The purpose of this study is to find a policy and to predict the needs of legislative information service of the 20th National Assembly. For this purpose, It is critical to understand the use behavior of legislative information service according to the attribute for the member of the 19th National Assembly. Thus, this study examined the results of reference service of National Assembly Library of Korea using the politics attribute and the relation attribute as independent variables for the member of the National Assembly in the First Half of the 19th National Assembly. Consequently, there were meaningful differences in the use of legislative information service between users by party affiliation, method of an election and introversion. Also, the increased demand of legislative information service was predicted in that the 20th National Assembly is the status of the opposition majority and the three major parties.

This study was conducted to suggest the ways of improving legislative information services in the National Assembly Library based on the information needs of the legislative support organization arising from the legislation process done by the National Assembly Members. For the purpose, 20 users of legislative support organizations were interviewed in depth. Based on the analysis of the results, the study suggested the improvement proposals in the areas of services and system. Service improvement reflected the information needs of overseas legislative cases, the need for supplementing policy information, and the areas that need to be promoted Second, in the area of system improvement, it was proposed to raise the service awareness of the legal information system centered on foreign legal information and to operate personalized service that can provide differentiated information services for each legislative support organization.

본고는 한국지식문화재단 입법 공청회에서 발표 자료로 제시된 것으로 현재 입법 준비과정에 있는 기존 법률에서 사이버명예훼손에 관한 부분에 대한 법률 개정을 위한 공청회 자료이다. 정보통신망이용촉진 및 정보보호 등에 관한 법률은 현재 인터넷을 통해 진행되는 갖가지 부조리와 불법적인 행태에 대처하지 못하는 감이 없지 않다. 때문에 개정안 입법도 변화하는 정보 사회에 발맞추기 위한 목적으로 진행되고 있다.

이글은 대의민주주의에서의 입법 메커니즘에 대한 이론적 논의를 전개한다. 이러한 논의를 근거로 한국 국회의원의 입법생산성에 영향을 미치는 변수들을 도출하고, 이 변수들이 16대와 17대 국회의 입법생산성에 미치는 효과를 분석한다. 이글의 경험분석은 국회의원의 입법생산성은 이들의 학력, 법조경력, 관직경력, 의정경력 같은 개인적 배경과 서로 무관하다는 사실을 보여준다. 이글의 경험분석에 의하면, 국회의원들의 개인배경보다는 원내 정당간의 역학관계와 소속정당의 여당지위, 그리고 의회요인들이 국회의원들의 입법생산성에 영향을 미치는 것으로 밝혀졌다. 이러한 분석결과는 한국 대의민주주의의 작동과 관련된 함의를 제공한다. 국회의원의 입법활동에 대한 정보를 접하기 어려운 환경에서는 국회의원의 개인배경에 의존하는 국회충원 방식이 대리인문제를 유발할 가능성이 높다. 이글은 국회의원 입법활동에서 발견되는 대리인 문제의 해소를 위한 제도적 방안들에 대해 논의한다.

Legislation needs to be understood within a political, societal relationship among lawmaking bodies rather than by legal provision itself. In order to examine features and functions of communication in the process of legislation, this study conducted focus group interviews with experts as well as in-depth individual interviews. The result of this research as follows: First, the study found that although the domestic legislative process has been made by active interactions among lawmaking subjects, it was hard to conclude that this procedure is providing effective and productive legislative agenda because of chaotic communications made along the process. Second, the study found that national legislative process has been gradually moving, although restricted, to an open political space, the National Assembly, from a closed space, the executive branch. Third, the study found a remarkable feature including growing influence of experts groups and civic organizations in the legislative process. It is a significant change that legislative staff such as National Assembly aides, investigators, expert committeemen and deputy director generals played a role of "insiders," unnoticeably influencing the legislative process, and that civic organizations and NGOs, which have been excluded in the previous legislative processes, emerged as a new influencing circle in the process. Lastly, the study found that media organizations, in the process of developing agenda, had a strong impact on the National Assembly as a subject forming public issues and as a messenger of the legislative agenda while they played a limited role in affecting the government. This study discusses why communication in the domestic legislative process is important and what are some hindering and facilitating factors in the process.

