  • This study aims to address the current situation and damage from sexual violence, to arouse public opinion, help broader awareness, and further lead to community social efforts to cope actively with the situation. In Korean society, discourse on sex is often conducted in a double structure. Sexual violence is not just a personal misfortune; it is a problem for women as a whole. Furthermore, it is a challenge that society needs to address. Therefore, the government should evolve its response to sexual violence into a collective, not individual, movement of men and women toward social and cultural movements together. Although the visible reality of sexual violence is important, damaging their mental health by passing on a distorted cultural environment to future generations should be seen as a type of historical crime.

FACTORS INFLUENCING PERCEPTIONS OF CHILD SEXUAL ABUSE: VIGNETTE STUDY FINDINGS (아동성폭력 상황인식에 영향하는 요인들에 관한 분석 : Vignettes를 이용한 연구결과를 중심으로 한 고찰)

  • This paper is a review of findings from studies that have used vignettes to identify salient characteristics that have been found to influence individuals' perceptions of child sexual abuse. Vignette studies finding avoid to unreliable and biased self-reports. A review of the literature revealed that factors influencing the perception process are divided into two groups. One group of factors relates to the details of the abuse situation including characteristics of sexual act (intrusiveness of the sexual act and the frequency of acts), characteristics of victim (age of victim, the gender of victim and victim resistance), and characteristics of perpetrator (age of perpetrator, gender of perpetrator and the relationship of the perpetrator to the child). The other group of factors focused on in research reflects individuals background variables that affect personal interpretations of the abuse situation. These factors include professional affiliation of the respondent and various other. demographics (e.g., gender of respondents, age, education, marital status, parental status, number of children, the length of experience, etc.), along with respondents own child sexual victimization experiences. Based on theses findings vignette studies have allowed researchers to learn how individuals vary their perceptions of various situational aspects of child sexual abuse situations, and how background characteristics of the respondents as observers may influence these perceptions.

Perception of women who claim sexual assault: The effects of agency and perceivers' gender (성폭력 피해 주장 여성에 대한 인식: 주체성과 판단자 성별의 효과)

  • In this study, we tested the hypothesis that a woman who claims sexual assault would be evaluated more negatively, and the suspected man would be judged more leniently, when the woman is agentic. In addition, we expected that this phenomenon would occur because the agentic accuser does not conform to the 'sexual crime victim' stereotype or feminine norms, and considered these as mediator variables. We also postulated that male (vs. female) participants would have a less positive regard of the agentic accuser and tested participant gender's moderating effects. Contrary to our hypothesis, participants criticized the agentic (vs. non-agentic) woman who claims sexual assault less and perceived her more positively and truthfully, and more likely to judged the suspected man to be guilty and recommended longer sentences. However, we observed the expected moderating effects of participant gender, so that male (vs. female) participants evaluated the agentic accuser more negatively. Mediation analyses yielded results on perceived truthfulness that were consistent with our hypothesis: Participants thought of agentic accuser as less feminine, which predicted less perceived truthfulness. Also, the less the agentic accuser was perceived to be feminine, male participants blamed her more while female participants had more positive impressions of her.

  • Following the social consensus for the need to stop sexual violence, the government has amended juvenile sex protection laws to impose fees on education practitioners who do not report sexual crimes against women, and amended the 'domestic violence prevention and victim protection laws' (2012. 2) so that the police can investigate on site. However, regardless of these wide efforts, the reality is that sexual crimes against the socially weak do not seem to be dwindling, raising concerns of the effectiveness of such amendments. Generally sexual crimes are hard to prove, and even if reports are filed, most cases are dropped with non-prosecution disposition. Victims are usually limited to women and children and this leads to secondary victims. As this thesis states, developed countries have a more systematic protection methods than our country. Therefore, the purpose of this thesis lies on the construction of public safety infrastructure for the protection of sexual abuse victims (enhancing safety protocols with related organizations, implementing a bill of rights for the victims, prevention-centered police education, amendments to current law) to limit human rights violations and criminal injuries.

