A Study on the Appropriateness of Regulatory Impact Analysis(RIA) on Technological Regulation: With the Focus on the Technological Regulation Impact Assessment (기술규제 규제영향분석의 적절성에 대한 연구: 기술규제영향평가 차원에서)

  • The purpose of this study is to examine the appropriateness of Regulatory Impact Analysis(RIA) in terms of the technological regulation impact assessment in order to confirm whether the current RIA process reflects the important characteristics of technological regulation. This paper develops a logical framework for analysis of technological regulation and evaluates the appropriateness of the RIA statements submitted by the government departments. From the viewpoint of [technological feasibility of regulation], [synthesis of domestic technological norms], [synthesis of international technological norms], as a result of evaluating the contents of the actual RIA statement on the basis of objective facts, feasibility of alternative analysis, and expert judgment, only 23.4% of the RIA statements were judged "appropriate", and there were no particular differences among the government. As a result of reviewing the appropriateness of RIA statements according to regulatory attributes, the appropriateness of RIA statements on technological regulation with social regulatory and indirect regulatory attributes was rather high. In sum, the level of Korean RIA statements is insufficient to carry out the practical meaning of technological regulation impact assessment. That is, as each government department adopts technological regulation, the understanding of the technological properties of the regulation may not be complete. The RIA statement that does not adequately reflect the technological rationale, hinders the careful review of other regulatory alternatives by exaggerating the feasibility of the technology regulation, at the same time leads to the serious problems that impede the acquisition of competitiveness of companies and the public in the global competition system.

해상 빅데이터 기반의 공간지도를 활용한 황산화물 배출규제 효과 분석

  • MARPOL (Maritime Pollution Treaty) 부속서 (Annex VI) 경우 대기오염 규제 내용이며, 최근 선박 배기가스 배출규제 강화 목적 개정됨에 따라 관련 규정을 충족하기 위한 적극적인 조치가 요구된다. 예를 들어 Sulfur Dioxide (SOx, 황산화물) 경우 2020년 기준 전 세계 해역 내 운항하는 선박은 황 함유량 0.5% 기준의 배출 요구 기준을 충족해야 한다. 배출규제 해역 지정 시 해당 해역 선박 배기가스 배출량 계산 산정 기준 확립이 필요함에 따라 대기환경에 대한 종합적인 분석이 필수적으로 요구된다. 본 연구에서는 황산화물 배출량 산출 방법론으로써 그리드 셀 내 선박 점유시간을 계산한다. 점유시간이 길수록 선박 통항 및 배기가스 배출이 밀집되어 있음을 의미한다. 밀집도 분석에 더불어 선박의 특성이 반영된 시간당 배출량을 적용하여 배출 공간 인벤토리를 구축하였으며 분석 결과를 GIS (Geographical Information System) 환경에서 공간 지도로 시각화하였다. 기존 국내 황산화물 배출규제 해역의 효과 평가에 더불어 외항 범위까지 규제 확대 시나리오확립 후 비교 평가를 통하여 배출량 감소 효과를 정량적으로 확인하였다.

A Study on the Validity of Net Neutrality Regulation in Respect of Zero-Rating (제로레이팅에 대한 망 중립성 규제의 정당성 연구)

  • Recently, the regulation issues for the zero-rating began to be proliferated. The corresponding regulators in charge of Internet services of all the countries of the world illustrated the various spectrums, rather than the similar policy line. In contrast, the oversee regulators not only recognized that zero-rating might be somethings to do with the net neutrality regulation, and but also actively debated regarding the validity for the regulation. However, any domestic study examining the issue has not endeavored yet. Therefore, the purpose of the study is to identify the validity of net neutrality regulation of zero-rating. Specifically, the study provided the features of zero-rating, the relationship with this new regulation and traditional regulations, and the various arguments and policies in major countries. The results of the study would be utilized as a reference in planning the regulation and countermeasure, from the corresponding policy makers and business operators.

  • Basel III (Third Basel Accord or Basel Standards) is a global, voluntary regulatory framework on bank capital adequacy, stress testing, and market liquidity risk. Basel III regulatory ratios include capital adequacy, asset soundness, and liquidity. The capital adequacy variables include BIS capital adequacy ratio, BIS tier 1 capital ratio, and tangible common equity ratio. The asset soundness variables include non-performing loan ratio and non-performing loan coverage ratio. The liquidity regulation variables include KRW liquidity coverage ratio and foreign currency liquidity coverage ratio. This study aims to investigate how capital adequacy standard affects efficiency of internet primary banks. As a result of this study, BIS capital adequacy ratio of domestic internet primary banks is lower than that of commercial banks. In order to maintain sustainable operation considering capital adequacy regulations, it is necessary to expand additional capital. In addition, the delinquency rate and non-performing loan ratio of domestic internet primary banks is gradually increasing due to the maturity of high-yield loans in 2019.

  • Recently the concerns on online ticket resale have been globally soared. Numerous countries have dealt with problems about online ticket tout and resale platforms in various ways in spite of differences of scope and method on restrictions. However, in contrast with the worldwide concerns and actions, Korea has been relatively slow to take any action against regulating online ticket resale issues, and any legislation has not been made. At the end of 2020, a revised Performance Act was passed and enforced from June, 2021. With the enforcement of the bill, this study aims to provide an exploratory analysis to present current situation related to online secondary ticket resale policy in Korea. It examined how US and England have coped with legislation for online ticket resale. And then it attempted to illuminate the current situation of legislation and restrictions on online secondary ticket market in Korea and examined the effectiveness of the revised Act. Finally, this study suggested that there should be prompt consideration and actions to carry out related policies for establishing stable market ecosystem and providing fair opportunities to consumers.