디지털 유산의 유형은 매우 다양하며 혼합성을 가진 정보의 특성상 민법의 상속 규정으로 해결될 수 없거나 기타 현행 개별법의 규정에서도 해결할 수 없는 경우도 있을 수 있다. 또한, 디지털 유산의 생성, 저장, 처리가 제3자인 정보통신서비스 제공자의 영역에서 이루어지며 현행 개인정보보호법제, 비밀준수관련법제 등 개별법상 정보통신서비스 제공자에 대한 법적 책임의 가능성이 있다는 점은 디지털 유산의 생산자(즉, 정보통신서비스 이용자)와 상속인에게 전통적인 상속법제를 적용하는데 실질적인 걸림돌로 작용하고 있다. 종래 국내에서 제안된 입법안들은 디지털 유산과 관련한 이러한 문제점을 인식하여 정보통신서비스 제공자에게 개별법상 책임의 가능성을 경감함으로써 디지털 유산의 법적 처리를 원활하게 하는 근거규정을 두고 있다. 그러나 디지털 유산의 범위, 디지털 유산 제공 대상자의 범위, 제공 대상자의 권한의 범위 등에 있어 많은 차이를 보였다. 이러한 점을 고려한다면 디지털 유산의 상속에 관한 타당하고 합리적인 해석론을 전제로 하되 추가적인 입법론적 논의가 필요하다. 입법론적 논의를 위해서는 디지털 유산에 대하여 실질적 지배영역을 가진 정보통신서비스 제공자에 대한 책임의 명확화와 더불어 디지털 유산을 둘러싼 관계인의 이해를 조화하는 방향성이 요구된다.

최근 7.7 DDoS 사건과 해킹 사건 등으로 국가기관의 정보보호에 관한 중요성이 대두되고 있고, 정보보호 관련 법률이 국회에서 논의되고 있다. 하지만 국회사무처의 정보보호컨설팅 결과 61.2점으로 매우 낮게 평가 되었으며, H/W, S/W분야의 평가에서도 보안성이 취약한 것으로 나타났다. 본 논문은 입법지원 기관인 국회사무처의 인터넷 네트워크와 사용 시스템 등에 대한 관리적, 기술적, 물리적 보안 요소에 대한 현황을 기밀성, 가용성, 무결성 등의 보안기준에 따라 파악하고, 이를 분석한다. 그리고 입법지원 기관이 갖추어야 할 인터넷 네트워크와 사용 시스템 등에 대한 보안 강화를 위한 설계를 연구한다. 본 연구를 통해 입법지원기관의 보안 현황을 분석하고, 사회적인 책임기관으로서 역할과 보안 강화를 위한 자료를 제공하고자 한다.

In study we analyze the network about the legislators in Korean National Assembly. We focused on 17th National Assembly since there were full of important changes in composition. Mutual cooperation is necessary to pass the bills beyond their given mission in legislation. In order to find out the relationship of legislators based on the introducing bills, total 5728 bills in 17th National Assembly, we used bipartite network projection. We can find who is a highly influential legislator and the difference between a ruling party and a main opposition party in aspects of cooperative behavior.

도시형소공인 지원법 법률 제정을 위한 입법공청회가 지난 9월 26일 한국패션산업그린포럼(공동대표 정세균, 전순옥 의원) 추최, 전순옥 의원 주관으로 국회입법조사처 대회의실(국회도서관 412호)에서 200명의 관계자가 참석한 가운데 개최됐다. 특히 도시형소공인 지원법 대상에서 인쇄업을 빼자는 중소기업연구원의 연구결과가 발표되기도 했지만, 대한인쇄문화협회, 대한인쇄정보산업협동조합연합회, 서울시인쇄정보산업협동조합 등 관련 단체와 인쇄인들의 지속적이고 조직적인 노력에 따라 지원법 대상에 포함키로 최종 결정됐다.
