This study is to investigate Trademark Prior Use Defence of prior use party under Trademark Law of the People's Republic of China. Chinese Trademark Law was amended for the third time and this Law shall enter into force on 1 May 2014. This third amendment introduced Prior Use Defence Right of Trademark for the first time. Article 59(3) gives the right to the prior use party for the continuous use of such trademark under the condition that first, an identical or similar trademark has been used in connection with the same goods or similar goods by others before the registrant's application, second, such trademark should have a certain influence in certain market, and third, such aforesaid trademark should be used within the original scope continuously. Then the exclusive right holder of said registered trademark shall have no right to prohibit others from continuous use of such trademark. Korean companies should be aware that it is almost impossible to search prior use trademark before a dispute arises, since the prior use trademark has never been registered. The best way to control the prior use trademark is to superintend aforesaid trademark for the use within the original scope.

This study aims to analyze the spatial patterns of intellectual property across various regions through an in-depth analysis of intellectual property trends and their influential factors. While there's an overall upsurge in intellectual property applications in the Seoul metropolitan areas, a more detailed inspection reveals divergent patterns based on the type of intellectual property - with patent rights primarily increasing in certain non-Seoul areas and trademark rights seeing a rise predominantly within Seoul. Our findings also suggest that the growth in intellectual property applications correlates positively with improvements in public transportation accessibility, expansion of knowledge-based service industries, and a rise in large enterprises, although the relationships vary by intellectual property type. These results indicate the significant influence of geographical factors and industrial structures on knowledge-generation activities, thereby suggesting a need for region-specific policies to bolster these capacities.

The purpose of this study was to analyze intellectual property right status and brand origin of traditional liquor. The data were derived from the brand of 385 traditional liquor species in Korea. The major results of this study were as follows: 1) The management types of traditional liquor were classified into three categories, namely; individual 27(0.74)%, stock company 304(78%) and corporation or union 38(9.8%). 2) Among 385 traditional liquor species, 102(26%) got the trademark registrations and 129(34%) were in the process of trademark applications, while 154(40%) were unregistered brands. 3) The origin of 187(48.6%) brands used the material names such as fruits, rices, trees, roots and flowers, while 176(45.6%) brand used proper noun such as mountain, distinction, rivers etc.. 4) The designation certification status of traditional skill possessor according to national and local autonomous entity were; intangible cultural assets 42 people, master craftsman 28 persons, and provincial intellectual property 16 persons.

The protection of Design is very important issues in these days. Even though Interior Design is also one of important design sections, it is relatively unprotected by formal intellectual property laws, yet creativity and innovation flourish. The needs for protection of Interior Design have been creased. The aim of this study is to suggest the weakness of the system for protection of Interior Design. The proposed research is comprised of two themes. One is to research Acts related to protection of Interior Design. The second is to study the registered cases under the Design Protection Acts. These two theme is generated by the comparative review between ROK and U.S.A. Through these comparative results, this study propose some considerations for an effective protection for Interior Design. Design need to be registered in the hole image of the space not a partial element. The concept needs to be protected because it is more effective way to respond the copying. Exterior for facade and Interior Design need to be registered in one registration to use the protection system actively.

The purpose of this study is to identify the limits of law on intellectual property generated from dance performance creation. It is based on literature research. It focus the way of dance works protection through current intellectual property laws after 21th century and the limits of them. First, it summarized copyright law, patent, trademark right, and trade secret. Second, it study the choreography of meaning and the process on field of the convergence. At last it summarized the limits of the intellectual property mentioned above. As a result, it is hard to fully protect the right by law whereas performing art create new form of style to communicate with audiences as develop convergence contents. There are significance on this study that summarize the intellectual property law and their limits when they applied to intellectual property from choreography, as a process of dance creation of today.

The purpose of this study is to investigate the spatial structure of the production of technological knowledge in the Korean photonics industry. Patent data were used as a proxy of knowledge production. The data were gathered by keywords among the registered patents which were applied from 1996 to 2007. The photonics industry patents registered at United States Patent Trademark Office(USPTO) show that Korea and Taiwan, as a latecomer, have rapidly increased. The photonics industry patents registered at Korean Intellectual Property Office(KIPO) were analyzed by type of application: single-applicant and co-applicant patents. The analysis of single-applicant patents shows that technological knowledge in the Korean photonics industry has been produced mainly in Seoul, Suwon, and Daejeon. The degree of spatial bias, however, has been slightly decreased during the study period. Above-mentioned regions are also main centers in the analysis of co-applicant patents, but the forms of inter-regional cluster and network are different over time. It is because agents participating in co-applicant patents are diverse and increased. Furthermore, it seems that policies, such as the improvement of the infrastructure of ICT, the promotion of the photonics industry and the industry-university-institute collaboration, are very influential.

As the capital of knowledge becomes more important than traditional capital like land or labor in the 21st century, the most competitive resource for corporations is knowledge. Furthermore, corporations may evaluate and improve latent knowledge of 'intellectual capital(IC)' within organizations, which will enhance their performance in the future. However, most Korea Distribution Companies have evaluated only tangible assets, ignoring latent capital. Since enterpreneurs have recognized that they cannot explain the difference between maret value and book value, the major advanced states lead to more sophisticated techniques to evaluate IC value. Although it is extremely important and urgent to evaluate IC value, the indexes of evaluating IC have never been examined and have been adopted by many corporations. Therfore, this study intends to develop a index for IC valuation. This study hopes to give some insights into the practical use of intellectual capital for the Korea Distribution Companies and help them develop a strategic perspective to enhance their competitiveness.
