Study on the Factors Affecting the Intention to Share Electronic Medical Records (전자의무기록 공유 의도에 영향을 미치는 요인 연구)

  • This study examined the factors affecting the intention of the public to share electronic medical records(EMR) based on the theory of reasoned action and the privacy calculus model. It also investigated whether the purpose of EMR sharing varies depending on personal characteristics, such as the degree of interest in health and personal medical history. According to an online survey of 145 people, altruistic enjoyment, awareness of personal information protection, recognition of legal and institutional roles, and interest in health had a positive impact on the level of EMR sharing, and trust in hospitals positively adjusted the relationship between recognition of legal and institutional roles and sharing intentions. Accordingly, we confirmed that the public recognized the role of the government and hospitals in the sharing process as necessary. The public interest benefits of sharing are critical to activating public participation in the sharing of EMR, and it is also essential to prepare guidelines that legally guarantee the security and proper use of EMR.

Informed Consent and Refusal of Treatment in Emergency Medical Situation (응급의료에서의 설명·동의 원칙과 응급의료거부죄)

  • By analyzing informed consent and the refusal of emergency medical treatment (called patient dumping) under the current Emergency Medical Service Act, this study suggests that an emergency medical professional is only liable for patient dumping if their duty to protect the patient's life takes precedence over the patient's right to self-determination. In emergency medical situations, as in general medical situations, medical treatment should be performed after the emergency medical professional informs the patient about the medical treatment, including its necessity and methods, and obtains consent from the patient. Refusing or evading the performance of emergency medical services on the excuse of the informed consent not considering a waiver or alteration of informed consent requirements without reasonable reasons violates the Emergency Medical Service Act and thus makes an emergency medical professional liable to administrative disposition or criminal penalty. In other words, depending on the existence of a waiver of alteration of the informed consent, patient dumping may be established. If the patient is a minor or has no decision-making ability, and their legal representative makes a decision against the patient's medical interests, the opinion of the legal representative is not unconditionally respected. A minor also has the right to decide over their body, and the decisions of their legal representatives should be in the patient's best interests. If the patient refuses treatment, in principle, the obligation of life protection of emergency medical professionals is the top priority. However, making these decisions in the aforementioned situations in the emergency medical field is difficult because of the absence of explicit regulations regarding these exceptional problems. This study aims to organize the following precedents of the Supreme Court of Korea. The court states that, when balancing the conflicting interests between the duty to provide emergency medical service and the duty to inform is unavoidable for emergency medical professionals, they should put the duty to protect the patient's life ahead of the duty to inform if the patient's life matters. Exceptionally, when a patient has seriously considered whether they should receive treatment before the emergency medical situation, their right to self-determination can be considered equal to the obligation of emergency medical professionals to provide emergency medical treatment. This research also suggests that an amendment of the Emergency Medical Service Act should include the following. First, the criteria for determining the decision-making ability of emergency patients should consist of medical content. Second, additional consent from a medical professional is unnecessary for first-aid treatment. Finally, new provisions for emergency medical obligations for minors, new provisions for the decision standard when there are conflicting opinions about the treatment of a patient, and new penalty provisions for professionals who suspend emergency medical examinations and treatments need to be established.

  • The protection of fundamental rights of people is a natural duty of a state. Since Constitutional Law declare that a state is obliged to protect the fundamental rights of people obviously, it is reasonable to postulate that a state has a duty to protect every person's right much more positively. Of course, it is true that whereas right of freedom is much more important in modern states, the social right becomes more important currently. Nevertheless, we have no choice but to put an emphasis on the importance of the right of freedom like modern states. Thus states are still bound to try to protect the right of people, specific duty of behavior for the sake of right of freedom belongs to states. In particular, due to the fact that lifts are essential to our comfortable life and the demage from the accident concerning with the lifts is fatal, the strategy for securing the safety of using the lifts is significant to some extent. And because it is true that the experience of UK that put an emphasis on the role of civil actors is meaningful to us, there seems implications for us. Accordingly, it is possible to consider the material components such as the check of safety before installation for the sake of safety enhancement, quality control for lifts parts, specification of check criterion and variation of check cycle etc. and personal ones such as specification of qualification of competent persons, guarantee of competent person's independence, variation of obligator's duty and variation of user's obligation etc. However, as the situation of UK is one thing and that of Korea is another, we don't have to adhere to the policy and the experience of UK strictly. Rather, we had better apply the policy and experience of UK to ours appropriately.

