The proposal for improvement of cultural heritage industry (문화유산산업의 발전에 대한 제언)

  • This research focus on suggesting productive proposal for Culture heritage industry improvement plan. we survey various other countries' policy for culture heritage industry development. It is important to collect ideas from other countries' cases then expand and adapt to our country's industry. Detailed proposal for Cultural heritage is suggested, Such as, young Cultural helper to increase the cultural activity participation. Three factors are stated, first cultural man power creation, digitalizing cultural asset data, and cultural asset story making.

  • Adoption of applicable law for the international trade of artworks is closely related to the results of lawsuits. Recently, starting with New York, the hub of the international artworks market, a modern, mixed-law is gradually being adopted more. It is difficult to designate an applicable law of an international trade of artworks through private laws regulations of relevant countries, and the public laws regulations must also be considered in relation to individual benefits and the public benefits to the relevant countries. With regards to the foreign relations issues, Korea's private international law embraces a so-called public order theory, and according to the Section 7 of the Act on the Private International Law and its enactment history, the compulsory provision, which seems appropriate for application to the corresponding matter, applies without regards to the selection of the applicable law. The Civil Act of Korea acknowledges bona fide acquisition of a cultural asset, in principle, if the Cultural Heritage Protection Act is not applicable. Moreover, a lost artwork is also a subject of bona fide acquisition; however, if the relevant artwork is either stolen or lost, the original owner has the right to demand the return of that artwork within 2 years of being stolen or lost according to the Section 250 of the Civil Act. Also, if the buyer purchased from a distributor specializing in the artworks, such as auction, open market or gallery, the buyer could request a compensation of the purchase price from the original owner, and if the buyer purchased through a private transaction, the buyer cannot demand a compensation of the purchase price and must return the artwork.

  • This research is safety administration turkey and research for improvement of a lot of cultural asset to butyric acid officer and whole country since Sungryemunhwajae, and is preventing by meantime Cultural Properties Protection and fire fighting relevant law to protect these cultural asset but want is not few in cultural asset fire precaution yet. Therefore, I wish to study about operation and application standard of water system system that is applying to supplement these problem.

  • This study focused on the classification systems of modern architecture and facilities reviewing the characteristics of domestic and foreign cultural heritage classification systems. The results are as follows : (1) It is necessary new classification system for recent emerging architectures and facilities which contains new functions, and reflecting new scope of cultural heritage, in example cultural landscape. (2) Reviewing the related spheres which can produce future cultural heritages such as KDC, Industrial Classification and foreign trends on the cultural heritages, we classified 6 main categories ; Politics & Diplomatics, Industry & Economy, Society & Life, Culture & Art, Technology & Science, Military & Public Safety. (3) Under the main category, we divided sub- and subject-category according usages of objects for reflecting the registered appreciations.

일본 나라문화재연구소의 독립행정법인 이행과 관련된 제문제

  • 일본 문화청 소속의 정부조직이었던 나라국립문화재연구소가 국가조직의 행정개혁에 따라 현재의 독립행정법인 나라문화재연구소로 변혁하면서 나타나고 있는 여러가지 상황에 대해서 살펴보고자 한다. 나분켄은 동아시아에서도 잘 알려진 국보 호류지금당벽화의 소실이 문화재 분야의 큰 문제로 부각되면서 종합적이고 학술적인 문화재의 연구 보호 종합기관의 설립 필요성에 의해 만들어진 기관이었다. 연구분야에서 보면 초기에는 역사, 건축, 미술공예, 정원, 유적 등 다양한 분야에서 출발했으나 나라지역의 헤이조큐 유적보존 문제가 주요 이슈로 떠오르면서 매장문화재의 발굴 중심으로 그 역할이 강화되는 변화를 겪에 되었다. 그러나 선사고고학이 아닌 역사고고학이 중심이었기 때문에 건축사나 정원사, 보존과학 등 서로 다른 학문이 융합하여 연구할 수 있는 강점이 강화되어 설립목적은 견지하면서 변모하였다. 독립행정법인으로의 변화는 1999년의 제145차 통상국회에서 "독립행정법인통칙법"이 성립되면서 부터였다. 독립행정법인의 취지는 독립 운영하는 쪽이 효율적인 부분을 분리시켜 법인격을 가진 기관으로 바꾸면서 운영교부금을 주무관청으로부터 받아 사용처를 독자적 재량에 맡기면서 이윤을 올릴 수도 있게 한 것이다. 또한 조직과 인사의 자율성을 보장받는 장점도 있으나 평가시스템이 되입되는 정신적 부담도 공존하게 된다. 즉, 민간 방법의 도입에 따라 국가의 부담을 경감하고자하는 의미가 내재되어있다. 나분켄의 독립행정법인화는 동시에 도쿄문화재연구소의 통합을 수반하게 되었다. 도분켄은 원래 미술공예품을 중심으로한 동산문화재 연구와 보존과학부분에 충실한 조직이었으므로 부동산문화재 중심의 나분켄과 통합에 우려의 목소리가 있었다. 그러나 불행중 다행으로 다카마쓰즈카 고분벽화의 열화문제와 키토라 고분 벽화의 보존문제로 인하여 전무후무한 협업연구가 진행되고 양 연구소의 역량을 결집할 수 있는 계기가 되었다. 결론적으로 말하자면, 독립행정법인화는 매년 예산을 중기계획이나 연도계획과 정합성을 유지하면서 독자적인 판단을 통해 편성하는 등 극히 유연한 대응이 가능하다는 장점을 가지고 있는 반면, 문화재 보존을 위한 연구라는 공공적인 목적을 가진 조직이 정부의 의도대로 독자적으로 이윤을 올리는 사업을 확립하여 국가의 부담을 경감하는 방향으로 나아갈 수 있는가라는 부분에서는 의심할 여지가 남아 있다.

