판례는 의사의 위험설명의무 위반에 대하여 그것과 환자의 동의 사이의 인과관계가 불분명한 때에는 위자료를 지급할 의무를 지우고, 인과관계가 증명되는 경우에는 민사상 전손해배상, 형사상 업무상과실치사상의 책임을 묻는다. 그러나 어느 경우든 설명하지 아니한 위험이 실현될 것을 요구한다. 그 결과 대부분의 사안에서 위자료책임이 인정되었는데, 이는 위험설명의 대상이 되는 위험을 매우 넓게 인정하는 또 다른 판례와 결합하여 의료과오가 증명되지 아니할 때 우회적·간접적으로 일정 부분 배상을 확보하는 사실상의 기능을 갖는다. 그러나 의사의 설명의무가 의료문화로 정착해가면 갈수록 설명의무 위반이 줄어들고 그 결과 어쩌다 우연적으로 약간의 배상을 제공하는 외에는 오히려 설명대화를 위험의 형식적 나열로 변질시키는 부작용이 두드러지게 된다. 본래 설명의무는 환자의 자기결정을 돕기 위한 것이므로 발생한 악결과가 설명의무 위반에 귀속되는지 여부도 환자의 구체적 자기결정과정을 고려하여 가려야 한다. 즉, 환자가 특정 위험에 대하여 특별한 선호를 갖고 있는 경우에는 그 위험이 제대로 설명되었는지, 그리고 제대로 설명되지 아니한 바로 그 위험이 실현되었는지를 보아 그것이 인정되는 경우 전손해배상을 인정함이 옳고, 그 이외의 경우, 특히 환자가 전체적으로 자신이 감수하는 수준의 위험과 기대효과에 노출된 것인지에만 관심을 갖는 경우에는 개개의 위험의 설명 여부나 그 실현 여부를 문제 삼지 아니하는 것이 옳다. 뒤의 경우 세부사항을 설명하지 아니하였는데 그 위험이 실현되었다 하여 인과관계와 귀속관련을 고려하지 아니한 채위자료 상당의 책임을 인정하는 것은 정당화되기 어렵다. 이러한 점은 형사법에서 피해자 승낙에 의한 위법성조각에도 타당하다. 이 경우 이른바 가정적 승낙은 위법성조각사유로서 동의의 요건 자체에 흡수되고 독자적인 항변이 되지 아니하는 것이다.
Psychiatrists who treat violent or potentially violent patients may be sue for failure to control aggressive outpatients and for the discharge of violent inpatients. Psychiatrists may be sued for failing to protect society from the violent acts of their patients if it was reasonable for the psychiatrists to have known or should have known about the patient's violent tendencies and if the psychiatrists could have done something that could have safeguarded in public. The courts of a number of jurisdictions have imposed a duty to protect the potential victims of a third party on persons or institutions with a special relationship to that party. In the landmark case of Tarasoff v Regents of University of California, the California Supreme Court held that the special relationship between a psychotherapist and a patient imposes on the therapist a duty to act reasonably to protect the foreseeable victims of the patient. Under Tarasoff, when a therapist has determined, or under applicable professional standards should determine, that a patient poses a serious threat of violence to another, he incurs an obligation to use reasonable care to protect the intended victim against such danger. After going through a period of transition, from McIntosh, Thompson and Brady case, finally, the narrow rule of requiring a specific or foreseeable threat of violence against a specific or identifiable victim is the standard threshold or trigger element in the majority of states. Judgements on these kinds of cases are not enough yet in Korea, so that it may be too early to try find principles in these cases, however it is hardly wrong to read the same reasons of Tarasoff in the judgements of Korea district courts. And the standard of conduct that is required to meet