본고는 한국지식문화재단 입법 공청회에서 발표 자료로 제시된 것으로 현재 입법 준비과정에 있는 기존 법률에서 사이버명예훼손에 관한 부분에 대한 법률 개정을 위한 공청회 자료이다. 정보통신망이용촉진 및 정보보호 등에 관한 법률은 현재 인터넷을 통해 진행되는 갖가지 부조리와 불법적인 행태에 대처하지 못하는 감이 없지 않다. 때문에 개정안 입법도 변화하는 정보 사회에 발맞추기 위한 목적으로 진행되고 있다.

최근 미국에서는 Feist 판결 이후 데이터베이스의 보호에 대해 저작권법에만 의존하기에는 미흡하다는 인식이 확산되었다. 이에 저작물성이 인정되지 않는 데이터베이스에 대해 주법상의 부정이용을 주장하여 해결하려는 움직임이 판례에서 종종 보여지고 있는데, 아래에서 소개하려는 NBA사건도 이와 관련된 사건으로서, NBA 경기에서 점수 등의 정보를 허락없이 이용하는 행위가 부정이용에 해당하는가가 쟁점 사항이다.

최근 세계 각국은 새로운 저작물 이용환경에 대응하기 위해 법 제도적인 방안을 강구하고 있으며 새로운 대안으로 저작권 정보관리시스템을 제시하고 있다. 저작권 정보관리시스템은 저작물의 내용, 권리자의 소재, 이용 조건 등 저작물의 이용에 필요한 각종 정보를 종합적으로 관리 제공함으로 저작물의 보호 및 이용에 편의성을 제공하고, 더 나아가 실제로 시스템상에서 저작물의 거래까지 지원하는 시스템이다.

언젠가 방영된 TV다큐드라마가 떠오른다. 정확한 수치는 기억나지 않지만 종이를 만들기 위해 무수히 베이지는 나무들을 본적이 있다. 무참히 쓰러지는 나무들, 기계층 번진 머리 마냥 휑하니 패인 숲속의 공간, 그 프로그램의 요지는 환경보호였다. 그 나무들은 종이로 만들어지기 위해 베어지고 있다는 것이었다. 종이의 재활용 운동은 내가 그 TV프로그램을 보기 훨씬 이전부터 활발히 진행되고 있었던 일이긴 하다.

사이버 아파트에 있어서 각 세대의 개인 및 가족 정보는 재산상의 직접적인 정보와 연결되어 있기 때문에 다른 어떤 분야만큼이나 중요하다고 할 수 있다. 아직은 언론이나 네티즌들에게 널리 알려지지 않은 사이버 아파트의 보안문제에 대해 살펴보고 그 법적인 검토를 해보고자 한다. 사이버아파트의 경우 웹마스터가 랜 관리까지 병행하는 경우가 많아서 웹마스터의 정보관리가 무엇보다 중요하다.

Home network is a network composed of devices in home and is being expanded by evolving devices. Also, The number of digital contents in home network has been increasing steadily. But it is difficult to continually protect the rights of digital contents due to lack of interoperability among contents devices. Besides, a license has to be re-issued by DRM sever for contents transfer between devices. Thus, this paper proposes framework which can freely transfer and contents to another device through mutual device authentication and a system that can decrease overload of license management of the DRM sever and that enable device outside home network to use contents through user authentication.

The emerging ubiquitous environment is improving IT technologies and the popularization of broadband Internet is encouraging creation and sharing of various contents. The contents include the concept of production and circulation of digital information/contents, in forms of characters, codes, voices, sounds, client and videos for being used on the Internet and networks. The contents are widely shared in networks and users can have a wide range of knowledge and gain the freedom of presentation from them. So now users participations are augmented gradually. However, many contents without acquiring agree of copyright are sharing on the Internet, so many problems happen in the manufacturing process of digital contents. To solve this problem, many research projects to limit contents utilization onto legitimate users and to provide secure contents protection and download, are in progress. Therefore, in this paper, we propose a secure D-CAS system (SDCS) which provides security for contents downloading.

With the coming of information times, digital contents are widely applied in various fields of the society. Along with this, scholars provided many techniques and research approaches related to digital contents management and copyright protection. But till now, most proposed techniques and approaches are based on single system. The independency and separation among management systems causes the problems such as application across systems are limited, and resources sharing can't be available, etc. In this paper, for the application cross systems and contents sharing, we propose the cross-systems DRM approach based on unified metadata. This approach can be applied for the incorporation of multiple congeneric or heterogeneous CMSs, in the same time, solve the copyright problem cross digital content systems.

IT벤처기업이나 디지털 콘텐츠기업에게 있어 영업비밀은 전 재산이나 다름 없을 정도로 매우 중요하다. 그러나 기업들 중 임직원들의 퇴직 후 경쟁업체 취업제한, 비밀유지 서약 등 영업비밀에 대한 보안대책을 가지고 있는 업체는 절반에 미치지 못하는 것으로 알려져 있다. 통계에 따르면, 영업비밀의 유출을 시도하는 주된 주체는 퇴직 임직원 이 69.4%, 현직 임직원이 16.7%인 것으로 나타나고 있다. 벤처기업들은 막대한 자금과 시간을 투입해 훌륭한 기술을 개발하고서도 영업비밀을 보호할 전문지식과 경험이 부족해 영업비밀이 경쟁업체에 유출되어 소송에 휩싸이거나 경쟁력을 잃게 되기도 한다. 영업비밀 보호는 한 기업의 존망을 넘어 그야말로 국가의 성장동력에도 커다란 영향을 미칠 수 있다. 이번 호에서는 영업비밀 보호와 관련된 법률적 제반 문제에 대해 살펴보고자 한다.

The online distribution systems under the wireless environment include many different factors from the conventional offline and wired networks. Furthermore, the multimedia content may be propagated more easily and illegally. The scheme to protect the rights and profits of people related to the copyrights of digital content Is needed. In this paper a framework for content distribution under the wireless environment based on MPEG-21 and UCI application process are proposed. This model can be applied to the digital rights management system and utilized to protect the rights of trading entities in online distribution of electronic commerce.
