Free Speech and the Void for Vagueness Doctrine: A Comparative Analysis of Free Speech Cases in the Korea Consitutional Court and the United States Supreme Court (표현의 자유와 "명확성 원칙": 한국 헌법재판소와 미국 연방대법원의 판례 비교연구)

  • This paper is a comparative analysis of constitutional decisions in which the Korea Consitutional Court and the United States Supreme Court applied the void for vagueness doctrine into free expression issues. Common aspects are: both courts applied the void for vagueness doctrine on the grounds that vague laws bring chilling effect on freedom of expression. Acknowledging inevitable uncertainties in lawmaking and legal jargons, however, both courts required minimum standards in the void for vagueness doctrine. In the cases where unclear legal meanings resulted in constitutional challenges, both courts adopted the "narrowing construction" by the courts or judges based on average/ordinary person's understanding. The biggest differences between the two constitutional courts are their approach to the degrees of vagueness allowed in free expression cases. The U.S. Supreme Court underscored the necessity of narrowly drawn, reasonable and definite standards. Meanwhile, the Korea Constitutional Court relaxed its standards in some cases such as the National Security Law cases, even though it admitted the possibility of curtailing the right to free expression. The Court reasoned that those laws, though vague, brought with bigger social interests and are necessary tools in dealing with changing world.

Recent Changes in Sex Ratio at Birth and Simulations on Sex-Selective Reproductive Behavior: With a Special Focus on Youngnam Region (출생성비의 최근 변화와 시뮬레이션을 통한 성선별 출산행위의 추정: 영남 지역을 중심으로)

  • Korea has been widely recognized as the most successful country for reversal of the rise in sex ratio at birth (from the mid-1980s to the mid-1990s) in a short period of time. However, unusually high sex ratios at birth are still observed in most regions as parity increases. Given that imbalanced sex ratios at high birth orders are mostly due to son-selective abortion, it still remains questionable whether son-selective reproductive behavior has vanished in Korea. The main purpose of this study is to analyze the pattern of changing trends and socioeconomic differentials in sex ratio at birth. Micro-data from birth registration for 2009 are utilized. Attention is focused on analyzing sex ratios at birth in Youngnam region according to age of mother, parity, educational attainment of parents, and occupation of parents. A series of simulations are also conducted in this paper to show how prenatal sex screening and son-selective abortion have affected the level of sex ratio at birth for years 1994, 2005 and 2009.

Genetic Composition of Korean Native Chicken Populations - National Scale Molecular Genetic Evaluation Based on Microsatellite Markers (초위성체 표지로 본 한국 재래닭 집단의 분자유전학적 구성)

  • The study was conducted to select and optimize microsatellite (MS) markers for evaluate Korean Native Chicken (KNC) breeds in order to provide standard for the classification and breed definition of the indigenous breeds. The study also aimed to characterize and classify each KNC populations for inventory and management of avian genetic resources. A total of 462 chickens from 11 populations of chicken breeds including eight KNC breeds and three commercial chicken breeds were analyzed with 19 MS markers. KNC breeds, especially Long-Tail Chicken breeds, formed separate cluster from those commercial chicken breeds. Genetic distances between KNC populations (0.11~0.18) were relatively shorter. Genetic uniformity of KNC (except KNCR breed) (0.86~0.88) were higher than that of commercial breeds (except Cornish) (0.95~0.97). On the other hand, genetic uniformity of KNC Long Tail (KNCLT) were relatively higher (0.91~0.97). The result can be used to evaluate and manage animal genetic resources at national scale.

A Study on the Local Identity and life Change of Female Marriage Migrants by Transnational Migration (초국가적 이주에 따른 결혼이주여성의 지역정체성과 생활 변화에 관한 연구)

  • The local identity of a female marriage migrant is not fixed to certain boundary or location, but rather comprised flexibly according to geographical movement or new settlement to different place. This research focuses on the local identity and life change of female marriage migrants that are constituted/reconstituted according to spatial transition, or migration. The analysis was conducted to find out traits of changes in the periods of migration and settlement based on the following categorization: multiculturalism and bicultural identity, assimilation and host country identity, exclusion and origin country identity, marginalization and marginal identity. The results are as follows; while having identical experience in terms of a migration, the local identities of marriage migrant women differed according to individual/regional characteristics as well as their respective roles within those traits. In addition, most of females showed passivity in maintaining and exposing their cultural identities of original states. Moreover the life satisfaction change of female marriage migrant that is type of assililation and host country identity is appeared more than others. through this assimilation and accommodation mean adaptation to female marriage migrant lived in Korea. However the intercultural competences of both marriage migrant woman and children in multicultural families facilitate the connection among different cultures. Based on these outcomes, with the transition to multicultural society and space, this research proposes the necessity of fostering global citizenship for mutual recognition of each culture, thus enabling coexistence.

