The reform of inspection of adult social care market in the UK and policy suggestions for long-term care in South Korea (영국 성인돌봄서비스 시장에 대한 감독 개혁과 한국 장기요양의 시사점)

  • The UK is famous for being the first country in Europe to adopt the policies of marketisation regarding social welfare. Numerous other countries, including social democratic countries, have followed suit, and South Korea has also adopted the marketisation of care through the introduction of long-term care insurance. The aim of this study is to examine recent reforms concerning adult social care market in the UK, and to determine policy recommendations to further develop the Korean long-term care insurance market. Findings show that the UK has actively regulated and managed the care market. In particular, after the sudden bankruptcy of nursing homes, the CQC systematically analyzes the risks of bankruptcy of big service providers in terms of financial conditions and quality of services according to the six steps detailed in the Care Act 2014. If some service providers experience high levels of risk, the CQC reports results to local authorities in order to manage the risk of bankruptcy of these service providers. Such reforms in the UK suggest a number of policy measures for South Korea in which the problems of long-term care market are prevalent, including increased system management, introduction of a new inspection system, the expansion of public-based inspection organizations, and disclosure of information by the National Health Insurance Corporation.

A Study on development of personal protection service (신변보호업무 발전방안에 관한 연구)

  • The purpose of this study is to find the development of the personal protection business plan based on the problem that guards are now aware of personal protection service. In order to achieve the objectives of this study, we analyzed the data after expert survey and interview conducted by seven experts engaged in personal protection services more than 15 years. The guard who perform personal protection service proposed a development plan of personal protection services as follows. First, the current education system for new employees' training is required to improve the educational program of 40 hours in subjects related to personal protection duties by reorganization Second, the personal protection service training for guards also appropriate to switch to 8-hour training program for three months through an educational organization controlled by country. Third, the personal protection guards should be proceeding the practical programs required in the field and quality education in the different section by competent and professional instructors. Fourth, it should be revised Regulating that on the site of collective civil petition including in Events related to events across the board in the security services law. Fifth, there needs to be a change of recognition between police and private security firms, and to be set up the organization for supervision of management by police and private security firms jointly. Sixth, there needs to be organized a subcommittee which is consisting of experts in each task on Korea Security Association, and founded Korea Personal Protection Association for development associated with the personal protection service and to protect the rights of personal protection guards.

병원에서의 산업보건관리

  • 본 연구는 병원에서의 산업보건관리 실태를 파악하기 위하여 전국에 있는 병원을 대상으로 1992년 12월 1일부터 1993년 1월 23일까지 설문조사를 설시하였다. 설문조사에 응당한 병원은 41개병원으로 회수율은 51.9%였다. 조사에 이용된 설문지는 산업안전보건법 내용을 기초로 하여 본 연구자가 작성한 것이며 안전보전에 관한 제반 규정, 안전보건관리체계, 근로자건강관리, 작업환경관리, 보건교육, 보건관련시설, 질병 및 상해에 대한 보상 등에 관한 45개문항으로 구성되어 있다. 분석결과는 다음과 같다. 첫째, 전체 병원 중 68.3%가 안전보건관리 규정이 있다고 답하였으며, 77.5%의 병원이 단체협약 중 근로자의 안전과 보건에 관한 조항을 포함시키고 있는 것으로 나타났다. 단체협약에 포함된 내용 중에는 정기건강진단(23.7%)과 질병 및 상해에 대한 보상(20.9%), 안전보건위원회의 구성(18.1%)등이 많았다. 둘째, 대상 병원중 66.7%가 안전보건관리책임자, 관리감독자, 안전담당자를 두고 있는 것으로 나타났고, 근로자수가 1,000명 이상인 병원은 83.3%가 이들 인력을 선임하고 있다. 그러나, 보건관리자와 안전관리자를 전담으로 두고 있는 경우는 한 곳도 없었으며 50%이내에서 겸직으로 선임하고 있었다. 또한, 안전보건위원회를 운영하고 있거나 노사협의회로 이를 대치하고 있는 병원은 54.2%로 절반 수준에 머물렀고, 그나마 정기적으로 운영을 하고 있다고 답한 병원은 3개 병원 밖에 되지 않았다. 세째, 근로자 건강관리를 위한 건강진단 실시 현황을 보면, 채용시검진 97.6%, 일반건강진단 100.0%, 특수 건강진단 24.4%가 실시하고 있었다. 건강진단에서 주로 실시하고 있는 항목은 흉부 X선검사, 시력, 혈압, 혈청GOT/GPT, 체중, 신장등이었다. 그러나, 병원에서 감염될 수 있는 기회가 높은 간염항원/항체검사의 실시율은 85.7%로 아직도 실시하지 않는 병원이 있음을 알 수 있다. 네째, 작업환경관리를 위하여 정기적으로 환경측정을 실시하는 병원은 21.6%였고 주로 측정하는 항목은 방사선이었다. 특히 소음, 조명, 분진에 대한 측정이 이루어지지 않음은 근로자뿐아니라 환자의 안위에도부정적인 영향을 미칠 수 있다. 다섯째, 안전한 작업과 근로자의 건강을 위하여 정기적인 보건교육을 설시하고 있는 병원은 불과 5.6%였다. 교육내용은 주로 안전에 관한 것이었다. 여섯째, 근로자의 일상적인 건강문제를 해결해주는 의무실을 독립적으로 마련하고 있는 병원은 한 곳도 없었고, 교대근무자나 당직자를 위한 수면시설은 44.7%, 작업 후에 사용할 수 있는 샤워시설은 35.1%의 병원이 마련하고 있었다. 일곱째, 근무중 다치거나 병에 걸렸을 때 치료비에 대한 부담은 대체로 병원이 하고 있으며 치료기간 중 근무는 병가나 휴직으로 처리되고 있다. 이는 병원이 산재보상보험법에 적용을 받지 않은 사업으로 분류되어 있는 현실에 기인된 것으로 보상과 관련된 부담을 병원이나 근로자 모두가 안게 되는 결과를 초래하게 되는 것이다. 이상에서 볼 때 병원근로자를 위한 산업보건관리는 주로 건강진단과 질병 및 상해에 대한 보상제도가 이루어지고 있는 실정이다. 그러므로 질병의 예방이나 악화방지 나아가 건강증진을 도모하기 위한 지속적인 노력을 기울이고 있는 병원은 전무한 상태임을 알 수 있다. 이러한 현실을 병원근로자를 위한 산업보건관리에 대한 인식이 전반적으로 부족함을 드러내는 것으로 이를 개선하기 위한 보다 적극적인 노력이 시급히 요청되고 있다.

