가동중조사(ISI)에 적용되는 ASME-MI 의 1974년 Edition에 ISI시 검출된 흠함을 평가하는 절 차가 제시되었다는 것은 이미 언급한 바 있다. 가동중검사의 개념은 ASME-III에 따라 건설된 부품이라 하더라도 원자력발전소의 온 수명기간동안 또는 정해진 수명기간동안 재료 내부에 흠 함이 전혀 생기지 않는다거나 또는 성장하지 않는다고 볼 수 없다는데 에 근거를 둔 것이다. 즉, 부품을 건설할 때 ASME-III의 규정에 따라 수행한 비파괴시험(nondestructive examination)에 의하여 합격된 부품이라 할지라도 시험방법의 유효성 및 합격기준등에 의하여 발견되지 않았 거나, 발견되었더라도 합격된 흠합등이 있을 수 있다. 이러한 흠함들이 원자로의 가동과 더불어 성장하거나, 또는 부품의 사용조건에 따라 흠함이 새로이 발생할 경우는 RCPB의 구조적 건전성 및 안정성은 위협을 받게된다. 이에 대처하기 위하여 원자력발전소의 전수명기간의 통하여 정 기적으로 ISI를 수행해 줄 것이 10CFR50의 50, 55a, "Codes and Standards"에 법적으로 명문 화되어 있다. ISI 시발견된 흠함은 그 크기를 평가하여 합격기준을 초과하는 경우에는, 흠함의 제거(removal), 항리(repair), 부품의 대체(replacement), 또는 파괴력학적인 해석에 의하여 그러한 흠함이 구조건 안전성을 손상시키지 않는다는 것을 입증해 주어야 한다. ISI 시에 검출된 흠함을 평가하고 파괴력학적으로 해석하는 규정으로서 ASME-XI에 명시된 절차는 다음과 같다.차는 다음과 같다.

With the development of the national industry, the importance of the elderly and children such as the elderly, disabled, and children is recognized. Similarly, the number of facilities for the elderly and children is increasing. Fires at facilities for the elderly and children cause heavy casualties. In response to these events, it is essential to activate fire alarms promptly and accurately and to secure evacuation routes. In this study, the laws and statistics related to facilities for elderly and children were reviewed, and problems with legal terms-such as elderly, children, others, unwanted alarm of fire alarm systems, blind spots of fire compartment standards, securing evacuation routes, and absence of standards for life safety rescue organizations-were identified. As an improvement measure, the legal definitions of similar terms-such as elderly, children, unwanted alarm checklist, and establishment of standards for fire prevention compartment-and introduction of other terms-evacuation elevators, the establishment of standards for life-safety rescue organizations, and provision of flame retardation objects for evacuees-were proposed.

The flag State is primarily responsible for implementing international maritime conventions(IMO conventions) and national laws and other standards as far as its own vessels are concerned, on the other hand the port State exercise its rights for the safety and marine environment under international law especially UNCLOS within port and territorial sea. In particular, the port State may take appropriate measures including detention of ships identified as sub-standard vessels which are considered as port State's supplementary role aiming for implementing international and national and regulations. But in the course of implementing port state control, international disputes may happen between port state, coastal state and flag state in spite of making all possible efforts to avoid these disputes. This paper aims to consider legal grounds on port state control(PSC) in international conventions and national laws concerned and deals with contradictions between international and national law arising from exercising PSC by port state control officers(PSCOs).

This study aims to propose methods for determining the minimum book purchase cost budget in university libraries in accordance with the "University Library Promotion Act" and efficiently allocating and executing the secured book purchase cost budget to each department. To achieve this, the current status of university libraries and legal standards were examined and strategies for securing the minimum book purchase cost budget in accordance with legal standards were suggested, and a method for efficiently distributing the secured budget to departments was proposed. First, we determined the material acquisition budget for university libraries by applying the average price of domestically published books to the standards set forth in the University Library Promotion Act. The allocated budget was distributed with 80% assigned to departments and 20% budget for librarians. The department's allocated budget of 80% was then recalculated to 100% and distributed by applying three criteria: book prices by topic, student enrollment, and utilization rates.

Recently, a patent holder of a technology that has been selected as a standard has caused considerable difficulties in enacting and using a patent technology standard as a patent ambush act that abuses the right. Major countries in the world are preparing legal grounds to prevent patent ambush, but in Korea, legal binding is very limited. Therefore, in this study, various proposals were attempted to prepare problems and policy solutions related to patent ambush in standard patents. In particular, we investigated issues and cases related to domestic and foreign ambush patents, it is considered that it is necessary to prepare a legally available device, clear standards for abuse of FRAND patent rights, and a patent compensation system to prevent patent ambushing.

