조달청은 지난 5월 23일 조달행정쇄신방안을 마련, 현행 가격위주 낙찰제도를 품질확보를 위한 계약제도로 개선한다는 방침 아래 2단계 경쟁입찰제, 경쟁적 협상계약 제도를 도입하는 등 다양한 조달 방식을 마련, 재정경제원 등 관계부처와 협의를 통해 예정가격 작성준칙 등 관계규정을 개정해 올해안에 시행하기로 했다.

This study was to examine the effect of job insecurity on their psychological contract violation and job satisfaction among airline crew members. Also, this study intended to give meaningful hint in reducing job insecurity crew members feel, and, by examining ways to relieve psychological contract violation, give theoretical and practical suggestions on human resource management of airlines. The findings from empirical analysis are as follows. First, H 1-1 that job insecurity of airline cabin crew members will have positive effect on their transactional psychological contract violation was adopted. Second, H 1-2 that job insecurity of airline cabin crew members will have positive effect on their relational psychological contract violation was adopted. Third, H 2-1 that transactional psychological contract violation of airline cabin crew members will have negative effect on their job satisfaction was adopted. In contrast, H 2-2 that relational psychological contract violation of airline cabin crew members will have negative effect on their job satisfaction was rejected. Finally, H 3 that job insecurity of airline cabin crew members will have negative effect on their job satisfaction was adopted.

정부는 건설현장에서 발생하는 다양한 형태의 불공정 관행을 개선하고 공정한 건설환경을 조성하기 위해 지난 6월 14일 '건설산업 불공정 거래관행 개선방안'을 발표했다. 개선방안은 하도급계약의 공정성을 높이기 위해 불공정 하도급계약을 무효화하고 발주자가 하도급계약을 의무적으로 점검토록 했다. 또한 건설하도급 외상매출채권 담보대출로 인한 하도급업체의 피해를 줄이기 위해 보험 보증 등을 통한 보호를 강화하는 방안도 담겼다. 이와함께 주계약자 공동도급 발주공사를 적극 발굴하여 원 하도급업체 간 수평적 협력관계 정착을 유도키로 했다. 정부의 이같은 개선방안은 그동안 대한설비건설협회가 정홍원 국무총리를 비롯하여 서승환 국토부 장관 등 관계부처와의 간담회와 관계요로에 수시로 건의한 결과 정부가 이를 적극 수용하여 마련된 것이다. 이로써 설비건설업계는 공공공사 분리발주 법제화와 함께 적극 추진하였던 주계약자 공동도급 활성화, 불공정하도급 관련 제도의 대폭적인 개선으로 경영환경이 크게 개선될 것으로 기대된다. 대한설비건설협회 김경회 총괄본부장은 "협회의 건의사항이 대폭 반영된 만큼 개선방안이 실효를 거둘 수 있도록 더욱 노력할 계획"이라고 밝혔다.

정보시스템 아웃소싱(이후 아웃소싱으로 기술) 시장이 성장하고 있는 현실 속에서 기업에서는 아웃소싱을 통하여 많은 편익을 얻을 것으로 기대하고 있다. 이에 아웃소싱에 대한 기존 연구는 아웃소싱의 관리형태를 계약으로 대표되는 공식적인 관리와 신뢰로 대표되는 비공식적인 관리로 분류하고 이것이 아웃소싱 현장에서 어떤 성과를 가져오는가를 평가하였다. 하지만 아직까지 아웃소싱 결과에 만족하는 기업은 그리 많지 않은 실정이다. 본 연구는 기존 연구와 달리, 첫째, 통합적 관점에서 서비스 사용자의 아웃소싱 관리메커니즘 전개가 어떤 요인의 영향을 받는가를 알아보고, 둘째, 이렇게 전개된 아웃소싱 관리메커니즘의 정도가 아웃소싱 성과에 어떤 영향을 주는가를 검증해보고자 하였다. 특히 아웃소싱 관리메커니즘과 아웃소싱 성과의 관계에 있어 관계관리강도의 매개역할에 대하여 중점적으로 살펴보았다. 연구결과, 계약준비능력, 관계관리능력 등의 두 요인이 아웃소싱 관리메커니즘에 양(+)의 영향을 준다는 점을 실증적으로 검증하였다. 둘째, 아웃소싱 관리메커니즘과 아웃소싱 성과 둘 간의 관계를 관계관리강도가 매개하는 것을 확인하였다. 도출 결과를 중심으로 아웃소싱 관리에 대한 실무적인 시사점과 향후 연구방향을 논의하였다.