the obligation of "due care" is based on what the "reasonable practitioner" would do in like circumstances. The standard is not one of excellence or superior practice; it only requires that the physician exercise that degree of skill and care that would be expected of the average qualified practitioner practicing under like circumstances. According to the development of medical technology, new medical treatments have been dramatically increased as an inevitable consequence, however, it is not easy for medical workers to learn the knowledge that is necessary for new medical treatments and their additions in the medical services. Therefore, it could not be helped increasing the guidelines for applying new medical treatments, and then, the problem would come out whether to attribute the medical negligence to the doctors who did not follow the guidelines when the patient became worse because of his non-compliance. Nevertheless, there is no document to review the problem mentioned above and also no definite precedents. Thus, the civil lawful character and obligation of guidelines on the lawsuit against the medical default have been examined in this studies. The medical negligence is defined as usual doctors violate the care obligation which is demanded for them to follow when they treat patients under the proper medical standard in those days. It is resonable to assume that the matter of guidelines is to decide the level of the care obligation, that means the care which is required of the rational doctors under same circumstances, and in general, the experts' testimonies should be needed in this case. In addition, the issue comes out whether the guidelines can be the standard of the judgement of the medical negligence. 의료사고에 대하여 의사측에게 손해배상책임을 묻기 위해서는 가해행위, 위법성, 유책성의 요건이 충족되어야 한다. 본 논문은 유책성의 요건인 과실에 대한 판례를 검토한 것이다. 의료손해배상에 대한 판례가 오랫동안 유지하고 있는 판결요지는 수정이 필요하다. 판결요지에 따르면 유책성 요소로서 의료과실은 주의의무 위반을 기준으로 한다. 주의의무 위반은 의료수준을 기준으로 한다. 의료수준은 임상의학의 실천수준에 따라 판단된다. 판결요지에서는 이를 사실적 판단대상이 아닌 규범적 판단대상이라고 한다. 그러나 개개 사안에서 판례는 판결요지와는 다르게 의료수준을 사실적으로 판단하고 있다. 주의의무는 의료수준이 아니라 의료수준에 따라 최선의 진료를 하여야 할 의무이다. 그리하여 의료수준을 규범적으로 판단하고, 이를 기준으로 주의의무를 다시 규범적으로 판단하여야 한다는 판결요지는 동어반복에 지나지 않는다. 판례는 과실로서 주의의무 위반에 이르지 않았다고 하여 의료손해배상책임을 부정한다. 그러나 실제 사안을 보면, 위법성이 부정되거나, 과실이 없거나, 인과관계가 없는 등 손해배상책임의 성립이 부정되는 이유는 다양하다. 판례는 일반인의 상식에 따른 증명, 간접사실을 통한 과실의 추정, 개연성을 통한 제한으로 과실증명에 대한 법리를 전개해 왔다. 구체적 사안의 해결에서 개연성에 대한 증명은 의학적 판단의 문제로 전환되었다. 요컨대 과실에 대한 증명부담의 완화라는 판례의 태도는 개연성을 통해 한걸음 후퇴하고 있는 모습이다. 이러한 배경하에서 의료지침을 위반한 중대한 치료상 잘못을 과실로 보고, 인과관계를 추정하는 독일민법 제630조의 h 제5항을 눈여겨 볼 필요가 있다. 이 조항은 독일에서 사실상 증명책임의 전환이라고 평가된다. 마취사고, 감염사고와 같이 일정한 의료지침을 준수하기만 한다면 경험칙상 악결과를 상당부분 예방할 수 있는 사안에서는 이와 같은 규정이 기능할 수 있는 가능성이 있다.
