Along with the increased use of e-journal since mid of 1990's, there has been a sharp increase of license contracting in the library. However the librarians who have no enough knowledge nor technology to handle the licensing are experiencing difficulties in the process. The study intended to help them understand the practical problems of license contracting between library and vendors, and proposed guidelines for developing model license for e-journal based on the licensing principles of IFLA and ALA.

Due to hardware resource limit and system incompatibility of the mobile device, and low bandwidth of wireless communication, there are a few difficulties in introducing the digital contract system based on wired communication to M-Commerce. To get over the difficulties, this paper defines a digital contract based upon XML and then addresses the design and implementation of M-XContract, a digital contract system for the mobile environment. M-XContract system has been constructed with the digital contract server, M-ESign module which contracts with the customer on the PDA and transfers the contract digitally signed to the server, M-EDecoder module which shows the contract to the customer from the server, and X-Auth which is a contract authoring tool. To evaluate the run-time performance of the M-XContract, we measured the digital signature generation time and transfer time to the server. The evaluation results show that the M-Xcontract is an efficient model for the mobile contract system.

The Electronic contract means creation sign management and storage of contract by online without limitations of the time and space through the electronic signature and encode which based on the Certificate instead of the past that treatment the contract such as creation sign management and storage of contract by face-to-face. Recently, the remarkable development of information and communication technology with supplying the high-speed Internet services. Accordingly, the transaction contract made by these also, the steady legal effect occurred by two or more parties by legal action which is the electronic agreement of expression. and it makes agreement improving corporate productivity and it can control the whole process such as contract documents and the actual buying store provision. Like this it has many benefits so, it suddenly rising as the new axis of economic activity area, it is a reality. In this change of era, with the establishment of electronic contracts, there are many problems are occurred to the expression of parties which is core of the contract on civil code so, the systematic legal composition is required. Thus, in this study will propose the reasonable improvements about the issue of electronic contract through the consideration.

인터넷은 단순히 통신수단의 변화에 그치지 않고 문화 사회 정치의 각 방면에서 커다란 변혁을 불러일으키고 있으며, 물품매매계약이 전자적으로 이루어지는 경우 전자상거래계약의 성립시기, 방식 및 전자문서의 효력, 준거법(applicable law, governing law), 재판관할(jurisdiction)등에 관하여 복잡 다양한 문제점들을 야기하게 된다. 전자상거래 계약상에서 청약의 기준에 관해서는 매도인의 행위를 청약으로 보는 것이 다수설이다. 따라서 매수인이 선돼한 상품에 대하여 구입의사를 표시, 즉 승낙하면 바로 전자상거래 계약이 성립한다고 할 수 있다. 그리고 인터넷을 이용한 전자상거래의 경우에는 국경을 초월하여 세계의 모든 소비자들을 그 대상으로 함으로써 준거법의 문제와 재판관할권의 문제가 상당히 중요한 문제로 부각되고 있는 바, 준거법의 결정은 일반적으로 당사자의 자유로운 의사에 따라 결정된다. 재판관할권에 대해서는 재판관할에 대한 합의가 있는 경우에 우려 나라는 이를 유효한 것으로 인정하고 있으나, 일반 소비자들을 대상으로 하고 있는 전자상거래의 특성을 고려할 때 이는 다소 무리가 따른다고 생각된다. 또한 재판관할에 대한 합의가 없는 경우에는 피고의 주소지국이 재판관할권을 부여받는바, 격지자간의 소액거래에서는 그 실익을 기대할 수 없는 것이 현실이다.

This study aims to check whether e-book purchase contracts have sufficient requirements to serve as legal basis for e-book lending outside the library, and also to understand the current status and characteristics of the library's e-book purchase contracts. To this end, the legal and technical environment related to e-book lending was reviewed, and the elements that must be included in the license contract were summarized as the legal basis for e-book lending. Based on this, it was analyzed whether these requirements were properly reflected in actual contract cases. For three years from 2020 to 2022, the actual 43 contracts that were bid through the Korea On-line E-Procurement System were inspected, and then problems were pointed out, and improvement measures were proposed.

1990년대 중반부터 전자 자료의 이용 증가와 더불어 라이선스 계약이 증가하였으나 국내의 경우에는 저작권 및 계약에 관한 기초적인 지식과 협상 기술이 부족한 도서관 사서들이 라이선스 계약시에 지침으로 삼을 수 있는 자료가 아직 전무한 실정이다. 이에 본 연구에서는 라이선스의 기반이 되는 계약과 저작권과의 관계를 정립하고, 문헌조사와 설문지조사, 국내외의 사례 분석 조사 결과를 바탕으로 도서관 사서의 라이선스 계약에 지침이 될 수 있는 라이선스 모델을 개발하고자 한다.

The multignature system is a digital contract system which can process multi-party contracts electronically. In this paper, we analyzed various insecure elements involved in general multisignature contract systems and suggest requirements needed for making such systems secure. Based on our analysis, we propose a new secure multisignature method and apply it to the conventional electronic digital contract systems along with several other existing multisignature methods. The applicability and the effectiveness of the newly developed method are demonstrated by comparing how well the suggested security requirements are satisfied by each method.