A Study on the Characteristics of the Spatial Distribution of Sex Crimes: Spatial Analysis based on Environmental Criminology (성폭력 범죄의 공간적 분포 특성에 관한 연구: 환경범죄학에 기반한 공간 분석)

  • The interest in the prevention of sex crimes and social secure is growing as the number of cases by sexual offences becomes higher. Although various punishable ways have been introduced so far, increasing sex crime is still going on. Thus, effectiveness of legal systems for preventing crimes is questionable. More recently, the approach for environmental criminology has been paid attention for reducing criminal opportunities through environmental design and management of crimes. This study attempts to look over the spatial distribution of sexual crimes in the context of environmental criminology, and examine the correlation between regional environmental factors and the occurrence of sexual crimes empirically. To do this, we visualized the map for sex crimes at the macro-scale and explored the spatial distribution of sexual crimes and spatial clusters based on various spatial statistics using sex crime data published online by the ministry of gender equality and family. Also, we derived the environmental characteristics of sexual crimes by multivariate regression analysis on a large number of explanatory variables of regional environment. Our results will help to understand the current situation and spatial aspects of sex crimes in the nation more realistically. Further, it is respected that our results might be useful basic information for establishing regional policies and plans for the prevention of the sexual crime and enhanced public policing.

Characteristics and Court's Decisions of Sexual Assault Case against the intellectually disabled (지적장애인 성폭력 사건 특성과 법원의 판단)

  • This study examined characteristics and judges' judgments regarding sexual violence cases against individuals with intellectual disabilities by analyzing total 716 cases of court decision. Of 716 cases, 6.0% sentenced not guilty, 53.5% imprisonment, 36.7% suspended sentence. More than half of the victims had experienced sexual assault more than one time with the tendency of repeating being higher when the accused were relatives or acquaintances to the victims. In half of the total cases, the victims were not able to specify the time of incidents. Only in 20% of the cases, there was actual compulsion but in the remaining cases, there was no clear coercion used during the crimes. There are three issues regarding court's decision of sexual assault case against individuals with intellectually disabilities; (1) credibility of victims' statement, (2) inability of resist during the crimes, and (3) whether the accused were aware of the victims's disabilities. In the judgment of credibility of statement, consistency of statement was the criterion that was used most frequently, being followed by specificity of statement, motivation for false accusation, cognitive capacity of victim, and reports of statement validity analysis in the order. The most frequently used criterion of inability to resist was the victim's statement and attitude, followed by the statement and attitude of the accused, the victim's knowledge and understanding of sexuality in the order. Regarding to the awareness of disabilities on the part of the accused, the statement and attitude of the accused was most frequently used, the victims' communicative abilities, duration of relationship, and daily life competence in the order. There were no differences in the rulings and issues according to levels of disabilities and gender. When victims were under 13 credibility of statement became more argues but the awareness of disabilities less frequently than the cases of victims who were 13 or older.

A SURVEY OF EXTRAFAMILIAL CHILD SEXUAL ABUSE BY PHYSICIANS' REPORTS (의사들의 보고에 의한 가정외 아동성학대 연구)

  • The authors surveyed extrafamilial sexual abuse in the children under 15years old by the physician's reports. We sent the semi-structured child sexual abuse questionnaires to 7055 board certified pediatrics, obstetrics and gynecology, family medicine and emergency medicine. Total respondents were 1205. The results from these respondents were as followings. 1) The number of respondents who have had the experience of treating victims of extraf/amilial child sexual abuse were 641(53.2% of total respondents). 2) 338(52.7%) of the perpetrators were known persons and 277(43.2%) were strangers, the most common age bracket were 20s, 30s and 10s, and almost all(99.8%) of the perpetrators were male. 3) The mean age of victims was $9.7{\pm}3.5$ years old, and almost all(98.6%) of the victims were female. 4) The ways by which extrafamilial child sexual abuses were found were victim’s own reports:273(62.6%), pain complaint, 156(24.3%) and abnormal behavior 96(15.0%), other person’s report 72(11.2%), detection during examination 19(3.0%), and pregnancy 4(0.6%). 5) Time lags between extrafamilial child sexual abuses and hospital visits were within 24 hours 332 (51.8%) and from 1 day to 1 week 232(36.2%), victims were rather quickly 6) Physical complications were perineal wound 571(89.1%), hymen rupture 349(54.4%), wound of other part of body 124(19.3%), pregnancy 37(5.8%), and sexually transmitted disease 18(2.8%), and other serious complications such as vaginal-rectal lacerations 8, intastinal bleeding 7, death 2, hypotensive shock 1. These results suggest considerable numbers of physicians have had the experience of treating victims of extrafamilial child sexual abuses, and extrafamilial child sexual abuses are the major medical as well as social issue in children in Korea.
