Gender Trouble in Brave New World (『멋진 신세계』에서의 젠더 트러블)

  • This paper examines gender trouble in the future society from Huxley's Brave New World, in which science is highly developed. In addition, I examined how gender equality was achieved in the World State in which equality and identity were emphasized, and considered the precise meaning of gender equality. Superficially, there are many gender inequality factors in the Reservation, and gender equality is achieved in the World State. However, if we look closely at the World State, we realize that they deprive individual rights under the name of social stability. Therefore, we should reconsider what real gender equality is, and we need to examine what is needed to achieve gender equality.

A Study on Human-Centered IT Utilization in Caring for Elderly People Who Live Alone (독거노인 돌봄에 있어 인간중심의 IT 활용방안에 관한 연구)

  • This study was conducted to find ways to utilize human-centered IT in caring for elderly people who live alone. Through focus group interviews with experts, this study investigated the problems with delivery system, and ethical issues. Problems such as lack of trust, supplier-centered care, and uniform service provision were derived as major problems in the delivery system. These findings indicate that IT should be used as an auxiliary means of face-to-face services and to be controllable and convenient. Issues such as "guaranteeing the right to self-determination," "protecting privacy," "sufficiently guaranteeing the right to know," and "encompassing blind spots" were raised as important ethical issues related to human-centered IT utilization. Based on the research results, this study presented the necessity of designing user-centered information technology and the necessity of developing ethical indicators for the use of human-centered technology.

  • In knowledge-based society, various forms of visible and invisible works are produced and published. As production and distribution of those works are increased, importance and value of copyright are gradually emerged. In the light of importance, students must learn and understand the concept and the right use of copyright as early as possible. Scales that students experience in the introduction stage of the class take the role of Advance Organizer. Through these scales, students can combine concept of copyright into their existing recognition structure and are interested in study contents. According to test results, it is concluded that the proposed system is very useful to enhance copyright consciousness for students.

  • The incompetency and quasi-incompetency system regulated legal incompetence in the past is insufficient for protections of the adults with insufficient abilities of judgement, the criticism has been continued that the system is not efficiently respond to their rights and legal relationship formation. At last, the government introduces adult guardianship system through revising the civil law. At this point, just several months prior to the enforcement of adult guardianship system, we should be prepared to issues which may occur in the actual operation of the system. Japan has high similarities in social and culture matters with Korea and in the general operation of its adult guardianship system is similar to Korea's, Therefore, Korea should be prepared for the basis to implement the optimized system through in advance understanding the trend in Japan. The study reviews the trends of Japanese adult guardian's type, and draws suggestions for Korea by finding activity requirements and subjects focusing on the currently increasing corporation guardiancy.

  • Previous research related to recovering deleted data in database has been mainly based on transaction logs or detecting and recovering data using original source files by physical collection method. However there was a limit to apply if the transaction log does not exist in the server or it is not possible to collect the original source file because a database server owner does not permit stopping the database server because of their business loss or infringement at the scene. Therefore it is necessary to examine various collection methods and check the recoverability of the deleted data in order to handling the constraints of evidence collection situation. In this paper we have checked an experiment that the recoverability of deleted data in the original database source according to logical and physical collection methods on digital forensic investigation of Microsoft SQL Server database.

  • This paper analyzes the current status of identity verification and authentication procedures when issuing and using alternative means for resident registration numbers and suggests measures to improve the problems. Users unconsciously use identity verification services by responding to identity verification requests from Internet service providers (ISPs). Ultimately, online service users are providing excessive amounts of personal information, and ISPs are charging fees for identity verification services, ultimately increasing online service costs. Therefore, this paper analyzes the current status of identity verification and authentication procedures for users when issuing and using alternative means for resident registration numbers and suggests measures to improve the problems.

