The Issues of Digital Copying and Application of Fair Use in the Network Environment (네트워크 환경에서의 디지털복제와 공정사용 법리 적용의 문제점)

  • The digital copying and digital transmission are rapidily Increasing with the innovation of information technology and the development of networking technology. But It Is Inevitable to limit copyright for the public benefit and cultural development In the digital environment in like manner with the analog environment. First, this study examinated the international trends and legulations relating to the copyright limitations In the U.S. and Japan for the fair use. Second, it dealed with the problems of the digital copying relating to the temporary storage In RAM and screen display that are recently becoming international issues. Third, it concretely explored and analyzed the problems according to the application of the fall use of the private copying, the library copying, and the copying for the purpose of school education in the network environment. In conclusion, to solve these problems that Is occurred from legulations In the analog environment Is needed the revision of the existing copyright law in Korea. Finally, this study suggested 'the copyright collecive management system' and 'the private copying levy system' as the systemic devices to control the digital private copying.

  • The purpose of the study is to analyze the judicial precedents of the copyright relating to advertising focusing on the photographic works and find the characteristics of the legal principles of the copyright infringement or no. As the results of the analyses of the exact 6 precedents, the creativity of the works was the main issue of the judgment of the copyright infringement or no, comparing that 'on the basis' and 'practical similarity' were mainly applied the judgment. It is implied that the photographic works depending on the technologies are more difficult to prove their creativity, and the simple photo of the product itself without or lack of the photographer's creative effort and labor is not acknowledged as a copyrighted work in advertising area.

  • In recently, thanks to the development of computer and internet, and reinforcement of digital media literacy of ordinary people, many users of comics and animations recombine contents into various ways, including UCCs. In a glance, it seems these outputs violates the copyrights of contents. But in reality, they helps the growth of the ecosystem of contents market, with increase of contents users. The reason of these reproductions inclines the characteristics of animation media. Animation, which are constituted by plastic symbols, auditory symbols, and narrative symbols, and Comic, which supports stories of Animations, affects as 'Imaginary signifier'. These signifiers helps users of contents to dismantle and reassemble stories. These aspects are seen in doujin culture, animation soundtrack fandom, and voice actor fandom. But In this article, we will concentrate into cosplay culture. Cosplay culture shows more active appearances than another fandoms. In especially, cosplay stage and daily cafe show more active reproductions of characters and communications. However, they are done by youth fans, which has not enough financial abilities: therefore, events are not sustainable and discontinued. And they have another limits, like lack of opportunity of performance. In the reality of Korean society, which needs of community making by community member, and hybrid culture, comics and animation productions in Korea are in need of access positively and encourage reproductions of active receivers of animations.

  • As technology advances, various applications linked to the music industry are becoming popular through new media. There have been many changes in the music market. Beyond the existing music market, where music copyright and performance rights were the center of the music business, we are unifying and operating communication channels that connect artists and fans, such as investment products derived from music copyrights. The technology that connects the fandom with additional business digital content has transformed into global platforms such as HYBE Entertainment's and YG Entertainment's Weverse, as well as SM Entertainment's Bubble. In addition, various national support projects to build a 5G MEC (MobileEdge Computing) environment to quickly respond to the rapidly changing 5G industry ecosystem are supporting for the immersive content demonstration, immersive content testing, and technical analysis, we are laying the groundwork to efficiently respond to the ever-expanding metaverse content market. Technology is changing dramatically. Therefore, we would like to study to changes in the music market brought about by technology and suggest strategies for a new era in the music business.

Research on illegal copyright distributor tracking and profiling technology (불법저작물 유포자 행위분석 프로파일링 기술 연구)

  • With the development of the IT industry and the increase of cultural activities, the demand for works increases, and they can be used easily and conveniently in an online environment. Accordingly, copyright infringement is seriously occurring due to the ease of copying and distribution of works. Some special types of Online Service Providers (OSP) use filtering-based technology to protect copyrights, but they can easily bypass them, and there are limits to blocking all illegal works, making it increasingly difficult to protect copyrights. Recently, most of the distributors of illegal works are a certain minority, and profits are obtained by distributing illegal works through many OSP and majority ID. In this paper, we propose a profiling technique for heavy uploader, which is a major analysis target based on illegal works. Creates a feature containing information on overall illegal works and identifies major heavy uploader. Among these, clustering technology is used to identify heavy uploader that are presumed to be the same person. In addition, heavy uploaders with high priority can be analyzed through illegal work Distributor tracking and behavior analysis. In the future, it is expected that copyright damage will be minimized by identifying and blocking heavy uploader that distribute a large amount of illegal works.

