Warranty contracting for pavements construction has been widely used in Europeans countries, Japan, and the U.S. and the benefits of warranty contract has been proven. This research investigated the European, U.S., and Japanese warranty contract policies and compared pros and cons. The most appropriate warranty contract policy solution is developed to fit in the Korean construction industry culture. Three main conclusions have been developed in this study: (1) performance specifications should be developed; (2) the systematic method is required to estimate the appropriate costs of performance bond and warranty period, etc.; and (3) short and long term plans for adopting performance warranty contract in Korea are suggested.

This study has been carried out in order to observe the status of performance warranty contracting system currently being implemented at the advanced countries including Europe, U.S.A., and Japan, review the introduction feasibility and possibility. For this purposes this study has surveyed the concept and necessity of performance warranty contracting system as well as the status of domestic performance warranty contracting system. Especially the application environment for the performance warranty contracting system of Europe, U.S.A., Japan and Korea in terms of maintenance guarantee liability system, performance warranty regulations for design-build contracting system, selection method of successful bidder, performance warranty means, project contracting system including maintenance cost, and specifications and contract conditions for performance warranty system have been comparatively evaluated. And introduction methods of performance warranty contracting system were suggested.

Warranty contracting is contracting methods that European Countries have applied to asphalt pavement projects from long ago, and in America as the expected effects of the warranty contracting are being verified to introduce it, the number of projects with warranty is being increased rapidly. In Japan, the warranty contracting suitable for Japanese style was established and is being applied. This study investigated and analyzed the present state of the warranty contracting being applied to European countries, America and Japan, and suggested advantages and disadvantages in introducing the warranty contracting into Korea and directions to introduce it. The principal result of this study is that performance bond contract system, performance surety bond system and performance bidding system should be established to introduce the warranty contracting into Korea.

There are many information assurance schemes(i.e., evaluation criteria and methodology) for security assurance of information systems, since the security is one of the most important characteristics in the modem information systems. However, there are confusions among schemes and redundancies of assurance. In this paper, we survey and classify conventional information assurance schemes by view points of assurance targets, life-cycles and nations. We propose three new information assurance schemes as the result of survey. Those are as follows: the schemes of the assurance on the requirement itself which is evaluated and certificated after standardizing the security requirements about the organizations and the applications, on the developing information system, and on the accreditation and certification about new information system. This will be helpful to set up a security assurance of National Defense.

건설산업 참여주체 사이의 고질적 문제들을 해소하고 건설산업의 재도약을 지원하기 위해 지난 1년 동안 운영해 왔던 건설산업 공생발전위원회(이하 공생발전위원회)가 하도급대금 지급보증제도 개선 등 많은 성과를 남기고 지난 10월 19일 제7차 위원회를 끝으로 활동을 마무리했다. 정해돈 대한설비건설협회 회장은 공생발전위원회 위원으로 참여하며 설비건설업계의 애로사항을 역설하고 ${\bigtriangleup}$공공공사 저가하도급심사제도 개선 ${\bigtriangleup}$하도급공사대금의 지급실적 점검 및 부당특약유형 확대 ${\bigtriangleup}$하도급대금지급보증서 보증약관 개선 및 발급감독 강화 ${\bigtriangleup}$주계약자 공동도급 대상범위 확대 ${\bigtriangleup}$산업재해 은폐에 대한 제도개선 등을 건의한 결과 저가하도급심사제도, 하도급대금 지급보증제도 등의 제도가 개선되었다. 특히 저가하도급 심사제도와 하도급대금 지급보증제도 개선 성과는 그동안 건설협회가 강력히 반대했으나 정해돈 회장을 비롯한 제8대 집행부가 똘똘 뭉쳐 일궈낸 성과라 더욱 의의가 크다. 본지는 공생발전위원회의 지난 1년간 활동을 점검해 본다.

This research suggests for efficient operation of the e-commerce guarantee financing system in domestic industries by reviewing the definition, current situation and problems of the e-commerce guarantee financing system in operation since 2001. Throughout the 10 years of the e-commerce guarantee financing system's implementation, technological development has solved many previously concerning factors. The goal of the study is to resolve the current issues of the e-commerce guarantee financing system and offer means by which to expand the accessibility of the system to domestic industries and further assistance to firms already using the system. One of the primary policies supported by the research is the reallocation of funds from archaic means of exchanging finances to the modem e-commerce guaranteed financing methods because of the increased transparency of the trading. Specifically, the funding operated by government guarantee agencies requires systematic promotion, justifying subsidies and tax breaks to companies that are using e-commerce guarantee financing because of the increased overall transparency. In addition, the benefits of e-commerce guarantee financing as a means of funding are numerous: the promotion of good business, relaxation of credit ratings for company loans, construction of the mobile operating system for small businesses, and creation of policy flexibility in operating fund agencies run by government. Future research areas include continued collection and analysis of the above data provided and new market feedback such as direct poll surveys of the operating staff in companies using e-commerce guarantee financing agencies.

감사원은 부실시공방지를 위해 건설제도 전반을 일대 혁신하는 총54개 사항의 건설제도 개선 방안을 최종 확정하고 재정경제원과 건설교통부등 관계부처에 통보했다. 앞으로 예정가격이 일정규모 이상인 낙찰자 선정방법이 가격경쟁에서 기술경쟁방식으로 개선되고, 공동도급으로 발주되는 공사의 입찰참가자격이 제한군 입찰대상업자만 입찰할 수 있도록 바뀐다. 또 감사원은 입찰 보증제도에서 일괄입찰보증하는 경우 매 공사별 입찰보증금 납부를 면제하도록 하고, 각종 보증 수수료를 건설업자의 성실도에 따라 차등 징수하도록 했다.

가업을 물려받는 영농후계자나 귀농을 생각하는 예비 농업인들도 농림수산업자신용보증기금의 보증지원을 받을 수 있을 전망이다. 또 일반 농가와 생산자뿐만 아니라 농업법인과 가공 유통업자도 보증지원을 보다 쉽게 받을 수 있을 것으로 보인다. 금융위원회는 농어업 활력제고 및 창조 농어업 지원을 위한 '농림수산업자신용보증기금(이하 농신보)' 제도를 이같이 개선할 방침이라고 지난 3일 밝혔다. 1972년 설립된 농신보는 농림어업인 등을 대상으로 농어업 대출자금 등의 보증을 지원한다. 설립 이후 96조5,000억원의 보증을 지원했다. 지난 5월 기준 보증잔액은 8조9,000억원으로 농어가(개인)와 농어업생산에 대해 중점적인 보증을 제공했다. 개인 생산자 보증잔액은 개인이 13조4,000억원, 생산자가 12조원이다. 금융위원회는 전통 소극적 지원방식에 치중된 농신보 보증지원을 대내외 여건변화에 따라 개설시킬 것이라고 밝혔다. 농신보 보증지원 대상 확대(농어가${\rightarrow}$법인, 생산${\rightarrow}$가공 유통) 및 보증방식 개선 등의 이유로 보증제도 개선이 필요해서다. 이 뿐 아니라 WTO 및 FTA 체결 등에 따른 농수산물 수입증가, 농어촌 인구 고령화 등 대내외 여건 변화도 이유다. 새로운 환경 대응 및 농어업 경쟁력 제고를 위해 지원 대상 확대 등 제로베이스에서의 검토 개선이 필요한 시점이다. 금융위가 발표한 농신보 기본 개선방향은 크게 3가지다. ${\triangle}$창업지원 및 우대보증 확대 ${\triangle}$지원대상 확대 ${\triangle}$기금제도 개선 등이다.