Process of Institutionalization of Cultural Property in Taiwan and Comparison of Joseon (일제강점기 대만(臺灣)의 문화재 제도화 과정과 조선 비교)

  • Taiwan and Korea have common memories of colonization by Japan. Therefore, for researchers studying colonial times, the two countries are becoming good comparative studies. In this article, a comparison of cultural properties systems between Taiwan and Joseon revealed the following. First, from a legal point of view, Japan's internalism was reflected to some extent in Taiwan. Accordingly, Taiwan's "Enforcement regulations for Historical scenic spot scenic natural monument storage method(short, Enforcement regulations)" was subordinate to Japanese law, and the Joseon's "Enforcement ordinances for Treasure and Historical scenic spot scenic natural monument storage method in Joseon(short, Enforcement ordinances)" was less than the preservation order of Taiwan. But it is not possible to equate the two differences to Japan's oppressive levels. Second, while the Joseon's "Enforcement ordinances" enactment referred to relevant laws that were promulgated in Japan, it is highly likely that Taiwan's "Enforcement regulations" When establishing Joseon's "Enforcement ordinances" order, it is reasonable to assume that all laws concerning cultural properties of Japan and Taiwan were taken into consideration. Third, the difference between Taiwan and Joseon in the quantity and content designated as cultural properties was huge. The difference in the designated quantity between Taiwan and Joseon was the difference between traditional cultural resources between the two regions, which led to 14 times more cultural properties designated in Joseon than in Taiwan. And while nearly half of Taiwan's history was the vestiges of Japan's ruling power, few of the ancient sites designated by the Joseon had traces of Japanese ruling forces. This is the result of a difference in the views that the two powers had on cultural properties.

A Study on the Improvement Direction of Natural Heritage in the Cultural Heritage Protection Act - Focused on the Landscape Architecture Field in Cultural Heritage - (문화재보호법에서 자연유산 분야의 개선 방향에 관한 연구 - 문화재 조경분야를 중심으로 -)

  • This study intends to discuss the system improvement of landscape architecture field in the cultural heritage protection system, which is changing continuously. The results are as follows. First, the status of landscape architecture in cultural heritage, including natural monuments and scenic sites, must be defined. If possible, careful consideration should be given to establish the natural monuments law and scenic sites law, respectively, related to landscape architecture. Second, natural heritage must be preserved by focusing on "space" to include cultural artifacts and landscapes that may be missing through the method of "object" focused protection. Institutionally, the scope of work should be clearly shared by reviewing the redundancy and interrelationship of related laws. Third, in order to protect and manage natural heritage, a department that is wholly responsible for landscape architecture should be established independently at the Cultural Heritage Administration. Fourth, the landscape architecture field should be specified as the requirements for the commissioner of commission at the Cultural Heritage Protection Act. In addition, it is necessary to improve the system such as expending the roles of the repairing technician for landscape architecture and plants in the Cultural Heritage Protection Act.

Material Stability Assessment of Low Oxygen and Heating Treatment (저산소 및 열처리법에 대한 문화재 재질 안정성 평가)

  • Low oxygen treatment and heating treatment are used to prevent insects in the field of food science. These eco-friendly control methods can be applied to biological control technique in conservation treatment of organic cultural properties. To evaluate material stability, low-oxygen treatment and low oxygen treatment are applied to wood, pigment, paper and textile that are related to historical wooden buildings. As a result, wood moisture content declined after low oxygen treatment. But decline rate is a little, so it can be expected to turn back original state as time passes. And test result on pigment, paper, textile of chrominance and strength of test materials are stable. But after heating treatment, pigments are separated.

