International discussions and enactment directions for e-business (e-비즈니스 관련 법규의 논의동향과 제정방향)

  • It is estimated that electronic commerce facilitates international trade and lower transaction cost and help firms make the best of the opportunities of market access. The comprehensive programs had been implemented to provide better electronic commerce environments by international organizations such as OECD, UNCITRAL, APEC, ICC and etc. Especially, WTO plays the most important role to implement efficient forms and rules on electronic commerce after Doha Ministerial Conference. Member countries recognize the need to conduct the electronic commerce in compliance with the principles and rules of WTO. However, there are many issues to be solved such as the clarifications of concepts and definitions, the possibility of adaptation of technological neutrality in GATS, the imposition of taxation in electronic commerce transactions and the methods of protecting copying as well as trademark. The Implementation of concrete forms and rules of electronic commerce in the WTO will be influential to international trade as the member countries have to adapt them in their transactions. Considering that further discussion will be continued in GATS, we need to analyze the problems and strategies for electronic commerce. As there are not concrete international laws for e-commerce, the existing laws must be revised and changed and each country need to present the enactment direction of e-commerce law to streamline e-commerce and to prevent trading partners from conflicting due to legal problems.

  • 효과적인 물 사용과 물 관리 정책을 수립하기 위해서는 산업적 차원에서의 물 발자국 연구를 통해 산업 전반적인 수자원 활용 상황을 비교 분석할 필요가 있다. 또한 앞으로 국가 차원의 물 안보 정책을 수립하기 위해서는 기후변화와 국제환경 변화로 인해 우리나라의 물발자국 변화를 예측하는 것이 필수적이다. 국외에서는 일찍이 물과 환경전문 교육기관인 UNESCO-IHE를 중심으로 물발자국 산정방식의 이론적 연구와 함께 가상수 무역에 대한 연구를 진행해왔으며, 국제표준화기구(International Organization for Standardization, 이하 ISO)는 2014년 물발자국에 대한 가이드라인을 국제표준으로 지정하였다. 국내에서는 2009년 가상수와 물발자국에 대한 이론이 소개되어 공공기관의 주도로 가상수 및 물발자국과 관련된 연구가 진행되어 왔다. 이러한 연구결과를 바탕으로 데이터베이스를 구축하기도 하였으나 1차 산업 위주로 구성되어 있어 2차, 3차 산업 등 다른 산업에 대한 정보는 부족한 상태이다. 따라서 앞으로는 2차, 3차 산업 등에 대한 연구가 필요하다. 국제 가상수 거래의 도출을 위한 기초자료로서 WIOD의 input-output tables와 environmental accounts 등을 활용하였다. 본 연구에서는 생산량, 물사용량과 관련된 지표를 결합하여 가상수량을 도출하는 과정을 제시하고, 가상수 이동흐름 및 추이를 분석하였다. 이를 위해 주요 16개국(아르헨티나, 호주, 브라질, 캐나다, 중국, 프랑스, 독일, 인도, 일본, 한국, 러시아, 사우디아라비아, 태국, 미국, 베트남)의 농축산물 주요 10개 품목(쌀, 보리, 옥수수, 밀, 콩, 감자, 채소, 소고기, 돼지고기, 계란)을 대상으로 분석을 실시했다. 또한 국가별 가상수 교역량, 국가 간 가상수 교역량에 대한 1989년부터 2014년까지의 데이터셋을 구축하고 이에 대해 분석을 수행하였다. 가상수 교역의 품목별 분석결과 주요 16개국의 주요 가상수 수입 품목은 콩, 옥수수, 밀, 보리 순이며, 주요 가상수 수출 품목은 밀, 콩, 옥수수, 쌀 순으로 파악되었다. 가상수의 종류별로 분석한 결과 가상수 교역량은 지난 25년간 녹색 가상수가 94%의 압도적으로 많은 비중을 차지하고 있었다. 국가별로 가상수 수출입량을 분석한 결과 1989년에서 2013년까지 미국, 브라질, 아르헨티나, 호주 등 주요 농업 국가들이 전 세계 가상수 수출에서 우위를 점하고 있는 것으로 분석되었다.