소득이 늘어나고 의학수준이 높아지면서 전문 의료의 영역이 확대되었고, 의료기술 전반에 대한 국민의 신뢰가 높아지면서 비단 질병을 치료하는 경우 뿐 아니라 생활 속에서의 의료영역은 더욱 넓어지고 있는 추세이나 약물에 대한 남용이나 내성균의 등장으로 인해 여러 가지 문제점 들이 발생하는 것도 사실이다. 언론보도에서 접할 수 있는 병원에서의 감염사례 이외에도, 의료소송을 통하여 분쟁의 대상이 되는 병원감염의 사례는 적지 않은 것이 현실이다. 병원감염에 의한 의료소송에 있어서 병원 자체의 관리나 감독의 소홀을 물어 손해발생의 인과관계를 입증할 수 있다면 피해자의 보호의 수준이 한층 높아질 수 있을 것이다. 병원감염과 관련된 비교법적 고찰을 통해 이러한 문제에 대한 해결점을 찾아보고자 하였다. 특히 병원감염과 관련한 비교법적 검토로서 독일의 입법례는 진료계약을 민법상의 전형계약으로 정해 두고 있어 독일의 민법 규정을 살펴보는 것은 우리 법에게도 시사하는 바가 크다. 또한 프랑스의 특별법 '환자의 권리'를 향상시키고자 노력하였고 이에 따른 판례의 변화도 살펴 볼 수 있다. 마지막으로 미국의 판례상의 과실추정칙의 이론은 원고의 입증의 부담을 줄여주려는 시도로서 배심원제 하에서 적용될 수 있으나 주의의무 위반의 증거제시가 어렵고 침묵의 모의를 통하여 감정단의 증언조차 확보가 어려울 때 참고해 볼 수 있는 이론이 아닌가 생각한다. 본 논문은 병원감염의 의료소송과 관련 될 수 있는 문제들을 비교법적 측면에서 검토하여 증명책임의 완화와 관련하여 우리에게 어떤 시사점이 있는지 찾아보고자 하였다.
현재 정보통신의 비약적인 발전은 의료서비스 전달체계에서도 큰 변화와 진전을 야기하고 있으며 세계적으로 점차 확대되어가고 있는 추세이다. 이는 의료정보화라는 이름으로 환자에게는 질병의 진단, 치료에 있어서 보다 신속, 세밀하고 정확히 판단할 수 있게 하여 수준 높은 보건의료서비스를 제공하는 한편 의료기관 및 관련기관은 업무의 효율성을높여가고 있다. 그 중 원격의료는 의료기관의 방문 없이 대기시간의 단축, 일률적인 고도의 의료수준을 기대할 수 있는 등의 장점이 있는 제도이다. 특히 장소와 시간에 구애받지 않고 방대한 의학에 관한 정보접근성이 높아질 수 있다는 점이다. 그러나 현대 과학 기술의 발달의 속도에 비해 운용상의 제반 규정과 마인드가 부족한 것이 현실이다. 현행 우리 의료법에서는 원격의료를 규정하고는 있으나 그 내부적 관계에 따르는 세부적인 법률관계의 부재 및 현장에서 이루어지는 의료행위가 아닌 정보통신망을 이용한 비대면접촉에 의한 특수한 형태라는 측면에서 제도적, 시설적, 환경적 제약이 있음을 부인할 수 없다. 따라서 본 논문에서는 현행 원격의료의 발전 잠재 가능성이 무한함을 전제로 법적 문제점 및 개선점을 고찰해보고 이를 통한 원격의료를 활성화할 수 있는 활로를 모색하고자 한다.
Recently the suits for medical malpractice are gradually increasing in this country. The main purpose of this study is to excavate the most suitable theories about civil liabilities on medical malpractice by radiological technologist. To solve the above-mentioned problems in medical malpractice, I have proceeded to make a survey of traditional theories and tried to exvacate the most suitable theories for our medical circumstances among those theories. Both domestic and foreign relevant professional literatures and legal cases were investigated in this study. Several important findings of this study are as follows. First, the nature of legal interrelationship between radiological technologist and physician(or the representative of a hospital) is to define the content of employment. But in the eye of medical law, the interrelationship between radiological technologist and physician is written that radiological technologist should be directed by physician. Second, the nature of legal interrlationship between patient and physician(or the representative of a hospital) is to define the content of legal obligation of physician(or the representative of a hospital), and radiological technoligst execute his obligation as proxy for physician. Therefore, patient can not clame any legal right to radiological technologist. Third, radiological technologist has the obligation of Due Care in medical practice. Fourth, on the medical malpractice by radiological technologist the civil liability can be treated as either tortious liability or contractual liability, and physician(or the representative of hospital) take the responsibility for the damage compensation. In this case, physician has the right of indemnity to radiological technologist. But it should be dinied or extremely limited.

