A Study on Recoverability of Opportunity Profits Loss upon Time-Delay in Construction Contract (건설공사의 공기지연과 기회이익의 손실보전에 관한 연구)

  • The loss of potential opportunity profit which is consisting in the partial markups of the corporation would taking placed in related with the time-delay deeply, has customarily disregarded in contract adjustment under the principles of denial of cost accounting method, declined conjecture in the point of benefits and protection of the law in scope of compensation and the restricted conditions of constant contract. It is being resulted from that the policies of the general principles of accounting standards which is subjected to ask an objective data and evidence, and the denial system as a debt derived from imperfect legal theory applied by current law. Therefore, it is necessitated to find if any irrationality in the positive system is and further to draw an improved reasonable measures to adopt by review of constant system preparing tile reasonableness with the method of suitable quantification devices provided that any time-delay is induced by the party.

The effect of Territorial Restraint in Food&Beverage Similar Brand Extension (외식 프랜차이즈 거래에서 지역제한(Territorial Restraint)이 가맹본사의 브랜드 확장에 미치는 영향)

  • In franchise industry, territorial restraint is a system that imposes exclusive right to franchisers in a certain business area. To the franchisers, this system guarantees monopoly profits in a local market and exclusive rights during the contract periods. In such a way, franchisee generates a big revenue at once on the basis of franchiser's initial investment such as interior cost and franchise fee, it must have supervised franchiser's moral hazard for the territorial restraint agreement. Rather than territorial restraint can be a system to give exclusive right to franchiser's so that they neglect their own sales and too much rely on headquarter's brand and marketing activities without their own efforts. This paper assesses the implication of territorial restraint by examining the effect on brand extension, degree of contract termination. Drawing on research in transaction cost agreement and opportunism, the authors suggest that franchisee is highly likely to launch similar brand which is not effected on previous contract when territorial restraint is set out in the contract system. Moreover, the authors find that the degree of contract termination will be high in the existence of territorial restraint due to the franchisee's opportunism. The results imply that territorial restraint induces franchisee's opportunistic strategy more aggressively so that the possibility of brand extension or new brand launching will be increased. At the same time, franchisee is aggressively seeking for the reason for contract termination due to the pursuit of its profit maximization. Based on some empirical findings, this paper concludes with policy implications and some necessary fields of future studies desirable.

  • 본 연구에서는 최근 학교 주변에서 발생하는 어린이 범죄 사고의 관리 및 예방을 위한 무선 센서 네트워크 기반의 스쿨존 안전관리 시스템을 제안한다. 학교 주변 무선센서네트워크 망 구축과 어린이들에게 부착되는 센서들을 통해 환경 및 위치 영상 센싱 정보들을 공간 지식화하여 안전과 관련된 서비스를 제공한다. 또한 스쿨존 망을 벗어나 통신이 되지 않는 어린이의 경우 기회주의적 네트워크를 통하여 관리할 수 있는 전략적 안전관리 방안을 제안한다.

Agent's Opportunistic Behavior: A Paradox of Control Mechanism (대리인의 기회주의적 행동: 의도하지 않은 통제의 패러독스)

  • This study explores how agents would make decisions responding to control mechanism in contractual relationship of their firm. Focusing on agent's averse behavior against control, system dynamics model for agent's opportunistic behavior is developed in view of agent theory and control theory. This SD model shows that control mechanism by contracts doesn't always play a positive role on corporate decision-making process and Control, especially in the over-controlled contracts, often makes a paradox accelerating agent's opportunistic behavior unexpectedly. This paradox provides us both theoretical and practical implications for the relationship between control mechanism and autonomous behavior for sustainable corporate management.

A Transaction Cost Approach to Analysis on Determinants of Korean SMEs' Transformation into Direct Export (거래비용이론을 이용한 중소기업의 직접수출 전환 결정요인 분석)

  • In this study, transaction cost approach was applied to analysis on direct export determinants of SMEs by using key attributes of transactions, asset specificity, environmental uncertainty, frequency and marketing capability, with a parameter of opportunism. Typical Transaction Cost Analysis theory explains that when transaction cost with business channels(whether it is for buy or sell) increase, the firms integrate the channels. So it is a choice made by firms regarding direct versus indirect channels. The theory was extended to a model of choice of institutional form of direct or indirect export by a norm of opportunism in this empirical study. The survey result showed that lower level of asset specificity and marketing capability or higher level of environmental uncertainty were likely to expose indirect exporters to higher level of opportunism of direct exporter. And we also saw that indirect exporters were likely to choose direct export chanel when opportunism of exporters was higher. From the standpoint of theory, we can say that the basic propositions of the Transaction Cost Analysis, except the attribute of frequency, are supported. This study result could provide a profiling of target business areas and firms for government's policy on direct export promotion of SMEs.