Study on the Characteristic of Media Lawsuits by Public Figures and the Tendency of the Court Decisions in Korea: Focusing on the Decision about Defamation of Politicians and Senior Government Officials Since 1989 (공인의 미디어 소송 특징과 국내 판결 경향에 관한 연구: 1989년 이후 정치인 및 고위 공직자 명예훼손 판례를 중심으로)

  • Defamation lawsuits of public figures against media have been an issue since Roh government set in. Dissension between the government and media has probably acted as the key factor on this problem. Accordingly, arguments on the defamation lawsuits of public figures occurred the political issues such as opposition between the Progressive and the Conservative Parties or between the ins and the outs and showed the limits to suggest an appropriate judgment or solution. This study will analyze how the court makes its judgement on their rights and the limits by understanding the characteristic and the problem of defamation lawsuits made by senior government officials including a politician, the government, the president, and etc. As results, the defamation lawsuits of politicians and senior government officials showed specially noteworthy matters in salvation (damage suits), the amount claimed, court costs, ratio of winning lawsuits, and etc. The result on the tendency of the court decision showed the following matters in confusion: it holds the media responsible for the burden of proof by applying the inappropriate criterion; The applied laws, especially in the inferior court decision, do not show the consistency of the burden of proof between the misconception/ intention (malice)/ accident/ purpose of slander on the legal principles of public figures. Therefore, this study suggests the court to apply an appropriate law, let alone regulating the Anti-SLAPP law, so that it curtails the rights of public figures; limits the salvation of damage suit; and protects the right only in the case of false accusation by applying the existing law of "the Protection of the Deceased's Defamation Law." In order to dissolve the confusion when applying the laws on the public figures, the study insists the court to positively apply the Constitutional Court made criterion on "people" and "content." The study also insists to distinguish "intention(malice)," "accident," and "purpose of slander" and variant sorts of the burden of proof should be applied to each.

Assisted Outpatient Treatment and Crisis Intervention in USA and their Implications for Korea (미국의 외래치료명령제도 및 위기대응과 국내적 시사점)

  • Since the 1960s, the United States' (U.S.) deinstitutionalization policy has reinstated people with mental illness into communities. Unfortunately, when untreated, some people with psychiatric disorders become homeless, and some commit serious crimes during a psychological crisis. Assisted Outpatient Treatment (AOT), also known as Kendra's Law in New York and Laura's Law in California, provides treatment, services and support to people with mental illness in the community. AOT has repeatedly been found effective and is recognized as an evidence-based practice. The response to the mental health crisis (crisis intervention) in the U.S. has also been successful in preventing worsening mental illness and related criminality and other issues. This paper provides an opportunity to create a platform from which to learn how to successfully apply the AOT and crisis intervention of the U.S. to South Korea within the cultural and societal context when establishing social services for people with mental illness in South Korea's communities.

The Effect of Female University Students' Gender-Role Stereotype on Sexual Assertiveness: Mediating Effect of Self-Esteem (여대생의 성역할고정관념이 성적자기주장에 미치는 영향: 자아존중감의 매개효과)

  • This study focused on the sex culture and the sexual rights of women, examining the gender-role stereotype that is related to the protection of the sexual rights of female college students and identifying the influence of self- esteem. The research was conducted on gender-role stereotypes, sexual assertiveness, and self-esteem among female university students attending four-year universities in Seoul and Gyeonggi. Four hundred eighty-two copies were used for analysis. The Pearson's correlation coefficient was used to identify the correlation between the variables. Multiple regression analysis was conducted to identify the mediated effects of self-esteem in the effects of gender-role stereotypes on sexual assertiveness. The Sobel test was conducted to confirm that the effects were statistically significant. The results of this study were as follows. First, the gender-role stereotype had negative correlations with self-esteem and sexual assertiveness. Self-esteem had positive correlations with sexual assertiveness. Second, self-esteem was found to be a partial mediating factor when the gender-role stereotype had a statistically significant effect on sexual assertiveness. Therefore, a coping strategy under the influence of the gender-role stereotype is necessary for improving the sexual assertiveness skill of female students. This study also suggests the need for sex role-related education programs or counseling on self-esteem.

A Study on the Copyright Policy and Open Access for Noncommercial Scholarly Works (비영리학술저작물의 저작권정책과 오픈액세스에 관한 연구)

  • This study is about the copyright policies by Korean government and the revision of the article 31 library exemption provision in the Copyright Act of Korea for noncommercial scholarly works considering through cases of copyright disputes occurred in Korea during the $2005{\sim}2007$. This study proposes that works not for sale including thesis should be exempted from the copyright compensation in the article 31(5) in the Copyright Act of Korea based on the properties of noncommercial scholarly works and the regulations on works for not for sale in the current Korean copyright act. Also, this study reports that the copyright trust of scholarly articles by the copyright trust management agency is illegal in part and the government which has a duty to direct it has to control the illegal actions. Finally, this study proposes that noncommercial scholarly works such as thesis and scientific articles are to be open access and Korean government should develop open policies for them.
