The purpose of this study was to propose appropriate requirements to obtain a pilot's license in order to improve the safety of pilotage related to a survey of experts involved with pilotage. The survey has been conducted by experts from stakeholders in various fields. To suggest requirements for the license, a hypothesis test has been conducted. It turns out that onboard experience with higher gross tonnage is eligible for pilot. Secondly, it is required to have onboard experience of more than one year as a captain, within 5 years from the date that the individual takes the pilot's written test, with 5 years onboard experience as a captain. Lastly, if personality and aptitude tests are added to the requirements to obtain a pilot's license, the safety of pilotage will increase rapidly.

심해에서의 유전개발이 활성화되면서 이러한 개발에 필수적인 장비인 동적위치제어시스템 (Dynamic Positioning System, DPS)을 설치한 선박 또는 해양구조물의 수요도 폭발적으로 증가하고 있으며, 이에 따라 DPS 운영에 필수적인 DPO (Dynamic Positioning Operator) 자격증을 취득하고자 하는 지원자도 매년 급속하게 증가하고 있다. 그러나 DPO 교육훈련과정은 강제요건이 아니며, 따라서 엄정한 자격증명 및 검증이 어려운 실정이다. 특히 매년 2000건 이상의 신규면허를 심사하고 발급하는 것은 물론 기존 면허자에 대한 재검증 절차도 수행하여야 하는 현재의 상황으로 볼 때 효율적인 DPO 양성을 기대하기는 어려운 실정이다. 이 연구에서는 보다 이러한 문제점을 개선하여 보다 더 효율적이면서도 엄정한 DPO 양성을 위한 제도개선을 제안한다.

주류산업에 대한 그동안의 규제개혁이 획기적인 성과를 가져왔을지라도 아직 미흡한 점이 적지 않다. 술 시장의 경쟁이 활성화되고, 저(低)알코올이면서 다양한 술이 많이 생산되어 소비자의 선택이 확대될 수 있는 방향으로 더욱 개선할 필요가 있다. 대표적인 예를 들어보면, 다양한 술이 생산될 수 있는 여건을 위해 시설 기준에 대한 규제를 재고하고, 주류 면허를 개방하면서 특산주와 소규모 맥주 제조처럼 제조자의 요건 등을 제한하고 있는 규제를 개선하는 것이다. 또한, 지역별로 특색있는 술 생산을 촉진할 수 있도록 외국에서처럼 중소기업에 대한 세금 감면 등을 실시하고, 술에 넣는 첨가물을 일일이 제한하는 것과 같은 주류 규격에 대한 규제를 더욱 완화하는 것이다.

Bisher wurde kein Beruf zwischen Recht und Berufsethik so diskutiert wie Ärzte. Diskussionen über die Qualifikation(od. Approbation) von Ärzten sind nicht nur eine Frage Koreas, sondern in den meisten zivilisierten Ländern ein wichtiges Diskussionsthema, wenn ein Arzt insbesondere für eine Straftat bestraft wird. Vor kurzem hat sich die koreanische Ärztekammer (the Korean Medical Association) weitgehend gegen das, "Entwurf eines Gesetzes zur Reform des Medizingesetzes" stark ausgesprochen, das die Grunde für den Entzug einer Approbation für ein Verbrechen eines Arztes erweitert. Vor allem wird auf die Gefahr hingewiesen, eine Approbation für Straftaten zu entziehen, die nicht mit beruflichen Pflichten zusammenhängen. Es ist jedoch vernünftig, den Beruf bzw. das Gewerbe zu verbieten, wenn ein Fachmann unter Missbrauch seines Beruf oder grober Pflichtverletzung die Tat begangen hat und die Gefahr bestehet, dass er bei weiterer Ausübung seines Berufs erhebliche rechtswidrige Taten der bezeichneten Art begangen wird. Die Untersagung der Berufsausübung soll die Allgemeinheit gegen die spezifischen Gefahren schützen, die mit der Ausübung eines Berufs oder Gewebes verbunden sind. Da das Berufsverbot nur die Berufsausübung untersagt, die Approbation selbst aber bestehen lässt, kann die Approbationsbehörde in eigener Entscheidungskompetenz die Approbation zurücknehmen, wiederrufen, oder in Ruhen anordnen. Entsprechend dem Verhätnismäßigkeitsgrundsatz ist aber auch das Berufsverbot auf bestimmte Tätigkeiten im Bereich des Berufs zu beschränken, wenn dies zur Erreichung des Maßregelzwecks, dem schutz der Allgemeinheit, ausreichend ist. In diesem Beitrag wurden die Voraussetzunen des Berufsverbots und die tatsächlich an Ärzte bzw. medizinische Personal gerichteten Fälle untersucht.