본 연구는 일본 국립공원의 경관관리를 위한 법제적 내용특성 중 공원시설물을 위주로 정리한 것이다. 이를 위해서 전국적 기준인 일본의 자연공원법규의 내용을 경관관리 측면에서 정리한 후. 아소. 쿠쥬 국립공원을 대상으로 공원계획서의 내용을 정리하여 전국적 기준과 지역적 관리기준의 차이를 파악하면서 국내범규와 차이점을 검토하였다. 그 결과 일본의 자연공원법규 중 우리 나라와 차이가 있는 공용제한의 내용과 공원계획의 내용 및 공원시설물의 차이를 파악하였고, 공원 내 각종행위에 관한 심사기준이 법제화되어 있음이 조사되었다. 한편, 일본의 경우에 있어서 법적인 근거는 없으나 집단시설지구에서의 이용허가 및 규제내용을 제시하기 위해 국립공원관리소장이 작성하는 관리계획은 보호, 유지할 지역의 경관자원을 명확히 하면서 각종 시설물의 건설행위에 대해 그 규모, 위치, 색채, 디자인 관련 사항 등에 관하여 관리지침을 작성하여 운영하고 있는 실체를 파악할 수 있었다.

전화망을 기반으로 한 우리나라의 공중 통신망이 인터넷 서비스가 도입되면서 이용자가 사용하는 단말장치도 다양한 형태로 발전하고 있다. 전기통신을 효율적으로 관리하기 위하여 정부가 시행하고 있는 단말장치에 대한 기술적 규제인 기술기준도, 통상의 아날로그 전화회선용 장치를 비롯하여 디지털 전송장치, 케이블모뎀, 이더넷인터페이스장치 ADSL모뎀 및 VDSL모뎀까지 새로운 단말장치의 등장에 보조를 맞추어 개정되어 오고 있다. 본 논문에서는 단말장치에 관한 기술기준의 필요성, 법적 위치, 대상 장치의 변천 기술적 조건의 설정 개념 등을 파악하고, 규제 설정의 핵심인 기준 내용분석 등을 통하여 현행의 제도를 이해함과 더불어 앞으로의 기술적 조건에 대한 연구 방향을 모색한다.

지하공간 건축물의 피난공간확보는 인명안전설계의 첫 단계로서 이를 위한 선큰설치 기준은 피난안전기준의 제도적 선진화를 위한 매우 중요한 규정으로 볼 수 있다. 본 연구에서는 현재 적용되는 선큰의 법적 기준에 대해서 살펴보고 일본과 비교하여 실제 건축물에 대한 사례 분석을 실시하였다. 현재 사용 중인 선큰 건물을 대상으로 피난시간을 비교 분석한 결과, 비상계단만을 이용한 피난 시간보다 선큰과 비상계단을 함께 이용한 피난 시간이 각각 52%와 65%의 감소하였다. 따라서 비상계단으로의 대피에 비하여 선큰의 피난 효용성이 매우 높은 것으로 분석되었으며 선큰 출입구의 설치 위치 및 평면 배치형태가 피난시간에 미치는 영향도 알 수 있었다.

공동구내 설비에 대하여 공동구 관련 설치 및 유지관리 지침이 있고 지자체별 또는 공공기관별로 법적 장치가 있으나 충분한 설계기준을 반영하지 못하고 있다. 운영중인 공동구의 관리도 지자체 시설관리공단등으로 나누어져 있어 공통되고 일괄된 설치기준이나 유지관리제도도 확립되지 못하여 비효율적이다. 본 연구에서는 공동구 설계기준과 작성과 관련하여 작성방향에 대하여 살펴보고자 하였다.

고객이 요구하는 정보를 효율적으로 제공하기 위한 전자 카탈로그를 구축하는 것은 e-business의 성공의 핵심적 요소이다. 우수한 상품 판매 기술을 이용하여 고객의 판매 결정을 촉진하는 전자 카탈로그가 있는 반면, 그렇지 않은 경우는 사업적 손실과 법적인 분쟁까지 초래하기도 한다. 전자 카탈로그가 전자 상거래 사이트의 중심 요소임에도 불구하고 이제까지 학문적, 실용적 분야에서 전자 카탈로그의 평가 방법에 관한 연구는 찾아보기 힘든 상황이다. 따라서 이 연구에서는 우선 효과적인 전자 카탈로그 구축을 위한 요구사항을 도출해 내고 그것을 전자 카탈로그 평가 기준으로 적용하여, AHP(계층적 분석 방법)를 사용해서 평가 기준간의 상대적 중요도를 개발해 내는데 목적이 있다. 그 평가 기준의 상대적 중요도는 기업이 전자 카탈로그를 구축할 때 중점을 두어야 할 사항을 결정하는데 기준을 제시해 줄 것이다. 이 연구의 결과는 평가는 물론 효율적인 전자 카탈로그의 개발을 위한 지침을 마련해 줄 것이다.
