The Effect of Quantity Flexibility Contract on the Military Medicine Inventory Using Dynamic Simulation (수량유연성계약이 육군 의약품 재고에 미치는 영향에 관한 시뮬레이션 연구)

  • This study simulated the effect of the quantity flexibility contract(QFC) on the Korean military inventory system. The results shows that the QFC make the inventory system more efficient. For validity of this study, we assume the basic four demand patterns (increase, decrease, high variation and long seasonality) which are the exogenous variables of these simulation systems. We measured the difference of the traditional military inventory system's and new QFC system's performances. Under the all demand patterns, QFC models have little inventory than the traditional systems. We suggest, therefore, the military change the supply contract into QFC for decrease inventory and expect the results of this study applied to the company level.

  • This study compares and analyzes wholesale(or price-only) contract, revenue-sharing contract, quantity-flexibility contract, and channel-rebate contract in a decentralized supply chain consisting of one supplier and one retailer. By setting the parameters of each coordination contract based on the previous results, we conduct simulations using @RISK for several combinations of these parameters. Under the supply chain coordination, we evaluate the probability of successfully signing a contract and the participant in favor of each contract. As a result, the quantity-flexibility contracts is most advantageous for the retailer and the channel-rebate contracts is most advantageous for the supplier. It revealed that revenue-sharing contracts can be used more flexibly because they can be selected in the widest range to redistribute profits between supplier and retailer.

  • The purposes of study is to propose a new method contract price adjustment in construction projects. The research method of this study includes a case analysis and questionnaire survey. The results of this study are as follows: 1) For improvement method of contract amount adjustment, enactment for legislation pertaining to computation methods such as military's organization through total unit cost, and price flexibility computation at the point of design modification were presented. 2) Arithmetic formulas for cases in which volume is deleted or modified below the price flexibility exemption amount or in which there is no change to quantity, at the occurrence of design modification resulting from price flexibility, were proposed.

  • The purpose of this study aims to analyse the implications of volume contract clause with Rotterdam Rules. The Hague-Visby Rules have been in force this jurisdiction for over 30 years. In those three decades they have performed valiant service, both for the development of maritime law in this country and for the countless parties from around the world who have chosen courts and arbitral tribunals in London for the resolution of disputes arising under bills of lading or under charterparties incorporating the Hague-Visby Rules. While the Hague-Visby Rules apply only to bills of lading or any other similar documents of title and hence all other contracts of carriage are not subject to the current regime, this is not the case for the Rotterdam Rules which, broadly speaking, apply to contracts of carriage whether or not a shipping document or electronic transport record is issued. To preserve freedom of contract where necessary, however, a number of significant concessions were made and Article 80 represents one of the most controversial: that of volume contracts. However, the provision lends itself to abuse under each one of the elements as there is no minimum quantity, period of time or frequency and the minimum number of shipments is clearly just two. This means that important contracts of affreighment concluded pursuant to, for example, oil supply agreements have the same right to be excluded from the scope of application of the Rotterdam Rules. The fact that a volume contract may incorporate by reference the carrier's public schedule of services and the transport document or other similar documents as terms of the contract would make a carefully drafted booking note for consecutive shipments a potential volume contract as well.

  • According to the National Contract Law, when determining Estimation cost Contract officers should consider contract quantity, contract period, supply and demand condition, difficulty of contract enforcement, terms and condition, and other various conditions based market price, costing based pricing, and appraisal. And they should not overestimate or underestimate the estimation cost. But the estimation cost system is used as preparedness for audit against the contract law. In this study, we identified the factors affecting estimation cost and analyzed their influence on estimation cost.

  • A construction project consists of a variety of contracts for the completion of work. The large number of contracts involved in a single project increases the likelihood that disputes will arise between the parties involved regarding the terms of service. Actually, there are many disputes that are caused by a change 0 order. While such disputes should be settled by interpreting the terms stipulated in the agreement entered between the two parties, the process of dispute settlement is often restricted to arbitration and lawsuit, and as a result the parties tend to avoid it due to its inefficiency. For this reason, in Korea it is hard to find cases of interpreting terms of service, while in the U.S. it is easy to find diverse cases of interpreting terms of service, since there is a process of dispute settlement by each stage by the party who has placed an order. Therefore, this study presents analysis of case studies of contract changes, looking specifically at changes in the scope of the work, changes in quantity, changes in the period of implementation, changes in the method of implementation or attitude, changes in items provided by the government or the delivery place, and the acceptance of such change procedure by a contractor, and the adjustment of a reduction.

  • This article reviews some problems arises from signing by the master bills of lading issued on time chartered ship. The underlying purpose of time charters is generally for the charterers to have the services of the vessel in order to engage in the business of carriage of goods by sea, a business which is likely to involve the issue of bills of lading to shippers. Charterer under the charter have a right to issue B/L, thereby the master must sign bill of lading as presented, but may not vary the contract. Bills of lading signed by, or on behalf of the master, impose contractual liabilities upon the shipowner. Charterer have no right to ask the master to sign a bill of lading in any way deviating from the charterparty. If the shipowner suffers loss as a result of the master obeying any order about employment or agency, he will be entitled to an indemnity from the charterer. The master may refuse to sign bills of lading which contain some discrepancy such as a false statement and manifestly inconsistent with the requirements of the charterparty.

Designing Forward Markets for Electricity using Weather Derivatives (날씨파생상품을 이용한 전기선물시장 설계)

  • This paper shows how weather derivatives can be used to hedge against the price risk and volume risk of purchasing relatively large amounts of electricity. Our specific approach to designing new contracts for electricity is to focus on the return over a summer season rather than on the daily levels of demand and price. It is shown that correct market signals can be preserved in a contract and the associated financial risk can be offset by weather options. The advantage of combining a forward contract with a weather derivative is that the high prices on hot days or when the temperature is high reflect the underlying high cost of producing power when the load is high and that the combined contract with a weather derivative substantially reduces the volatility of the return.

Estimation Method of Waste Amount from Materials to Develop Generation Rates of Construction Waste in New Apartment Construction Sites: Focused on Bill of Quantities for Architectural Works (신축아파트 현장의 건설폐기물 발생원단위 개발을 위한 자재별 폐기물 수량 예측 방법: 건축공사 내역서의 투입 물량을 중심으로)

  • The amount of new apartment construction has been trending upward in 3~4% each year since 11% increase in 2002. Currently, in public apartment construction sites under separate delivery system for construction waste processing, the significant difference between estimated quantity for contract and actual amount frequently causes severe controversy among project participants. Many factors such as poor environmental management, inadequate contractual amount are assumed to influence the above problem, and the requirement to revise existing generation rates, the key criteria applied in estimating the quantities of waste, is increasing. Most of generation rates were established in early 2000's, and have difficulty in reflecting the changes from new materials and technologies accordingly. Therefore, this study aims to clarify the types of construction waste for each trade and the forecast method as preliminary work in order to develop more accurate generation rates for construction waste in new construction. To achieve this purpose, the architectural bills of quantities in ten apartment projects executed during 2010~2013 were collected, and the possible waste types and reasonable material loss ratio for each item from temporary works to owner-supplying material area were defined and compared through the workshops and interviews with the experts and on-site environmental managers. The results of this study will contribute to establishing the categories of construction waste for construction trades and proper generation rates by the indirect estimation method in new apartment construction in the follow-up study.