Negligence has been found not exist, however, when a patient abruptly and unexpectedly dashes from an attendant and jumps out a window or otherwise attempts to injure himself or herself. And the standard of conduct that is required to meet the obligation of "due care" is based on what the "reasonable practitioner" would do in like circumstances. The standard is not one of excellence or superior practice; it only re quires that the physician exercise that degree of skill and care that would be expected of the average qualified practitioner practicing under like circumstances. However, the patient may be in difficult situation to prove the malpractice of doctors since he or she cannot recognize the facts because he or she was in unconscious while the medical practice was conducted, or they cannot judge precisely even though they recognize the facts. Nevertheless, the lawsuits against medical malpractice are the field that never achieves the equality of arms since the most of the evidence belong to the doctor's side. Hence, to maintain the principle of the equality of arms under the constitution, the theory leads to alleviate the burden of proof that patients hold. However, the doctors cannot be asked for the burden of proof that they conduct medical practice without errors. Because the doctors may experience difficulty to prove their innocence as the patients because of the unique characteristic that medical practices have. Therefore, the methods of the alleviation of the patient's burden of proof should have the equality of arms and the equal opportunity between the patients and the doctors with the evaluation of the justifiable interest from both the patients and the doctors. As the methods of the alleviation of the burden of proof, the alleviation of the demands and the degree of the burden of proof or resolutely the conversion of the burden may be considered. However, Recognizing the exception from general principle with converting the burden of proof is not proper in principle because the doctors may experience difficulty of the proof as the patients may have. If the difficulty of proof can be resolved by alleviating of the demands and the degree of the burden of proof, it is more desirable resolution rather than converting the burden of proof.
상업광고는 경쟁의 수단이자 그 자체 표현양식이기도 하다. 따라서 이는 영업의 자유(헌법 제15조)와 언론 출판의 자유(헌법 제21조 제1항)의 보호를 받는다. 영업의 자유 내지 경쟁과 관련하여서는 부정경쟁행위로서 제재되어야 하는 부당광고와 그 제한이 부당한 경쟁제한으로 오히려 금지될 수 있는 정당한 광고의 구분이 중요하다. 언론 출판의 자유 내지 표현과 관련하여서는 검열금지의 원칙(헌법 제21조 제2항)이 문제된다. 이 글에서는 이들 두 쟁점을 중심으로 (자유)전문직 광고규제, 특히 의료광고를 검토하였다. 그 결과는 다음과 같다. 첫째, (자유)전문직 광고, 특히 의료광고라 하더라도 사전심의를 받게 할 것은 아니다. 이는 검열금지가 상업광고에 대하여 적용되어야 한다는 뜻은 아니다. 검열금지를 상업광고에까지 적용하는 것은 부적절하다. 그러나 헌법재판소는 검열금지를 상업광고에 적용하고 있고, 실제로 의료광고에서 사전검열이 필요하다고 보이지도 아니한다. 사전심의를 지지하는 이는 주로 의료에 정보비대칭성이 있고, 잘못된 의료로 인한 해가 중대할 뿐 아니라 회복불가능하다는 점에서 그 근거를 찾는데, 의료법은 의료과오책임과 설명의무로 이에 대응하고 있고 의료광고가 여기에 미치는 영향은 매우 제한되어 있기 때문이다. 사전심의는 전면 폐지하거나 굳이 틀을 유지하려면 심의 받은 광고에 대한 인증제도 또는 완전한 자율규제로 전환하여야 한다. 둘째, (자유)전문직 광고, 특히 의료광고에 대하여 광고 일반보다 더 높은 규제를 가할 근거도 없다. 더 높은 수준의 규제를 가하여야 한다는 주장은 그 근거로 (자유)전문직은 윤리성, 비영리성을 갖고 있고, 특히 의료업은 국민건강보험체제에 편입되어 있는바, 경쟁이 이 체제의 안정성을 해할 수 있다는 점을 지적한다. 그러나 (자유)전문직이라 하더라도 직업윤리 등의 제약 하에 영리를 추구하고 경쟁할 수 있고, 또 실제로 하고 있으며, 의료업이 국민건강보험체제에 편입되어 있다는 사정 또한 경쟁의 수단 등에 일정한 제약을 부과할 뿐 경쟁 자체를 배제하지는 아니한다. 의료업에 대하여 일반 광고규제보다 더 엄격한 광고규제를 가하는 것은 초보의사에 대한 진입장벽으로 작용할 가능성이 높고, 그러한 점에서 경쟁제한적 행위로서 그 정당성이 의심스럽다.

