수해양 공간 이용에 대한 다양한 시도와 관심이 증가하고 있다. 하지만 플로팅 건축물의 설계 및 설치를 위한 법제도의 미비와 명확하지 못한 법적 지위로 인하여 플로팅 건축물을 적극적으로 도입하고 활용하는 과정에서 많은 어려움이 발생되고 있다. 이러한 법제도의 미비와 법적 지위의 불평확함은 플로팅 건축물 및 관련 산업의 성장을 저해하는 가장 중요한 요소 중 하나로 국내 상황에 적합한 법제도의 정비와 개선이 시급한 실정이다. 하지만 현재까지 이와 관련된 자료조사나 연구가 체계적으로 이루어 지지 못 하고 있다. 따라서 본 연구에서는 플로팅 건축물에 대한 현행 법제도의 문제점과 법 적용 현황을 분석하고 국외 법제도 사례조사를 통해 플로팅 건축물의 설계 및 설치에 있어 가장 많은 영향을 미치는 플로팅 건축물의 법적 지위, 입지, 대지 및 인 허가에 대한 법제도 개선방안을 제시하였다.

Recently, the importance of systematic Land-monitoring has been emphasized. The existing Law does not include any definitions or regulations of monitoring. Although there exist laws regarding examining and measuring the current status of region, utilization, distribution, share, security and management of the data need to be improved. In order to upgrade the Land-monitoring system, several tasks such as terms, building cycle, forms, scope, management team should be well-defined. In this study, problems of the Land-monitoring is investigated by understanding the legislation in the land planning system and its operating system. The setting of the land-monitoring concept in Framework Act on the National Land and revision of specific laws in this field were introduced. Finally, new Land-monitoring legislation covering the improvement of the data-acquisition and co-utilization were suggested.

Recently many different floating buildings are planed and constructed in the sea, river, etc. for active use of water spaces. But many problems are occurred in the process of floating building design, construction and management due to the inadequate legal system. This incomplete legal system has become one of the critical factors which are hampering the invigoration of floating buildings. Therefore this study is to suggest preliminary data and improvement directions through a case study with domestic and foreign examples of appropriate laws and law applications concerning floating buildings. As the results of this study the laws related to floating building have to be revised in the directions of qualifying legally floating building as 'building' but not 'ship', designating 'special zone' for floating building site, and applying the established 'building licensing procedure' to floating building also.

우리나라는 항공안전을 위한 지속적인 노력으로 국제적인 수준의 안전성을 유지하여 왔으나, 최근의 여러 항공사고의 발생과 급변하는 국제적 환경에 따라 항공안전관리체계의 개선 필요성이 요구되고 있다. 본 연구는 이러한 상황에 대응하기 위해 2014년부터 수행되고 있는 시스템 기반 항공(운항, 감항) 안전감독 지원시스템의 개발 이후 원활한 운영을 위하여, 운영에 필요한 기반에 해당하는 법령 고시 훈령 예규 등 법제도와 정책의 수립을 위한 연구이다. 본 연구에서는 항공안전감독 업무에 관련되는 국내외 법제도를 조사 및 분석하여 문제점을 파악하고, 국외 사례와 비교하여 개선방안을 제시한다. 주요 개선방안으로는 법령에 위험관리를 위한 체계의 정의와 그 역할에 대한 세부적인 명시 등이 필요하다는 시사점을 제시한다.

In the current legal system, establishing aging friendly smart home based on healthcare for the senior people over 65 seems hard to be achieved. For these reasons, this study is intended to explore the improvements in the legal system using the comparative analysis in the domestic and foreign legal systems. The related legal system is divided into three sections - 'healthcare,' 'aging friendly,' and 'smart home' - providing that telemedicine would be implemented. According to the analysis of the legal system for healthcare, telemedicine is executed by the medical law. Thus, we need to investigate the concept and all the matters of telemedicine on the basis of foreign cases. As the result of the analysis of the legal system for 'Aging Friendly,' the definition of the elderly is ambiguous and we find the improvement of health and medical system. In addition to these, the definite bounds of the healthcare equipment have to be set. From these results, we are aware of the necessity of the improvements of the legal system, and suggest plans for these problems. That is to organize the legal system and make a new law through revising the current specific identification. This study focuses on suggesting the improvements of the legal system with the comparative analysis of the domestic and foreign legal systems.

The Government of the Republic of Korea has been continuously improving its legal system to ensure marine safety as a precaution against marine accidents. However, despite the ongoing improvement of the legal system, the number of maritime accidents has been increasing steadily, suggesting that the efficacy of the legal system is insufficient. As for recent marine accidents, small fishing vessels (less than 10 tons) account for 44.9 % of marine accidents over 5 years ('13_'17). Therefore, this study investigated the improvement status of the Korean government's legal system for small fishing vessels and the characteristics of related overseas legal systems in order to find a way to further improve marine safety for small fishing vessels. Following the results, the Korean government's laws related to small fishing vessels show a hybrid phenomenon due to the history of merging ('97) and separation ('09) of legal systems for fishing and non-fishing vessels, and it has been concluded that only improvements to construct additional facilities are being performed, and those in a fragmentary manner. In addition, overseas legal systems for small fishing vessels were confirmed to have requirements strengthening the responsibility of owners and operators of fishing vessels and introduced a self-inspection program. Based on these results, a plan is suggested to improve the efficacy of the legal system to ensuree marine safety for small Korean fishing vessels.

Purpose: This study aims to apply the counter terrorism policy in pertain to malicious drone abuse and the croweded public places in South Korea. And, to improve counter terrorism protection measure, this study suggests an adoptation of Anti UAV technology into counter terrorism related regulation. Method: Compared to nations' operations of counter terrorism prevention and protection activities with the South Korean gov, problems and limitations are suggested. Results: Anti UAV technology could not be applied for Multi-user facilities by any law due to the limitation, so that it is required to amend counte terrporism related policies and law. Conclusion: This study intends to identify various protection methods against UAV threats. To reduce the risk of UAV, the law of public safety and counter terrorism should be promoted and reinforced for the first.

Existing comparative studies on legal system of cyber security just listed and introduced several laws of Korea and other countries and presented comprehensive comparison. These studies makes it difficult to know that which part of the cyber security activities has insufficient legal system from a practical standpoint because it is not easy to figure out. So cybersecurity stages are chosen as comparison criteria. And the legal system of United States are chosen as the target comparing one of South Korea. Then the legal system on cybersecurity stages in South Korea is compared with one of United States. Therethrough many problems of the legal system of South Korea is identified, for example, the absence of regulations, the lack of clarity, lack of effectiveness, and overlapping regulations, in prevention, detection, response, the recovery in cyber security. And many ways are suggested to improve the legal system for the resolution of such problems.

Lee Myung-bak Administration declared the National Infomatization Strategy(NIS) in a timely manner from its inauguration. The NIS is a new program which innovates old-fashioned Infomatization policy of the past administration. NIS aims to upgrade Information-society(NIS defines its goal as 'The Creative and Trustful Knowledge-Information-society') This study examines both the Legislative Implication and the Legislation Principles for fulfilling Lee Myung-bak Administration's National Infomatization Strategy(NIS) by deducting legislative way concerning concrete plan for NIS. We expect this study to contribute to the IT Legislative policy of Lee Myung-bak Administration.
