Internet baking, e-commerce, business processing, etc on smartphone handing could be possible in present days. Ambiguity between cyber and real life has made vulnerability on infrastructure, Gov't Service and National security by cyber terrorism. Especially, Lots of Infrastructure and Gov't Service based on Information Technology were exposed by Cyber terror. Legal system should be improved to keep from these threats. This paper proposed needs of cyber legal system by analyzing proposed cyber related code on Korean National Assembly, issue on Cyber Control Tower, National Cyber Security Industry and Human resource.

Cyber attacks threaten the national security in this day and age. The government of the Republic of Korea recently released the National Cyber Security Comprehensive Countermeasures as a new cybersecurity policy. But current legal system cannot provide legal basis for the implementation of such measures. The current legal system related to cybersecurity is applied in each sector, thus the governance system in cybersecurity is separate. So there are many problems in the governance system in cybersecurity. To solve these problems fundamentally, it is righter to make a new cybersecurity law than to revise existing laws. Meanwhile, lawmakers proposed some bills in Congress to strengthen the cybersecurity in Korea in 2013. It will increase possibility of legislation of cybersecurity act to make a law through the analysis of these bills and to derive the essential elements from those. and to reflect these in the new cybersecurity act.

The Cybersecurity Information Sharing Act(CISA) of 2015, enacted in December 2015, is one of the greatest achievements of cybersecurity legislation in the United States. The promotion of cybersecurity information sharing is one of the tasks to improve cybersecurity governance in Korea. So it is an important issue to be addressed in cybersecurity legislation in Korea in the near future. CISA has many implications for cybersecurity legislation in Korea. Nevertheless, it is difficult to find preceding research that explain the content of CISA and study its normative meaning in Korea. Therefore, in this paper, the contents of the CISA is identified and its normative meaning and implication is found in five categories: definition of terms, establishment of information sharing procedures and conditions, promotion of voluntary information sharing by the private sector, checks on the executive branch and report to the Congress, and other matters. CISA facilitates information sharing based on willingness, while eliminating the side effects that may arise in the information sharing process. It is necessary to appropriately apply the good points of CISA to the cybersecurity legal system in Korea.

During the recent years, cyber attacks have been increasing both in the private sector and the government. Those include the DDOS cases in 2009, the Blue House cyber attack, bank hackings etc. Cyber threats are becoming increasingly serious. However, there is no basic law related to cyber security at present, and regulations related to cyber security are scattered in various domestic laws. This can lead to confusion in the application of the law and difficult to grasp the regulations related to cyber security. In order to overcome this situation, the bill on the prevention and countermeasures against cyber crisis was initiated in 2006, but it has been abrogated. Since then, it has been repeatedly proposed, but it has been abrogated repeatedly due to the overlapping of existing laws and concerns about infringement of personal information. The most recent initiative was the National Cyber Security Act, which was initiated by the government in January 2017. The act focuses on resolving the absence of a basic law related to cyber security, strengthening its responsiveness in the event of a cyber security crisis, and fostering security strength. Therefore, this study seeks to contribute to the establishment of National Cyber Security legislation as a basic law of cyber security by examining the necessity of National Cyber Security legislation through comparative legal analysis with existing domestic laws related to cyber security and suggesting policy implications.

Republic of Korea is divided into South Korea and North Korea, creating military conflicts and social conflicts. North Korea is conducting cyberattacks against South Korea and has hacked South Korea's defense network. In the world of cyberspace, the boundaries of the borders are becoming obscured, and cyberattacks and cyberterrorism for cyberwarfare operate with digital computing connected to points, time and space. Agenda and manual are needed for national cybersecurity. Also, it is necessary to study national cybersecurity laws and policies that can create and implement nationalcyber security policy. This paper investigates cyberterrorism situation in North and South Korean confrontation situation and damage to cyberwarfare in the world. We also study cybersecurity activities and cyberwarfare response agendas, manuals and new technologies at home and abroad. And propose national cybersecurity policy and propose policies so that '(tentative) The National Cybersecurity Law' is established. This study will be used as basic data of national cybersecurity law and policy.

Cyber attacks are threats to national security. Today, cybersecurity threats have various types, the theft or spread of privacy and national secret, the realization of direct attacks to infrastructure and the hacktivism with political or social objectives. Furthermore, There are special situations in South Korea because of North Korea's threats. Thus, It is necessary to handle cybersecurity as a kind of national security problem. It is a time to identify problems of governance system in cybersecurity and to improve related Acts and subordinate statutes. There are several tasks for legal improvement for governance system in cybersecurity. They are improving legal bases for the roles of the relevant authorities in cybersecurity, consolidating national joint response to cyber accidents, establishing and vitalizing information sharing system, constructing foundation of cybersecurity through industry promotion and manpower development, and acquiring defensive tools by enhancement research an development. In order to address these challenges, it is necessary to pay much attention to enactment and to revision laws and to practice legislative procedure.

본 논문에서는 전 세계적으로 사이버공간에서 발생하는 위협 등에 대한 대응으로 다각적인 방식에서의 사이버공간 내 행위에 대한 제재와 통제에 대한 법제변화에 대한 연구를 토대로 최근 사회주의체제 국가들에서의 적극적인 사이버공간 내 규제를 위한 입법동향을 비교·분석하고 있다. 더불어 현재 사이버안보법, 사이버기본법 등 사이버공간상 보안과 안보에 연계된 관련 입법안들이 사회적으로 논의가 지속되고 있는 상황에서 개인정보 등 헌법상 가치를 보호함과 동시에 국가차원의 사전적 방어를 위한 방안으로 '사이버 아이언돔(가칭)' 구축과 이를 위한 제도화를 제안하고 있다.

Since President Biden's inauguration, significant cyberattacks have occurred several times in the United States, and cybersecurity was emphasized as a national priority. The U.S. is advancing efforts to strengthen the cybersecurity both domestically and internationally, including with allies. In particular, the Biden administration announced the National Cybersecurity Strategy in March 2023. The National Cybersecurity Strategy is the top guideline of cybersecurity and is the foundation of other cybersecurity policies. And it includes public-privates as well as international policy directions, so it is expected to affect the international order. Meanwhile, In Korea, a new administration was launched in 2022, and the revision of the National Cybersecurity Strategy is necessary. In addition, cooperation between Korea and the U.S. has recently been strengthened, and cybersecurity is being treated as a key agenda in the cooperative relationship. In this paper, we examine the cyber security strategies of the Trump and Biden administration, and analyze how the strategies have changed, their characteristics and implications in qualitative and quantitative terms. And we derive the implications of these changes for Korea's cybersecurity policy.

Despite much discussions on cyber-terrorism in South Korea, several missing issues could be addressed. This paper attempts to deal with such missing but important issues. In South Korea, there has been little attentions on cyber-terrorism with the respects of national security strategy development under macro framework responding to future security environment. This article focuses on such issues. In other words, the purpose of this paper evaluates the meaning of national security threats raised from cyber-terrorism as a mode of security threats and proposes the matter of cyber-terrorism within the development of national security strategy in the future security environment. several issues in this discussion pass some important messages for the construction of national security strategic approach framework within the future security environment adding cyber-space. in the future environment, a new space called cyber is added as an important external condition which might determine the security of individuals, societies, and nations. Therefore, the fundamental strategic framework should be prepared. After that, the trend and direction of future technological advancement should be understood and the identity, nature, and types of threat should be analyzed. Also, after that, various responses and countermeasures are together constituted in the aspect of function and system regarding various anticipated threats of the future human society including cyber-terrorism.
