A Study of Children's Statements in sexual violence cases of children less than the age of 13 -Focusing on video-recorded hearsay evidence- (13세미만 아동성폭력 재판에서의 아동진술연구 -영상매체를 통한 전문 증거를 중심으로-)

  • This study aimed to examine how video-recorded hearsay statements are taken in trial with regard to testimony of children less than the age of 13 in terms of children's rights, and to assess policy implications for the purpose of improving the current system. This study analyzed the precedents in accordance with their facts and contents. The analysis of the contents dealt with the main issues of trials concerning the sexual violence of children less than the age of 13. Specifically, This study selected precedents dealing with video-recorded hearsay statements, which are children's indirect statement, as core legal issues; examined the credibility(probative power) and admissibility of video-recorded statements; and prepared systemic alternatives in accordance with the United Nations Convention on the Rights of the Child, the international standards for the protection of children's rights. As a result, this study proposed creating and utilizing indicators to assess evidence admissibility and the credibility of video-recoded statements in trial, thus reducing judgement through judges' discretion. Also proposed are new regulations with regard to cross-examination coverage of the hearsay statement of a child in a sexual violence trial of concerning children less than the age of 13. This study suggests an improvement in legal policies, based given that children's rights are more vulnerable than those of adults in trial. Nevertheless, this study is limited in that it selected and reviewed only among precedents that are in the public record.

Anatomically-Neutral Dolls and Interviewing Techniques : Effects on the Memory and Suggestibility of 5-Year-Old Eyewitnesses (면담자의 인형사용과 질문유형이 5세 유아의 진술에 미치는 영향)

  • This investigation compared the eyewitness accounts of 5-year-old children by verbal-only inter views and interviews using anatomically neutral dolls. The verbal interviews consisted of free recall, specific question, and leading questions. While the overall accuracy of the interviews increased with the introduction of dolls as memory aids, the efficacy of the dolls was not uniform across types of interviews. In free recall, the dolls were not effective in eliciting accurate accounts. The use of dolls also did not compromise the memory of children in free recall which recalled greater number of correct details with the memory aids than without, but it should be careful in free recall could be reported exactly correct in spite of little bit amounts. Responses to leading questions showed that the children were affected by suggestive misleading question and were susceptible to incorporation of that information into their memory.

Korean Quality Assessment Criteria for Statement Analysis Reports and Testimony (한국 진술분석 보고서 및 증언에 대한 질적 평가 기준)

  • Statement analysis is a technique that examines the credibility of a statement by scientifically analyzing problems and psychological characteristics that appear in the content of the statement. The statement analysis report is prepared, submitted, and used for legal judgments when there is a suspicion of sexual abuse for children(under 13 years of age) and persons with disabilities since it is usually difficult to secure physical evidence nor eyewitnesses. However, the criteria for evaluating the quality of a statement analysis report or testimony are not available in Korea. Although forensic experts and professional organizations in North America and Europe are providing recommendations and guidelines for preparing forensic assessment reports, qualitative analysis research studies for forensic reports revealed a number of problems such as missing or poorly described essential information and lack of logical connection between evaluation results and forensic opinions. Therefore, forensic evaluation guidelines and forensic reports submitted to the courts in the United States, as well as the Structured Quality assessment of eXpert testimony (SQX-12) developed in Sweden were examined to suggest the Korean version of quality evaluation criteria for statement analysis report and testimony. This criteria can be used to improve effectiveness of forensic reports within criminal justice system and used as a guideline to assess the quality forensic reports or expert testimony prepared by experts. However, this criteria do not guarantee the reliability of the statement itself.

The credibility of child testimony (유아증언의 신뢰성 연구)

  • This study investigated differences between the ability of children and young adults to describe their experience. Forty 5-year-olds and 40 16-year-olds viewed 12 pictures(Azmitia, 1987) and responded to open-ended, closed and misleading questions. Responses were categorized by the SPSS WIN program into rate of correctness, incorrectness, unresponsiveness and "don't know". Data were analyzed by t-test. On open-ended questions, the rate of incorrectness by young adults was higher than that of children. On closed questions, children had a higher rate of incorrectness than young adults. On misleading questions, children showed a lower performance in the rate of correctness and "don't know" and the rate of incorrectness by children was higher than that of young adults.

  • In 1964, Roman Catholic Church declared that 'Christ is the light of mankind' at the Second Vatican Council. Pope John Paul II also proclaimed the 'The Mysteries of the Light of Christ' in 2002. For past two centuries, the fact that Christ is the light was emphasized and people were urged to realize the mysteries by focusing on 'Christ of light' and 'Christ who shines like the sun'. This study examined the meaning of living up to 'the Mysteries of the Light of Christ' through analytic psychological perspective on the symbolism of 'the mysteries of light.'in the Rosary. In order to study symbolism of 'the Mysteries of Light' from analytic psychological perspective, this study dealt with the symbolic meaning of images appeared in 'the mysteries of light' of the Rosary. That is, the symbolism of images was revealed'the mysteries of light'has been testifying for Christ the light in the Bible. Those images represented the Baptism, Wedding at Gana, the Kingdom of God, Transfiguration of Christ, and the Last Supper. To live up to the 'The mystery of Christ the light' means to assimilate the unique Self with the image of 'Christ the light'. in other words, the study has meaningful findings that the personality which became conscious and individuation through experiencing the opposites existed as 'the light of the world' or 'the light of the ages'.