Evaluation of the Mental Health Status of the Aged by Zung's Self-rating Anxiety Scale (불안척도에 의한 노인들의 정신건강)

  • The authors studied on anxiety, using Zung's self-rating anxiety scale (SAS), on the subjects of 329 men and 522 women of 60 years old and older. This study was carried out for 8 months from November 1983 to June 1984 in the area of Seoul, Taegu and Kyungsan Gun, Kyungpook province. The results showed that there was no significant difference in the means of total anxiety scores between the two groups of men and women. The anxiety scores in items of sweating, apprehension, dyspnea, restlessness and insomnia were relatively high in both groups. The scores of faintness, panic, fear, tremor and facial flushing were low in both groups. Among 329 men, 48(14.6%) showed rather serious anxiety level of score 50 or higher, while 153 of 522 women (29.4%) showed the same score. Among these psychosocial factors, suppoter, living place, religion and security system are significantly related with anxiety scores in both groups (p<0.01).

Specialty Hospital and Keyword Searching Ads Regulation (전문병원과 키워드검색광고 규제)

  • The (Korean) Medical Services Act revised in 2009 introduces the accreditation of specialty hospital. When a hospital meets prescribed standards, passes a board review, and is accredited as a specialty hospital by the Minister of Health and Welfare, then it may use 'specialty hospital' in its name and certification mark of specialty hospital. The problem is that the (Korean) Fair Trade Commission and the (Korean) Ministry of Health and Welfare, both of which have authorities to regulate advertising in general and in health care service in turn, announced the guidelines to prohibit internet (portal) service providers to provide keyword search ads service using key-words such as 'specialty' or 'specialized in' for those who are not accredited by the Minister of Health and Welfare. In this article, whether these guidelines can be justified by the current regime and whether the current specialty hospital policy is agreeable would be examined. To do this, the legal nature of accreditation of specialty hospital, the limit of advertisement regulation, the law of keyword search ads, and the liability of internet service providers also would be analyzed.

New Framework for Convergent Services between Telecommunication and Broadcasting: Public Goods and Interactivity (방송.통신 융합서비스의 적정 규제 방안: 서비스의 공공재적 속성과 양방향적 특성을 중심으로)

  • As we know, broadcasting implies a unilateral transmission by one sender to several recipients of information generally produced by third parties. Contrary to that, telecommunications implies an exchange between participants. Participants exchange information they produce during an interaction. However, in the age of convergence between telecommunication and broadcasting, it becomes difficult to determine exactly the boundary between services classified under telecommunications and those classified under broadcasting services. This means that new regulatory regime should be introduced to meet the convergence between telecommunication and broadcasting. In this article, we try to overcome the existing framework for understanding and regulating convergent services. In order to develop more powerful and useful framework for dealing with new convergent services, we focus on the original characteristic of "cast services," which could give us very significant basis for further discussion. "Cast services," such as traditional broadcasting services, have the characteristics of both public goods (non-exclusivity and non-rivalry in consumption) and non-interactivity. Depending on the existence of these three characteristics, we are able to apply different regulatory regime to those convergent services.

