해양환경보전을 위한 국제동향과 대책

  • 세계 해양환경의 보전을 위하여 설립된 UN 기구인 국제해사기구(IMO)에서는 해양환경 오염물질 등에 대한 규제강화를 위하여 최근 새로운 해양환경협약의 채택 및 발효를 강력히 추진해 오고 있다. IMO의 국제협약은 선박이라는 효과적인 제어수단을 통하여 가장 강력한 통제력을 갖는 협약으로 세계 모든 해양국의 해양환경에 관한 국제법의 성격을 띄고 있다. 구속력이 강력한 만큼 변화되는 국제협약에 의해 새롭게 창출되는 해양환경시장의 규모가 엄청나므로 당사국들이 서로 자국의 이익을 위해 올인하는 전형적인 그린라운드의 양상을 띄고 있는 현실이다. 우리나라는 국제해사기구의 A그룹 이사국이며 아울러 세계 제일의 조선대국, 또한 세계 6위의 해양대국으로서의 국제적인 위상을 감안할 때 해양환경 보호를 위하여 현재 발효되고 추진 중에 있는 협약에 대한 연구와 효과적 대처를 하여야 함은 물론 우리나라 조선, 해양산업이 보호되고 나아가 이익이 창출될 수 있는 방향으로 모든 국제협약이 이루어지게 노력해야할 것이다. 이 논문은 해양관련 환경규제 협약인 Marpol 73/78 협약, 선박의 유해방오도료 사용규제협약, 평형수 배출규제협약, 선박으로부터 오수에 의한 오염방지를 위한 협약, 대기오염방지협약 등의 주요 현안을 파악하고 분석하여 이에 따른 현실적인 대응책을 제시하고자 한다.

  • 유엔환경개발회의(UNCED)와 국제환경협약의 정책적 경제적 영향이란 주제로 서울국제환경심포지움이 지난 9월 2일부터 3일간 잠실 롯데월드에서 열렸다. 미국, 일본등 9개국 3개 국제기구에서 25명의 환경문제에 대한 세계각국의 대응과 국제 환경협약의 경제ㆍ사회적 파급효과 우리나라의 대응전략등이 다각적으로 논의됐다. 다음은 이번 심포지움에서 발표된 주요 논문들을 요약하여 옮긴 것이다.

A Study on the Sequence of Developing Marine Environmental Conventions (국제해양환경협약의 제정 과정에 관한 연구)

  • In recent years, the major interest in international environmental laws has focused on the ways to secure observation of the laws. For the implementation and compliance of international marine environmental convention, the new sequence of developing convention has been sdopted. The main convention is adopted in a form of 'Framework Convention' and the details are expressed in the Annex and/or Guidelines of the convention for the purpose of conveniense of adoption and to secure the observation of the convention And the Annexes or Guidelines are amended, revised and newly adopted continuously. Therefore this study is to analyze the tendency of sequence for developing new convention, which will help understanding one particular international marine environmental convention as a whole.

  • As recently, ' International convention for the control and management of ship's ballast water and sediments ' was adopted, it is necessary to accept the international convention in Korea. The systems of foreign countries for ship's ballast water control and management were investigated, and domestic environment-related laws were reviewed and compared regarding the discharge of industrial wastewater and ship's ballast water. Alternative measures of domestic legislation were suggested for acceptance of the international convention.

A Feasibility Study on Joining "The Supplementary Fund Protocol" (2003 추가기금협약 가입에 대한 경제적 타당성 분석)

  • Since adopting 1969 CLC and 1971 FC, IMO increased maximum amount of compensation by adopting protocols of 1969 CLC and 1971 FC. Recently IMO adopted 2003 Supplementary Fund by which the compensation limits increased dramatically to 750 million SDR. Korea government has only entered 1992CLC/FC. However, since the Hebei Spirit incident in 2007, there have been strong claims that Korea government should enter 2003 Supplementary Fund. In this article, feasibility study was carried out to help Korea government decide whether or not entering the Convention. The quantitative analysis has been carried out using data of the past oil spill accidents and contribution fee to IOPC Fund and showed that the benefit was much bigger than costs. The qualitative analysis in relation to resources fix compensation to victims, benefits of consignee, and the status of Korea in IMO also showed that Korea should ratify the 2003 SF.

Designs for Self-Enforcing International Environmental Coordination (자기 강제적인 국제환경 협력을 위한 구상)

  • The paper presents game theoretic models for self-enforcing coalition formation in order to sustain effective international environmental agreements(IEAs). The model analyzes how the intrinsically strategic nature of a government's environmental policies(the emission allowance standard) calls for rules to sustain an IEA. Focusing on the recent theoretical developments in the infinitely repeated game, the paper introduces some mechanisms to show how self-interested sovereign countries are cooperatively able to maintain an IEA rather than defect to initially profit at the expense of a pollution heaven later on. For a more realistic case needed to sustain an IEA, an optimal international environmental policy with both signatories and non-signatories under imperfect monitoring is also explored. In this extension of the model, the derivation process for a critical discount factor, a trigger price level and the length of punishment period is briefly discussed.

Domestic Status for Acceptance of Various International Conventions relating to Marine Environment Management (해양환경관리 관련 각종 국제협약의 국내 수용 현황)

  • Domestic laws such as Korea Marine Pollution Prevention Law which has been made and amended according to the conclusions and amendments of various international conventions, especially by MARPOL 73/78, were reviewed and compared with major contents of international conventions, and several alternative measures for legislating new laws or amending existing laws such as Korea Marine Pollution Prevention Law in accordance with new contents and recent amendments of existing and new international conventions were proposed. Annex VI of MARPOL 73/78 has been recently accepted in Korea Marine Pollution Prevention Law which should be applied to ships which are the moving point sources of air pollution at Sea rather than in Korea Air Environment Conservation Law which should be applied to automobiles and industrial installations which are the line and/or point sources of air pollution in land. International Convention for Ship's Ballast Water/Sediment Management should be accepted in Korea Marine Pollution Prevention Law or by a new law in order to prevent domes marine ecosystem and costal environment from the invasion of harmful exotic species through the discharge of ship's ballast water. International Convention for the Control of Harmful Anti-Fouling Systems on the Ships should be accepted in Korea Marine Pollution Prevention Law which should be applied to ships which are navigating in open sea and coastal waters rather than in Korea Noxious Chemicals Management Law. Basel Convention which shall regulate and prohibit inter-nations movements of noxious chemical substances should be accepted in Korea Marine Pollution Prevention Law in order to prevent the movement and transfer of scrap-purpose tanker ships containing bilge water of oil/water mixtures and chemicals remained on board from advanced countries to developing and/or underdeveloped countries and to conserve global marine environment after all.