Analysis of Instruction Materials for Physical Computing from the Perspective of Computer and Information Literacy (컴퓨터 및 정보 리터러시 관점에서의 피지컬 컴퓨팅 교육 교재 분석)

  • Computer and Information Literacy(CIL) is one of Key Competences in 21st century. Many countries, including Korea, have adopted related contents in their national curriculum for conducting software education. With this movement, many book-type instruction materials for software education have been developed in Korea. However, it is scarce to find researches that evaluate the instruction materials from the perspective of CIL. In this study, we selected 4 instruction materials which were distributed by government with 'SW centered society' web site as well as were developed to teach physical computing for elementary students. Also, we analyzed if they can foster students' CIL. First of all, the evaluation framework was developed based on 'The Manual for Authorized and Approved Textbook' and 'The 2018 ICILS(International Computer and Information Literacy Study) Assessment Framework'. Then, 12 school teachers who have professional insight of software education evaluated the 4 instruction materials with the framework. Averaging the score given by evaluators, we determined that which instruction materials were superior or not. Finally, we figured out the characteristics of superior and inferior instructional materials. Based on the results of this study, we suggested implications for developing instruction materials for physical computing education to build students' CIL.

A Study on Mental Injury Suffered by Passengers in International Air law (국제항공법상 정신적 손해에 관한 연구)

  • The meaning and application of 'lesion corporelle' in the context of a variety of mental or psychic injuries is less clear, while there is very little disagreement about its literal translation. U.S. Court decisions since Floyd allow recovery for a range of claims involving emotional injury under Article 17; in some cases there is no recovery, while in others there is full recovery, depending on the allegations and the nexus between the alleged injury and any related or accompanying physical injury. Courts are in agreement that pure emotional injury is not compensable under the Convention. Most courts agree that emotional injury is not compensable in those cases where it has resulted only in physical manifestations such as weight loss or sleeplessness. At the same time, most courts generally agree that emotional injury is compensable if it proximately flows from a physical injury. The issue as to whether the courts would associate PTSD with bodily injury as envisioned in the present Warsaw structure or even the new regime reflected in the Convention proposed by ICAO would largely depend on the extent to which courts would be ready to embrace the compelling scientific findings with regard to mental distress and its application within the term 'bodily injury'. Taken together, these points when the current under Article 17 of the Warsaw Convention, 'physical injury' notion of 'mental injury' is to be extended. Of course, the current terms of the Warsaw Convention have been maintaining a precedent for many countries appear to have a statue of the original purpose of the treaty does not contribute to the diffusion. Therefore, in future treaties 'bodily injury', the term 'injury', the term 'personal injury' or 'health undermined' the term should be replaced or revised.

Energy Scenarios and the Politics of Expertise in Korea (한국의 에너지 시나리오와 전문성의 정치)

  • Recently concerns on the energy future are rising in Korea after nuclear disaster of Fukushima in Japan last year. However, even after Fukushima disaster Korean government keeps on insisting nuclear oriented energy policy. Contrary to it, some of civil society's organizations(CSOs) including environment groups and progressive political parties are making strong voices for phase-out nuclear. As a way of phase-out nuclear activity researcher groups based on CSOs have presented several alternative energy scenarios against the official government scenario so that contest between the two senarios seems not to be avoided. This article aims to analyse the politics of expertise around energy scenarios in Korea by highlighting differences between two scenarios of government and CSOs in terms of epistemological and methodological base, value orientation, institutional foundation, and the socio-political contexts of scenarios. Our research shows that government's energy scenario is based on scientific-positivist epistemology, firm belief in value neutrality and forecasting method, and is built by neo-classical economists at government-sponsored research institutes in accordance with the 'Business As Usual' approach. In contrast, alternative scenarios of CSOs can be said to be based on epistemological constructivism, value oriented attitudes and backcasting method, and be built by collaboration of researchers and activists with different academic and social backgrounds after Fukushima nuclear disaster.