The space center will be constructed by 2005 for launch of KSLV-I at Woinara-Do, Haban Village, Yenae-Ri, Bongrae-Myon, Kohung-Goon, Junlanam Province on the southern coast of the Korean peninsular. This will make Korea be the 13th advanced country in space development having launching site in the world. This paper presents licensing and safety requirements to protect the public from the risks associated with activities at a launch site.

In 2013, dental hygienist is in its 100th year. As Dr. Fones opened two year dental hygiene training program at Bridgeport Junior College in 1913. 'Dental Hygienist', the profession that specializes in oral disease prevention and health science, was first used. Since 'Dental Hygienist' was first introduced in the States, looking back through the America's development of dental hygienist would be the basis of checking development process of the international dental hygiene system and comparing the system of each country. This study focused on the contemplation of how America's dental hygienist became professional through 'development of dental hygienist', 'development of dental hygiene education system', 'development of dental hygienist's license and related qualification system', 'Dental hygienist laws and ethics', and 'dental hygienists' role and scope'. America's dental hygienist has requirements to become professional and also dental hygienist is socially recognized as professional. Therefore, the purpose of this study is to investigate the process of American dental hygienist professionalization. Thus, references and literature were gathered and analyzed.

본 연구는 도선사의 근무 연한이 도선의 안전성에 미치는 영향을 살펴보고, 도선사의 근무 연한에 영향을 주는 요인에 대해 분석하는데 목적이 있다. 우선, 지난 10년간 도선사의 진입연령 추이를 통해 해마다 약 0.3년씩 신규 도선사의 고령화가 진행되고 근무 연한 또한 줄어들고 있음을 확인하였다. 둘째, 도선사의 근무 연한이 짧아져서 전문 인력의 활용도가 떨어지고 도선의 안전성에도 악영향을 미치는 것으로 나타났다. 셋째, 도선사의 근무 연한에 직접적인 영향을 미치는 요인인 도선사 면허시험 응시요건과 승무경력가산점 그리고 도선사의 정년에 대하여 상세히 분석하였다. 따라서 도선사의 근무 연한에 영향을 미치는 이러한 요인들에 대하여 정책적으로 개선한다면 도선의 안전성을 향상시키고 나아가 아름다운 우리나라의 항만을 깨끗하고 안전하게 지킬 수 있을 것으로 기대된다.

This paper investigates the mandatory minimum requirements for certification of officers in charge of a navigational watch on ship specified in the international convention of STCW. The training education and evaluation systems for navigational competence of Korean navy were compared and analyzed. The paper suggests adjustment of the evaluation range, increment of evaluation items, diversification of evaluation types, differentiation of certification-related education by officer's commissioning program in order to improve the PQS system.

An increase in the number of retiring experienced pilots as well as drastic graying of new pilots will raise the problems on deepening imbalance of supply and demand of pilots over the next 7 years, which could entail fatal problems for the safety of harbour pilotage. In this study, the improvement plan of legal system to ease imbalance between supply and demand of pilots and help secure more experienced pilots has been proposed. A current state survey and analysis, statistical analysis, questionnaire survey on foreign countries, in-depth consultation with experts, etc., were all carried out to support this research. The conclusions of this study are, firstly, to propose an amendment that the minimum requirement of 5 years of seagoing service as a master to sit for the pilot exam should be relaxed to 2 years(which must include at least 1 year of master's seagoing service within the most recent 5 years) but the minimum requirement of 1 year of pilotage service should be reinforced to 1 year and 6 months to obtain a higher class of pilot certificate. Secondly, it is proposed that an amendment offering an additional 1 point per year over the minimum period of 2 years of seagoing service as a master should be added, with a maximum of 10 points in order to rationalize the additional incentive point system. In order to secure experienced pilots and resolve the legal conflict between the certificate revalidation system and the retirement system, it is also proposed that an amendment be passed revoking the retirement system and limiting the validity of any new certificates only to 68 years of age when issuing or revalidating a certificate, if an applicant is over a certain age. Promotional work, such as collecting opinions from interested parties and generating positive public awareness, should be carried out in the future. It will also be necessary to conduct a study on the training pilot exam system.
