An Administration Model for Causes of Delay in Construction Projects to Decide Time Extension Responsibility (건설공사 공기연장 책임구분을 위한 지연사유 관리 모델)

  • Since the cases of time extension have continuously transpired in the public construction project, the potential of economical loss and claims is increasing because the concerned parties such as an owner or a contractor have not properly performed their own responsibility for time extension. One of the main reasons is that the present planning and scheduling do not support the method to apportion the proper responsibility to the right party. This problem has repeatedly led to time extension and made it difficult for the concerned parties to perform the responsibility for time extension. In order to overcome this problem, a framework of delay administration is required as the method to apportion the proper responsibility to the right party. To solve this problem, this paper aimed to develop the conceptual model and prototype system as the practical method to administrate delay causation. Furthermore, the verification result for the reliability and applicability throughout the case studies on real construction projects shows that the conceptual model and prototype system developed would help efficiently to administrate the delay causation.

  • If project time extension were required in the construction projects, either liquidated damages or extension costs should be applied according to causation of the schedule delays. However, in actual cases it is not applied so far according to the contract conditions. The reason why this situation happened Is that function of the present planning and scheduling is not working feasibly. The CPM schedule could not provide a proper solution for apportioning responsibility for the schedule delays. This situation could be considered as breach of contract and will cause potential disputes for schedule delay. Therefore, in this research process based contract administration model for construction delay claim is proposed to prevent schedule delay and solve the claims. The model is based on pro-active management for causation of delay to provide apportionment of responsibility and written evidences.

  • Top priority to manage construction projects is given to the planning and scheduling in order to keep the project duration, which is one of the most important factors in construction management. However, recently most of public construction projects especially for civil projects are delays and preventive research, many efforts were made concerning construction delays and preventive management methods. But analysis of delay causation, which is a main key to solve the problems is not done, yet. Therefore, in this research causation delays are analyzed by characteristics of construction projects, which are type of projects, type of contracts, project participants, and general condition. As a result of the analysis, delay causation are proved to be different by characteristics of the projects. The research results will be used for prevention of time extension and dispute resolution.

  • Confucianism acts as the representative of Chinese mainstream cultures. Its research on the relation between groups and individuals, and about norms of the system is not only complete but of a long history. And its abundant management thoughts are important assets for us to know traditional culture and construct the management study of local colors. Menzi and Xunzi both inherit Confucianism but evolve into two Confucian paths of different scenarios. Both of them are different despite sameness, and are the same despite differences. Both are artistic all right, but have their imitation. This article aims to use Mengzi thoughts and Xunzi thoughts as a study domain. The study includes five sections. The first section as an introduction presents problems. The second section uses extrinsic factors to research the birth ground of Menzi, Xunzi management thoughts. The third section examines its basic presumptions in terms of inner logic. The fifth section analyzes its logical structure, and in this section the previous sections are concluded, presenting the possible development and relative limitations of Mengzi, Xunzi management thoughts. It is expected that we can re-examine traditional Confucius thoughts from the angle of management, renewing Confucius thoughts constantly in different ages.

Analyzing Factors Affecting the Use of Landowner's Purchase Requisition Policy in Bukhansan National Park (북한산국립공원 내 토지매수 청구 제도 활용 요인 분석)

  • This study conducted an empirical analysis on a land purchase requisition policy in Bukhansan National Park to draw the efficacy, limitations and implications of this policy. A logistic regression analysis was conducted to identify factors that affected the landowners' decision on applying for land purchase requisition using the government's records on acquisition of private lands in the park since 2006 when this policy began to be implemented. Results illustrate that the probability that a landowner applied for purchase requisition increased if the land was classified as forest, if a large proportion of the land was designated as the nature conservation district, if it was located farther from park boundary, and if it had higher appraised value per square meter. These results indicate that as the landowners had less chance to utilize their lands, they more likely apply for purchase requisition. These results also imply that the government can achieve a high conservation performance level if private lands are acquire by the land acquisition requisition policy. The logistic regression model also predict that 401m2 of the private lands in Bukhansan National Park will likely be purchase-requested in future. Despites its usefulness in mitigating landowners' complaints in national parks, the land purchase requisition policy has not been widely utilized. Based on these empirical results, this study provides policy implications to facilitate the ulitization of this policy.

  • 다목적댐 하류하천은 댐 건설당시 정비가 필요한 지역으로 댐 방류의 영향을 받는 일정구간에 대해서는 댐설계방류량에 대응하도록 하천정비가 시행되어야 하나, 지금까지의 댐 하류하천은 댐과 별개로 하천정비가 시행되어 왔으며, 관리 또한 댐과 이원화되어 이루어져 왔다. 이로 인해 댐하류하천은 제방월류, 하천구역내 사유지 및 불법시설물 등의 댐운영 제약사항으로 댐 본래의 치수기능이 저하되어 한국수자원공사에서 관리중인 15개 다목적댐 여수로 방류가 설계방류량의 16%(15개 다목적댐 전체 여수로 설계방류량 $57,004m^3/s$ ${\rightarrow}$ 무피해방류량 $9,300m^3/s$)에 불과하고, 대규모 홍수 발생시 댐하류지역에서 막대한 피해와 민원을 발생시키고 있다. 이러한 댐운영 제약사항해소를 위해 한국수자원공사에서는 '07년부터 연차별로 소양강댐을 포함한 22개댐 하류하천의 정비를 시행하고 있다. 현재 시행중인 용담댐 하류하천정비를 시행사례를 통해 댐운영 제약사항해소와 이에 따른 댐의 치수기능 회복효과를 분석해보면 다음과 같다. 댐방류시 현장조사를 통해 확인된 댐운영 제약사항은 하천구역내 사유지를 포함해하여 총 8건이며, 구조적 대책인 제방 축조와 비구조적 대책인 사유지 보상 등을 통해 댐 무피해방류량을 현재 $700m^3/s$ (여수로 설계방류량 대비 22%)에서 $2,730m^3/s$(여수로 설계방류량 대비 85%)로 증가 방류 할 수있는 것으로 분석되었다. 그러나, 구조적 비구조적 대책으로 불가능한 하천구역내 불법 경작지 및 시설물 등이 일부 잔존하여 댐운영 제약사항으로 여전히 남아 있는 실정이다. 이러한 문제를 해소하기 위해서는 불법행위에 대한 관리감독 강화 등의 조치가 필요하나, 이원화된 현행 관리체계에서는 한계가 있으며, 이와 같은 문제를 해소하기 위해서는 댐 방류의 영향을 받는 하류하천 일정구간에 대해서는 댐관리자의 역할 강화가 필요하다.

A Study on the Damage to Cargo Caused by Shipper's Liability in Marine Transport (해상운송에서 하주의 귀책사유에 의한 화물손해에 관한 연구)

  • The objective of this study is to discuss damage to cargo caused by shipper's Liability. an analysis of the excepted perils of the carriers and the scope of marine insurance coverage reveals that the excepted perils of the carrier are covered by the most part by marine insurance. however damage to cargo caused by shipper's fault remains uncovered. Damage to cargo by insufficient packing is caused by the cargo owner's error or negligence, thus both the underwriter and the marine carrier are exmpted from responsibility. but a problem aries from the fact that there is no objective standard for full packaging. In order to solve these problems, it is required to specify the method of packaging for certain goods when making an individual agreement, so that the owner can be exmpted from responsibility for packaging conformed to the pertinent article.