The Relationship between Earnings Management and Future Firm Performance in Public Institutions (공공기관의 이익조정과 미래 경영성과와의 관련성)

  • Earnings management is a collection of management decisions which firms do not report the true performance. Many prior studies suggest that earnings management could be the results of either managerial earnings management or manager's private information for future performance. This study attempts to delve into the fundamental implications inherent in earnings management by analyzing how earnings management affects future firm performance in public institutions. If discretionary accruals as a measurement of earnings management embrace manager's private information, it will have a positive effect on future performance in succeeding period. In contrast, if discretionary accruals embrace manager's opportunistic earnings management, it will have a negative effect on future performance in succeeding period. Empirical findings are summarized as following.: Earnings managements are negatively associated with future firm performance for all succeeding period. This negative relationship continues for all succeeding period. The overall results can be serve as a evidence that the discretionary accruals capture opportunistic earnings management on average.

  • In this study, the factors affecting opportunism in the relationship between suppliers and key accounts were analyzed from the viewpoint of transaction cost theory, market power theory, and relationship marketing theory. As a result of the hypothesis test, Hypothesis 1 stating that demand volatility will have a positive effect on opportunism and Hypothesis 2 that transaction-specific investment will have a positive effect on opportunism were also supported. In addition, Hypothesis 3 stating that channel power will have a positive effect on opportunism was also supported. Lastly, Hypothesis 4 stating that relational commitment will have a negative effect on opportunism was not supported, along with Hypothesis 5 stating that transaction satisfaction will have a negative effect on opportunism. The theoretical and practical implications of this study are as follows. This study has identified the antecedents of opportunism by comprehensively applying the transaction cost theory, market power theory, and relationship marketing theory. In addition, this study can identify what a company should manage specifically to lower opportunism by identifying the antecedents of opportunism. The limitations of this study and the directions for future studies are as follows. First, not all of the antecedents of opportunism of key accounts have been extensively investigated from the viewpoint of the transaction cost theory, market power theory, and relationship marketing theory. In the future, it is necessary to identify additional factors. Second, the study was conducted only in the supplier's viewpoint. In future studies, it is expected that more accurate research results can be obtained by simultaneously examining not only the supplier's point of view but also the buyer's point of view.

Alleviating and Promoting Factors on Dissolution Intention in Low Commitment Buyer-Seller Relationships (저결속 구매자-판매자 관계에서 관계해지의 완화요인과 촉진요인)

  • This study has investigated the effects of relieving and promoting factors on dissolution intention under the condition of low commitment buyer-seller relationships. Based on intensive literature reviews, eight alleviating factors (dependence, cooperation, communication, relational norms, transaction specific investments, relationship termination costs, satisfaction, and trust) and five promoting factors (opportunism, conflict, goal incongruity, attractiveness of alternatives, and unfairness) were included. A total of thirteen hypotheses were testee using data collected from a dining franchising system. Among 300 collected, 79 cases of low commitment buyer-seller relationships were analyzed. The results showed that eight out of thirteen hypotheses were supported. But five hypotheses related to the variables of cooperation, transaction specific investments, relationship termination costs, attractiveness of alternatives, and opportunism were not supported. following a detailed presentation of the analysis results, the paper concludes by discussing the academic and managerial implications of the findings.

Effects of Relationship Characteristics on the Adoption of Online Distribution Channels: The Case of Korean Manufacturing Companies (중간상과의 거래특성이 제조업체의 온라인 경로 활용에 미치는 영향)

  • This study investigates the effects of relationship characteristics on the adoption of online distribution channels in Korea. A questionnaire survey of 81 domestic manufacturing companies revealed that relationship characteristics have no effects on the range of products sold through online channels. In terms of functional usage, manufactures' dependence and their perceptions of middlemen's opportunism were found to affect the extent of adoption of online channels. Overall, these two variables were significantly related to such functions as delivery, refunding, and A/S that have been traditionally considered efficient when implemented by the middlemen. None of the relationship characteristics was found significantly related to the adoption of online channels as a tool of information provision. The authors discuss the theoretical and practical implications of the findings.