A Study on the Influence of Social Regulation on Competition and Innovation: A Case of Fire-retardant Coating Material for Steel Structure Sector in Korea (사회적 규제가 대체재 간 경쟁과 혁신에 미치는 영향에 관한 연구 : 국내 철강 구조물용 내화 피복재 산업의 사례연구)

  • The interest in social regulation and its influence on innovation are increasing as the society concerns more for environment and safety. There have been plenty of literature about the impact of social regulation on innovation and its mechanism. Majority of research have been influenced by or based on the famous Porter's hypothesis. However, majority of the literature focus on internal factors such as expected benefits from change of regulations, and it is hard to find one studying social regulation's influence on innovation through external factors such as market or industrial structure. This study addresses this issue of the impact of social regulation on innovation by analyzing the case of fire-retardant coating material for steel structure industry in Korea. It scrutinizes the impact of social regulation which affects competition and innovation on substitute competing market, and tries to reveal that there might exist the other path to innovation, besides the way that the expected benefit from compliance of regulation directly drives innovation. As a result of the case study, we have found that changes in social regulation may act like economic regulation and restructure the market segment and this effect may lead to innovation. It can be explained by the fact that expected benefits from compliance of regulation can be a direct source of innovation, as Porter suggested, but the change of industry structure and competitive strength caused by the change in social regulation can also act as a driving force of innovation.

Comparison Study between Institutional Response to Security Risks of the EU's Revised Payment Services Directive and Domestic Electronic Finance Regulation (개정된 유럽연합 지급결제서비스지침의 보안위험에 대한 제도적인 대응과 관련 국내 전자금융 규제와의 비교 연구)

  • Traditionally banks and other financial institutions use customers' accounts and information managed by them and provide payment services in dominant positions. Recently, EU amends Payment Services Directive to institutionally guarantee access to customers' accounts and use of account-related information even to third parties, which facilitates competition in financial markets and promotes innovation. However, this kind of change can increase potential security risks and therefore institutional responses from financial authorities are required so that all participants in financial markets can properly respond to security risks. In this study institutional responses to the security risks in the EU's new Payment Services Directive (PSD2) are analyzed, comparisons between this and domestic electronic financial regulations are analyzed, and implications for the direction of improving domestic electronic financial regulations will be suggested.

A Study on the Noise and Vibration Characteristics during Construction of Screw Concrete Pile for Reduction of Noise and Vibration (소음 및 진동 저감을 위한 스크류콘크리트말뚝의 시공 중 소음과 진동 특성에 관한 연구)

  • Because the noise and vibration regulations in domestic areas are being tightened more and more, a more environmentfriendly method than the current low-noise & low-vibration methods is needed. In this study, the characteristics of screw concrete piles for reduction of noise and vibration were explained, and during pilot tests the noise and vibration were measured. The measured vibration value is satisfied with the vibration regulations at 7.5m distance from the source. The measured noise value is exceeded over about 2dB(A) at the 15.0m distance from the source but these values are about 5~20dB(A) less than the measured values of the current low-noise & low-vibration method.

  • In March 2017, the State of New York became the first state to implement regulation specific to cybersecurity for financial institutions. Unlike previous regulations regarding information security, it has set a minimum requirements to establish cybersecurity program based on risk assessment results, protect Nonpublic Information, designate of CISO, and report to regulatory entity. This paper presents a need for a new cybersecurity policy in Korea by examining newly adopted cybersecurity regulation in the United States. Finally, the paper identify policy suggestions based on the United States's approach as they have successfully implemented the program.

  • 현재 주요 가스상물질은 미국의 경우 규제전보다 일산화탄소가 96%, 탄화수소 96%, 질소산화물 76%가 개선되어 어느정도 안정단계에 들어 갔다고 볼 수 있다. 그러나, 입자상물질규제는 디이 젤자동차의 증가와 더불어 1986-1994기간동안 대폭적으로 강화되고 있다. 그러나 자동차 배출 가스중에는 수백가지의 화학물질이 존재하고 인체에 유독한 물질은 규제물질외에도 엄청나게 많다. 따라서 1977년 8월에 개정된 미국의 대기정정법(CAA, clean air act)에는 "신규 제작자동 차나 엔진에 사용되는 어떠한 방지장치, 시스템 또는 부품도 공중보건, 복지 및 안전에 부당한 위험을 일으키거나 일으키는 요인이 될 수 없다"(참조, CAA 202 (a) 및 CFR 86.084-5)고 규 정하고 있다. 이에 따라 미국환경청에서는 회람 등을 통하여 가능한 독성물질에 대하여 경우에 따라 측정할 것을 요구하고 있다. 국내 환경보전법에도 자동차연료첨가제 사용할 때 현저하게 유해한 물질이 배출된다고 인정하는 때에는 그 사용을 규제할 수 있게 되어있고 새로 제정될 자동차 배출가스 시험검사방법 및 절차에 관한 규정에 이에 관한 사항을 추가할 움직임이 있다. 물론 미규제물질의 규제하는 인체에 대한 피해정도나 측정방법 등의 여러 가지 문제가 수반되나 장기적인 국민보건과 환경보전 측면에서 신중하게 다루어져야 되리라 봐서 여러 가지 오염물질의 현황이나 분석방법 등에 대하여 기술코자 한다.여 기술코자 한다.