① 서비스 이용은 당 사이트의 업무상 또는 기술상 특별한 지장이 없는 한 연중무휴, 1일 24시간 운영을

② NDSL에서 제공하는 콘텐츠를 상업적 및 기타 영리목적으로 복제/배포/전송할 경우 사전에 KISTI의 허락을
받아야 합니다.
③ NDSL에서 제공하는 콘텐츠를 보도, 비평, 교육, 연구 등을 위하여 정당한 범위 안에서 공정한 관행에
합치되게 인용할 수 있습니다.
④ NDSL에서 제공하는 콘텐츠를 무단 복제, 전송, 배포 기타 저작권법에 위반되는 방법으로 이용할 경우
저작권법 제136조에 따라 5년 이하의 징역 또는 5천만 원 이하의 벌금에 처해질 수 있습니다.
제 14 조 (유료서비스)
① 당 사이트 및 협력기관이 정한 유료서비스(원문복사 등)는 별도로 정해진 바에 따르며, 변경사항은 시행 전에
당 사이트 홈페이지를 통하여 회원에게 공지합니다.
② 유료서비스를 이용하려는 회원은 정해진 요금체계에 따라 요금을 납부해야 합니다.
제 5 장 계약 해지 및 이용 제한
제 15 조 (계약 해지)
회원이 이용계약을 해지하고자 하는 때에는 [가입해지] 메뉴를 이용해 직접 해지해야 합니다.
제 16 조 (서비스 이용제한)
① 당 사이트는 회원이 서비스 이용내용에 있어서 본 약관 제 11조 내용을 위반하거나, 다음 각 호에 해당하는
경우 서비스 이용을 제한할 수 있습니다.
- 2년 이상 서비스를 이용한 적이 없는 경우
- 기타 정상적인 서비스 운영에 방해가 될 경우
② 상기 이용제한 규정에 따라 서비스를 이용하는 회원에게 서비스 이용에 대하여 별도 공지 없이 서비스 이용의
일시정지, 이용계약 해지 할 수 있습니다.
제 17 조 (전자우편주소 수집 금지)
회원은 전자우편주소 추출기 등을 이용하여 전자우편주소를 수집 또는 제3자에게 제공할 수 없습니다.
제 6 장 손해배상 및 기타사항
제 18 조 (손해배상)
당 사이트는 무료로 제공되는 서비스와 관련하여 회원에게 어떠한 손해가 발생하더라도 당 사이트가 고의 또는 과실로 인한 손해발생을 제외하고는 이에 대하여 책임을 부담하지 아니합니다.
제 19 조 (관할 법원)
서비스 이용으로 발생한 분쟁에 대해 소송이 제기되는 경우 민사 소송법상의 관할 법원에 제기합니다.
[부 칙]
1. (시행일) 이 약관은 2016년 9월 5일부터 적용되며, 종전 약관은 본 약관으로 대체되며, 개정된 약관의 적용일 이전 가입자도 개정된 약관의 적용을 받습니다.