  • These days Taekkeon of Shin Han-Seong is newly rased as traditional martial which made up in the academic world. The reason why is that create new shaped Traditional Taekkeon which stipulate good points of systematize Martial Arts to register Song Duck-Ki Taekkyeon eleven figures's a piece of skills to cultural assets. This research show how Shin Han-Seong make up Taekkyeon to register to intangible cultural assets, and found next conclusion and meaning. First, skill organization of Song Duk-Ki Taekkeon that is only one modern Taekkeon's initiator have been transmitted for a piece of skills of playing figure which don't have regular system. But Taekkyeon which have regular system have been developed by Shin Han-Seong, finally Taekkyeon is approved to intangible cultural assets. Second, Shin Han-Seong modernized Taekkyeon by borrowing training system of Judo, Fencing, Hapgido, Taekwondo, Karate. But people criticize that Song Duk-Ki Taekkeon is not initiate with original thing. Third, Shin Han-Seong made the grade classification and practical technique screening, Bon-Dae Buigi Twelve part like Pomse of Taekwondo (there is no for traditional Taekkyeon). And he contributed to popularization and modernized learning system by pursuiting sportization. Through this research geared up Taekkyeon's original shape and generational outline about skill transition or composition. And it gave important data for understand about Taekkyeon controversy which scattered.

Study on Methods for Determining Half-Life of Domestic Wooden Panel among Harvested Wood Products (국산 목질판상재의 반감기 결정방법에 관한 연구)

  • Harvested wood products (HWP) are known as products from the tree such as sawn wood, plywood, particle board, structural lumber, wooden interior material, wooden furniture, and paper products. Because carbon is locked up in the HWP until eventual end-use of HWP, HWP played a role as the carbon storage which has the effect of stabilizing the concentration of carbon dioxide in the atmosphere. For these reasons, the suggestion that it must admit the carbon storage effect of HWP has been constantly raised. In 2011, the 17th session of the Conference of the Parties (COP) to the United Nations Framework Convention on Climate Change (UNFCCC) which was held in Durban, South Africa, assigned "Production Approach" which targets only the HWP producted by using round wood of domestic forestry as a official method for carbon accounting. Therefore, it is necessary that each country has to determine the half-life of wood in order to correspond to the discussions and negotiations between countries in the future and to develop an inventory of product-specific domestic wood. In this study, some countries' examples of the methods and conditions for determining half-life of HWP were investigated, and it was tried to derive the factor and methodology to determine half-life span of domestic HWP appropriately.

A Study on Improvement Plan of Teacher Librarians' Placement by a Comparison between Teacher Librarian and Other Teachers Not-teaching the Subject Matter (사서교사와 타 비교과 교사의 배치 비교를 통한 사서교사 배치 개선방안 연구)

  • The purpose of this study is to find a better way for placement of teacher librarians. So, the literature research is applied for the study. It is unreasonable to arrange one school librarian staff per 1,500 students, based on the criteria of the total number of personnel including that of teacher librarians and practice teachers and librarian, in accordance with the existing enforcement decree of Article 7. In fact, this clause, linked to other related regulations, makes it difficult to place teacher librarians. And the quota of teacher librarians is noticeably low as compared with that of other teachers who are not-teaching the subject matter. This operates disadvantageously to teacher librarians when it comes to assigning quota in secondary teacher selection test and the accumulation of this phenomenon gradually worsens the current situation. The roles of teacher librarians and librarians should be defined separately when amending the Enforcement Decree of School Libraries Promotion. And we should also take into consideration that the number of students per school is around 500. Therefore, Enforcement Decree of School Libraries Promotion Act should be revised toward placing teacher librarians depending on the size and number of schools. Predictability should be secured in teacher librarians selection test. In addition, flexibility should be granted to the training institute so that many people can prepare the teacher librarians qualification. Finally, it is necessary to increase the teacher librarian capacity for private schools. This study will be the basis of the theoretical foundation for stable teacher librarian placement.