  • 규모의 면에서는 서울도서전과 거의 비슷하고 열기의 면에서는 그것에도 훨씬 못 미쳤지만 94동경국제서적박람회에 우리 출판업계 종사자들은 잔치집 구경가듯 무더기로 몰려갔다. 그 대열에 끼어 애꿎은 머릿수를 하나 더 늘렸지만 '우리출판의 일그러진 초상'은 거기서도 예외없이 찾아볼 수 있었다. 최근 국내에 번역 출간되어 호응을 얻고 있는 어린이책 원작을 그곳에서 보았을 때의 새로운 당혹감, 번역할 책이 없나 싶어 '될 만한 책'을 찾아다니기에 혈안인 출판사들, 저작권 상담을 하는 듯 부스 곳곳에서 들려오는 귀에 익은 우리말소리. 아직도 우리의 출판사들은 자극받고 배우기 위해서가 아니라 '사다 베낄'만한 책을 구하러 다니는 모습이 역력했다.

  • 최근 인터넷 상에서 블로그나 미니홈피에 올린 음악이나 사진 등을 둘러싸고 저작권 관련 업체들의 소송이 잇따르고 있다. 자신 들의 정당한 권리를 찾고 포털업체들이 독점하고 있는 이익을 찾아오겠다는 것이다. 이에 반대하는 네티즌들은 현실적으로 돈을 주고 산 유료음악조차 마음대로 활용 못하는 등 온라인 음악시장이 제대로 갖춰지지 않은 상황에서 단속부터 강화해 애꿎은 범법 자만 양산한다고 반발하고 있다. '펌'이 정보공유라는 인터넷 고유의 속성에 걸맞은 거역할 수 없는 흐름이라는 의견과 이에 반대 하는 의견이 팽팽하게 맞서고 있는 가운데 이에 대한 빠른 대책마련이 요구되고 있다.

'구글 프린트' 프로젝트에 관한 고찰

  • 계속 발전하고 있는 정보 커퓨터 통신 기술의 발달은 일상생활뿐만 아니라 도서관에도 큰영향을 주고 있다. 특히 도서관이라는 개념을 실제공간(장소)에서 가상공간으로 확대하는데 큰 기여를 했다. 구글의 "구글 프린트" 프로젝트는 지금까지 우리가 생각해오던 "도서관"으 정의를 시대에 맞추어 다시 생각하게 할 수 있는 분기점이라고 한다면 너무 큰 과장이 될까? 현재 저작권 문제로 당분간 구글의 "library project"가 중단된 상태이지만 이 프로젝트가 계속 진행된다면 도서관계에 영향이 있을뿐 만 아니라 도서관 이용자에게는 기술의 이점을 이용, 도서관장서의 사용에 많은 편리함을 제공할 수 있기 때문에 도서관에서 종사하는 사람으로 이 글을 나누고자 한다.

  • 산업재산권의 중요성은 아무리 강조해도 지나치지 않다. 산업재산권은 산업영역의 기여에 대한 보호를 목적으로 하는 특허권, 실용실안권, 의장권, 상표권등의 권리를 포함하며, 여기에 문화영역에 대한 보호를 본질로 하는 저작권 영역까지를 포함하고 있다. 아무리 좋은 기술이나 발명도 그 권리보전이 없이는 독점배타적인 재산권을 행사할 수 없는 시대에 있어 산업재산권에 대한 올바른 인식은 무엇보다 중요한 일일게다. 금호에서는 산업재산권에 대해 좀더 구체적으로 알 수 있는 기회를 마련하기 위해 우선 특허 , 실용실안에 대한 바로알기 정보를 게재한다.

  • With Recently in art and culture domains, there's rising controversy over shared economy and public domain works. The government is introducing institutional measures such as Gongumadang and KOGL(Korea Open Government License) program to expand the grounds for public domain works. In order to promote and facilitate the use of public domain works, it is imperative to understand how the providers who create and provide the public domain works, as well as the users, perceive shared economy and public domain works. However, preceding studies usually put emphasis on the meaning and significance of the shared economy and show limitation of not discussing providers' perception on shared economy and public domain works. Therefore, this study examines to see if there's a difference of perception between the consumers/users and the providers who owns the copyright of public domain work.
