This article analyzes the new approach to regulation with regards to the railway industry and determines the government's new role. For this purpose, the regulations are categorized into three dimensions (economic, societal and administrative), following the criteria adopted by the Regulatory Reform Committee. Furthermore, these items are analyzed as compulsory vs. incentive, and prior vs. ex post, according to the managerial characteristics. As a result, some recommendations were derived: the economic regulations should be deregulated and the societal regulations should be modified in order to rationalize the criteria. From this perspective, the government's role needs to be repositioned in order to activate the railway industry.

서울시의회가 도시계획 조례 개정안을 의결해 지난달 9일 본회의에서 최종 통과시켰다. 시내 준공업지역 내 공장 부지에 대해 최대 80%까지 아파트를 건설할 수 있도록 규제를 대폭 완화하는 내용이 주된 골자다. 대규모로 토지를 소유한 기업들을 위한 특혜라는 논란이 일고 있는 가운데, 이번 조치로 어떤 파급 효과가 미칠지 관심이 집중되고 있다.

미국에서의 항공기 운항업계에 대한 규제완화 여파로 우리나라 등 각국에도 규제 완화의 바람이 불고 있다. 항공기 제조업계는 기업의 통합과 구조 조정이 급진전하여 소수 정예의 과점 상황으로 나아가는가 하면 운항업계에서는 대규모 회사에 의한 독과점 체제가 무너지고 있다. 이런 배경 아래 항공기 사고에 대해서도 사고 조사가 제3자에 의하여 공정히 행해질 것을 바라는 소리가 높다.

분양가 상한제가 적용되는 아파트가 속속 분양되고 있는 지금도 이에 대해 논란이 끊이질 않는다. 법 개정으로 불합리한 부분이 많이 개선되었지만 아직도 부족한 점이 많다. 분양권 전매 제한 기간의 조정이 필요하다는 이야기도 설득력을 얻고 있다. 실수요자의 통상적인 주택 구매 주기에 비해 전매 제한 기간이 지나치게 길기 때문이다.

70년대 중반 미국의 규제완화를 시작으로 세계항공운송산업이 재편되게 되었다. 1996년부터 한국운송시장이 개방되면서 한국의 항공운송산업은 세계적인 경쟁에 노출되게 되었다. 이러한 변화에 대응하기 위해서는 한국의 항공운송당국은 규제완화를 적극적으로 추진하여야 하며 업계 또한 경쟁력을 배양하기 위하여 노력하여야 한다.

국내 석유산업을 둘러싼 대내외 환경은 최근 몇 년간 급격히 변화하였고, 이러한 변화 추세는 향후 더욱 가속화될 것으로 예상된다. 우선 대내적으로 정부는 국가경제 각 부문의 $\ulcorner$경쟁력 강화$\lrcorner$를 위하여 시장에 대한 불필요하고 불합리한 규제를 폐지하여 시장기능을 활성화시킴으로써 각 산업의 경쟁력을 강화시키는 동시에 자원 배분의 효율성 증대를 도모해 나가고 있다. 이러한 전반적인 정책기조 하에서, 정부는 에너지산업, 특히 석유산업에 대한 많은 규제를 완화.폐지하여 왔다. 특히, 국내유가에 대한 자유화, 정제 및 유통부문에 대한 허가제가 등록제로 전환되었다. 또, 정제부문 및 유통부문에 대한 대외개방도 허용되었으며, 석유제품 수출입에 대한 규제도 완화되었다. 기업활동에 관한 행정규제의 완화 및 특례에 관한 사항을 규정하여 원활한 기업활동을 도모하고 국민경제의 건전한 발전에 기여함을 목적으로 하는"기업활동규제완화에 관한 특별조치법(1993.6.11.법률 제4560호)"의 제정으로 동법 제3장에서 규정하는 "안전관리자 등의 고용의무완화"에 따란 산업안전보건법 시행령이 1993.11.20.개정되고 그 시행에 관하여 필요한 사항을 규정하는 산업안전보건법 시행규칙 및 산업안전기준에 관한 규칙 및 산업안전기준에 관한 규칙 등이 1994년 3월29일자로 개정ㆍ공포되었다. 동개정내용 중 건설업과 관련되는 조문을 중심으로 해설함으로써 안전관리업무에 도움을 드리고자 한다.

The deregulation on non-standard workers is inclined to make companies increase the employment of the non-standard workers because of cost-saving effect. As non-standard work rises, so involuntary choice of it does. This trend has resulted in the decline of the non-standard workers' job satisfaction. The internalization of firm-specific skills is strong in Japanese companies. Therefore, even though cost-saving effect is high, the companies cannot assign all the jobs to non-standard workers. Hence, the companies are likely to divide the jobs into standard worker's and non-standard workers' ones. The standard workers' jobs, which focus on high firm-specific skills, has reduced, while the non-standard workers' jobs, which can be outsourced from outside the companies, has increased. As a result, the productivity of standard workers has improved, and their wage levels have increased. Since the deregulation on non-standard workers, their job satisfaction has deteriorated. On the contrary, the job satisfaction of standard workers has increased.

정부는 규제를 통해 삶을 보호하고 보장해 주는 정부의 역할을 기대하는 국민의식을 반영하여 쾌적하고 안전한 생활에 불가피한 규제의 신설과 강화를 중점분야로 표명함으로써, 규제를 완화하는 것만이 능사가 아님을 명확히 하고 있다. 이에 따라, 이제는 규제가 국민의 건강과 생명을 보호하고 쾌적하고 안전한 삶을 보장하는 '공공서비스'로서 국민과 더 가까워질 것으로 기대된다.

The Japanese government has announced that it would invest 30 billion yen in iPS cell research for the next 10 year, and the Japan National Assembly has made an act that supports the iPS cell research. This study analyzes 1) the current trend and application field of stem cell research under Japan; 2) recent policy and regulation change in stem cell research and its application under Japan. This treatise reviews about "Act for Promoting Regenerative Medicine", "Act for Assuring Safety of Regenerative Medicine", and "the Revision of Pharmaceutical Act under Japan. This study may serve as the fundamental reference for the improvements of legal and institutional systems with regard to regulations on the stem cell research under Korea.
