level of biosafety concerning the import of LMOs. Exporters can take different kinds of trade measures to countervail adverse effect on the export of LMOs in this case. Therefore importer will endure the aftereffect. However, if korea were in exporter's place, to accept the wider scope STOs under POB will not have a good influence on the export of LMOs. Korea, therefore, should devise scheme for responding to debate about the STOs in MEAs, which have to be based on cost-benefit analysis and scenarios taking into account of speed and level in biotechology progress, status and trend of LMOs R&D and production, and condition of other industries. Second, it is not easy to agree with applying to what's rule between the POB and WTO for settlement dispute. Because there is the incompatibility between the POB characterized according to social rationality and WTO's rules for safety and environmental protection characterized according to scientific rationality. This issue have to be discussed for long period due to gap like that. Accordingly Korea, one of major LMOs importing countries, should suggest continuously that the effort is needed to ensure an adequate level of protection in transboundary movements of LMOs and scientific, environmental and socio-economic study. Third, in case of dispute between party and non-party of the POB, the duties under the WTO of non-party of the POB(if WTO member country) is valid. The country, therefore, will try to settle dispute based on WTO's rules. However, international society have to ensure for sound and safe use of LMOs in the field of transboundary movements. Accordingly Korea should devise scheme for preventing the possibility of dispute between party and non-party of the POB(if WTO member country), which is supported by policy options under the POB.

Collaboration for Carbon Market of Three Countries: KOREA, JAPAN and CHINA (한·중·일 탄소시장 협력 방안)

  • In global, there is an active movement to reduce the green house gas. Allowance and carbon tax are the one of effective alternatives to mitigate green gas effect. In addition, the clean development machinism(CDM) can be applied between the ANNEX 1 and developing countries. It could be an one good solution to reduce the GHG. In the Northern Asia, the CDM can be the one of the possible solution to reduce the GHG because the Japan has a responsibility to reduce GHG and the China and Korea have a room to supply CDM credit. It is suffice to say that if these three countries decide to collaborate, the new international carbon market can be established that can be the similar form of EU-ETS. It is clear that few barriers must be removed to launched such new form of carbon market. Protection of domestic technology, excessive financial request of business opportunities by CDM, and irrational needs of carbon credit that created by CDM, listed constraints define as an one single word, the national selfishness. Once it is cleared, there is high possibility that the Northern Asia CDM trading system can be launched.

Study on sea fog detection near Korea peninsula by using GMS-5 Satellite Data (GMS-5 위성자료를 이용한 한반도 주변 해무탐지 연구)

  • Sea fog/stratus is very difficult to detect because of the characteristics of air-sea interaction and locality ,and the scantiness of the observed data from the oceans such as ships or ocean buoys. The aim of our study develops new algorism for sea fog detection by using Geostational Meteorological Satellite-5(GMS-5) and suggests the technics of its continuous detection. In this study, atmospheric synoptic patterns on sea fog day of May, 1999 are classified; cold air advection type(OOUTC, May 10, 1999) and warm air advection type(OOUTC, May 12, 1999), respectively, and we collected two case days in order to analyze variations of water vapor at Osan observation station during May 9-10, 1999.So as to detect daytime sea fog/stratus(OOUTC, May 10, 1999), composite image, visible accumulated histogram method and surface albedo method are used. The characteristic value during day showed A(min) .20% and DA < 10% when visible accumulated histogram method was applied. And the sea fog region which is detected is similar in composite image analysis and surface albedo method. Inland observation which visibility and relative humidity is beneath 1Km and 80%, respectively, at OOUTC, May 10,1999; Poryoung for visble accumulated histogram method and Poryoung, Mokp'o and Kangnung for surface albedo method. In case of nighttime sea fog(18UTC, May 10, 1999), IR accumulated histogram method and Maximum brightness temperature method are used, respectively. Maxium brightness temperature method dectected sea fog better than IR accumulated histogram method with the charateristic value that is T_max < T_max_trs, and then T_max is beneath 700hPa temperature of GDAPS(Global Data Assimilation and Prediction System). Sea fog region which is detected by Maxium brighness temperature method was similar to the result of National Oceanic and Atmosheric Administratio/Advanced Very High Resolution Radiometer (NOAA/AVHRR) DCD(Dual Channel Difference), but usually visibility and relative humidity are not agreed well in inland.

