전자책은 최근 몇 년 동안 급속 성장을 하고 있는 중이다. 전자책은 현재 판매와 대여라는 두 가지 방식으로 서비스되고 있는데, 이 서비스의 법적 근거는 무엇인지 따져본다. 저작권자는 저작물의 원본이나 그 복제물을 공중에게 대가를 받거나 받지 아니하고 양도 또는 대여할 권리인 배포권을 가진다. 단, 배포권은 최초 판매의 원칙에 의해 제한을 받는다. 저작권자의 허락을 받아 판매된 복제물의 경우 더 이상 저작권자의 배포권이 미치지 않으며, 이를 최초 판매의 원칙이라고 부른다. 최초 판매의 원칙은 도서나 영화 DVD 등과 같은 유형물에만 적용되는 것으로서, 디지털화되어 유형물 없이 거래되는 저작물은 그 적용 대상이 아니다. 단, 우리나라 법에는 최초 판매의 원칙의 예외로 판매용 음반이나 판매용 프로그램에 대해서는 대여권을 부여하고 있다. 예외 조항에 전자책은 포함되지 않는다. 법적 근거가 없는 전자책 대여의 맹점에 대해서 고찰토록 하겠다.

European Union has recently encouraged its member states to enforce the Public Lending right that is a remuneration system for free lending service in public libraries. This study reviews the problem and the actual conditions of Public Lending Right System which is systematized in European Union and a few advanced countries. By analyzing the present state of many states which is running the public lending right system, this study also explores a reasonable compensation system which remunerate a copyrighter for his rending right md ensure the fair use tradition in libraries.

앞으로 우리가 좋아하는 가수에게 저작관련 인격권이 부여되고, 즐겨보는 만화에는 대여권이 부여되는 등 저작권 관련자들에게 포괄적인 권리를 인정하거나 새로운 권리를 부여하는 이른바‘저작권 권리장전’시대가 열릴 것으로 보인다. 정부는 길게는 1957년 법 제정 이후 50여년 만에 짧게는 1986년 법 제정 이후 20여년 만에 저작권자의 권리를 한층 더 강화하는 방향으로 저작권법을 전면적으로 개정하기 위해 추진하고 있다. 이에 대한 반발도 만만치 않아 앞으로 많은 시행착오가 있을 것으로 예상된다.

초기 저작권은 낱말 뜻 그대로 카피할 권리(right to copy), 즉 복사권을 의미했다. 그러나 IT의 발전과 더불어 방송권, 영화 판권 등이 이에 포함됐으며, 새로운 이용방법의 발달과 더불어 대여권이 저작권의 내용으로 논의되기에 이르렀다. 이렇듯 저작권은 사이버스페이스의 등장과 더불어 확장일로에 있으며 새로운 해석과 개념정립이 요구되고 있다. 특히 최근 들어 정보화사회로 나아가면서 지적재산권의 개념은 정보 자체를 보호대상으로 하기 위해 본질적인 면까지 바꾸면서 정보재산권으로 발전하고 있다. 여기서는 디지털콘텐츠를 둘러싸고 벌어지는 저작권을 포함한 지적재산권 등 주요 법적인 문제를 일반인이 쉽게 이해할 수 있도록 사례 중심으로 설명한다.

현재 코로나 19로 인한 비대면 상황이 지속되면서 온라인 쇼핑의 수요가 증가함에 따라 불필요한 의류자원 낭비 증가와 온라인 거래에서의 배송문제가 제기되고 있다. 본 논문은, 위치기반 서비스 기술을 활용한 의류를 공유할 수 있는 의류대여 서비스를 제안하고, 시스템을 구축해 봄으로써 앞에서 제기된 문제점을 해결하고자 한다. 의류대여 플랫폼을 제공하고 이용자와 대여자가 직접만나 직거래를 한다. 이로써 새로운 거래문화 형성 및 사회적 자원낭비 감소효과에 도움을 줄 수 있는 의류대여 플랫폼을 제안한다.

초기 저작권(copyright)은 낱말 뜻 그대로 카피할 권리(right to copy), 즉 복사권을 의미했다. 그러나 IT의 발전과 더불어 방송권, 영화 판권 등이 이에 포함됐으며, 새로운 이용방법의 발달과 더불어 대여권이 저작권의 내용으로 논의되기에 이르렀다. 이렇듯 저작권은 사이버스페이스의 등장과 더불어 확장일로에 있으며 새로운 해석과 개념정립이 요구되고 있다. 특히 최근의 기술발전은 정보의 이동이 지리적 한계를 갖지 않으며 거래 비용의 문제도 거의 무시할 정도가 됐다. 이는 정보 중심의 사회로 가는 견인차 역할을 하고 있는 IT의 발전으로 가능해진 것이다. 그러나 IT의 발달은 소프트웨어의 불법복제 등으로 인한 창작의욕 및 산업 발전에 부정적인 영향을 주는 요인으로도 작용하고 있다. 최근 들어 정보화사회로 나아가면서 지적재산권의 개념은 정보 자체를 보호대상으로 하기 위해 본질적인 면까지 바꾸면서 정보재산권으로 발전하고 있다. 여기서는 사이버스페이스에서 논의되고 있는 저작권의 개념과 환경의 변화를 검토한다.

This study investigated the present situation of the use of cinematographic works and the problems of copyright. Surveys were conducted in public and university libraries for these. Also, content analyses were conducted to make sense of copyright problems in libraries. As a result, this study found that problems of copyright had occurred in various aspects related to public performance, lending, digitization and internet services according to the diversity of facilities for watching cinematographic works and library services. Also, the librarians' questions to the copyright were very various from the primary level to specific level. This study suggested that regular courses of study in library schools need to be opened to primitive understanding to copyright law and occupational training programs for librarians need to be opened to complementary education as revisions of copyright law. This study also suggested that the online Q&A services need to be started for librarians who have detailed copyright problems.

Over the last two decades, the attitudes to cars have changed from buying a car to sharing a car, especially among young people. Shared transport services and autonomous vehicles together can resolve the accessibility issue of shared transport services. Furthermore, they will make it possible to develop a new model of apartments without car parking. Therefore, the study estimated the demand for car sharing by young people and the running efficiency of car-sharing dealing with their car-based trip demand. The study chose nine apartment complexes for study sites where a majority of the residents were young people. The questionnaire survey was conducted to collect data on the trip demands of young people. The results showed that there are significant differences in the car-sharing use patterns and demand between the apartment houses located in the Capital region and non-capital region. Young people living in apartments in the Capital region used car sharing once per day per person for approximately 80 minutes per trip and tended to hire that between 8 AM and 10 AM. On the other hand, the young people living in apartments in the non-capital region used car sharing twice per day per person for approximately 200 minutes per trip. They tended to hire that frequently in the afternoon and evening as well as in the morning. The results also showed that a single car-sharing vehicle could deal with 3~4 trips per day in the Capital region and around 2 trips per day in the non-capital region.
