A Study on the Korean National Police's Protesting Policing Policy through the Analysis of Negotiated Management Model (협의관리모델 분석을 통한 한국 경찰의 집회시위 관리정책 연구)

  • In Western Europo and the US, there has been a general trend over 30 years of reducing the amount of force by the police, through a paradigm shift from 'Escalated Force Model' towards 'Negotiated Management Model'. In tune with this trend, for example, the Swedish Police have implemented the uniformed 'Dialogue Police' system, in order to establish communication contact with demonstrators, before, during, and after their events, The Negotiated Management Model involves a greater respect for the rights of protesters, a more tolerant approach to community, and improved intelligence, communication, and flexibility, in order to facilitate lawful protests and to reduce the possibility of an escalation of major public disorder. The Korean National Police (KNP) appears to be operated within this negotiated management framework, since in preparation for the G20 Seoul Summit, they have also emphasized good communication between the police and protest groups, by newly creating the concept of 'Protest Policing Through Facilitation of Lawful Protests'. In this context, this study first attempts to analyze not only the negotiated management model, but also the Swedish dialogue police. Secondly, the study conducts a comparative study between the KNP's Protest Policing Through Facilitation of Lawful Protest and the Swedish dialogue police system, particularly, in conjunction with the negotiated management. Although Korean and western police have different system and history, protest policing model is now approaching with each other through a link between conflict resolution techniques, such as dialogue, negotiation, mediation and facilitation. Finally, the study is to prove if the KNP's protest policing model corresponds with the negotiated management model, and further to suggest new 'Facilitation of Conflict Resolution Model' as a desirable future of the KNP's protest policing.

  • The existing legal regulations that indiscriminately distributed various illegal information on the information network are discussing focused on civil liability and criminal liability. however, at this paper that approached with problem of police responsibility as a target of the exert of police authority for blocking illegal information on the information network. based on this recognition, this paper propose the problem and reformation about the present Information Communication Networks law's 7 of Article 44, Section 2 that for prompt blocking illegal information on the information network, not about direct regulatory approach to a person in charge of act but about the information network service provider which is a person in charge of condition.

메타버스 범죄 동향 및 디지털 포렌식 대응 방안

  • 메타버스 플랫폼에 대한 관심 및 사용량의 증가에 따라 기존 사이버 범죄 유형인 정보통신망 침해 범죄, 정보통신망 이용 범죄, 불법 콘텐츠 범죄와 더불어 아바타에 대한 강간, 강제추행, 공연음란, 스토킹 등 새로운 유형의 범죄가 발생하고 있다. 이에 형사법적 관점에서의 대응 방안과 기술적 관점에서의 디지털 포렌식 연구가 시작되고 있다. 사용자의 몰입감을 증대하여 가상 환경이 현실이라고 느낄 정도의 실감 기술을 제공하는 메타버스의 특성으로 인해 메타버스 플랫폼에 대한 포렌식 분석은 기존의 전통적인 포렌식 연구와는 다른 접근이 요구된다. 이에 본 논문에서는 메타버스 범죄 사례들을 살펴보고 이에 대응하기 위한 연구 동향을 파악해 보았다. 또한 메타버스에 대한 포렌식 분석 시 기존 디지털 포렌식과는 다른 관점에서 접근해야 할 사항들을 정리하였다.

  • 안티 포렌식 기술은 정보보안에는 효과적이지만 해당 기술을 악용하여 증거를 은닉하거나 증거 인멸에 사용할 경우 이로 인해 수사에 걸리는 시간이 길어지거나 수사관이 중요한 증거를 찾기 힘들게 만든다는 점에서 디지털 포렌식 수사에 악영향을 주는 요인으로 작용할 수 있다. 또한 우리나라의 경우 선별압수를 원칙으로 하지만 안티 포렌식 흔적이 발견될경우 전체압수가 가능해지기 때문에 수사관이 하드웨어 내에서 안티 포렌식 활동이 이루어졌는지 여부를 파악하는 것이중요하다. 따라서 본 연구에서는 안티 포렌식 중 File wiping 도구의 실행이 Windows 아티팩트에 남기게 되는 흔적을 분석하고 본 연구를 확장시켜 향후 연구의 방향성과 수사관들이 File wiping 도구의 실행 흔적을 손쉽게 파악할 수 있도록 할 수 있는 방안을 모색해보고자 한다.