A Comparative Study of the Efficiency among Korea, Chinese, and Japanese Ports (한·중·일 항만효율성 비교연구)

  • The aim of this study is to analyze the efficiency of major ports in Northeast Asia such as Korea, China and Japan. For the empirical analysis, we tried to apply the data envelopment analysis (DEA), which is an efficiency evaluation model based on mathematical programming theory, and we also established a model to Northeast Asian ports. In our opinion, DEA analysis which involves multiple inputs as well as multiple outputs in its efficiency valuation makes analysis more suitable for port efficiency measurement because ports produce a number of different outputs. In this paper, we attempted to analyze the relative efficiency of 27 ports (5 Korean ports, 13 Chinese ports, 9 Japanese ports) through DEA-CCR, DEA-BCC models. According to the result, Chinese ports are relatively efficient than Korean and Japanese ports. The result of the analysis shows that 7 Chinese ports are efficient in DEA-CCR model in 2009, but in DEA-BCC model 8 Chinese ports and 1 Koran port are efficient. Most of inefficient ports have a value closed to 1 in efficiency for scale, it means that the reason of inefficiency is caused from the technical aspect. Furthermore, we also verified that there exists excess of input in Korean and Japanese ports than Chinese ports.

Considerations for the 2009 Montreal Two New Air Law Conventions (Unlawful Interference and General Risk Conventions) by ICAO (국제민간항공기구에 의한 2009년 몬트리올 2개의 새로운 항공법조약 (불법방해 및 일반위험조약)에 대한 고찰)

  • 오늘날 항공기사고는 우리나라뿐만 아니라 세계도처에서 때때로 발생되고 있다. 특히 항공기에 대한 갑작스러운 테로 공격 또는 일반 항공사고에 기인된 항공기의 추락 및 물건의 낙하로 인하여 지상에 있는 제3자에게 손해를 입히는 경우가 간혹 발생되고 있다. 이와 같은 항공사건에 있어 가해자(항공기 운항자)는 피해자(지상 제3자 등)에 대하여 불법행위책임을 부담하게 되는데 이러한 사건들을 해결하기 위하여 1952년의 개정로마조약과 1978년의 몬트리올의정서 등이 있음으로 본 논문에서는 이들 조약의 성립경위 및 주요내용과 개정이유 등을 간략하게 설명하였다. 특히 2001년 9월 11일에 뉴욕에서 발생된 이른바 항공기 납치에 의한 동시다발 테러 사건의 피해는 4대의 항공기에 탑승한 승객 및 승무원 266명이 전원 사망하였고 워싱턴에 있는 미국 방성청사에서의 사망 및 실종이 125명, 세계무역센터에서의 사망 및 실종이 약5,000여명에 달하는 막대한 피해가 발생되었다. 9/11참사사건은 지상에 있는 제3자의 인적 및 물적 손해가 거액에 달하였음으로 이에 따라 영국의 로이드보험 등 세계보험업계가 크게 손실을 입게 되어 항공보험을 기피하는 현상이 생겨나 법적인 문제점이 제기되었다. 국제민간항공기구(ICAO)에서는 9/11사태 이후 이와 같은 테로 사건의 법적대응책과 자구책을 마련하기 위하여 약 8년간의 심의 끝에 항공기에 대한 테로 공격(불법방해 행위)과 1952년 개정로마조약의 현대화(일반위험) 등 새로운 2개 조약을 2009년 5월 2일에 성립시켜 공표하였다. 상기 새로운 2개의 조약 중 첫째 조약은 항공기의 불법방해 행위에 기인된 제3자에 대한 손해 배상에 관한 조약(Convention on Compensation for Damage to Third Parties, Resulting from Acts of Unlawful Interference Involving Aircraft: 일명 불법방해조약이라고 호칭함: Unlawful Interference Convention)이고 둘째 조약은 항공기에 기인된 제3자에 대한 손해배상에 관한조약 (Convention on Compensation for Damage Caused by Aircraft to Third Parties: 일명 일반위험 조약이라고 호칭함: General Risk Convention) 이다. 본 논문에서는 이 새로운 2개 조약에 대한 ICAO가 주관한 성립경위와 주요 내용 및 필자의 논평을 제시하였고 이들 조약에 대하여 한국의 조속한 비준을 촉구하는 바이다.