Measures of International Standardization in Korean Landscape Drawing Practice (한국 조경제도의 국제표준화 방안)

  • WTO/TBT aims to reduce impediments to trade resulting from differences between national regulations and standards. Where international standards exist or their completion is imminent, the Code of Good Practice says that standardizing bodies should use them, or the relevant parts of them, as a basis for any standards they develop. Drawing is a formal and precise way of communicating information about the shape, size and, features. In addition, drawing is a part of the universal language of engineering. However there are many differences between international landscape drawing standard ISO 11091 and Korean landscape drawing practice(KLDP). The result of a comparison of ISO 11091 with KLDP and suggestions for international standardization of KLDP are summarized as follows. First, Among the 33 kinds of conventions from ISO 11091, 2 similar kinds and 15 different kinds from KLDP and 16 kinds of conventions which exist only in ISO 11091 appeared-for the international standardization of KLDP, it is necessary to make an extensive alteration of KLDP. Second, Europe Unity countries accepted ISO 11091 and are using it as their national standard for landscape drawing. Even Japan has accepted ISO 11091 on their civil engineering drawings and is using it as their national standard. Therefore, we need to hasten KS standard enactment based on ISO 1091. Third, For the KS standard of construction drawings, the degree of international standardization is rising even though there are still differences from the ISO standard. Therefore, since the burden on the international standardization of KLDP is expected to be weighed, preparations should be quickly brought about in the practice fields. Fourth, Since in the landscape planting ordinances of local independent governments is the standard presented by categorizing trees into evergreen and deciduous, such parts should be modified and introduced when enacting the KS standard based on ISO 11091. Fifth, For the enactment of the KS standard for landscape drawings, a wide range of opinions should be collected by the relevant landscape organization by installing a committee, and based on its recommendation, an application for the KS standard enactment of landscape drawing should be made to the chief of Ministry of Knowledge Economy.

  • After the Cold War, international terrorism and related issues have been the most urgent problems. However, Korea hasn't recognized this seriousness due to relatively slight damage. Yet the interest about the international maritime terrorism and related issues is increasing as the maritime terrorism issues emerged. This is because Korea is located next to three oceans and majority of international trades depend largely on international maritime transportation due to its scarce natural resources. Therefore this study has the purpose that it reviews the advanced researches and documents, analyzes the priority about response system against international maritime terrorism, suggests the practical solutions. For these purposes, it conducted Delphi technique to international maritime terrorism experts with response system factors selected among the advanced researches and documents. As the result of analysis, this study figured out that legal and institutional countermeasures are needed as international measures, strategic countermeasures are needed as domestic measures to set up the response system against international maritime terrorism. Synthetically, for the efficient and practical counteract against international maritime terrorism, the response institute against international maritime terrorism and the awareness of relevant experts are preferentially necessary.

The Potential Impacts of Recent Developments in Timber Certification Schemes on the Korean Forest Products Trade (우리 나라 임산물무역(林産物貿易)에 대한 목재인증제(木材認證制)의 잠재적(潛在的) 영향(影響))

  • This study was conducted to examine the recent developments in timber certification schemes at global level such as FSC certification and ISO 14001 system and to analyze their potential impacts on the Korean forest products trade. Data and information on standards and procedure of timber certification and certified forest lands were collected from relevant papers, statistics and reports published by regional and international organizations. In order to analyze the impacts on the Korean forest products trade, questionnaire survey to the affected parties was conducted on acknowledge of key words relating to environment and trade and on the additional amount of willingness to pay for a labeled timber from environmentally sound and sustainably managed forests. Quantities of certified timbers supplied would continue to increase due to lots of timber certification schemes developed and implemented at national, regional and global levels and growing interests in certification from many countries. Demand for certified timbers, however, is far from clear at this stage. The deciding factor would be consumer reaction to the certified products. In the short run, the timber certification would have a little impacts on forest products imports into Korean markets since domestic purchasers do not have much interests in environment related trade measures and their willingness to pay price premiums for certified timbers is not high. However, it could be expected that timber certification has negative impacts on exports of forest products, such as flooring and plywood, to developed European markets where timber certification is used as a trade barrier.