A Study of the Cultural Legislation of Historic Properties during the Japanese Colonial Period - Related to the Establishment and Implementation of the Chosun Treasure Historic Natural Monument Preservation Decree (1933) - (일제강점기 문화재 법제 연구 - 「조선보물고적명승천연기념물보존령(1933년)」 제정·시행 관련 -)

  • The Preservation Decree (1933) is the basic law relevant to the conservation of cultural property of colonial Chosun, and invoked clauses from the Old History Preservation Act (1897), the Historic Scenic Sites Natural Monument Preservation Act (1919), and the National Treasure Preservation Act (1929), which were all forms of Japanese Modern Cultural Heritage Law, and actually used the corresponding legal text of those laws. Thus, the fact that the Preservation Decree transplanted or imitated the Japanese Modern Cultural Heritage Law in the composition of the constitution can be proved to some extent. The main features and characteristics of the Preservation Decree are summarized below. First, in terms of preservation of cultural property, the Preservation Decree strengthened and expanded preservation beyond the existing conservation rules. In the conservation rules, the categories of cultural properties were limited to historic sites and relics, while the Preservation Decree classifies cultural properties into four categories: treasures, historic sites, scenic spots, and natural monuments. In addition, the Preservation Decree is considered to have advanced cultural property preservation law by establishing the standard for conserving cultural property, expanding the scope of cultural property, introducing explicit provisions on the restriction of ownership and the designation system for cultural property, and defining the basis for supporting the natural treasury. Second, the Preservation Decree admittedly had limitations as a colonial cultural property law. Article 1 of the Preservation Decree sets the standard of "Historic Enhancement or Example of Art" as a criteria for designating treasures. With the perspective of Japanese imperialism, this acted as a criterion for catering to cultural assets based on the governor's assimilation policy, revealing its limitations as a standard for preserving cultural assets. In addition, the Japanese imperialists asserted that the cultural property law served to reduce cultural property robbery, but the robbery and exporting of cultural assets by such means as grave robbery, trafficking, and exportation to Japan did not cease even after the Preservation Decree came into effect. This is because governors and officials who had to obey and protect the law become parties to looting and extraction of property, or the plunder and release of cultural property by the Japanese continued with their acknowledgement,. This indicates that cultural property legislation at that time did not function properly, as the governor allowed or condoned such exporting and plundering. In this way, the cultural property laws of the Japanese colonial period constituted discriminative colonial legislation which was selected and applied from the perspective of the Japanese government-general in the designation and preservation of cultural property, and the cultural property policy of Japan focused on the use of cultural assets as a means of realizing their assimilation policy. Therefore, this suggests that the cultural property legislation during the Japanese colonial period was used as a mechanism to solidify the cultural colonial rules of Chosun and to realize the assimilation policy of the Japanese government-general.

  • 필자는 대학박물관의 건전한 육성을 위한 선결과제로서 법령정비의 중요성을 강조하여 오면서 ${\ulcorner}$대학박물관, 법적근거 마련이 시급하다${\lrcorner}$(한국 대학박물관협회 편, ${\ulcorner}$고문화${\lrcorner}$ $40\cdot41$ 합집, 1992. 12)를 발표한 데 이어, ${\ulcorner}$'박물관 및 미술관 진흥법'의 개정방향과 그 시안${\lrcorner}$(한국 대학박물관협회 편, ${\ulcorner}$고문화${\lrcorner}$ 44집, 1995. 1)을 발표하였다. 필자는 이 시안을 준비한 1993년부터 문화체육부, 교육부, 총무처, 법제처, 국립중앙박물관, 국립현대미술관, 문화재 관리국, 한국 박물관 협회, 한국 대학박물관 협회 등 관련기관과 협의하여 동법의 전면개정을 추진하여 왔으나, 각 기관의 이기주의가 극심하여 동 법의 개정작업이 얼마나 험난한가를 뼈저리게 절감하였다 이에 이미 발표한 시안을 현행법규와 비교한 개정시안으로 다듬어, 관계 제 기관이 참여하는 공청회를 통하여 전면개정을 추진하는 한편, 1996년 4월 총선으로 새로 구성되는 15대 국회의 문공위원회에도 전면개정의 여론을 환기시킬 예정이다. 필자는 1991년부터 국립대학교 박물관장 협의회 부회장을 맡아오고 있으며, 95년도부터 정부예산안에 각 국립대학별로 ${\ulcorner}$박물관 지원비${\lrcorner}$의 예산계상을 관철시킨 바 있다.