  • Information spill was occurred several times in the country due to the negligence of the large internet service providers including SK Communications, Auction, KT. In order to judge the Internet Service Provider(ISP)'s liability in individual data spill caused by hacking, the violation of existing legislation or general principle of law's good faith principle has to be examined. However, based on current ISP's good faith principle, there is no objective standard for judging liability. Such uncertain range of protection action duty based on good faith principle generates complaint toward companies, therefore presentation of objective judgement range index on how to determine this range is needed. However due to the legal characteristic of above-mentioned law, it is not possible to fix the range of protection action duty and regulate it on law. In order to resolve this, rather than concerning simply on legal system level, fusion approach method is needed. Thus, this research will discuss the measure for objective standard for predicting ISP's range of protection action duty through fusion view dividing in technical, legal and administrative aspects.

  • 건설산업기본법이 지난 6월 1일 개정되어 시행에 들어갔다. 이 중 대한설비건설협회가 하도급자의 권리 보호와 공생발전을 위해 그동안 국토해양부에 관련제도 개선을 지속적으로 건의한 결과 하도급자 보호를 위한 부당특약 유형 확대 등이 개정되었다. 하도급자 보호조치 강화로는 부당특약 유형 확대, 하도급공사 준공 기성 검사결과 통지 의무화, 선급금 지급기한 신설, 도급계약서 미교부시 과태료 부과 등이 개정되었고 부실 부적격 업체에 대한 제재 강화로는 건설업 등록의 결격사유 강화, 건설업 등록말소 기준 강화 등이 개정되었다. 또 건설업 신고대상 추가, 과징금 상향조정, 과태료 대상 등도 개정되었다.

불법유해정보 법.제도 동향 분석

  • 기존 불법유해정보 분류체계를 비교 분석하여 재정립하고, 국내외 불법유해정보 법 제도 현황을 살펴 보았다. 이와 함께 불법유해정보 접근 차단 방안에 대한 이용자 설문 결과를 기초로 불법유해정보 차단에 대한 정책적 제언을 다음과 같이 제시하고자 한다. 먼저 기존 유해정보차단 프로그램의 문제점인 메모리 사용량 증가에 따른 컴퓨터 성능 저하현상을 개선할 수 있는 기술적인 대책이 마련되어야 하며, 청소년 이용자의 보호자 또는 학부모가 사이트별로 제한할 수 있는 기능을 추가하여 다중 필터링 시스템 환경을 조성해야 한다. 또한 기존의 불법유해정보 신고 프로그램은 신고주소, 신고제목, 증거자료 입력 등 복잡한 구성으로 인해 효율성이 떨어지므로, 신고를 원하는 사이트를 이미지화 하여 바로 저장 및 전송이 가능한 형태로 신고 프로그램을 제작하여 신고완료까지의 시간을 단축해야 할 것이다. 기존의 주민등록번호 입력 방식에서 개인식별번호를 이용한 i-PIN 도입을 의무화하고, 기존 i-PIN 사용자의 전환사용을 통해 불편함을 최소화하여 개인정보유출 방지를 위한 i-PIN 사용을 의무화해야 한다. 마지막으로 '자율 등급 서비스' 이외에도 제3의 기관을 통한 '제3자 등급 서비스'를 동시에 사용하여 정보제공자의 부정확한 등급 표시의 문제점을 보완하도록 해야 한다.