공급사슬의 구성문제는 주문의 동적환경를 고려하여 전체 관점에서 스케줄링되어야 한다. 이러한 공급사슬구성문제를 본 연구에서는 에이전트 협상 방법론을 통해 해결하고자 한다. 에이전트 협상은 공급사슬망을 경쟁적 관계로 이해하고 개별목적을 가진 구성원 에이전트간의 협상과정을 통해 재스케줄링이 발생되어 공급사슬을 구성하게된다. 지금까지의 연구는 공급사슬 상에서 수직적 통합(vertical integration)을 중심으로 조직의 유연적 조정에 초점이 맞추어졌다. 그러나 본 문제에서는 구매자로부터 주문을 받기 위해 경쟁적 관계에 놓인 제조자가 도급계약(sub-contract)이 허용되는 환경에서 협력적 관계를 통해 개별적 이익을 최대화하는 동시에 공급사슬 전체의 관점에서도 비용 최적화를 이룰 수 있는 제조자 협상방법론을 제안하였다. 본 협상방법론을 통해 수평적 관계에 놓인 경쟁업체들의 협력적 관계 및 전략적 제휴의 중요성을 살펴볼 수 있다.

국제물품매매계약은 당사자간의 합의에 의해서 이루어진다. 그러나 국제간의 물품매매에 관련하여 모든 상황을 특정계약에 반영하는데는 한계가 있다. 따라서 특정계약에 대한 해석과 판단의 기준이 되는 하나의 보편적이며 합리성에 기초를 둔 준거법이 필요하게 된다. 이러한 준거법은 어느 특정국가의 사범으로 충분할 수도 있지만 국제거래가 안전하고 원활하게 실행되기 위해서는 그것이 세계 어느 나라에 있어서도 같은 내용의 통일적인 법에 의하여 규율되는 것이 바람직하다. 특히 경제적 합리성에 기초를 둔 거래법의 분야에서는 이론적으로 법의통일은 가능하며 실제적으로는 로마의 사법통일협회(UNIDROIT)나 국제연합 국제상거래위원회(UNIDROIT)에 의하여 지금까지 어느 정도 통일사법 제정의 필요성이 꾸준히 제기 되어 왔다. 이러한 목적을 수행하기 위하여 UNICITRAL(국제연합 국제상거래위원회)이 1980년에 발표한 국제물품매매계약에 관한 UN 조약-비엔나협약(CISG)은 국제간의 물품매매에 관한 계약법으로서 중요한 역할을 수행하고 있다. 비엔나협약(CISG)의 법리적인 근거는 "자주적인 준거법의 제정 및 그 적용상의 통일성"에 있다는 것이다. 또한 그 내용을 보면 첫째, 지역적 의미를 가지는 법률용어의 사용을 피하고 대신 격지간의 계약시 실제로 발생하는 현실적 사례의 관점에서 법안을 작성하고자 하였고 둘째, 그 내용을 달리하고 있는 각국의 사법을 통일하는 것에 의해 모든 사법적 법률관계에 같은 내용의 사법을 적용하는 방법, 즉 세계통일사법의 제정이라 하겠다. 본 연구는 비엔나협약(CISG)의 입법취지와 배경을 고찰하였으며 또한 통일사법으로서 협약상의 "일반원칙의 통용"을 계약성립(Formation of Contract)의 과정별로 정리하였다.

The purpose of this study was to better understand the influence of psychological contract breach in deluxe hotel culinary staff memeberss on job satisfaction and turnover intention. Based on a total of 280 samples obtained for empirical research, this study reviewed the reliability and fitness of the research model and verified a total of 4 hypotheses using the AMOS program. The hypothesized relationships in the model were simultaneously tested by using a structural equation model(SEM). The proposed model provided an adequate fit to the data, ${\chi}^2=334.152$ (p<.001), df=162, CMIN/DF=2.063, GFI=.893, AGFI=.861, NFI=.919, CFI=.956, RMSEA=.062. The model's fit, as indicated by these indexes, was deemed satisfactory, thus providing a good basis for testing the hypothesized paths. The SEM showed that relational contract breach (${\beta}=-.236$) had a negative significant influence on job satisfaction. In addition, job satisfaction (${\beta}=-.236$) had a negative significant influence on turnover intention. The moderating effects on career the formulated model was verified. Limitations and future research directions are also discussed.

This study researches on the two types. If franchisor with to experience the benefits of a strong franchise partnership, they must be willing to work on behalf of the partnership, perform roles that may extend beyond their traditional boundaries, and resolve their disagreement to the benefit of the partnership rather than to their own benefit. Strong partnerships require sacrifices on the part of both the franchisees and franchisors. However, These sacrifices have substantial payoffs in terms of franchisor performance as well as the performance of the relationship as a whole.

This study is to review methodological limitations of previous studies, propose Tobit Model as an analysis model. We model used annual rent-free as dependent variable and considering to contract characteristics and building characteristics as independent variable. We model was consisted to the three model as follow: Basic model, Time control model, Quadratic model. As a result of the analysis, existing variables revealed through previous studies such as contract period, contract area, total floor area, and building age were all statistically significant. These results were robust when considering time effects. Also, floor area and annual rent-free was quadratic relationship by inverse U shape. This result provide to methodological contribution for related research. Also, provide to more accurate information for participants in seoul office market.