  • This research verified that how citizen feel about police protection for the mass rally and how they trust about police and private security. Mass rally is lots of people gathering therefore, each of member could feel fear for their safe. And that kind fear has effect on success of rally Therefore we researched that security level by police and private security and the result is that most of people think that the charge of security is police and they think police member need to be more for their security. And police should be involved for the rally security. But they don't think for the private security.

A Study on the Current State and Improvement Plans for the Information Disclosure System of Metropolitan Police Agencies : Focusing on Busan Metropolitan Police Agency (지방경찰청의 정보공개제도 운영 현황 및 개선 방안 연구 부산지방경찰청을 중심으로)

  • The aim of this study was to investigate the current state of operation of information disclosure system in Busan Metropolitan Police Agency and to suggest recommendations for improvement. To achieve this goal, this study quantitatively analyzed the data on information disclosure claims (2010~2020.6), appeal cases (2010~2020.6), the disclosure rate of original documents (2014~2019) and so on. Furthermore, it examined how and how much information is announced in advance through the agency's homepage and the information disclosure portal site. Results show that the agency has various problems regarding information disclosure including the high rate of transferring information to other institutions, the low disclosure rate of original documents, the high rate of information released publicly only after an administrative appeal, a small number of information announced in advance, and a not user-friendly website. To solve these problems, this study proposes providing accurate information about the scope of information the agency and other related institutions own, expanding the disclosure of original documents, discovering more information to announce in advance, and enhancing the usability of the website.

Information and Communications Technology in the Field of Public Security: Crime Prevention and Response System (치안분야의 정보통신기술 활용방안 연구 - 빅데이터기반 치안수요분석과 대응체계를 중심으로 -)

  • Rapid advances in information and communications technology are new challenges and also opportunities for the police. For the purpose of identifying its implications, this study reviews utilization cases of information and communications technology in the field of public security in South Korea and other countries. As theoretical basis for utilization of information and communications technology, this study introduces intelligence-led policing, predictive policing and evidence-based policing. Also, utilization of big-data based crime analysis and crime prediction technology, as well as advancement of information and communications system and command and control technology of the police, are discussed. Based on the identified implications in this study, the following proposals are made. They are (1) procuring basic data, (2) creating an integrated database, (3) increasing utilization of policy decision-makers, (4) exchange and cooperation between related institutions, (5) training professional analyzers, (6) establishing legal basis and practical guidelines for an integrated database.

  • '21년 전국 20개 해상교통관제센터의 선박통항량, 교신량, 관제정보 제공 등 VTS 운영실적 분석 및 사고현황, 원인 분석을 통한 관제서비스 개선방안을 제시하고자 한다. 또한 해양사고 예방기능 강화를 위해 관제사 경험·직관에 의한 관제에서 빅데이터·인공지능(AI) 기반 첨단관제로의 전환, VTS 운영성과에 대한 공신력 확보 및 첨단관제 기술개발에 활용 등을 위한 VTS 통계관리체계 개산 방안에 대해서도 고찰해보았다.

  • The aim of this study is to discuss some of the prominent ideas which use drone for police works. Focusing on the extent of the utility and practicability of using drone in policing, this paper attempts to address both positive and negative aspects in conjunction with related statutes and regulations. This study uses a qualitative case study approach and offers three practical implications including: (1) enacting a law that covers using drones in policing, (2) hiring technical professionals or training police officers to prevent illegal drones and to implement a variety of policing strategies, and (3) collecting data and information on crime and criminals and then developing the best way to respond to these problems.

A Study on limit of Policeman's Exertion in Police Questioning (불심검문시 경찰관의 유형력행사의 한계)

  • Police questioning is police measure for acquiring information or inquiring an identification without questionee's will in order to accomplish the goal under the Police Act. However, like spear and shield, it has its own inherent limits between both sides of public power and human right and has stirred an hot issue in our society for longtime. The core problem is whether policeman can force a questionee stop when the questionee refuses policeman's stop requirement, the first step for police questioning. Some opinions argue that police questioning has somewhat effects on crime prevention and suspect arrest but people still have inconvenience and refusal from experiences of reckless police questioning in the past. Because of this, the police needs to recover people's trust on police questioning. In order to do so, in case of police questioning, human right should be superior to crime prevention or suspect arrest. This is the time's call. So when there is a police questioning, policeman's exertion of it on the questionee who refuse it should be conducted under strict conditions.