The Factors Associated with Job Satisfaction of Assistant Nurses in General Hospitals (종합병원 간호조무사들의 직무만족도와 관련요인)

  • Background : The main aim of this study was to analyze the factors that could be used to predict job satisfaction of assistant nurses in general hospitals. Material and Methods : This study was based on a survey of assistant nurses in the Daegu region from January 1, 2006 to January 31, 2006. Originally 300 questionnaires were distributed and among them 291 were completed. The data was collected and used for the statistical analysis. Descriptive and inferential statistics, such as the frequency, t-test and one-way ANOVA were used for the analysis. Results : Among the respondents, the average score for job satisfaction was lowest in the university-trained nurses and highest in the nurses who had only graduated from high school. Conclusion : The working conditions, work place and motivation are significantly associated with job satisfaction. In particular, there was lower job satisfaction in those nurses who wanted to change their occupation.

  • Game industry is certain to change rapidly as its attribute. Therefore, It's not easy that the law response to reflect the technological change of game industry properly, and a new legal issue that is difficult to cover with the existing law. Recently, Court battle or cases about games are socially receiving attention. Nevertheless, Research accumulation about the legal action to response this is rare situation. The legal system that is related games mostly approach in the regulation and punishment of one-sided administration so far. Relatively, Approach from the game industry development and promotion act standpoint is low. Shrinking rapidly the current game industry is not an irrelevance to this. So It is necessary to reconstruct rationally in side that embrace with variety of views of members of the society and interests about current game-related laws, systems and regulation instruments. Access to how will develop competitiveness of the game industry in legal aspects and how will promote the balanced development between game industries are needed. The problems that needs to handle in legal aspect such as game development, game distribution, and game usage which in the part of the game industry are getting more and more in the future. Therefore, there is a need to review consistently in the legal aspect for the game industry promotion.

Healthcare Legislation Cases in the National Assembly Petition System: Focused on Petitions to the Health and Welfare Committee of the 13th National Assembly through the 20th Assembly (국회 청원제도를 통한 보건의료 입법사례 연구: 13-20대 보건복지위원회 청원을 중심으로)

  • The right to petition is a classical right of the people in constitutional states, and in Korea, it is a statutory right in the Constitution, the National Assembly Law, the Petition Law, and the Local Autonomy Act. The healthcare community first made a successful petition to the National Assembly when it achieved the amendment of the Government Organization Act through a petition to the National Assembly for the independence of the Ministry of Health, and this achievement served as the basis for further petitions. Since then, the healthcare community has successfully achieved the enactment and amendment of related occupational laws through National Assembly petitions, such as the amendment of Article 41, Paragraph 7 of the former Medical Insurance Act (Korean Medical Association, 14th Assembly), enactment of the Dental Health Act (Korean Dental Association, 15th Assembly), and amendment of the Health Functional Foods Act (Korea Pharmaceutical Association, 16th Assembly). Its petition accomplishment rate is higher than the total petition accomplishment rate of the Health and Welfare Committee of the National Assembly. However, along with the overall decrease in the number of National Assembly petitions, the Korean Medical Association and Korea Pharmaceutical Association have not achieved any results through petitioning since the 16th Assembly (June 2000), and the Korean Hospital Association and Korean Nurses Association have not achieved any results through petitioning since the 17th Assembly (April 2004). Furthermore, no National Assembly petitions have been made at all for 5 years (2014-2018). The Korean Medical Association and Korea Pharmaceutical Association previously showed a high petition accomplishment rate through their accumulated experience with National Assembly petitions and vigorous policy assistance from doctors/pharmacists/nurses turned lawmakers. More specifically, healthcare organizations have achieved results by actively conducting organized activities with the National Assembly, as implemented by a national assembly director and employees, and in case of petitions for legislation, each group has established infrastructure for reviewing the relevant laws by appointing a legislative director, as well as a legal advisor and advisory counsel. Although the organization that has submitted the most petitions to the National Assembly is the Korean Hospital Association, the group with the highest petition success rate is the Korean Medical Association, which may be linked to the relatively high proportion of doctors who have become lawmakers. Furthermore, the fact that other healthcare organizations were highly interested in petitioning the National Assembly has had major implications for the petition activities of healthcare organizations.

The New Structure of Police Governance and Its Impact on Police Service Delivery in the UK (치안 거버넌스의 새로운 구조와 경찰 서비스 제공에 미치는 영향: 영국을 중심으로)

  • This article assesses the recent police reform strategy in England and Wales with the Police Reform and Social Responsibility Act 2011. Police and Crime Commissioners have a responsibility not just for the police force but also for reducing crime in their area of responsibility. This ensures that their remit runs much more widely than their predecessor body, the police authority. The article goes on to evaluate the nature and extent of crime by making immediate use of survey of local police commanders. The surveys showed that police commands were swamped with minor crime and anti-social offences. The arrival of Police and Crime Commissioners has meant that now police priorities can be more closely aligned to those of the public and where anti-social behaviour is now recognised as impacting on the lives of many residents more significantly than criminal activity. The article highlights the changes introduced by government following the Winsor Review to police pay, pensions and conditions of service. It reflects on the impact of this on both police morale and professional motivation. It suggests that current government policy is now haemorrhaging the police service as increasing numbers of experienced officers are leaving the police service which could ultimately undermine its long-term resilience as a strategic emergency service.