An Analysis of the Impact to Korea-China FTA Negotiation from China-Taiwan ECFA (중.대만 ECFA 체결이 한.중 FTA 협상에 미칠 영향에 관한 연구)

  • Currently, the most common form of regional economic integration is FTA (Free Trade Area), which is formed by two countries or more as either a bilateral or multilateral agreement. A proposed FTA between Korea and China recently has been re-focused after China concluded its ECFA (Economic Cooperation Framework Agreement) with Taiwan in June 2010. By May 2010, China was the No.1 export partner to Korea (as a Chinese No.2 import partner). Also, Korea and Taiwan trade structure to China is similar and competitive at the same time. So, China-Taiwan ECFA has a significant effect on the trade between China and Korea. As a result, it will hurt Korean industrial production and trade with China. Therefore, the progress and expected issue of a FT A between Korea and China which is prompting will be analyzed. In this situation, the final purpose of this paper is to analyze the impact on a Korea-China FTA Negotiation from the China-Taiwan ECFA.

Proficiency testing of cadmium and lead in polypropylene resin (폴리프로필렌 수지 중 카드뮴과 납 측정 숙련도시험)

  • The various environmental regulation directives such as RoHS (restriction of hazardous substances in electrical and electronic products) and WEEE (waste from electrical and electronic equipments) are practically used as the technical barrier in international trade (TBT) of vehicles and electrical and electronic products recently. Regarding such an environmental regulation, Korea Research Institute of Standards Science (KRISS) organized a proficiency testing scheme to establish the reliability of measurement results produced by the relevant research institutes and test laboratories in Korea. Participants were 31 laboratories related to production of the electrical and electronic equipments and mobile vehicles. Two polypropylene samples of pellet type were employed as the proficiency testing materials (PTMs). Cadmium and lead were the analytes chosen among six components regulated in European Union (EU) RoHS directive. The PTMs were sent to the participants by post on September $1^{st}$ 2006, and deadline for results submission were October $10^{th}$ 2006. The results of each laboratory were evaluated in comparison with KRISS reference values using Robustic Z-score and Youden plot methods. The results of the various sample digestion methods were also compared. Most of participants reported good agreement within 10 % range of reference values. However, results from several laboratories showed significant biases from reference values. These laboratories should establish the quality assurance system for improvement of the measurement reliability.

A Study on the Alternative Establishment of Global Terminal Operator(GTO) and Improvement of Legal System (글로벌 터미널 운영사(GTO) 설립의 대안설정 및 관련 법 제도의 개선방안에 관한 연구)

  • The global container terminal market is predicted to see continued future volume growth. According to Drewry, global container shipments rose by 6.3% year-on-year to 750 billion twenty-foot equivalent units (TEUs) in 2017 and are forecast to experience continued growth to 9.3 billion TEUs in 2022. According to IHS Markit, the global terminal operator (GTO) market is forecast to grow more than 10% annually, up from $2.4 billion in 2017, to exceed $3 billion by 2022. However, Hyundai Merchant Marine is the only real GTO in Korea. In particular, the shipping and port markets are facing drastic changes, both at home and abroad, including a slowdown in the growth of domestic export and import shipments, environmental changes in the container market caused by the trade frictions between the US and China, and increased changes in container shipments caused by the trade frictions between Korea and Japan. In this study, we propose ways for domestic companies to participate in the continuously growing GTO market. After analyzing the current status of the global GTO market, the government expressed a desire to explore ways to establish GTOs through the Port Authority and the Korea Ocean Business Corporation. Therefore, four types of establishment plans were proposed, along with a legal framework for the establishment of GTOs.