  • This study analyzes the achievement of the shipping policies and the priority for the promotion of such policies, in order to consider the features of the shipping industries in Korea and other advanced shipping countries and manage the rapidly changing shipping environment actively. Based on such analysis, this study also discusses the promotional strategy to strengthen the international competitiveness of the shipping industry. Regarding the promotion of the related policies, it is necessary to establish a base for growth, strengthen a capacity of leading the market, and create an opportunity in the market. By considering such three factors, it has become known that the establishment of the market order is important for the establishment of a base for growth. It is important to consider the advancement of the shipping tax system. Also, the information-orientation and the knowledge-industrialization of the shipping industry need to be considered. In order to strengthen a capacity of leading the market, the stable security of the labor force in the shipping industry is the most important factor. Also, it is important to consider the development and the upbringing of the global mega career and the shipping business. Regarding the creation of an opportunity in the market, it is important to expand the range of the shipping exchange between South Korea and North Korea, which will influence the administrative and the operative results related with the promotion of the related policies.

  • Non-curable rubberized polymer asphalt waterproof coating materials in Korea and China are manufactured without advanced quality control techniques and common standard, And they are exposed consistent water leakage problems. Import and application of Korean waterproofing products and installation methods is difficult in the present situation as the Chinese standard(JC/T 2428) is different in nature with the Korean counterpart products, And quality assurance is inevitable based on mutual standards. In order to resolve this issue, alternatives such as using standards provided by the ISO (International Organization for Standardization) are generally employed, but there is no such ISO standard as a waterproof material for non-curable rubberized polymer asphalt material. Furthermore, it is unreasonable to develop the ISO standard for rubber asphalt seals for exchange in terms of time and cost. This study proposes that the establishment of a quality standard that can be applied for both countries will be required via an joint international standard that outlines the properties of materials if applied in mutual trade exchange.

  • Future of Busan New Port may depend even on the efficient use of the port hinterland. Accordingly, selection of which industry according to which standard in the port hinterland is another task. In order to solve this problem, it analyzed the structure in international division of labor with China and Japan, which are possessing considerable portion in the trading volume with our country, and the export-import structure of Busan Port against China and Japan, by using RCA index and GL index as well as export-import results. In addition to this, the proper industry was selected on the basis of 10 strategic industries for development in Busan. According to the analytical results, the industries, which will be induced in the hinterland of Busan New Port, include textile clothing, pulp printing matter, jewelry, basic metal nonmetallic product, machine lectric product, automobile, shipbuilding, optics accurate machinery medical treatment musical instrument, nano material, fuel battery, aerospace and intelligent robot.

  • After the establishment of WTO for strengthening of GATT in 1995, the world economy has gradually been integrating toward economic globalisation. Even though this multilateral agreement may be beneficial to many countries but it also interferes domestic policies of member countries and threatens the role of local government and policy independence. For these reasons, FTA between countries or regions has been increasing. According to this trend, Korea and China has reached a substantial agreement of Korea-China FTA for mutual benefits. In general, the Korean automobile industry will benefit from Korea-China FTA due to its competitiveness in the global market and improvement of market access. However in the provisional schedule of concessions and commitment reported by press, the automobile seems to be excluded in this schedule of concessions. Hence, Korean automobile industry can not use the price competitiveness from tariff elimination. Therefore, Korean automobile industry needs aggressive marketing strategies for enhancement of brand equity as well as development of environment-friendly cars for following environment policies of Chinese government. Furthermore, they should make efforts to create the efficient investment environment by the removal of non-tariff barriers.

  • Aquatic animal diseases control act which is to assure the prevention of outbreak and spread of aquatic animal diseases in Korea has come into effect since 22 December 2008. In order to prevent outbreak and spread of aquatic animal diseases, risk analysis is newly introduced. The introduction of risk analysis for movement of aquatic animals related to implementation of recommendation of the World Trade Organization (WTO) Agreement on the Application of Sanitary and Phytosanitary Measures and should be conducted in accordance with guidelines of OIE Aquatic Animal Health Code. This report involves gathering and analysing the information of international regulation and situations of risk analysis framework in Korea for movement of aquatic animals.
